To Whom It May Concern:
I wanted to follow up on the following Freedom of Information Act request, copied below, and originally submitted on Dec. 3, 2024. Please let me know when I can expect to receive a response.
Thanks for your help, and let me know if further clarification is needed.
Escalated Legal Complaint and Appeal: Freedom of Information Act Request: Exposing Systemic Failures in Medicaid Oversight, ADA Enforcement, and Whistleblower Protections to Ensure Justice and Transparency for All Americans (Department of Justice, Civil Rights Division)
Explaining David Medeiros Advocacy for Disabled People, Medicaid Consumers, Taxpayers, and Whistleblowers
What Was Asked For?
David Medeiros, founder of ABI Resources, submitted a formal Freedom of Information Act (FOIA) request on November 23, 2024. He asked government agencies for critical information to ensure fairness, transparency, and accountability in several key areas:
Medicaid Oversight: Information about how the Medicaid Acquired Brain Injury (ABI) Waiver Program is being run, including any audits, sanctions, or violations.
ADA Compliance: Records showing whether agencies are following the Americans with Disabilities Act (ADA) to ensure accessibility for people with disabilities.
Whistleblower Protections: Policies and records about protecting individuals who report problems in government programs.
Government Transparency: Internal communications, decision-making records, and inter-agency agreements that reveal how agencies handle their responsibilities.
FOIA Processing Records: Documentation showing how these requests were handled, including logs, timestamps, and communications.
David requested this information on behalf of all Americans, particularly disabled individuals, Medicaid consumers, taxpayers, and whistleblowers, to ensure these systems are working as they should.
What Was Given?
The responses David received raise significant concerns:
Delays and Lack of Thoroughness:
Agencies acknowledged receiving the requests but delayed responses far beyond legal deadlines.
The Department of Justice (DOJ) claimed they did not maintain many of the requested records, failing to provide a complete search or refer the requests to other relevant offices.
Incomplete or Corrupted Responses:
Some records provided were inaccessible, with corrupted files or formats that David, as a person with a disability, could not access.
Key details about Medicaid program oversight, ADA enforcement, and whistleblower protections were missing or withheld without proper explanation.
Improperly Consolidated Requests:
Multiple requests for distinct complaints were combined, limiting transparency and accountability.
This approach obscures important details about specific systemic failures.
Failure to Address ADA Accommodations:
Despite clear legal requirements, agencies ignored requests for ADA-compliant communication, such as providing accessible formats and embedding text in emails.
This not only discriminates against David but violates federal disability rights laws.
Why Is This Concerning?
These failures are not just about one personthey represent broader systemic issues affecting millions of Americans:
Disabled People and Medicaid Consumers:
Delays and inaccessible records harm vulnerable individuals who rely on Medicaid programs. The lack of oversight increases the risk of mismanagement or fraud in programs designed to support people with disabilities.
Ignoring ADA accommodation requests undermines the rights of disabled people to participate fully in society.
Taxpayers:
Medicaid is funded by taxpayer dollars, and transparency is crucial to ensure funds are being used responsibly. Withholding information or failing to audit programs risks waste, fraud, and abuse.
Citizens deserve to know how their money is spent and whether agencies are fulfilling their legal obligations.
Whistleblowers:
Retaliation against whistleblowers like David, who report systemic issues, creates a chilling effect. When agencies fail to protect those who speak out, problems remain hidden, and accountability diminishes.
Whistleblower protections are critical to exposing wrongdoing and improving government services.
All Americans:
A lack of transparency and accountability weakens public trust in government institutions. When agencies fail to provide timely, complete, and accessible records, they violate the principles of fairness, justice, and democracy.
What This Means for Us
David Medeiros is advocating for solutions to these systemic issues because they affect all of us, especially:
Disabled individuals who depend on fair access to government programs.
Medicaid consumers who rely on effective oversight of healthcare services.
Taxpayers who deserve accountability for how public funds are spent.
Whistleblowers who risk everything to expose wrongdoing for the greater good.
This is about ensuring that government systems work for the people they are meant to serve, not against them.
David Medeiros and ABI Resources: Advocating for Change
David and ABI Resources are standing up for the rights of all Americans by:
Demanding Transparency: Ensuring government agencies provide the information they are legally required to share.
Pushing for Accountability: Highlighting systemic failures and advocating for corrective actions to improve Medicaid programs, ADA compliance, and whistleblower protections.
Protecting Vulnerable Communities: Advocating for people with disabilities, Medicaid consumers, and others who are often overlooked or underserved.
Engaging Oversight Entities: Involving Congress, watchdog organizations, and advocacy groups to hold agencies accountable.
Whats Next?
If these issues remain unresolved, David plans to escalate the matter by:
Filing lawsuits to enforce transparency and ensure ADA compliance.
Engaging Congress to investigate systemic failures in Medicaid and whistleblower protections.
Working with journalists and advocates to expose these issues to the public.
David Medeiros and ABI Resources are committed to making government programs fair, transparent, and accountable for everyonebecause this is about us, the people.

