On January 2, 2025, David Medeiros, founder of ABI Resources, submitted an escalated legal complaint regarding significant violations of FOIA, ADA, whistleblower protections, and constitutional rights. The complaint outlines federal and state agencies' failures to respond to FOIA requests submitted in November 2024 concerning DOJ complaints. These violations include the lack of timely responses, failure to provide ADA-compliant formats, improper use of inaccessible systems, and suppression of whistleblower protections. Overview of Violations

This legal complaint and appeal address systematic violations of the Freedom of Information Act (FOIA) (5 U.S.C.  552), the Americans with Disabilities Act (ADA) (42 U.S.C.  12132), Section 504 of the Rehabilitation Act (29 U.S.C.  794), and constitutional rights under the First, Fifth, and Fourteenth Amendments.

The lack of response to my FOIA request, submitted on November 22, 2024, concerning DOJ Complaints #534659-XGL, #539298-RJM, #534060-HWM, and #539330-JBZ, demonstrates a failure to comply with statutory obligations and reasonable ADA accommodations, obstructing public accountability and my ability to pursue legal remedies.

Violations Identified
1. FOIA Non-Compliance
Failure to Respond Within Statutory Deadlines: Agencies failed to respond within the 20-business-day timeframe, violating 5 U.S.C.  552(a)(6)(A)(i).
No Vaughn Index or Justification for Withholding: Withheld or redacted records lack legally required explanations, in violation of 5 U.S.C.  552(b).
Failure to Identify Personnel: Agencies omitted required identification of FOIA officers and decision-makers, contravening 5 U.S.C.  552(a)(6)(C).

2. ADA Non-Compliance
Inaccessible Responses: Failure to provide responses in screen-reader-compatible formats, violating 42 U.S.C.  12132 and 29 U.S.C.  794.
No Simplified Summaries: Agencies ignored requests for plain-language explanations, violating 28 C.F.R.  35.160.
Exclusive MuckRock Use Ignored: Agencies improperly used portals and inaccessible methods contrary to explicit ADA accommodation requests.

3. Constitutional Violations
First Amendment: Obstructing access to public records infringes on my right to petition the government and access information critical for oversight.
Fifth and Fourteenth Amendments: Denial of ADA accommodations and FOIA responses constitutes a deprivation of due process and equal protection.

4. Whistleblower Suppression
Delays in addressing DOJ Complaints #534659-XGL, #539298-RJM, #534060-HWM, and #539330-JBZ raise concerns about systemic retaliation and obstruction under the Whistleblower Protection Act (5 U.S.C.  2302(b)(8)).

Despite repeated Freedom of Information Act (FOIA) requests, OSC and related agencies have failed to provide:

Justification for withheld or redacted information.

Clear timelines for compliance.

Identify the individuals, teams, or automated systems involved in creating, altering, and assigning these case numbers and reports.

Investigate potential obstruction of justice, retaliation, or misuse of authority under whistleblower protection laws and FOIA.

Your agencys obligations are not discretionary, and failure to meet them constitutes a violation of statutory and constitutional law. This letter establishes your duties, addresses deficiencies, and anticipates and counters all potential deflection strategies.

1. FOIA Obligations: Statutory Mandates and Required Actions
FOIA establishes an enforceable right of access to federal agency records. Your response must meet the following requirements:

A. Timeliness
Under 5 U.S.C.  552(a)(6)(A), you are required to provide a determination within 20 business days. Delays beyond this timeframe, absent legitimate extension requests, constitute a violation of FOIA.
Countermeasure: Delays are actionable under Citizens for Responsibility and Ethics in Washington v. DOJ, 711 F.3d 180 (D.C. Cir. 2013).
Required Action: Provide the requested records or a lawful determination.

B. Adequacy of Search
FOIA requires a thorough and reasonable search for records, as established in Campbell v. DOJ, 164 F.3d 20 (D.C. Cir. 1998). This includes:

Countermeasure: A vague claim of "no responsive records" is insufficient without a detailed affidavit.
Required Action: Submit a sworn affidavit documenting the search or confirm the existence of responsive records.

C. Proper Use of Exemptions
Exemptions under 5 U.S.C.  552(b) must be narrowly applied and justified with specific explanations. Blanket or vague exemptions are impermissible.
Countermeasure: A Vaughn index (Vaughn v. Rosen, 484 F.2d 820 (D.C. Cir. 1973)) is required to justify each withholding.
Required Action: Submit a Vaughn index detailing each exemption and its justification within 10 business days.

D. Decentralization and Referrals
Referrals or decentralization excuses do not absolve your agency of its responsibility to provide a consolidated response. As held in McGehee v. CIA, 697 F.2d 1095 (D.C. Cir. 1983), agencies must coordinate internally to ensure compliance.
Countermeasure: Require assurance of continuity and coordination across divisions.
Required Action: Consolidate records from all relevant offices and provide a unified response.

2. ADA and Rehabilitation Act Compliance: Equal Access as a Legal Right

This is in further response to your December 26, 2024, Freedom of Information Act
request, received by the Civil Rights Division, seeking access to records pertaining to:

1. OSC Case Records Complete files, internal and external communications,
investigations, and resolutions regarding: DI-25-000310; DI-25-000325; DI-25-
000379; DI-12192024714; DI-12112024134.

2. Interagency Correspondence Communications between OSC, FBI, DOJ, CMS,
HHS, and relevant state agencies regarding: Whistleblower disclosures and
investigations. Enforcement of ADA, Medicaid transparency, and constitutional
compliance. Allegations or investigations into fraud, retaliation, and procedural
violations.

3. FBI Involvement Documentation reflecting FBIs role in addressing OSC-related
investigations, whistleblower protections, and Medicaid; compliance. Include:
Correspondence with OSC, DOJ, CMS and HHS regarding whistleblower
allegations. Investigative records and findings.

4. DOJ and HHS Oversight DOJ Civil Rights Division and HHS OCR records
related to: ADA compliance investigations. Complaints and procedural
documentation under OCR Transaction Number 01-25-592844. Federal and state
enforcement actions against systemic non-compliance.

5. CMS and Medicaid Audits All internal and external audits, investigations, and
compliance reviews associated with the Medicaid Acquired Brain Injury (ABI)
Waiver Program. Documents relating to whistleblower-reported fraud, misuse of
funds, and oversight deficiencies.
