FOIA Appeal and Demand for ADA Accommodation Compliance Medicaid ABI Waiver Program Provider Registry Records
Date: November 12, 2024
To: FOIA Appeals Officer, U.S. Department of Health and Human Services, Centers for Medicare & Medicaid Services
From: David Medeiros, ABI Resources
To the FOIA Appeals Officer:
I am submitting this formal appeal due to the Centers for Medicare & Medicaid Services (CMS) failing to respond to my FOIA request from October 23, 2024, regarding records for the Connecticut Medicaid Acquired Brain Injury (ABI) Waiver Program Provider Registry. Additionally, CMS has failed to comply with legally mandated ADA accommodations specified under Section 504 of the Rehabilitation Act (29 U.S.C. 794) and Title II of the ADA (42 U.S.C. 12131 et seq.). These accommodations are essential for equitable access due to my traumatic brain injury (TBI) and were detailed in my original FOIA request. CMSs failure to meet these accommodations represents a serious violation of my rights under federal law.
This appeal seeks immediate CMS compliance with both FOIA and ADA requirements. Specifically, I demand the release of requested records, strict adherence to ADA accommodations, and expedited processing to remedy CMSs non-compliance.
Failure to Adhere to ADA and Rehabilitation Act Accommodations
Non-Compliance with Required ADA Accommodations
In my initial FOIA request, I specified ADA accommodations necessary to ensure accessible and equitable participation in the FOIA process. CMSs disregard for these ADA requirements constitutes a significant violation of both the Rehabilitation Act and the ADA. My requested accommodations are not discretionary; they are legally required and must be followed without modification.
Requested ADA Accommodations (Non-Negotiable):
Email-Only Communication via MuckRock Platform
All responses, updates, and records must be sent exclusively via email to support accessibility. No physical mail, phone calls, or portal-based responses are acceptable, as these methods impose barriers.
Direct Text in Email Body
Whenever possible, response text must be embedded directly in the email body to ensure immediate readability and accessibility. Attachments alone are insufficient and must serve to supplementnot replacethe response text.
PDF Attachments for Documents
All documents must be provided as clearly labeled PDF attachments, organized by date and document type, with original formatting retained to ensure clarity and navigability.
Simplified Summaries for Complex Records
For records containing complex legal, financial, or procedural information, simplified summaries must accompany the documents to facilitate comprehension.
Identification of Responsible Personnel
All responses must include the names, titles, and contact information of FOIA officers, decision-makers, and supervisory personnel involved in processing this request, ensuring transparency and accountability.
Detailed Justifications for Redactions and Denials
Any redacted or withheld information must include detailed explanations, citing specific statutory exemptions under 5 U.S.C. 552(b), with sufficient detail to allow for independent verification of each exemptions applicability.
Expedited Processing
Due to the public interest nature of this request and ADA compliance requirements, this appeal requires expedited processing under 5 U.S.C. 552(a)(6)(E) and Executive Order 13392.
Confirmation of Accommodation Compliance
Upon receipt of this appeal, CMS must confirm that each ADA accommodation will be strictly adhered to in all responses and communications.
CMSs continued failure to comply with these accommodations is a violation of federal law. I am formally documenting this non-compliance with the Office for Civil Rights (OCR) and will escalate further if CMS persists in ignoring ADA requirements.
FOIA Obligations and Demand for Records
Under 5 U.S.C. 552(a)(6)(A), CMS is required to acknowledge and respond to FOIA requests within 20 business days, providing access to records or citing specific statutory exemptions. CMSs complete lack of response, despite statutory deadlines, constitutes a violation of federal FOIA obligations.
Requested Records:
A complete and current provider registry for the Medicaid ABI Waiver Program, including provider names, contact details, specialty areas, enrollment dates, and current status.
Policies, criteria, and documentation governing provider inclusion, monitoring, or removal from the ABI Waiver Program registry.
Records of complaints, violations, or disciplinary actions related to providers participation in the ABI Waiver Program.