I. Overview
This legal complaint and appeal highlight systemic failures in:
Constitutional protections, including First, Fifth, and Fourteenth Amendments.
Whistleblower retaliation under 5 U.S.C. 2302(b)(8).
Medicaid oversight under federal accountability laws.
ADA enforcement, as mandated by 42 U.S.C. 12132 and 29 U.S.C. 794.
FOIA compliance, pursuant to 5 U.S.C. 552.
The following violations involve the DOJs Civil Rights Division, CMS, DSS, and other federal entities in mishandling FOIA requests, retaliating against whistleblowers, failing to provide ADA accommodations, and denying public transparency.
II. Key Violations
A. Constitutional Violations
First Amendment
Denial of access to critical public records undermines the right to petition the government and hinders public oversight (New York Times Co. v. United States, 403 U.S. 713 (1971)).
Fifth and Fourteenth Amendments
Systemic delays, inaccessible records, and failure to accommodate ADA requests constitute violations of due process and equal protection (Tennessee v. Lane, 541 U.S. 509 (2004); Mathews v. Eldridge, 424 U.S. 319 (1976)).
B. Whistleblower Retaliation
Retaliatory actions against ABI Resources following whistleblower reports filed on December 18, 2023, include:
Medicaid billing suspension and operational disruptions.
Premature closure of critical complaint files, including Sandata EVV Ticket #539494.
Intimidation tactics violating the Whistleblower Protection Act (Burlington N. & Santa Fe Ry. Co. v. White, 548 U.S. 53 (2006)).
C. FOIA Non-Compliance
Failure to Conduct Adequate Searches
Agencies failed to locate responsive records tied to complaint numbers #534659-XGL, #539298-RJM, #534060-HWM, and others.
Inter-agency communications and digital repositories were ignored.
Insufficient Justifications for Withholdings
Agencies failed to issue a Vaughn Index for withheld or redacted records as required (Vaughn v. Rosen, 484 F.2d 820 (D.C. Cir. 1973)).
Improper Application of Exemptions
Misuse of FOIA exemptions to delay or deny release of non-privileged records (DOJ v. Reporters Committee, 489 U.S. 749 (1989)).
Processing Errors and Accessibility Failures
Corrupted downloads and inaccessible formats contravened ADA mandates under 28 C.F.R. 35.160.
D. ADA and Rehabilitation Act Violations
Failure to Provide ADA-Compliant Records
Ignored requests for screen-reader-compatible formats, embedded email text, and exclusive communication via MuckRock.
Discrimination Against Individuals with Disabilities
Failure to engage in the interactive process for reasonable accommodations as required by ADA Title II (Barnett v. U.S. Air, Inc., 535 U.S. 391 (2002)).
E. Medicaid Oversight and Taxpayer Accountability
Mismanagement of Medicaid Funds
Suspension of ABI Resources Medicaid billing privileges without transparency or due process.
Failure to Address Systemic Issues
Lack of corrective action in the Medicaid ABI Waiver Program and failure to address operational disruptions.
III. Legal Remedies and Demands
1. Constitutional Protections
Restore access to denied records in compliance with First Amendment protections for transparency and public accountability.
Provide a timeline for resolving ADA accommodation violations under Fifth and Fourteenth Amendments.
2. FOIA Compliance
Conduct a comprehensive search across DOJ, CMS, DSS, and related agencies for requested records.
Provide a Vaughn Index detailing justifications for redacted or withheld records.
Deliver non-exempt records in accessible, ADA-compliant formats within statutory deadlines.
3. ADA Enforcement
Commit to full ADA accommodation compliance:
Screen-reader-compatible PDFs.
Summaries for complex documents.
Communication solely via MuckRock.
Identify personnel responsible for handling ADA requests.
ADA Accommodations Request
This request includes explicit ADA accommodations to address cognitive processing challenges resulting from my traumatic brain injury (TBI). These accommodations are legally required under Title II of the ADA (42 U.S.C. 12132) and Section 504 of the Rehabilitation Act (29 U.S.C. 794).
Requested ADA Accommodations
To ensure accessibility and compliance with ADA standards (42 U.S.C. 12101 et seq.), I request the following accommodations for all communications and records:
Screen-Reader Compatible Formats
All documents must be provided in properly labeled PDFs or plain-text files.
Ensure that the documents are screen-reader compatible and retain clear, accessible formatting.
Exclusive MuckRock Platform Communication
All communications must occur exclusively via the MuckRock platform.
Do not send external links, emails, portals, passwords, codes, or require phone calls for access.

