Dear Ms. Freeman,

I am following up on my FOIA request No. 25-00044-F, submitted to the DOJ Civil Rights Division on October 24, 2024, and acknowledged on October 25, 2024. Subject: FOIA Mediation Request for Case No. 25-00044-F
To: ogis@nara.gov
Dear OGIS Team,
I am seeking mediation assistance regarding my Freedom of Information Act (FOIA) request, case
number 25-00044-F, submitted to the Civil Rights Division on October 24, 2024. This request seeks
access to records for a comprehensive and up-to-date provider registry associated with the
Connecticut Medicaid Acquired Brain Injury (ABI) Waiver Program, specifically including provider
details, areas of specialty, enrollment statuses, and any records related to complaints or actions taken.
The Civil Rights Division acknowledged my request on October 25, 2024, but noted that processing
might be delayed due to a high volume of FOIA requests. Given the importance of these records in
supporting transparency and accountability in Medicaid program administration, I believe there may be
ways to expedite or better track the status of my request through your mediation services.
Please note my basic accommodation request: All communication for this matter should be
conducted exclusively via email, without the use of external portals, alternate websites, or phone
calls, as this ensures I can fully manage and review the information provided.
Thank you for your assistance in pursuing a complete and timely response.
Sincerely,
David Medeiros

Dear David Medeiros:
Thank you for contacting the Office of Government Information Services (OGIS), an office of
the National Archives and Records Administration. As you are aware, Congress created OGIS to
serve as the federal Freedom of Information Act (FOIA) Ombudsman. We assist the public and
federal agencies by helping them resolve their FOIA disputes, and by addressing their questions
and concerns about the FOIA process.
It appears that you are seeking assistance with a FOIA request currently pending with the U.S.
Department of Justices Civil Rights Division. Please note, OGIS cannot compel an agency to
process a request more quickly or ahead of others in the queue. However, in working cases
similar to yours, we have learned that some requesters have had success receiving a more timely
response by refining the scope of a request. If you would like to discuss narrowing your
requestwhich may allow it to be processed more efficiently you may wish to contact the
agency's FOIA Public Liaison (FPL). All federal agencies have an FPL, whose role is to explain
the FOIA process and assist requesters with their FOIA requests at any stage of the
administrative process.
Additionally, it is important to know that all federal agencies are required to provide an estimated
date of completion (EDC) when asked (5 U.S.C. 552(a)(7)(B)(ii)). In order to obtain an
estimated date of completion for your request, we recommend that you contact the agency
directly. The FOIA Public Liaison (FPL) for the Civil Rights Division, April Freeman, can be
reached at 202-514-4210.
We hope you find this information useful. At this time, we will take no further action. If you
have questions or concerns that we have not addressed, please contact us again.
Best regards,
The OGIS Staff

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Sincerely,

DAVID MEDEIROS

Expedited Processing

Given the urgent public interest and the necessity of ADA compliance, I request expedited processing under 5 U.S.C. 552(a)(6)(E).

If the Civil Rights Division cannot fulfill this request, it must:
Provide detailed reasons and legal justifications for its inability to process.
Confirm referral of the request to the appropriate office or agency, with written acknowledgment of the referral.
Full Disclosure

All requested records must be provided unredacted unless specific FOIA exemptions under 5 U.S.C. 552(b) are cited and justified.
Consequences of Non-Compliance
Failure to comply with FOIA and ADA requirements, or any further delays in this matter, will necessitate immediate escalation through:

OGIS Mediation: Filing a formal complaint with the Office of Government Information Services for mediation.
Legal Action: Pursuing judicial remedies for violations of FOIA, ADA, and constitutional rights.
Public Advocacy: Engaging public transparency organizations and media outlets to highlight non-compliance and obstruction of justice.
Conclusion

Subject: Appeal for FOIA Request No. 1671521 Request for Estimated Completion Date (EDC), ADA Accommodation Confirmation, and Transparency of Responsible Personnel

Date: November 19, 2024

Dear Ms. Freeman, Mr. Luckey, and the Office of Government Information Services (OGIS),

I am formally appealing the handling of my FOIA Request No. 1671521, which was submitted to the U.S. Department of Justice (DOJ), Civil Rights Division, on November 10, 2024, and acknowledged by your office. Despite the statutory timelines and legal requirements under the Freedom of Information Act (FOIA), I have yet to receive an estimated date of completion (EDC) for my request, which is in violation of 5 U.S.C. 552(a)(7)(B)(ii).

