Legal Basis for FOIA Request and Compliance Mandates
1. FOIA Compliance (5 U.S.C. 552)
FOIA mandates timely responses, full disclosure of non-exempt records, and explicit justifications for any redactions or denials. Any failure by DSS, CMS, or other federal agencies to meet these statutory requirements will constitute non-compliance. All denials must include precise statutory citations under FOIA, and records must be provided in their entirety unless exemptions are clearly and legally justified.

2. ADA Compliance Obligations (42 U.S.C. 12132; 28 C.F.R. 35.160)
Under Title II of the ADA, public entities must ensure effective communication with individuals with disabilities. This includes providing accessible documents in screen-reader-compatible formats and meeting specific requests for auxiliary aids. DSS and CMSs failure to meet these requests for ADA accommodations in communications constitutes non-compliance under federal ADA statutes.

3. Federal Whistleblower Protection Standards
Whistleblower protections prohibit retaliation against individuals who report agency misconduct. The actions taken against ABI Resources and David Medeiros, including billing suspension, premature ticket resolution, and operational disruptions following his whistleblower report, are viewed as retaliatory actions that must be substantiated and documented by all relevant agencies.

Specific Demands for Compliance
To ensure adherence to FOIA and ADA mandates, and to facilitate the transparency required by federal and state law, I formally request:

Delivery of ADA-Compliant Records in Full:

Email-Only Communication via MuckRock Platform: All responses, updates, and records must be sent exclusively via email to eliminate accessibility barriers. CMS must refrain from using phone calls, physical mail, or portal-based responses.
Direct Text in Email Body: Embed response text directly in the email body for immediate readability and accessibility.
PDF Attachments for Documents: All records should be provided as clearly labeled PDF attachments, organized by date and document type, with original formatting preserved for clarity and navigability.
Identification of Responsible Personnel: Each response must include names, titles, and contact information of all FOIA officers, decision-makers, and supervisory personnel responsible for processing my request, ensuring transparency and accountability.

Detailed Justifications for Redactions and Denials: Any information withheld or redacted must include detailed explanations citing specific statutory exemptions, in accordance with 5 U.S.C. 552(b). These explanations must include enough detail to verify the legal basis for each exemption claimed.

Request for Expedited Processing of FOIA Request
Pursuant to 5 U.S.C. 552(a)(6)(E), I formally request expedited processing of this FOIA request. This demand is based on critical statutory factors, including significant public interest, imminent risks to the rights of individuals with disabilities, and the need for urgent transparency to prevent ongoing retaliatory actions by public agencies.

Failure to grant expedited processing within the statutory 10-day review period will constitute non-compliance with FOIAs provisions, necessitating formal escalation of this request to administrative or legal authorities.

Consequences of Non-Compliance
Failure to respond to this FOIA request in full compliance, or any delays without proper statutory explanation, may result in formal escalation through administrative, legal, or public channels. DSS, CMS, and other involved agencies are expected to adhere strictly to statutory timelines, ensuring transparency and adherence to ADA and FOIA standards. Non-compliance will be documented and pursued through all available legal remedies.

Conclusion

This FOIA request seeks full and unambiguous access to records necessary to verify and substantiate claims of retaliation, ADA non-compliance, and procedural violations following the December 18, 2023, whistleblower report. I expect each agency to adhere strictly to both FOIA and ADA standards, ensuring prompt and thorough disclosure of all relevant documentation.

Sincerely,
David Medeiros
Founder, ABI Resources, LLC

Summary of Complaint
On November 13, 2024, I submitted a Freedom of Information Act (FOIA) request with explicit ADA accommodation requirements through the MuckRock platform. Despite statutory requirements under FOIA and the ADA, this request has been neither acknowledged nor addressed, violating federal transparency laws and disability rights protections.

This document is designed to hold the responding agency accountable and demand immediate corrective action.