Key information must be embedded directly in the email body to facilitate comprehension and accessibility.
Simplified Summaries
Provide plain-language summaries for complex or legal documents to ensure clarity and understanding.
Identification of Responsible Officers
Include the full name, title, and contact information of all responsible officers handling this request.
Non-Negotiable Compliance
These accommodations are non-negotiable and are essential for ensuring equal access to information. Failure to provide the requested accommodations may constitute a violation of the ADA and the Rehabilitation Act. Thank you for ensuring compliance and accessibility in addressing this request.
4. Whistleblower Protections
Investigate retaliatory actions against ABI Resources, including:
Medicaid billing suspension.
Premature closure of Ticket #539494.
Provide assurance of protection from further retaliation.
5. Medicaid Accountability
Publish records detailing decisions affecting ABI Waiver Program authorizations.

Pursue injunctive relief to compel agency compliance.
Administrative Oversight
Submit formal complaints to the Office of Government Information Services (OGIS), DOJ Office of Inspector General (OIG), and relevant congressional oversight committees.
Congressional Notification
Inform House Oversight and Senate Judiciary Committees of systemic violations.
Public Advocacy
Work with journalists and advocacy groups to expose failures in Medicaid oversight, ADA compliance, and whistleblower protections.
V. Legal Basis for Appeal
FOIA (5 U.S.C. 552)
Ensures public access to government records and mandates timely responses.
ADA (42 U.S.C. 12132)
Prohibits discrimination by public entities and mandates reasonable accommodations.
Rehabilitation Act (29 U.S.C. 794)
Ensures equitable access to federally funded programs.
Whistleblower Protection Act (5 U.S.C. 2302(b)(8))
Shields individuals from retaliation for lawful disclosures.
Single Audit Act (31 U.S.C. 7501-7507)
Requires accountability for federal funds in state-administered programs.
Constitutional Amendments
First Amendment: Public access to information.
Fifth and Fourteenth Amendments: Due process and equal protection.
VI. Conclusion
This complaint demands immediate corrective action to uphold constitutional protections, statutory obligations, and public accountability. Failure to act will result in legal, administrative, and public escalation to ensure compliance and systemic reform.
Signed,
David Medeiros