Documentation of registry maintenance processes, including the frequency of updates, responsible personnel, and procedures for communicating updates to the public.
Demand: CMS must provide the requested records promptly or offer a formal response with legally sufficient justifications for any withholding of records under 5 U.S.C. 552(b). Failure to comply with this appeal within 10 business days will lead to escalation to the Office of Government Information Services (OGIS) for enforcement.
Justification for Expedited Processing and Fee Waiver
Legal Basis for Expedited Processing and Fee Waiver
Expedited processing is justified given the critical public interest in Medicaid ABI Waiver oversight, as this program impacts a vulnerable population. Under 5 U.S.C. 552(a)(6)(E), requests serving a significant public interest warrant expedited processing. Furthermore, a fee waiver is justified under 5 U.S.C. 552(a)(4)(A)(iii) and Executive Order 13392 as this request seeks to advance public knowledge and is not for commercial use.
Demand: I request immediate confirmation of both expedited processing and fee waiver approval as provided by law.
Certification of Compliance and Immediate Action Required
To resolve this matter, CMS must take the following actions without delay:
Acknowledge Receipt of this Appeal and confirm compliance with FOIA obligations,
Commit to Full ADA Accommodation Compliance as outlined in both my initial request and this appeal,
Disclose All Requested Records or provide detailed justifications for any withholdings,
Confirm Expedited Processing and Fee Waiver Approval, and
Identify Responsible FOIA Personnel involved in processing this response, including their names, roles, and contact information.
Failure to adhere to these requirements will result in immediate escalation to the Office of Government Information Services (OGIS) and OCR, with full documentation of FOIA and ADA non-compliance.
Thank you for your attention to this critical matter. Full compliance with FOIA, ADA, and Rehabilitation Act obligations is expected within the legally mandated timeframe.
Sincerely,
David Medeiros

Subject: FOIA Appeal and Demand for ADA Accommodation Compliance Medicaid ABI Waiver Program Provider Registry Records
Date: November 19, 2024
To: FOIA Appeals Officer, U.S. Department of Justice, Civil Rights Division
From: David Medeiros, Founder, ABI Resources
I. INTRODUCTION
I am submitting this formal appeal due to the Centers for Medicare & Medicaid Services (CMS) failing to respond to my FOIA request dated October 23, 2024, for records related to the Connecticut Medicaid Acquired Brain Injury (ABI) Waiver Program Provider Registry. Additionally, CMS has failed to comply with ADA accommodations as mandated under the Rehabilitation Act (29 U.S.C. 794) and Title II of the Americans with Disabilities Act (42 U.S.C. 12131 et seq.). These violations not only hinder my legal rights to access information but also limit my participation in the oversight and administration of a program that is critical to vulnerable populations.
II. BASIS FOR APPEAL
The Department of Justice (DOJ) response, dated November 19, 2024, fails to address several ADA non-compliance issues and does not provide critical FOIA documentation as required. The following issues require immediate attention:
1. Failure to Provide ADA Accommodations
In my initial FOIA request, I outlined non-negotiable ADA accommodations to ensure equitable participation in the process due to my traumatic brain injury (TBI). These accommodations are mandated by federal law and must be adhered to by CMS and all associated agencies. The requested accommodations, as outlined under Section 504 of the Rehabilitation Act and Title II of the ADA, include:
Email-Only Communication via MuckRock Platform: All responses must be sent via email through MuckRock, as phone calls, physical mail, and portal-based communications are not accessible.
Direct Text in Email Body: Responses must include substantive text directly in the email body, as opposed to relying solely on attachments or external links that hinder accessibility.
PDF Attachments for Documents: Documents must be clearly labeled and formatted in PDF for accessibility, retaining the original formatting to ensure clarity and usability.
Simplified Summaries for Complex Records: For documents containing complex legal, financial, or medical terminology, summaries must be provided to ensure comprehension and effective participation in the FOIA process.