Introduction
This appeal addresses the Department of Justice Civil Rights Divisions failure to acknowledge, process, and respond to my FOIA request dated November 13, 2024. This request concerns records related to Medicaid billing actions, ADA compliance, and whistleblower retaliation. The agencys inaction constitutes violations of the Freedom of Information Act (5 U.S.C. 552) and the Americans with Disabilities Act (42 U.S.C. 12132).

Background of the FOIA Request
The original request sought essential records to ensure public accountability, including:

Medicaid Billing and Ticket #539494: Documentation on billing restrictions affecting ABI Resources, LLC.
ADA Compliance: Records on ADA accommodation requests and adherence to accessibility standards.
Whistleblower Retaliation: Records addressing potential retaliatory actions following a whistleblower report filed on December 18, 2023.
These records are critical for transparency, taxpayer accountability, and upholding the rights of individuals with disabilities.

Violations Identified

Failure to Acknowledge: The DOJ did not acknowledge my FOIA request within the 10-day statutory timeframe under FOIA (5 U.S.C. 552(a)(6)(A)).
Failure to Respond: No estimated completion date or substantive response has been provided, exceeding the statutory 20-business-day deadline.
2. ADA Non-Compliance
Ignored Accommodations: The DOJ failed to honor ADA-required accommodations, including email-only communication, accessible document formatting, and simplified summaries.
3. Whistleblower Retaliation Concerns
No Action on Retaliation Claims: The DOJ has not acted on potential retaliatory measures targeting ABI Resources, LLC, raising concerns about whistleblower protections.
4. Constitutional Violations
Infringement of Rights: By denying access to requested records, the DOJ has infringed upon First Amendment rights (petitioning the government), Fifth Amendment protections (due process), and Fourteenth Amendment guarantees (equal protection).
Remedies Requested
Acknowledgment of FOIA Request:

Immediately acknowledge the FOIA request as of the original submission date (November 13, 2024).

Expedited Processing:

Process this request immediately due to significant public interest and risks to the rights of individuals with disabilities.
Legal Basis for Appeal

Americans with Disabilities Act (42 U.S.C. 12132; 28 C.F.R. 35.160): Public entities must ensure effective communication, including reasonable accommodations for individuals with disabilities.

Subject: Escalated Complaint and FOIA Appeal for Non-Compliance on Constitutional Rights, ADA, Whistleblower, and Taxpayer Protections

Subject: Escalated Complaint and FOIA Appeal for Non-Compliance on Constitutional Rights, ADA, Whistleblower, and Taxpayer Protections

Introduction
This letter serves as an escalated complaint and appeal regarding the Department of Justices failure to adequately address my Freedom of Information Act (FOIA) request submitted on November 13, 2024. This request sought critical records related to Medicaid billing actions, ADA compliance, and retaliation against ABI Resources, LLC, following my December 18, 2023, whistleblower report.

The agency's failure to respond appropriately violates FOIA (5 U.S.C. 552), ADA (42 U.S.C. 12132), constitutional protections, and whistleblower statutes. Additionally, it raises concerns about transparency, accountability, and potential retaliation.

Key Issues
1. FOIA Non-Compliance
Failure to Acknowledge: The agency failed to acknowledge my initial FOIA request within the statutory 10-day timeframe.
Failure to Respond: No substantive response or estimated completion date has been provided within the required 20-business-day period.
Improper Handling: Recent correspondence suggests delays unrelated to FOIA compliance obligations, further obstructing public access to critical records.
Legal Basis:
Under Judicial Watch, Inc. v. U.S. Dept of Homeland Security, 895 F.3d 770 (D.C. Cir. 2018), procedural inefficiencies or administrative delays are insufficient to justify non-compliance with FOIA timelines.

Relief Requested:

Immediate acknowledgment of the FOIA request and appeal.
A detailed timeline for fulfillment, including any statutory exemptions claimed.
2. ADA Non-Compliance
Ignored Accommodations: Despite clear requests, communications have not adhered to ADA guidelines, including exclusive email communication, screen-reader-compatible formats, and simplified summaries of complex documents.
Barriers to Access: Use of portals, physical mail, and inaccessible formats violates Title II of the ADA and Section 504 of the Rehabilitation Act.
Legal Basis:
In Tennessee v. Lane, 541 U.S. 509 (2004), the Supreme Court affirmed public agencies obligations to provide meaningful access to services under the ADA.