Further, I continue to experience inadequate ADA accommodations and have not received any information regarding the responsible personnel managing my request. These failures undermine the principles of transparency, accountability, and equitable access as guaranteed by FOIA and ADA.

I respectfully request that this appeal be processed expeditiously to ensure compliance with federal law and to avoid further delays in fulfilling my request. This appeal addresses the following key issues:

Key Legal Issues:
FOIA Non-Compliance (5 U.S.C. 552):

Failure to Provide an Estimated Date of Completion (EDC): Under 5 U.S.C. 552(a)(7)(B)(ii), agencies are required to provide an EDC when requested. Despite asking for this, I have not received a response from the DOJ regarding the estimated timeline for processing my request.
Failure to Meet FOIA Deadlines: Under 5 U.S.C. 552(a)(6)(A), FOIA requests must be processed within 20 business days. My request remains unresolved without any formal explanation or legal justification for the delay.
Violation of ADA and Section 504 of the Rehabilitation Act (42 U.S.C. 12132, 29 U.S.C. 794):

Failure to Provide ADA Accommodations: My request for ADA accommodations, including email-only communication, has been disregarded. This violates the Americans with Disabilities Act (ADA) and Section 504 of the Rehabilitation Act, which mandate that public agencies ensure accessible communication methods.
Refusal to Accommodate: All correspondence related to this FOIA request should be conducted via email only, without the use of portals, phone calls, or other inaccessible methods.
Lack of Transparency Regarding Responsible Personnel:

Demand for Responsible Personnels Information: Under 5 U.S.C. 552, I am entitled to the names, titles, and contact information of personnel responsible for handling my FOIA request. The DOJ has failed to provide any transparency regarding who is managing my request or processing the relevant records.
Specific Requests:
Estimated Date of Completion (EDC):

I request that an EDC be provided immediately for my FOIA request, in compliance with 5 U.S.C. 552(a)(7)(B)(ii).
Full Disclosure of Responsible Personnel:

I request the names, titles, and contact information of all personnel involved in processing my FOIA request, including FOIA officers, legal advisors, and decision-makers within the Civil Rights Division and any other offices involved.
ADA Compliance:

I request that all future communications be conducted exclusively via email. No external portals or phone calls should be used, as these methods are inaccessible.
All documents should be provided as screen-reader-compatible PDF attachments that are properly organized by type and date.
Expedited Processing:

Given the urgent public interest in ensuring transparency and the critical need for ADA compliance, I request expedited processing under 5 U.S.C. 552(a)(6)(E).
Legal Justifications for Redactions:

If any information is withheld or redacted, I request that detailed legal justifications be provided, in compliance with 5 U.S.C. 552(b).
Consequences of Non-Compliance:
If the DOJ continues to delay or fail to comply with the legal requirements outlined in this appeal, I will take the following steps:

OGIS Mediation:

I will file a formal complaint with the Office of Government Information Services (OGIS) and request their mediation services.
Legal Action:

I will pursue judicial remedies for violations of FOIA, ADA, and constitutional rights if the DOJ continues to delay or mishandle my request.
Public Advocacy:

I will engage public transparency organizations and media outlets to bring attention to the DOJs non-compliance with FOIA and ADA requirements.
Conclusion:
The Department of Justice and the Civil Rights Division are required to fulfill their obligations under FOIA, ADA, and the U.S. Constitution. The failure to provide an estimated date of completion (EDC), ADA accommodations, and responsible personnel information constitutes a violation of federal law. I expect immediate action on this appeal and request that the DOJ fully comply with all statutory requirements.

Please confirm receipt of this appeal and provide a timely response in compliance with all legal requirements.