Identification of Responsible Personnel: All responses must clearly identify the names, titles, and contact information of the FOIA officers and personnel handling my request to ensure transparency and accountability.
Detailed Justifications for Redactions and Denials: If any records are withheld or redacted, detailed statutory explanations under 5 U.S.C. 552(b) must be provided to demonstrate compliance with legal requirements.
Expedited Processing: As mandated by 5 U.S.C. 552(a)(6)(E) and Executive Order 13392, I am requesting expedited processing due to the public interest involved in the Medicaid ABI Waiver Program, which impacts vulnerable individuals.
CMSs failure to meet these accommodation requirements constitutes a violation of federal law, and I demand immediate action to rectify this.
2. FOIA Processing Violations
CMS has failed to respond to my request within the statutory timeframe of 20 business days under 5 U.S.C. 552(a)(6)(A), which mandates an acknowledgment and response to FOIA requests. The lack of response and failure to provide the requested records represents a violation of FOIA obligations and demonstrates CMS's non-compliance with federal transparency laws.
The records I requested, specifically regarding the Medicaid ABI Waiver Program Provider Registry, are essential for oversight and accountability of Medicaid spending and provider oversight. The requested records are:
A complete and current provider registry, including provider names, contact information, areas of specialty, enrollment dates, and current status.
Policies, regulations, and documents governing provider inclusion, monitoring, and removal from the registry.
Records of complaints, violations, or disciplinary actions taken against providers.
Correspondence regarding registry maintenance, including documentation outlining the frequency of updates, the responsible parties for maintaining the records, and how these updates are communicated to the public.
CMS has not fulfilled its FOIA obligations and has failed to provide the requested records without proper justification.
III. RELIEF SOUGHT
1. Immediate Compliance with ADA Requirements
Confirmation of ADA Compliance: I request immediate confirmation from CMS that they will fully comply with my ADA accommodations, specifically the requirement to communicate via email only, provide accessible formats, and include all necessary personnel contact information.
2. Expedited Processing and Fee Waiver
Expedited Processing: I request that CMS expedite processing of this appeal under 5 U.S.C. 552(a)(6)(E) due to the public interest in the Medicaid ABI Waiver Program and its impact on vulnerable populations.
Fee Waiver: In accordance with 5 U.S.C. 552(a)(4)(A)(iii), I request a fee waiver, as the release of this information is in the public interest and will advance public understanding of Medicaid services and government transparency.
3. Immediate Disclosure of Requested Records
Release of Records: CMS must immediately disclose the requested provider registry and related documents, or provide a detailed justification for withholding any specific records, citing specific legal exemptions under 5 U.S.C. 552(b).
4. Identification of Responsible Personnel
CMS is required to provide the names and titles of the FOIA officers and all personnel involved in processing this request. This is in line with my right to transparency and accountability as mandated by FOIA and ADA regulations.
5. Escalation and Legal Action
If CMS fails to meet these requirements, I will escalate this matter to the Office for Civil Rights (OCR) and the Office of Government Information Services (OGIS) for enforcement. Failure to comply will result in further legal action to ensure accountability and compliance with federal FOIA and ADA laws.
IV. CONCLUSION
I demand immediate and full compliance with both FOIA and ADA regulations. CMSs failure to adhere to my ADA accommodations, coupled with their non-compliance in fulfilling FOIA obligations, requires prompt action. I am seeking immediate relief, including expedited processing, fee waivers, release of requested records, and full ADA accommodation. Failure to do so will lead to formal escalation and potential legal action.

Formal FOIA and ADA Complaint and Appeal
Date: January 1, 2025
01/01/2025
To: All
FOIA Appeals Officers and Supervisory Officials
Centers for Medicare & Medicaid Services (CMS)
U.S. Department of Justice (DOJ), Civil Rights Division
Connecticut Department of Social Services (DSS)
Subject: Demand for Compliance with FOIA and ADA Requirements Medicaid ABI Waiver Provider Registry
I. Introduction
This is a formal complaint and appeal regarding the failure of CMS, DOJ, and DSS to comply with their statutory obligations under the Freedom of Information Act (FOIA, 5 U.S.C. 552) and the Americans with Disabilities Act (ADA, 42 U.S.C. 12101 et seq.). This failure obstructs access to critical public records and violates my right to equitable participation due to a documented disability.