Relief Requested:

All future responses must be in ADA-compliant formats, including accessible PDFs and email-only communication.
Confirmation that accommodations have been fully implemented.
3. Whistleblower Protection Violations
Retaliatory Actions: My FOIA request documents significant retaliatory actions, including Medicaid billing restrictions and premature resolution of Ticket #539494, following my December 18, 2023, whistleblower report.
Failure to Investigate: No documentation or explanation has been provided regarding actions taken in response to the whistleblower report.
Legal Basis:
In Lane v. Franks, 573 U.S. 228 (2014), the Supreme Court affirmed whistleblower protections under the First Amendment and federal whistleblower statutes.

Relief Requested:

Release all documents related to Ticket #539494, including complete correspondence and directives.
Investigate and disclose retaliatory measures undertaken by DSS, CMS, or other agencies.
4. Constitutional Violations
First Amendment: Denying access to government records obstructs my constitutional right to petition the government for redress of grievances.
Fifth Amendment: The DOJs failure to provide timely responses violates procedural due process protections.
Fourteenth Amendment: Disparate treatment and ADA non-compliance constitute equal protection violations.
Legal Basis:
In NARA v. Favish, 541 U.S. 157 (2004), the Supreme Court reinforced FOIAs role in promoting government accountability, underscoring its constitutional importance.

Relief Requested:

Ensure compliance with constitutional protections by releasing all requested records without undue delay.
Provide a comprehensive justification for all redactions or denials, as required by the FOIA Improvement Act of 2016.
Specific Demands for Compliance
ADA-Compliant Communication: All responses must adhere to ADA standards, including email-only communication, accessible PDFs, and plain-language summaries.
Identification of Personnel: Provide the names, titles, and contact information of all individuals handling this request.
Transparency on Delays: Deliver a detailed explanation of the reasons for any delays, including timelines for resolution.
Expedited Processing: Grant expedited processing under 5 U.S.C. 552(a)(6)(E) due to significant public interest and whistleblower protection concerns.
Release of Records: Provide all requested records, including unredacted documentation of Ticket #539494 and related correspondence.
Consequences of Non-Compliance
Failure to address these violations within five (5) business days will result in the following actions:

Administrative Complaints:

Filing with the Office of Government Information Services (OGIS) for mediation.
Submitting ADA complaints to HHS Office for Civil Rights and DOJ Disability Rights Section.
Judicial Remedies:

Pursuing litigation under FOIA (5 U.S.C. 552(a)(4)(B)) and ADA (42 U.S.C. 12188).
Seeking injunctive relief and damages for violations of federal law.
Public Advocacy:

Engaging media outlets, public advocacy groups, and whistleblower organizations to highlight systemic failures.
Conclusion
This complaint and appeal demand immediate corrective action to address procedural, legal, and constitutional violations. Transparency, accountability, and accessibility are non-negotiable. I expect a substantive response, including the full release of requested records, within five (5) business days.

Your agencys role as a public servant obligates you to uphold the law and ensure equitable access to justice for all individuals, including those with disabilities. I demand immediate corrective action to address these violations and ensure compliance with federal and constitutional protections.

I look forward to your full cooperation and resolution of these issues.

Sincerely,
David Medeiros

Legal Response and Analysis: Constitutional, ADA, and Whistleblower Protections
Subject: Appeal Number A-2025-00582 and Related Violations

The response provided regarding expedited handling for Appeal Number A-2025-00582 demonstrates a failure to adhere to constitutional rights, ADA protections, and whistleblower safeguards. The claim that the appeal is "unperfected" and the suggestion to file a lawsuit against the government further underline systemic obstructions.