Sincerely,
David Medeiros

Introduction
This appeal challenges ongoing non-compliance with FOIA statutory requirements, failure to adhere to ADA accommodation mandates, and violations of constitutional rights related to FOIA Request No. 25-00044-F. The request seeks critical records regarding Medicaid transparency in the Connecticut ABI Waiver Program, which holds significant public interest for taxpayers and disability advocates.

Despite statutory deadlines, the Civil Rights Division has failed to:

Provide an estimated date of completion (EDC), as required under 5 U.S.C. 552(a)(7)(B)(ii).
Deliver records in a timely, ADA-compliant manner.
Acknowledge responsible personnel managing this request.
The delays and non-compliance infringe upon my First, Fifth, and Fourteenth Amendment rights and undermine public trust in government accountability.

Legal Grounds for Appeal
1. FOIA Non-Compliance
Failure to Provide EDC: Under 5 U.S.C. 552(a)(7)(B)(ii), agencies must provide an EDC upon request. To date, no EDC has been provided despite multiple follow-ups.
Failure to Meet FOIA Deadlines: Under 5 U.S.C. 552(a)(6)(A), agencies are obligated to process FOIA requests within 20 business days.
2. ADA Violations
ADA Title II (42 U.S.C. 12132) and Section 504 of the Rehabilitation Act (29 U.S.C. 794) mandate reasonable accommodations for individuals with disabilities. Failure to provide ADA-compliant communication (e.g., email-only correspondence, screen-reader-compatible documents) constitutes discrimination.
3. Constitutional Violations
First Amendment: Denying timely access to records impedes the publics right to transparency and accountability, fundamental to democratic participation. (New York Times Co. v. United States, 1971).
Fifth and Fourteenth Amendments: Procedural delays and inadequate accommodations violate due process and equal protection rights (Tennessee v. Lane, 2004).
Supremacy Clause: Federal FOIA and ADA laws preempt conflicting agency practices, requiring strict adherence to statutory mandates.
Public Interest Justification
This request serves the publics right to transparency in Medicaid administration, which involves taxpayer funds and services for vulnerable populations. Expedited processing under 5 U.S.C. 552(a)(6)(E) is warranted due to the:

Significant public interest in ensuring accountability in Medicaid programs.
Potential systemic issues in ADA compliance and recordkeeping that this case highlights.
Demands for Compliance
Immediate EDC and Records

Provide an EDC for this FOIA request within five (5) business days, as mandated under 5 U.S.C. 552(a)(7)(B)(ii).
Fulfill the request with unredacted records unless exemptions under 5 U.S.C. 552(b) are cited and justified.
ADA Compliance

Ensure all future communication is conducted exclusively via email.
Deliver all records as screen-reader-compatible PDFs, properly labeled and organized.
Identification of Responsible Personnel

Include the names, titles, and contact information of all individuals involved in processing this request.
Consequences of Non-Compliance
Failure to comply with FOIA, ADA, and constitutional obligations will result in:

Judicial Action: Initiating legal proceedings to enforce compliance with FOIA and ADA statutory and constitutional requirements.
OGIS Mediation: Filing a formal complaint with the Office of Government Information Services for resolution.
Public and Media Engagement: Engaging transparency organizations and media outlets to expose systemic non-compliance and constitutional violations.
Conclusion
The Department of Justice must act immediately to rectify these violations, ensuring adherence to FOIA and ADA statutes and protecting constitutional rights. Transparency, accountability, and compliance with federal law are non-negotiable.

Please confirm receipt of this appeal and provide a response addressing all points within the statutory timeframe.