This appeal demands immediate compliance to address:
FOIA violations, including missed deadlines and incomplete responses.
ADA violations, specifically the failure to honor reasonable accommodation requests.
Whistleblower protections, which mandate transparency and accountability in taxpayer-funded programs.
II. Summary of Key Violations
1. FOIA Non-Compliance
Delayed Responses: Statutory deadlines (20 business days) for responding to FOIA requests have been ignored, constituting a "constructive denial" under FOIA.
Incomplete Disclosure: The requested Medicaid ABI Waiver provider registry and related records have not been produced, with no valid statutory exemptions cited under 5 U.S.C. 552(b).
2. ADA Accommodation Violations
Failure to Communicate Accessibly: CMS and DOJ ignored explicit requests for email-only communication and failed to provide records in accessible formats (e.g., screen-reader-compatible PDFs).
Lack of Summaries for Complex Records: No effort was made to simplify complex legal or technical documents, despite their necessity for equitable access.
Personnel Identification: Responses lack transparency, failing to identify responsible officials as required under FOIA and ADA.
3. Whistleblower and Taxpayer Accountability
Suppression of Public Oversight: Denying access to records undermines the public's ability to monitor Medicaid spending and provider accountability.
Potential Fraud Implications: Withholding records impedes whistleblower efforts under 31 U.S.C. 3730 (False Claims Act) and fails to uphold taxpayer protections.
III. Relief Requested
1. Full Disclosure of Records
Immediate release of the following:
Provider Registry: Names, contact information, specialties, enrollment dates, and statuses.
Compliance Records: Complaints, violations, or disciplinary actions related to ABI Waiver providers.
Policy Documentation: Criteria and processes governing provider inclusion and monitoring.
2. ADA Compliance Confirmation
Agencies must confirm compliance with ADA accommodations by:
ADA Accommodations Request
This request includes explicit ADA accommodations to address cognitive processing challenges resulting from my traumatic brain injury (TBI). These accommodations are legally required under Title II of the ADA (42 U.S.C. 12132) and Section 504 of the Rehabilitation Act (29 U.S.C. 794).
Requested ADA Accommodations
To ensure accessibility and compliance with ADA standards (42 U.S.C. 12101 et seq.), I request the following accommodations for all communications and records:
Screen-Reader Compatible Formats
All documents must be provided in properly labeled PDFs or plain-text files.
Ensure the documents are screen-reader compatible and retain clear formatting.

Grant a fee waiver under 5 U.S.C. 552(a)(4)(A)(iii), as the request serves the public interest.
4. Personnel Accountability
Disclose the names, titles, and contact details of all individuals responsible for processing this request to ensure transparency and accountability.
5. Legal and Administrative Escalation
If compliance is not achieved within 10 business days, I will:
File complaints with the Office of Government Information Services (OGIS) and the Office for Civil Rights (OCR).
Pursue injunctive relief in federal court to compel compliance under FOIA and ADA statutes.
Publicize systemic transparency failures through advocacy and media channels.
IV. Supporting Legal Precedents
FOIA Precedents
Nader v. Federal Trade Commission, 202 F.3d 173 (D.C. Cir. 2000): Establishes agency obligations to respond within statutory deadlines.
Brennan Center for Justice v. DOJ, 377 F. Supp. 3d 428 (S.D.N.Y. 2019): Reinforces the public's right to critical records for government accountability.
ADA and Rehabilitation Act Precedents
Alexander v. Choate, 469 U.S. 287 (1985): Protects equitable access to government programs.
Tennessee v. Lane, 541 U.S. 509 (2004): Mandates accessibility in public processes.