Relevant Constitutional Law and Case Law
First Amendment: Petition Clause

Case Law: California Motor Transport Co. v. Trucking Unlimited, 404 U.S. 508 (1972): Protects the right to petition the government without interference, including seeking redress of grievances. Denying or obstructing FOIA requests undermines this right.
Fifth Amendment: Due Process

Case Law: Mathews v. Eldridge, 424 U.S. 319 (1976): Establishes the need for procedural due process, including transparency and timely responses. Delayed and obstructed FOIA processes violate procedural due process.
Fourteenth Amendment: Equal Protection

Case Law: Bolling v. Sharpe, 347 U.S. 497 (1954): Ensures equal protection under the law. Using procedural technicalities to stonewall access discriminates against individuals based on disability or whistleblower status.
Relevant ADA Civil Rights Protections and Case Law
ADA Title II: Effective Communication

Legal Framework: 42 U.S.C. 12132; 28 C.F.R. 35.160
Case Law: Tennessee v. Lane, 541 U.S. 509 (2004): Ensures individuals with disabilities can access public services on equal terms.
Violation: Refusal to provide accessible communication formats directly violates ADA Title II protections.
ADA Compliance in Public Processes

Case Law: Olmstead v. L.C., 527 U.S. 581 (1999): Reinforces that public services must provide accommodations to individuals with disabilities, including auxiliary aids.
Whistleblower Protections and Case Law
Whistleblower Protection Act (5 U.S.C. 1213)

Protects against retaliation for disclosing information on governmental misconduct.
Violation: The delay in FOIA processing and the refusal to expedite are retaliatory acts against a whistleblower who seeks transparency and accountability.
Case Law:

Garcia v. HUD, 769 F.2d 409 (7th Cir. 1985): Demonstrates retaliation as a direct violation of whistleblower protections.
Passaic Valley Sewerage Commissioners v. Department of Labor, 992 F.2d 474 (3d Cir. 1993): Emphasizes the need for protective mechanisms for whistleblowers seeking redress.
Key Failures in the Government's Response
Lack of Transparency and Identification of Personnel

Violation: FOIA (5 U.S.C. 552) requires disclosure of names, titles, and roles of personnel processing requests. The agency has failed to provide this information.
Stonewalling Whistleblower Protections

The agency's actions undermine the intent of whistleblower protections by delaying responses and denying rightful requests for expedited processing.
Encouragement to Sue the Government

Suggesting litigation as a remedy (5 U.S.C. 552(a)(6)(E)(iii)) exemplifies administrative obstruction rather than resolution. This response burdens the requestor with unnecessary legal challenges.
Conclusion and Demands

The actions described violate constitutional rights, ADA protections, and whistleblower statutes. To remedy these violations, the following actions are demanded:

Full Disclosure:

Provide unredacted records promptly.
Identify FOIA officers by name and title.
Expedited Processing Justification:

Reassess and approve expedited processing due to the public interest, systemic implications, and whistleblower status.
ADA Accommodations:

Deliver all records in accessible formats as mandated by ADA Title II.
Whistleblower Protections:

Confirm that all actions against the whistleblower are being investigated and provide findings.
Failure to comply will result in formal escalation, including administrative complaints, legal action, and public advocacy. These rights are non-negotiable, and systemic obstruction must not continue.

What Was Asked For
David Medeiros, founder of ABI Resources, submitted a Freedom of Information Act (FOIA) request on November 13, 2024. He requested records to:

Investigate retaliation: Evidence of actions taken against his company, ABI Resources, following his whistleblower report in December 2023.
ADA Compliance: Documentation showing how government agencies provided (or failed to provide) accessibility accommodations required by law.
Program changes: Records related to Medicaid billing restrictions and program adjustments affecting ABI Resources.
Transparency: Clear, unredacted records of communications, directives, and decisions involving government officials.

What Was Given
Acknowledgment of the request was delayed far beyond the statutory deadlines under FOIA.
No meaningful responses, records, or timelines were provided for the request.
The request for expedited processing was improperly denied, citing procedural issues rather than substantive factors.
No action was taken to ensure communications were accessible under ADA requirements, ignoring explicit requests for email-only communication and accessible formats.

Failures
FOIA Violations:
Government agencies failed to provide records or respond within the required 20-business-day timeframe.
The denial of expedited processing ignored public interest and urgency criteria.