David Medeiros

Federal Bureau of Investigation (FBI)
Subject: Urgent Request for Investigation into OSC Case Records, Altered Decisions, and Suppressed Reports

Dear FBI Team,
I am formally requesting your assistance to investigate systemic failures, misconduct, and potential criminal activity surrounding the handling of my submissions to the Office of Special Counsel (OSC). These failures directly impact whistleblower protections, Medicaid oversight, and public accountability.
Issues to Investigate

1. Case Numbers and Records Management
 Case Numbers Requiring Investigation:

DI-25-000310
DI-25-000325
DI-25-000379
DI-12192024714
DI-12112024134

OSCFiling-MedeirosDavid-DI-12022024333
OSCFiling-MedeirosDavid-DI-12032024933
OSCFiling-MedeirosDavid-DI-12042024718
OSCFiling-MedeirosDavid-DI-12052024838
OSCFiling-MedeirosDavid-DI-12062024939
OSCFiling-MedeirosDavid-DI-12072024240
OSCFiling-MedeirosDavid-DI-12112024134
OSCFiling-MedeirosDavid-DI-12202024300
OSCFiling-MedeirosDavid-DI-112620241121

2. Anonymity and Lack of Accountability in Decision-Making
Unsigned Determination Letters:
Many determination letters from OSC lack identifiable signatures, names, or clear authorship.
This practice raises serious concerns about accountability and compliance with transparency laws.

3. Suppressed or Altered Records
Evidence suggests discrepancies between the whistleblower reports I submitted and how they were recorded or handled by OSC.
Specific issues include:
Alterations or removal of content from submitted complaints.
Suppression of reports that exposed systemic failures in Medicaid oversight and retaliation against whistleblowers.

4. Lack of FOIA Compliance
Despite repeated Freedom of Information Act (FOIA) requests, OSC and related agencies have failed to provide:
Complete case files and communication logs.
Justification for withheld or redacted information.
Clear timelines for compliance.

Specific Questions to Investigate
1. Who is Responsible for Managing These Records?
Identify the individuals, teams, or automated systems involved in creating, altering, and assigning these case numbers and reports.

2. What Decisions Were Made and Why?
Determine how decisions were reached, why some reports were closed without action, and why letters were sent anonymously.

3. Were There Violations of Federal Law?
Investigate potential obstruction of justice, retaliation, or misuse of authority under whistleblower protection laws and FOIA.

Key Agencies and Officials Involved
This matter spans multiple federal and state agencies, including:
 Office of Special Counsel (OSC)
 Department of Justice (DOJ)
Centers for Medicare & Medicaid Services (CMS)
Department of Health and Human Services (HHS)
 Office of Inspector General (OIG)

Why This Matters
1. Whistleblower Protections:
Retaliation against whistleblowers and suppression of reports undermine federal protections designed to safeguard transparency and accountability.

2. Impact on Vulnerable Populations:
These failures harm Medicaid consumers, particularly those with disabilities, by allowing systemic mismanagement to persist unchecked.

3. Misuse of Taxpayer Funds:
Lack of oversight and accountability results in waste and misuse of federal funds meant to serve the public.

Requested Actions
1. Investigate Record Management:
Audit all OSC records, emails, and internal communications related to these case numbers.

Identify responsible individuals or systems.
2. Subpoena Additional Evidence:

Secure all suppressed or altered reports to ensure a complete and accurate investigation.
3. Hold Accountable Those Involved in Misconduct:

Recommend prosecution or disciplinary action for any individuals found to have violated federal laws.
4. Ensure Compliance with FOIA and Whistleblower Protections:
Mandate OSC and related agencies to comply fully with FOIA requests and whistleblower laws.

Attachments
I have attached all available documentation, including:
Correspondence with OSC, including determination letters and emails.
FOIA requests and responses (or lack thereof).
Detailed reports submitted to OSC and other federal agencies.

Conclusion
This issue demands immediate attention to uphold the principles of transparency, accountability, and justice. I am available to provide additional information or documentation as needed.

Sincerely,
David Medeiros

As recognized in National Archives and Records Administration v. Favish, 541 U.S. 157 (2004), transparency is fundamental to democracy and public trust. Your agencys obligations are not discretionary, and failure to meet them constitutes a violation of statutory and constitutional law. This letter establishes your duties, addresses deficiencies, and anticipates and counters all potential deflection strategies.

1. FOIA Obligations: Statutory Mandates and Required Actions
FOIA establishes an enforceable right of access to federal agency records. Your response must meet the following requirements:

A. Timeliness
Under 5 U.S.C. 552(a)(6)(A), you are required to provide a determination within 20 business days. Delays beyond this timeframe, absent legitimate extension requests, constitute a violation of FOIA.