Whistleblower Protections
31 U.S.C. 3730: Encourages reporting of Medicaid fraud and protects whistleblowers from retaliation.
V. Deadline for Compliance
Agencies must confirm compliance and provide all requested records. Failure to do so will result in formal escalation to oversight bodies and federal court intervention.
Conclusion
This appeal underscores the critical need for transparency, equity, and accountability in government operations. Agencies must fulfill their legal obligations to ensure access to public records and accommodate individuals with disabilities as mandated by law.
Sincerely,
David Medeiros

Easy-to-Understand Summary of the Formal Complaint and Appeal
What is the Issue? David Medeiros, founder of ABI Resources, is filing a formal complaint because government agencies, including the DOJ, CMS, and DSS, have failed to provide requested information under the Freedom of Information Act (FOIA). This information relates to Medicaid oversight, whistleblower retaliation, and Americans with Disabilities Act (ADA) compliance.
The agencies have:
Delayed responses or failed to respond entirely.
Provided incomplete or heavily redacted records without proper explanations.
Ignored requests for ADA accommodations, such as accessible document formats and simplified summaries.
What Rights Have Been Violated?
Constitutional Rights: Denial of access to information violates Davids right to petition the government, equal protection under the law, and due process.
FOIA Obligations: Agencies failed to meet deadlines, provide complete records, or justify redactions, violating transparency laws.
ADA Protections: Agencies ignored Davids disability-related accommodations, which are legally required to ensure fair access to public services.
Whistleblower Protections: Agencies appear to be retaliating against David for exposing systemic issues in Medicaid programs.
What Does David Want? He is asking for:
Complete Records: Unredacted documents related to Medicaid billing, program compliance, and actions affecting ABI Resources.
ADA Compliance: All records in accessible formats (e.g., screen-reader-compatible PDFs) and clear communication protocols.
Accountability: Identification of the government officials handling the FOIA requests and their supervisors.
Expedited Processing: Immediate action on his request due to public interest.
Fee Waivers: Waive any fees, as the request serves public accountability.
What Happens if the Agencies Dont Respond? David will escalate his complaint by:
Filing formal complaints with oversight bodies like the Office of Government Information Services (OGIS).
Taking legal action to enforce FOIA, ADA, and whistleblower protection laws.
Informing Congress and the public through advocacy and media campaigns.
Why This Matters? These failures not only harm Davids rights but also undermine public oversight of taxpayer-funded Medicaid programs. Ensuring transparency and ADA compliance protects everyones rights and holds the government accountable.

Subject: Escalated Complaint and Appeal for Violations of Constitutional Rights, FOIA, Whistleblower Protections, Taxpayer Accountability, and ADA Compliance
I. Introduction
This appeal seeks immediate resolution of egregious failures by CMS, DOJ, and DSS to comply with statutory obligations under the Freedom of Information Act (FOIA), Americans with Disabilities Act (ADA), whistleblower protections, and constitutional guarantees. These failures obstruct transparency, suppress public oversight, and retaliate against whistleblowers reporting systemic abuses in Medicaid programs.
This complaint highlights the following violations:
Constitutional Rights Violations: Denial of due process, equal protection, and the right to petition the government.
FOIA Non-Compliance: Failure to produce requested records, vague redactions under Exemption 6, and missed deadlines.
ADA Violations: Ignoring mandated accommodations for individuals with disabilities, impeding equitable participation in government processes.
Whistleblower Retaliation: Obstructing access to evidence of systemic abuse in Medicaid programs.
Taxpayer Law Violations: Shielding misuse of taxpayer funds from scrutiny.
II. Violations and Legal Framework
1. Constitutional Rights Violations
Fifth and Fourteenth Amendments: Procedural due process requires timely and transparent responses to FOIA requests. Equal protection mandates non-discrimination against individuals with disabilities.
First Amendment: Denial of access to public records infringes on the right to petition the government for redress of grievances.
Cited Case Law:
Mathews v. Eldridge, 424 U.S. 319 (1976): Established procedural due process standards.