ADA Violations:
Requested accommodations for disability (e.g., screen-reader-compatible documents, muckrock platform communications) were ignored.

Whistleblower Protections Ignored:
Retaliation claims against ABI Resources were not addressed or investigated.
Constitutional Violations:
Failure to respond obstructs the First Amendment right to petition the government.
Procedural delays violate due process protections under the Fifth Amendment.
Ignoring ADA accommodations breaches the equal protection clause of the Fourteenth Amendment.

How It Affects Everyone
Transparency: The lack of response undermines public trust and accountability in government operations.

Disability Rights: Ignoring ADA requirements sets a dangerous precedent, denying equal access and participation for individuals with disabilities.

Whistleblower Protections: Failing to address retaliation discourages whistleblowers from exposing wrongdoing, which harms public interest.

Public Interest: Delayed or denied access to information obstructs efforts to ensure taxpayer-funded programs, like Medicaid, operate fairly and legally.

Next Steps Demanded
Provide all requested records in accessible formats without further delay.
Investigate and disclose retaliatory actions against ABI Resources.
Adhere to ADA standards for all future communications.
Ensure compliance with constitutional and legal requirements to uphold public trust and accountability.

Introduction
This complaint and appeal address egregious violations of federal law, including the Freedom of Information Act (FOIA), Americans with Disabilities Act (ADA), Whistleblower Protection Act, and constitutional protections. My original FOIA request, submitted on November 13, 2024, sought critical records regarding Medicaid billing actions, ADA compliance, and retaliation against ABI Resources, LLC following my December 18, 2023, whistleblower report.

The Department of Justice (DOJ) and related agencies have failed to uphold their legal obligations, including:

FOIA Non-Compliance: Refusal to acknowledge or process my request in a timely manner.
ADA Violations: Ignoring accommodations essential for accessibility.
Whistleblower Retaliation: Documented retaliatory actions targeting ABI Resources.
Constitutional Violations: Obstructing access to government records, violating my First, Fifth, and Fourteenth Amendment rights.
This appeal demands immediate corrective action, compliance with federal laws, and release of all requested records.

Violations Identified
1. FOIA Non-Compliance (5 U.S.C. 552)
Failure to Acknowledge: The DOJ failed to acknowledge my FOIA request within the statutory 10-day period, violating 5 U.S.C. 552(a)(6)(A).

Failure to Respond: No substantive response or estimated completion date was provided within the statutory 20-business-day period, demonstrating gross non-compliance.

Improper Handling of Expedited Processing: My request for expedited processing under 5 U.S.C. 552(a)(6)(E) was denied on procedural grounds despite meeting public interest criteria.

Legal Precedents:

Judicial Watch, Inc. v. U.S. Dept of Homeland Security, 895 F.3d 770 (D.C. Cir. 2018): Administrative inefficiencies cannot justify delayed responses.
Al-Fayed v. CIA, 254 F.3d 300 (D.C. Cir. 2001): Agencies must prioritize FOIA requests demonstrating urgency and public impact.
Relief Requested:

Immediate acknowledgment and substantive response to my FOIA request.
Rolling disclosure of records to ensure timely access.
Vaughn Index identifying any withheld/redacted records and the specific exemptions applied.
2. ADA Violations (42 U.S.C. 12132)
Failure to Provide Accommodations: The DOJ ignored my specific ADA accommodation requests, including email-only communication, screen-reader-compatible formats, and plain-language summaries for technical documents.

Barriers to Communication: Use of inaccessible portals and physical mail has denied me equal access, violating ADA Title II and Section 504 of the Rehabilitation Act.

Legal Precedents:

Tennessee v. Lane, 541 U.S. 509 (2004): Public entities must provide meaningful access to individuals with disabilities.
Alexander v. Choate, 469 U.S. 287 (1985): Denial of effective communication constitutes discrimination.
Relief Requested:

All responses must adhere to ADA standards, including email-only communication and accessible formats.
Immediate confirmation of compliance with ADA accommodation requests.