Countermeasure: Delays are actionable under Citizens for Responsibility and Ethics in Washington v. DOJ, 711 F.3d 180 (D.C. Cir. 2013).
Required Action: Provide the requested records or a lawful determination.

B. Adequacy of Search
FOIA requires a thorough and reasonable search for records, as established in Campbell v. DOJ, 164 F.3d 20 (D.C. Cir. 1998). This includes:

Identifying the databases, locations, and terms used.
Providing a sworn affidavit detailing the search scope.
Countermeasure: A vague claim of "no responsive records" is insufficient without a detailed affidavit.
Required Action: Submit a sworn affidavit documenting the search or confirm the existence of responsive records.

C. Proper Use of Exemptions
Exemptions under 5 U.S.C. 552(b) must be narrowly applied and justified with specific explanations. Blanket or vague exemptions are impermissible.

Countermeasure: A Vaughn index (Vaughn v. Rosen, 484 F.2d 820 (D.C. Cir. 1973)) is required to justify each withholding.
Required Action: Submit a Vaughn index detailing each exemption and its justification within 10 business days.

D. Decentralization and Referrals
Referrals or decentralization excuses do not absolve your agency of its responsibility to provide a consolidated response. As held in McGehee v. CIA, 697 F.2d 1095 (D.C. Cir. 1983), agencies must coordinate internally to ensure compliance.

Countermeasure: Require assurance of continuity and coordination across divisions.
Required Action: Consolidate records from all relevant offices and provide a unified response.

2. ADA and Rehabilitation Act Compliance: Equal Access as a Legal Right
As a person with a documented disability, I am entitled to reasonable accommodations under the ADA and Section 504 of the Rehabilitation Act. Your failure to provide accessible formats for requested records constitutes discrimination and violates federal law.

Case Law:
Tennessee v. Lane, 541 U.S. 509 (2004): Agencies must ensure meaningful access to government services.
Alexander v. Choate, 469 U.S. 287 (1985): Denial of reasonable accommodations creates barriers that violate civil rights.
Required Action:

Provide all requested records in accessible formats, including plain-language summaries or electronic files compatible with assistive technologies.
Confirm compliance with ADA requirements by [specific date].
3. Mandated Reporting and Whistleblower Protections
Your handling of this request implicates broader concerns, including potential fraud, misuse of federal funds, or retaliation against whistleblowers. Under the Whistleblower Protection Act (5 U.S.C. 2302), you are required to report and address systemic violations.

Countermeasure: Reference Misprision of Felony (18 U.S.C. 4), which requires the reporting of observed violations of law.
Required Action: Document and escalate evidence of misconduct to oversight bodies, including the Office of Inspector General (OIG).

4. Consequences of Non-Compliance
Failure to comply with your statutory obligations knowingly constitutes violations of:

Obstruction of Justice (18 U.S.C. 1505): Delaying lawful access to records obstructs public accountability.
Civil Rights Violations (42 U.S.C. 1983): Denying ADA accommodations constitutes a deprivation of federally protected rights.
Misprision of Felony (18 U.S.C. 4): Concealing or failing to report observed violations is a criminal act.
Countermeasure: Prepare for judicial review, oversight complaints, and public advocacy if compliance fails.
5. Escalation Pathways
If your office does not comply within the specified timeframe, I will escalate this matter through:

Judicial Review: Filing a lawsuit under 5 U.S.C. 552(a)(4)(B) to compel disclosure.
Oversight Complaints: Submitting formal complaints to OGIS, OIG, and the DOJ Civil Rights Division.
Public Advocacy: Engaging investigative journalists, transparency advocates, and public interest organizations to ensure accountability.

6. Final Statement: Upholding Transparency and Accountability
This matter reflects the publics right to transparency and the preservation of trust in government institutions. Your actions will either affirm your agencys commitment to accountability or further evidence systemic disregard for these principles.

I look forward to your prompt and substantive response.
