Any decision-making records explaining the determination to take no further action on the report.

Personnel Assignments

Names, titles, and roles of all individuals involved in the review, evaluation, and disposition of this report.
ADA Accommodations
To ensure full compliance with the Americans with Disabilities Act (ADA) and Section 504 of the Rehabilitation Act, I require the following accommodations:

Communication via MuckRock Platform Only:

All responses must be submitted exclusively through MuckRock, avoiding portals, phone calls, or physical mail.
Accessible Formats:

Provide all records as screen-reader-compatible PDFs.
Simplified Summaries:

For complex records, include simplified summaries to ensure clarity and accessibility.
Detailed Justifications for Redactions or Denials:

Cite specific statutory exemptions under 5 U.S.C. 552(b) for any withheld or redacted material.
Identification of Responsible Personnel:

Include the names, titles, and contact details of all FOIA officers and personnel involved in the response.
Partial Records as They Become Available:

Provide responsive records as they are located rather than withholding all records until the entire request is processed.
Expedited Processing
This request qualifies for expedited processing under 5 U.S.C. 552(a)(6)(E) because it concerns significant public interest and addresses systemic civil rights issues with potential societal impact. Delayed access would hinder the public's ability to hold the government accountable and ensure adherence to civil rights protections.

Fee Waiver Request
This request serves the public interest by promoting transparency and accountability within the DOJ's Civil Rights Division. It seeks no commercial benefit and qualifies for a fee waiver under 5 U.S.C. 552(a)(4)(A)(iii).

Timelines and Compliance
FOIA requires a determination within 20 business days. Failure to meet this timeline will prompt escalation to the Office of Government Information Services (OGIS) and potential legal remedies under 5 U.S.C. 552(a)(4)(B).

If no records exist, please confirm this in writing as required by law.

Acknowledgment and Accountability
Please confirm receipt of this request immediately and provide the following:

An estimated completion date as required by 5 U.S.C. 552(a)(7).
The name, title, and contact information of the FOIA officer(s) processing this request.
Thank you for your attention to this matter. I look forward to your timely response in compliance with FOIA statutes.

Sincerely,
David Medeiros
Founder, ABI Resources

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Sincerely,

DAVID MEDEIROS

From: David Medeiros
Date: December 12, 2024
Subject: FOIA Appeal DOJ Civil Rights Division Records Pertaining to Report Number 533252-GXC

To: Director, Office of Information Policy (OIP)
United States Department of Justice
441 G Street NW, 6th Floor
Washington, DC 20530

CC:

Merrick B. Garland, Attorney General, DOJ
Kristen Clarke, Assistant Attorney General, Civil Rights Division
Michael E. Horowitz, Inspector General, DOJ
Sean R. ONeill, Director, OIP
Brian Flannigan Chief, FOIA and Privacy Office
Introduction:

This is a formal appeal of the Department of Justice Civil Divisions response dated December 12, 2024, to my Freedom of Information Act (FOIA) request concerning Report Number 533252-GXC. The Civil Division improperly closed my request, citing misdirection to the Civil Rights Division (CRT), without conducting a search, providing substantive action, or verifying the absence of responsive records.

This appeal demands immediate action to correct procedural errors, initiate a comprehensive search, and ensure compliance with FOIA and ADA obligations.

Grounds for Appeal
1. Improper Routing Without Substantive Action
The Civil Division misdirected my request to CRT without confirming the absence of records within its own jurisdiction or initiating a search as required by 5 U.S.C. 552(a)(3). The lack of clarity on jurisdiction violates FOIA's transparency mandates.

Relief Requested:

Initiate a search for responsive records within the Civil Division.
Confirm in writing whether the Civil Division, CRT, or another DOJ component has jurisdiction.
2. Failure to Identify FOIA Officer(s) and Decision-Makers
The response failed to identify the FOIA officers and decision-makers responsible for processing my request, violating FOIAs transparency requirements.

Relief Requested:

Provide the names, titles, and contact information of all personnel involved.
Include a sworn affidavit confirming the absence of records, if claimed.
3. Failure to Adhere to ADA Accommodations
Despite explicit requests, the Civil Division failed to provide reasonable accommodations required under the ADA and Section 504 of the Rehabilitation Act. This failure created barriers to equitable access.

Relief Requested:
Adhere to ADA requirements by:

Communicating exclusively via MuckRock.
Providing accessible PDFs and simplified summaries.
Ensuring all future responses comply with ADA standards.
4. Improper Denial of Expedited Processing
The denial of expedited processing ignored the significant public interest in addressing systemic civil rights violations. This oversight contravenes 5 U.S.C. 552(a)(6)(E).

Relief Requested:
Reassess and grant expedited processing based on the compelling public interest.

5. Non-Compliance with Statutory Timelines
The Civil Division failed to provide a determination within the statutory 20-day timeline, violating 5 U.S.C. 552(a)(6)(A).

Relief Requested:
Provide an estimated completion date and detailed explanation for delays.

Legal Basis for Appeal
Freedom of Information Act (5 U.S.C. 552): Mandates timely responses, reasonable searches, and detailed explanations for denials.
Americans with Disabilities Act (42 U.S.C. 12132): Requires reasonable accommodations to ensure equitable access.
Rehabilitation Act (29 U.S.C. 794): Prohibits discrimination and mandates accessible communication.
First and Fifth Amendments: Protect public access to information and due process rights.
Consequences of Non-Compliance
Failure to comply with this appeal will result in the following actions:

Administrative Escalation: Filing complaints with OGIS and the DOJ Office of Inspector General.
Judicial Remedies: Seeking court enforcement of FOIA and ADA obligations.
Public Advocacy: Dissemination of systemic non-compliance to media and watchdog organizations.
Conclusion and Deadline for Response:

This appeal demands immediate corrective action to ensure compliance with FOIA, ADA, and constitutional standards. I expect:

A complete response by December 20, 2024, including acknowledgment of ADA accommodations.
Full disclosure of responsive records or a detailed explanation of exemptions.
Thank you for your prompt attention to this matter. Please confirm receipt of this appeal and provide the name and contact information of the individual responsible for its resolution.