3. Whistleblower Retaliation Violations (5 U.S.C. 2302(b)(8))
Documented Retaliation: My whistleblower report on December 18, 2023, exposed misconduct, followed by retaliatory Medicaid billing restrictions and premature resolution of Ticket #539494.

Failure to Investigate: DOJ has provided no evidence of investigations into retaliation claims, raising concerns about enforcement of whistleblower protections.

Legal Precedents:

Lane v. Franks, 573 U.S. 228 (2014): Whistleblowers are protected under the First Amendment for reporting matters of public concern.
Relief Requested:

Release all records related to Ticket #539494, including correspondence, directives, and personnel involved.
Investigate and disclose findings of retaliatory measures targeting ABI Resources.

4. Constitutional Violations
First Amendment: DOJs obstruction of access to government records violates my right to petition the government for redress of grievances.

Fifth Amendment: Procedural delays and refusals infringe upon due process rights.

Fourteenth Amendment: Disparate treatment and ADA non-compliance violate equal protection guarantees.

Legal Precedents:

NARA v. Favish, 541 U.S. 157 (2004): FOIA ensures government accountability, reinforcing constitutional principles.
Goldberg v. Kelly, 397 U.S. 254 (1970): Procedural fairness is essential in administrative processes impacting fundamental rights.
Relief Requested:

Release of all requested records to address constitutional grievances.
Detailed explanations for any denials or delays, ensuring procedural fairness.

Release of Records:

Deliver unredacted records related to Medicaid billing restrictions, ADA compliance, and whistleblower retaliation.
Investigation into Retaliation:

Investigate retaliatory actions against ABI Resources and disclose findings.
Consequences of Non-Compliance
Failure to address these violations within five (5) business days will result in immediate escalation through:

Administrative Complaints:

Filing with the Office of Government Information Services (OGIS).
Submitting ADA complaints to DOJ Disability Rights Section and HHS Office for Civil Rights.
Judicial Remedies:

Seeking injunctive relief and damages under FOIA (5 U.S.C. 552(a)(4)(B)) and ADA (42 U.S.C. 12188).
Public Advocacy:

Engaging media outlets, public advocacy groups, and congressional oversight committees to expose systemic failures.
Certification for Expedited Processing
I hereby certify that the information provided in support of expedited processing is true and correct to the best of my knowledge, in compliance with 28 C.F.R. 16.5(e)(3).

Conclusion
This complaint and appeal demand immediate corrective action to address procedural, legal, and constitutional violations. Transparency, accountability, and accessibility are non-negotiable. I expect a substantive response, including the full release of requested records, within five (5) business days.

Sincerely,
David Medeiros

*** Federal Bureau of Investigation (FBI)
Subject: Urgent Request for Investigation into OSC Case Records, Altered Decisions, and Suppressed Reports

Dear FBI Team,

I am formally requesting your assistance to investigate systemic failures, misconduct, and potential criminal activity surrounding the handling of my submissions to the Office of Special Counsel (OSC). These failures directly impact whistleblower protections, Medicaid oversight, and public accountability.

Issues to Investigate

1. Case Numbers and Records Management

Case Numbers Requiring Investigation:

DI-25-000310

DI-25-000325

DI-25-000379

DI-12192024714

DI-12112024134

OSCFiling-MedeirosDavid-DI-12202024300

OSCFiling-MedeirosDavid-DI-112620241121

2. Anonymity and Lack of Accountability in Decision-Making

Unsigned Determination Letters:

Many determination letters from OSC lack identifiable signatures, names, or clear authorship.

This practice raises serious concerns about accountability and compliance with transparency laws.

3. Suppressed or Altered Records

Evidence suggests discrepancies between the whistleblower reports I submitted and how they were recorded or handled by OSC.

Specific issues include:

Alterations or removal of content from submitted complaints.

Suppression of reports that exposed systemic failures in Medicaid oversight and retaliation against whistleblowers.

4. Lack of FOIA Compliance

Despite repeated Freedom of Information Act (FOIA) requests, OSC and related agencies have failed to provide:

Complete case files and communication logs.