Good Morning,

In an effort to be fair to the requesters that filed prior to your request, the Division is responding to these in the approximate order of receipt. Various factors impact the turnaround time such as complexity, the volume of the responsive records, the need to consult with attorneys involved in particular matter. This correspondence pertains to my Freedom of Information Act (FOIA) request. Your handling of this matter raises critical concerns under FOIA (5 U.S.C. 552), the Americans with Disabilities Act (ADA, 42 U.S.C. 12132), and constitutional principles of government accountability.
As recognized in National Archives and Records Administration v. Favish, 541 U.S. 157 (2004), transparency is fundamental to democracy and public trust. Your agencys obligations are not discretionary, and failure to meet them constitutes a violation of statutory and constitutional law. This letter establishes your duties, addresses deficiencies, and anticipates and counters all potential deflection strategies.
1. FOIA Obligations: Statutory Mandates and Required Actions
FOIA establishes an enforceable right of access to federal agency records. Your response must meet the following requirements:
A. Timeliness
Under 5 U.S.C. 552(a)(6)(A), you are required to provide a determination within 20 business days. Delays beyond this timeframe, absent legitimate extension requests, constitute a violation of FOIA.
Countermeasure: Delays are actionable under Citizens for Responsibility and Ethics in Washington v. DOJ, 711 F.3d 180 (D.C. Cir. 2013).
Required Action: Provide the requested records or a lawful determination.
B. Adequacy of Search
FOIA requires a thorough and reasonable search for records, as established in Campbell v. DOJ, 164 F.3d 20 (D.C. Cir. 1998). This includes:
Identifying the databases, locations, and terms used.
Providing a sworn affidavit detailing the search scope.
Countermeasure: A vague claim of "no responsive records" is insufficient without a detailed affidavit.
Required Action: Submit a sworn affidavit documenting the search or confirm the existence of responsive records.
C. Proper Use of Exemptions
Exemptions under 5 U.S.C. 552(b) must be narrowly applied and justified with specific explanations. Blanket or vague exemptions are impermissible.
Countermeasure: A Vaughn index (Vaughn v. Rosen, 484 F.2d 820 (D.C. Cir. 1973)) is required to justify each withholding.
Required Action: Submit a Vaughn index detailing each exemption and its justification within 10 business days.
D. Decentralization and Referrals
Referrals or decentralization excuses do not absolve your agency of its responsibility to provide a consolidated response. As held in McGehee v. CIA, 697 F.2d 1095 (D.C. Cir. 1983), agencies must coordinate internally to ensure compliance.
Countermeasure: Require assurance of continuity and coordination across divisions.
Required Action: Consolidate records from all relevant offices and provide a unified response.
2. ADA and Rehabilitation Act Compliance: Equal Access as a Legal Right
As a person with a documented disability, I am entitled to reasonable accommodations under the ADA and Section 504 of the Rehabilitation Act. Your failure to provide accessible formats for requested records constitutes discrimination and violates federal law.
Case Law:
Tennessee v. Lane, 541 U.S. 509 (2004): Agencies must ensure meaningful access to government services.
Alexander v. Choate, 469 U.S. 287 (1985): Denial of reasonable accommodations creates barriers that violate civil rights.
Required Action:
Provide all requested records in accessible formats, including plain-language summaries or electronic files compatible with assistive technologies.
Confirm compliance with ADA requirements by [specific date].
3. Mandated Reporting and Whistleblower Protections
Your handling of this request implicates broader concerns, including potential fraud, misuse of federal funds, or retaliation against whistleblowers. Under the Whistleblower Protection Act (5 U.S.C. 2302), you are required to report and address systemic violations.
Countermeasure: Reference Misprision of Felony (18 U.S.C. 4), which requires the reporting of observed violations of law.
Required Action: Document and escalate evidence of misconduct to oversight bodies, including the Office of Inspector General (OIG).
4. Consequences of Non-Compliance
Failure to comply with your statutory obligations knowingly constitutes violations of:
Obstruction of Justice (18 U.S.C. 1505): Delaying lawful access to records obstructs public accountability.
Civil Rights Violations (42 U.S.C. 1983): Denying ADA accommodations constitutes a deprivation of federally protected rights.
Misprision of Felony (18 U.S.C. 4): Concealing or failing to report observed violations is a criminal act.
Countermeasure: Prepare for judicial review, oversight complaints, and public advocacy if compliance fails.
5. Escalation Pathways
If your office does not comply within the specified timeframe, I will escalate this matter through:
Judicial Review: Filing a lawsuit under 5 U.S.C. 552(a)(4)(B) to compel disclosure.
Oversight Complaints: Submitting formal complaints to OGIS, OIG, and the DOJ Civil Rights Division.
Public Advocacy: Engaging investigative journalists, transparency advocates, and public interest organizations to ensure accountability.
6. Final Statement: Upholding Transparency and Accountability
This matter reflects the publics right to transparency and the preservation of trust in government institutions. Your actions will either affirm your agencys commitment to accountability or further evidence systemic disregard for these principles.
I look forward to your prompt and substantive response.
David Medeiros

The challenges we face today demand more than acknowledgmentthey require action, collaboration, and a unified commitment to solutions. Together, we must embrace transparency, accountability, and compassion as the foundation of our efforts. By fostering open communication, prioritizing the needs of the most vulnerable, and holding systems accountable, we can rebuild trust and ensure equitable outcomes for all.
Solutions lie in unitywhen state and federal leaders, advocates, and communities work hand in hand to uphold justice and fairness. Transparency through accessible Freedom of Information processes, adherence to legal mandates, and robust oversight are the pillars that support meaningful change. Each of us has a role to play in creating a system that serves and protects.
Our collective mission is clear: to build bridges between agencies and communities, ensure the dignity of every individual, and honor the principles that guide us toward progress. Together, with determination and unity, we can overcome systemic failures and pave the way for a brighter, more inclusive future.