Tennessee v. Lane, 541 U.S. 509 (2004): Reinforced ADA compliance as a constitutional mandate.
2. FOIA Non-Compliance
Failure to Respond Timely: FOIA (5 U.S.C. 552) requires a response within 20 business days. Delays constitute constructive denial.
Overuse of Exemption 6: Privacy exemptions cannot shield public-facing provider information essential for Medicaid oversight.
Lack of Adequate Search: Agencies failed to confirm whether critical records, including policies, complaints, and violations, were searched.
Cited Case Law:
Judicial Watch, Inc. v. Dept of Justice, 2001: Agencies must adhere to statutory deadlines.
NARA v. Favish, 541 U.S. 157 (2004): Public interest can outweigh privacy claims under Exemption 6.
3. ADA Violations

Non-Negotiable Compliance
These accommodations are non-negotiable and are essential for ensuring equal access to information. Failure to provide the requested accommodations may constitute a violation of the ADA and the Rehabilitation Act. Thank you for ensuring compliance and accessibility in addressing this request.
Ignored Accommodations: Agencies failed to honor requests for screen-reader-compatible formats, email-only communication, and simplified summaries, violating Title II of the ADA (42 U.S.C. 12132) and Section 504 of the Rehabilitation Act (29 U.S.C. 794).
Cited Case Law:
Alexander v. Choate, 469 U.S. 287 (1985): ADA protects equal access to public benefits.
Olmstead v. L.C., 527 U.S. 581 (1999): Public entities must ensure meaningful participation for individuals with disabilities.
4. Whistleblower Retaliation
Suppression of Transparency: Delayed responses and withholding critical records obstruct whistleblowers reporting Medicaid fraud and abuse.
Retaliatory Tactics: Administrative burdens and delays discourage oversight efforts.
Cited Statutes:
Whistleblower Protection Act (5 U.S.C. 2302): Protects against retaliation for disclosing government misconduct.
False Claims Act (31 U.S.C. 3729): Mandates transparency to prevent misuse of federal funds.
5. Taxpayer Law Violations
Failure to Disclose Financial Oversight Records: Denying access to records of provider compliance undermines the publics ability to oversee taxpayer-funded programs.
Cited Statutes:
Taxpayer Bill of Rights (IRS Pub. 1): Mandates transparency in the use of public funds.
III. Relief Requested
Full Disclosure of Records
Provider Registry: Names, contact details, specialties, enrollment dates, and statuses.
Compliance Records: Complaints, violations, and disciplinary actions.
Policy Documentation: Criteria and processes for provider inclusion and oversight.
Registry Maintenance: Documentation on update processes and responsible personnel.

Subject: Urgent Request for Investigation into OSC Case Records, Altered Decisions, and Suppressed Reports
Dear FBI Team,
I am formally requesting your assistance to investigate systemic failures, misconduct, and potential criminal activity surrounding the handling of my submissions to the Office of Special Counsel (OSC). These failures directly impact whistleblower protections, Medicaid oversight, and public accountability.
Issues to Investigate
1. Case Numbers and Records Management
Case Numbers Requiring Investigation:
DI-25-000310DI-25-000325DI-25-000379
DI-12192024714
DI-12112024134

OSCFiling-MedeirosDavid-DI-12202024300
OSCFiling-MedeirosDavid-DI-112620241121
2. Anonymity and Lack of Accountability in Decision-Making
Unsigned Determination Letters:
Many determination letters from OSC lack identifiable signatures, names, or clear authorship.
This practice raises serious concerns about accountability and compliance with transparency laws.
3. Suppressed or Altered Records
Evidence suggests discrepancies between the whistleblower reports I submitted and how they were recorded or handled by OSC.
Specific issues include:
Alterations or removal of content from submitted complaints.
Suppression of reports that exposed systemic failures in Medicaid oversight and retaliation against whistleblowers.
4. Lack of FOIA Compliance
Despite repeated Freedom of Information Act (FOIA) requests, OSC and related agencies have failed to provide:
Complete case files and communication logs.