Justification for withheld or redacted information.

Clear timelines for compliance.

Specific Questions to Investigate

1. Who is Responsible for Managing These Records?

Identify the individuals, teams, or automated systems involved in creating, altering, and assigning these case numbers and reports.

2. What Decisions Were Made and Why?

Determine how decisions were reached, why some reports were closed without action, and why letters were sent anonymously.

3. Were There Violations of Federal Law?

Investigate potential obstruction of justice, retaliation, or misuse of authority under whistleblower protection laws and FOIA.

Key Agencies and Officials Involved

This matter spans multiple federal and state agencies, including:

 Office of Special Counsel (OSC)

 Department of Justice (DOJ)

Centers for Medicare & Medicaid Services (CMS)

Department of Health and Human Services (HHS)

 Office of Inspector General (OIG)

Why This Matters

1. Whistleblower Protections:

Retaliation against whistleblowers and suppression of reports undermine federal protections designed to safeguard transparency and accountability.

2. Impact on Vulnerable Populations:

These failures harm Medicaid consumers, particularly those with disabilities, by allowing systemic mismanagement to persist unchecked.

3. Misuse of Taxpayer Funds:

Lack of oversight and accountability results in waste and misuse of federal funds meant to serve the public.

Requested Actions

1. Investigate Record Management:

Audit all OSC records, emails, and internal communications related to these case numbers.

Identify responsible individuals or systems.

2. Subpoena Additional Evidence:

Secure all suppressed or altered reports to ensure a complete and accurate investigation.

3. Hold Accountable Those Involved in Misconduct:

Recommend prosecution or disciplinary action for any individuals found to have violated federal laws.

4. Ensure Compliance with FOIA and Whistleblower Protections:

Mandate OSC and related agencies to comply fully with FOIA requests and whistleblower laws.

Attachments

I have attached all available documentation, including:

Correspondence with OSC, including determination letters and emails.

FOIA requests and responses (or lack thereof).

Detailed reports submitted to OSC and other federal agencies.

This issue demands immediate attention to uphold the principles of transparency, accountability, and justice. I am available to provide additional information or documentation as needed.

Sincerely,
David Medeiros

As recognized in National Archives and Records Administration v. Favish, 541 U.S. 157 (2004), transparency is fundamental to democracy and public trust. Your agencys obligations are not discretionary, and failure to meet them constitutes a violation of statutory and constitutional law. This letter establishes your duties, addresses deficiencies, and anticipates and counters all potential deflection strategies.

1. FOIA Obligations: Statutory Mandates and Required Actions
FOIA establishes an enforceable right of access to federal agency records. Your response must meet the following requirements:

A. Timeliness
Under 5 U.S.C. 552(a)(6)(A), you are required to provide a determination within 20 business days. Delays beyond this timeframe, absent legitimate extension requests, constitute a violation of FOIA.
Countermeasure: Delays are actionable under Citizens for Responsibility and Ethics in Washington v. DOJ, 711 F.3d 180 (D.C. Cir. 2013).
Required Action: Provide the requested records or a lawful determination.

B. Adequacy of Search
FOIA requires a thorough and reasonable search for records, as established in Campbell v. DOJ, 164 F.3d 20 (D.C. Cir. 1998). This includes:
Identifying the databases, locations, and terms used.
Providing a sworn affidavit detailing the search scope.
Countermeasure: A vague claim of "no responsive records" is insufficient without a detailed affidavit.
Required Action: Submit a sworn affidavit documenting the search or confirm the existence of responsive records.

C. Proper Use of Exemptions
Exemptions under 5 U.S.C. 552(b) must be narrowly applied and justified with specific explanations. Blanket or vague exemptions are impermissible.
Countermeasure: A Vaughn index (Vaughn v. Rosen, 484 F.2d 820 (D.C. Cir. 1973)) is required to justify each withholding.
Required Action: Submit a Vaughn index detailing each exemption and its justification within 10 business days.