Sincerely,
David Medeiros

Subject: Final Assertion of Legal Obligations Under FOIA, ADA, and Constitutional Law
Subject: 11/20/2024 Freedom of Information Act Request: Request for Comprehensive Records Pertaining to Report Number 533252-GXC (Department of Justice, Civil Division)

01.08.2025

To all It May Concern in All Relevant Departments and Divisions,

Brian Flannigan
Chief, FOIA and Privacy Office
U.S. Department of Justice
Civil Division, FOIA and Privacy Office
Room 8314
1100 L Street, NW
Washington, DC 20530

This correspondence pertains to my Freedom of Information Act (FOIA) request. Your handling of this matter raises critical concerns under FOIA (5 U.S.C. 552), the Americans with Disabilities Act (ADA, 42 U.S.C. 12132), and constitutional principles of government accountability.

As recognized in National Archives and Records Administration v. Favish, 541 U.S. 157 (2004), transparency is fundamental to democracy and public trust. Your agencys obligations are not discretionary, and failure to meet them constitutes a violation of statutory and constitutional law. This letter establishes your duties, addresses deficiencies, and anticipates and counters all potential deflection strategies.

1. FOIA Obligations: Statutory Mandates and Required Actions
FOIA establishes an enforceable right of access to federal agency records. Your response must meet the following requirements:

A. Timeliness
Under 5 U.S.C. 552(a)(6)(A), you are required to provide a determination within 20 business days. Delays beyond this timeframe, absent legitimate extension requests, constitute a violation of FOIA.

Countermeasure: Delays are actionable under Citizens for Responsibility and Ethics in Washington v. DOJ, 711 F.3d 180 (D.C. Cir. 2013).
Required Action: Provide the requested records or a lawful determination.

B. Adequacy of Search
FOIA requires a thorough and reasonable search for records, as established in Campbell v. DOJ, 164 F.3d 20 (D.C. Cir. 1998). This includes:

Identifying the databases, locations, and terms used.
Providing a sworn affidavit detailing the search scope.
Countermeasure: A vague claim of "no responsive records" is insufficient without a detailed affidavit.
Required Action: Submit a sworn affidavit documenting the search or confirm the existence of responsive records.

C. Proper Use of Exemptions
Exemptions under 5 U.S.C. 552(b) must be narrowly applied and justified with specific explanations. Blanket or vague exemptions are impermissible.

Countermeasure: A Vaughn index (Vaughn v. Rosen, 484 F.2d 820 (D.C. Cir. 1973)) is required to justify each withholding.
Required Action: Submit a Vaughn index detailing each exemption and its justification within 10 business days.

D. Decentralization and Referrals
Referrals or decentralization excuses do not absolve your agency of its responsibility to provide a consolidated response. As held in McGehee v. CIA, 697 F.2d 1095 (D.C. Cir. 1983), agencies must coordinate internally to ensure compliance.

Countermeasure: Require assurance of continuity and coordination across divisions.
Required Action: Consolidate records from all relevant offices and provide a unified response.

2. ADA and Rehabilitation Act Compliance: Equal Access as a Legal Right
As a person with a documented disability, I am entitled to reasonable accommodations under the ADA and Section 504 of the Rehabilitation Act. Your failure to provide accessible formats for requested records constitutes discrimination and violates federal law.

Case Law:
Tennessee v. Lane, 541 U.S. 509 (2004): Agencies must ensure meaningful access to government services.
Alexander v. Choate, 469 U.S. 287 (1985): Denial of reasonable accommodations creates barriers that violate civil rights.
Required Action:

Provide all requested records in accessible formats, including plain-language summaries or electronic files compatible with assistive technologies.
Confirm compliance with ADA requirements by [specific date].
3. Mandated Reporting and Whistleblower Protections
Your handling of this request implicates broader concerns, including potential fraud, misuse of federal funds, or retaliation against whistleblowers. Under the Whistleblower Protection Act (5 U.S.C. 2302), you are required to report and address systemic violations.

Countermeasure: Reference Misprision of Felony (18 U.S.C. 4), which requires the reporting of observed violations of law.
Required Action: Document and escalate evidence of misconduct to oversight bodies, including the Office of Inspector General (OIG).

4. Consequences of Non-Compliance
Failure to comply with your statutory obligations knowingly constitutes violations of:

Obstruction of Justice (18 U.S.C. 1505): Delaying lawful access to records obstructs public accountability.
Civil Rights Violations (42 U.S.C. 1983): Denying ADA accommodations constitutes a deprivation of federally protected rights.
Misprision of Felony (18 U.S.C. 4): Concealing or failing to report observed violations is a criminal act.
Countermeasure: Prepare for judicial review, oversight complaints, and public advocacy if compliance fails.
5. Escalation Pathways
If your office does not comply within the specified timeframe, I will escalate this matter through:

Judicial Review: Filing a lawsuit under 5 U.S.C. 552(a)(4)(B) to compel disclosure.
Oversight Complaints: Submitting formal complaints to OGIS, OIG, and the DOJ Civil Rights Division.
Public Advocacy: Engaging investigative journalists, transparency advocates, and public interest organizations to ensure accountability.

6. Final Statement: Upholding Transparency and Accountability
This matter reflects the publics right to transparency and the preservation of trust in government institutions. Your actions will either affirm your agencys commitment to accountability or further evidence systemic disregard for these principles.

I look forward to your prompt and substantive response.