Justification for withheld or redacted information.
Clear timelines for compliance.
Specific Questions to Investigate
1. Who is Responsible for Managing These Records?
Identify the individuals, teams, or automated systems involved in creating, altering, and assigning these case numbers and reports.
2. What Decisions Were Made and Why?
Determine how decisions were reached, why some reports were closed without action, and why letters were sent anonymously.
3. Were There Violations of Federal Law?
Investigate potential obstruction of justice, retaliation, or misuse of authority under whistleblower protection laws and FOIA.
Key Agencies and Officials Involved
This matter spans multiple federal and state agencies, including:
Office of Special Counsel (OSC)
Department of Justice (DOJ)
Centers for Medicare & Medicaid Services (CMS)
Department of Health and Human Services (HHS)
Office of Inspector General (OIG)
Why This Matters
1. Whistleblower Protections:
Retaliation against whistleblowers and suppression of reports undermine federal protections designed to safeguard transparency and accountability.
2. Impact on Vulnerable Populations:
These failures harm Medicaid consumers, particularly those with disabilities, by allowing systemic mismanagement to persist unchecked.
3. Misuse of Taxpayer Funds:
Lack of oversight and accountability results in waste and misuse of federal funds meant to serve the public.
Requested Actions
1. Investigate Record Management:
Audit all OSC records, emails, and internal communications related to these case numbers.
Identify responsible individuals or systems.
2. Subpoena Additional Evidence:
Secure all suppressed or altered reports to ensure a complete and accurate investigation.
3. Hold Accountable Those Involved in Misconduct:
Recommend prosecution or disciplinary action for any individuals found to have violated federal laws.
4. Ensure Compliance with FOIA and Whistleblower Protections:
Mandate OSC and related agencies to comply fully with FOIA requests and whistleblower laws.
Attachments
I have attached all available documentation, including:
Correspondence with OSC, including determination letters and emails.
FOIA requests and responses (or lack thereof).
Detailed reports submitted to OSC and other federal agencies.
This issue demands immediate attention to uphold the principles of transparency, accountability, and justice. I am available to provide additional information or documentation as needed.
Sincerely,
David Medeiros

As recognized in National Archives and Records Administration v. Favish, 541 U.S. 157 (2004), transparency is fundamental to democracy and public trust. Your agencys obligations are not discretionary, and failure to meet them constitutes a violation of statutory and constitutional law. This letter establishes your duties, addresses deficiencies, and anticipates and counters all potential deflection strategies.
1. FOIA Obligations: Statutory Mandates and Required Actions
FOIA establishes an enforceable right of access to federal agency records. Your response must meet the following requirements:
A. Timeliness
Under 5 U.S.C. 552(a)(6)(A), you are required to provide a determination within 20 business days. Delays beyond this timeframe, absent legitimate extension requests, constitute a violation of FOIA.
Countermeasure: Delays are actionable under Citizens for Responsibility and Ethics in Washington v. DOJ, 711 F.3d 180 (D.C. Cir. 2013).
Required Action: Provide the requested records or a lawful determination.
B. Adequacy of Search
FOIA requires a thorough and reasonable search for records, as established in Campbell v. DOJ, 164 F.3d 20 (D.C. Cir. 1998). This includes:
Identifying the databases, locations, and terms used.
Providing a sworn affidavit detailing the search scope.
Countermeasure: A vague claim of "no responsive records" is insufficient without a detailed affidavit.
Required Action: Submit a sworn affidavit documenting the search or confirm the existence of responsive records.
C. Proper Use of Exemptions
Exemptions under 5 U.S.C. 552(b) must be narrowly applied and justified with specific explanations. Blanket or vague exemptions are impermissible.
Countermeasure: A Vaughn index (Vaughn v. Rosen, 484 F.2d 820 (D.C. Cir. 1973)) is required to justify each withholding.