D. Decentralization and Referrals
Referrals or decentralization excuses do not absolve your agency of its responsibility to provide a consolidated response. As held in McGehee v. CIA, 697 F.2d 1095 (D.C. Cir. 1983), agencies must coordinate internally to ensure compliance.
Countermeasure: Require assurance of continuity and coordination across divisions.
Required Action: Consolidate records from all relevant offices and provide a unified response.

2. ADA and Rehabilitation Act Compliance: Equal Access as a Legal Right
As a person with a documented disability, I am entitled to reasonable accommodations under the ADA and Section 504 of the Rehabilitation Act. Your failure to provide accessible formats for requested records constitutes discrimination and violates federal law.

Case Law:
Tennessee v. Lane, 541 U.S. 509 (2004): Agencies must ensure meaningful access to government services.
Alexander v. Choate, 469 U.S. 287 (1985): Denial of reasonable accommodations creates barriers that violate civil rights.

Required Action:
Provide all requested records in accessible formats, including plain-language summaries or electronic files compatible with assistive technologies.
Confirm compliance with ADA requirements by [specific date].

3. Mandated Reporting and Whistleblower Protections
Your handling of this request implicates broader concerns, including potential fraud, misuse of federal funds, or retaliation against whistleblowers. Under the Whistleblower Protection Act (5 U.S.C. 2302), you are required to report and address systemic violations.
Countermeasure: Reference Misprision of Felony (18 U.S.C. 4), which requires the reporting of observed violations of law.
Required Action: Document and escalate evidence of misconduct to oversight bodies, including the Office of Inspector General (OIG).

4. Consequences of Non-Compliance
Failure to comply with your statutory obligations knowingly constitutes violations of:
Obstruction of Justice (18 U.S.C. 1505): Delaying lawful access to records obstructs public accountability.
Civil Rights Violations (42 U.S.C. 1983): Denying ADA accommodations constitutes a deprivation of federally protected rights.
Misprision of Felony (18 U.S.C. 4): Concealing or failing to report observed violations is a criminal act.
Countermeasure: Prepare for judicial review, oversight complaints, and public advocacy if compliance fails.

5. Escalation Pathways
If your office does not comply within the specified timeframe, I will escalate this matter through:
Judicial Review: Filing a lawsuit under 5 U.S.C. 552(a)(4)(B) to compel disclosure.
Oversight Complaints: Submitting formal complaints to OGIS, OIG, and the DOJ Civil Rights Division.
Public Advocacy: Engaging investigative journalists, transparency advocates, and public interest organizations to ensure accountability.

6. Final Statement: Upholding Transparency and Accountability
This matter reflects the publics right to transparency and the preservation of trust in government institutions. Your actions will either affirm your agencys commitment to accountability or further evidence systemic disregard for these principles.

I look forward to your prompt and substantive response.

The challenges we face today demand more than acknowledgmentthey require action, collaboration, and a unified commitment to solutions. Together, we must embrace transparency, accountability, and compassion as the
foundation of our efforts. By fostering open communication, prioritizing the needs of the most vulnerable, and holding systems accountable, we can rebuild trust and ensure equitable outcomes for all.

Solutions lie in unitywhen state and federal leaders, advocates, and communities work hand in hand to uphold justice and fairness. Transparency through accessible Freedom of Information processes, adherence to legal
mandates, and robust oversight are the pillars that support meaningful change. Each of us has a role to play in creating a system that serves and protects.

Our collective mission is clear: to build bridges between agencies and communities, ensure the dignity of every individual, and honor the principles that guide us toward progress. Together, with determination and unity, we can
overcome systemic failures and pave the way for a brighter, more inclusive future.

Americans living with disabilities and their families are Americansfull citizens of this nation, protected by the same Constitution that guarantees the rights and freedoms of every individual. We are not separate, lesser, or forgotten. We are Americans with the same unalienable rights to life, liberty, and the pursuit of happiness.

We stand firmly on the principles of equality, dignity, and justice. Our voices matter. Our contributions matter. And our rightsour Constitutional rightsmust be respected, upheld, and protected without exception or delay.