Subject: Urgent Request for Investigation into OSC Case Records, Altered Decisions, and Suppressed Reports
Dear FBI Team,
I am formally requesting your assistance to investigate systemic failures, misconduct, and potential criminal activity surrounding the handling of my submissions to the Office of Special Counsel (OSC). These failures directly impact whistleblower protections, Medicaid oversight, and public accountability.
Issues to Investigate
1. Case Numbers and Records Management
Case Numbers Requiring Investigation:
DI-25-000310DI-25-000325DI-25-000379
DI-12192024714

OSCFiling-MedeirosDavid-DI-12202024300
OSCFiling-MedeirosDavid-DI-112620241121
2. Anonymity and Lack of Accountability in Decision-Making
Unsigned Determination Letters:
Many determination letters from OSC lack identifiable signatures, names, or clear authorship.
This practice raises serious concerns about accountability and compliance with transparency laws.
3. Suppressed or Altered Records
Evidence suggests discrepancies between the whistleblower reports I submitted and how they were recorded or handled by OSC.
Specific issues include:
Alterations or removal of content from submitted complaints.
Suppression of reports that exposed systemic failures in Medicaid oversight and retaliation against whistleblowers.
4. Lack of FOIA Compliance
Despite repeated Freedom of Information Act (FOIA) requests, OSC and related agencies have failed to provide:
Complete case files and communication logs.
Justification for withheld or redacted information.
Clear timelines for compliance.
Specific Questions to Investigate
1. Who is Responsible for Managing These Records?
Identify the individuals, teams, or automated systems involved in creating, altering, and assigning these case numbers and reports.
2. What Decisions Were Made and Why?
Determine how decisions were reached, why some reports were closed without action, and why letters were sent anonymously.
3. Were There Violations of Federal Law?
Investigate potential obstruction of justice, retaliation, or misuse of authority under whistleblower protection laws and FOIA.
Key Agencies and Officials Involved
This matter spans multiple federal and state agencies, including:
Office of Special Counsel (OSC)
Department of Justice (DOJ)
Centers for Medicare & Medicaid Services (CMS)
Department of Health and Human Services (HHS)
Office of Inspector General (OIG)
Why This Matters
1. Whistleblower Protections:
Retaliation against whistleblowers and suppression of reports undermine federal protections designed to safeguard transparency and accountability.
2. Impact on Vulnerable Populations:
These failures harm Medicaid consumers, particularly those with disabilities, by allowing systemic mismanagement to persist unchecked.
3. Misuse of Taxpayer Funds:
Lack of oversight and accountability results in waste and misuse of federal funds meant to serve the public.
Requested Actions
1. Investigate Record Management:
Audit all OSC records, emails, and internal communications related to these case numbers.
Identify responsible individuals or systems.
2. Subpoena Additional Evidence:
Secure all suppressed or altered reports to ensure a complete and accurate investigation.
3. Hold Accountable Those Involved in Misconduct:
Recommend prosecution or disciplinary action for any individuals found to have violated federal laws.
4. Ensure Compliance with FOIA and Whistleblower Protections:
Mandate OSC and related agencies to comply fully with FOIA requests and whistleblower laws.
Attachments
I have attached all available documentation, including:
Correspondence with OSC, including determination letters and emails.
FOIA requests and responses (or lack thereof).
Detailed reports submitted to OSC and other federal agencies.
This issue demands immediate attention to uphold the principles of transparency, accountability, and justice. I am available to provide additional information or documentation as needed.
Sincerely,
David Medeiros

The challenges we face today demand more than acknowledgmentthey require action, collaboration, and a unified commitment to solutions. Together, we must embrace transparency, accountability, and compassion as the
foundation of our efforts.
Transparency through accessible Freedom of Information processes, adherence to legal
mandates, and robust oversight are the pillars that support meaningful change. Each of us has a role to play in creating a system that serves and protects.
Our collective mission is clear: to build bridges between agencies and communities, ensure the dignity of every individual, and honor the principles that guide us toward progress. Together, with determination and unity, we can
overcome systemic failures and pave the way for a brighter, more inclusive future.
Americans living with disabilities and their families are Americansfull citizens of this nation, protected by the same Constitution that guarantees the rights and freedoms of every individual. We are not separate, lesser, or forgotten. We are Americans with the same unalienable rights to life, liberty, and the pursuit of happiness.