Required Action: Submit a Vaughn index detailing each exemption and its justification within 10 business days.
D. Decentralization and Referrals
Referrals or decentralization excuses do not absolve your agency of its responsibility to provide a consolidated response. As held in McGehee v. CIA, 697 F.2d 1095 (D.C. Cir. 1983), agencies must coordinate internally to ensure compliance.
Countermeasure: Require assurance of continuity and coordination across divisions.
Required Action: Consolidate records from all relevant offices and provide a unified response.
2. ADA and Rehabilitation Act Compliance: Equal Access as a Legal Right
As a person with a documented disability, I am entitled to reasonable accommodations under the ADA and Section 504 of the Rehabilitation Act. Your failure to provide accessible formats for requested records constitutes discrimination and violates federal law.
Case Law:
Tennessee v. Lane, 541 U.S. 509 (2004): Agencies must ensure meaningful access to government services.
Alexander v. Choate, 469 U.S. 287 (1985): Denial of reasonable accommodations creates barriers that violate civil rights.
Required Action:
Provide all requested records in accessible formats, including plain-language summaries or electronic files compatible with assistive technologies.
Confirm compliance with ADA requirements by [specific date].
3. Mandated Reporting and Whistleblower Protections
Your handling of this request implicates broader concerns, including potential fraud, misuse of federal funds, or retaliation against whistleblowers. Under the Whistleblower Protection Act (5 U.S.C. 2302), you are required to report and address systemic violations.
Countermeasure: Reference Misprision of Felony (18 U.S.C. 4), which requires the reporting of observed violations of law.
Required Action: Document and escalate evidence of misconduct to oversight bodies, including the Office of Inspector General (OIG).
4. Consequences of Non-Compliance
Failure to comply with your statutory obligations knowingly constitutes violations of:
Obstruction of Justice (18 U.S.C. 1505): Delaying lawful access to records obstructs public accountability.
Civil Rights Violations (42 U.S.C. 1983): Denying ADA accommodations constitutes a deprivation of federally protected rights.
Misprision of Felony (18 U.S.C. 4): Concealing or failing to report observed violations is a criminal act.
Countermeasure: Prepare for judicial review, oversight complaints, and public advocacy if compliance fails.
5. Escalation Pathways
If your office does not comply within the specified timeframe, I will escalate this matter through:
Judicial Review: Filing a lawsuit under 5 U.S.C. 552(a)(4)(B) to compel disclosure.
Oversight Complaints: Submitting formal complaints to OGIS, OIG, and the DOJ Civil Rights Division.
Public Advocacy: Engaging investigative journalists, transparency advocates, and public interest organizations to ensure accountability.
6. Final Statement: Upholding Transparency and Accountability
This matter reflects the publics right to transparency and the preservation of trust in government institutions. Your actions will either affirm your agencys commitment to accountability or further evidence systemic disregard for these principles.
I look forward to your prompt and substantive response.

The challenges we face today demand more than acknowledgmentthey require action, collaboration, and a unified commitment to solutions. Together, we must embrace transparency, accountability, and compassion as the
foundation of our efforts. By fostering open communication, prioritizing the needs of the most vulnerable, and holding systems accountable, we can rebuild trust and ensure equitable outcomes for all.
Solutions lie in unitywhen state and federal leaders, advocates, and communities work hand in hand to uphold justice and fairness. Transparency through accessible Freedom of Information processes, adherence to legal
mandates, and robust oversight are the pillars that support meaningful change. Each of us has a role to play in creating a system that serves and protects.
Our collective mission is clear: to build bridges between agencies and communities, ensure the dignity of every individual, and honor the principles that guide us toward progress. Together, with determination and unity, we can
overcome systemic failures and pave the way for a brighter, more inclusive future.
Americans living with disabilities and their families are Americansfull citizens of this nation, protected by the same Constitution that guarantees the rights and freedoms of every individual. We are not separate, lesser, or forgotten. We are Americans with the same unalienable rights to life, liberty, and the pursuit of happiness.
