Subject: Freedom of Information Act Appeal
FOIPA Request Number: NFP-166685

Dear FOIA Appeals Officer,

I am submitting this appeal to contest the FBIs administrative closure of my Freedom of Information Act (FOIA) request, referenced above, concerning records related to the Connecticut Medicaid Acquired Brain Injury (ABI) Waiver Program. I respectfully request a reconsideration of my FOIA request under 5 U.S.C. 552 and 28 CFR 16.3(b), specifically with regards to scope, specificity, and relevance to the FOIA.

Basis for Appeal
The FBIs response, dated October 24, 2024, indicated that my request was administratively closed due to its breadth and lack of sufficient specificity, as well as concerns that the request may fall outside the scope of the FOIA. To address these issues, I am submitting a revised description of my request with additional specificity as outlined below. I believe these adjustments will assist the agency in locating responsive records within a reasonable amount of effort.

Revised Request Scope
Records Requested:

Legislative Records:

Records concerning federal legislative history, proposals, or amendments that mention or affect the Connecticut Medicaid ABI Waiver Program, with particular focus on CMS regulations or guidance.
Any meetings, reports, or discussions between federal officials or federal agencies and Connecticut state agencies that specifically address the ABI Waiver Program (including dates of events where possible).
Public and Financial Records:

Federal-level budget allocations or expenditures related to Medicaid waiver programs, specifically referencing the Connecticut ABI Waiver.
Relevant federal audit results or compliance reviews of the Connecticut Medicaid ABI Waiver Program from 2015 to 2023.
Correspondence and Policy Communications:

Emails, memos, or policy statements from the Centers for Medicare & Medicaid Services (CMS) or Department of Health and Human Services (HHS) regarding administration, compliance, or program evaluation related to the Connecticut Medicaid ABI Waiver from 2018 to present.
Program and Personnel Information:

Copies of CMS guidelines, protocols, and procedural documents governing the Medicaid ABI Waiver Program, pursuant to 42 CFR 440.180.
Organizational charts within CMS or HHS indicating personnel responsible for overseeing the Connecticut Medicaid ABI Waiver Program.
Request for Fee Waiver and Expedited Processing
In line with 5 U.S.C. 552(a)(4)(A)(iii), I request a waiver of all fees associated with this request, as the information serves the public interest by contributing to the understanding of government operations in Medicaid waiver programs impacting vulnerable populations. Additionally, I reiterate my request for expedited processing due to the public significance and personal impact of the information.

Accessibility Accommodations
To facilitate my full participation in this process, I request the following basic accommodations due to my documented TBI and associated needs:

Email-Only Communication: Please ensure all responses are conducted solely via email, as phone communication and other platforms present accessibility challenges.

Full Response Language in Email Body: Please include all substantive response language directly within the body of emails, rather than solely as attachments, as attachments are challenging for me to interpret and review effectively.

Clear Officer Identification: For accountability and effective communication, I request that all responses include the full name, title, and direct contact information of the officer handling my request.

No Use of Portals or External Links: Please avoid requiring me to use external links or navigate portals, as doing so complicates access to information.

Clear and Concise Responses: Due to memory and processing challenges associated with my TBI, responses should be provided in a clear, concise, and comprehensive manner.

Non-Waiver of Rights
Please note that this appeal does not waive any rights I may have under FOIA, the Americans with Disabilities Act, the Rehabilitation Act, or any other applicable law, and I reserve all rights regarding this matter.

Conclusion
Thank you for your attention to this appeal and your consideration of these accommodations. I look forward to your prompt response within the statutory timeframe. If further clarification is needed, I am available to discuss the specifics of my request by email.

Sincerely,
David Medeiros

Re: Non-Compliance with Required ADA and Rehabilitation Act Accommodations in Response to FOIA Appeal No. A-2025-00307

Dear Ms. Jones,

I am writing regarding your offices November 7, 2024, response to my FOIA appeal for Request No. NFP-166685. Regrettably, your response was provided as a downloadable document in disregard of my explicit request for accommodations due to my disabilities. I respectfully ask for corrective action that aligns with legal mandates, particularly under the Americans with Disabilities Act (ADA) (42 U.S.C. 12101 et seq.) and Section 504 of the Rehabilitation Act (29 U.S.C. 794), which require accessible communication accommodations for individuals with disabilities.

Background and Accommodation Requests
On November 1, 2024, I submitted a FOIA appeal in which I specified several accessibility accommodations, including:

Direct Communication via Email Only - Due to my condition, I requested that all communication be conducted solely through email, with no external portals or downloadable files.
Substantive Text within the Email Body - I requested that all substantive responses be included directly in the body of the email, as attachments present accessibility challenges.
Clear Officer Identification - I requested that responses include the full name, title, and contact information of the officer handling my request.
Concise Responses - Due to cognitive processing limitations, I requested clear, concise, and comprehensive responses.
These accommodations are legally mandated to ensure equal access and effective participation in the FOIA process, per 5 U.S.C. 552 and relevant provisions of the ADA and the Rehabilitation Act. These laws obligate federal agencies to provide reasonable accommodations for individuals with disabilities, ensuring that communications are accessible in a manner that does not impede access to federal records.

Legal Basis for Accommodation
As stated in 42 U.S.C. 12101 et seq. and 29 U.S.C. 794, federal agencies are required to provide individuals with disabilities with effective communication through accessible formats and methods. The ADA and Section 504 of the Rehabilitation Act ensure that individuals with disabilities are not excluded from participation or subjected to discrimination in services, programs, or activities provided by federal entities.

Further, the Freedom of Information Act (5 U.S.C. 552) obligates federal agencies to facilitate public access to records. This obligation includes considering the accessibility needs of requestors to ensure full and equal participation in FOIA processes. In this regard, Executive Order 13392 also directs agencies to improve their responsiveness and transparency in FOIA processing, with accessibility being a critical component of such efforts.

Request for Immediate Rectification
I respectfully request that OIP immediately resend the response to my FOIA appeal in a manner that fully complies with my documented accommodations, specifically:

Re-sending the Response within the Email Body: Please provide all substantive information and responses directly in the body of an email.
Contact Information for Accountability: Include the name, title, and contact information of the officer responsible for handling my FOIA appeal.
Confirm Compliance with Electronic-Only Communication: Please confirm that all future correspondence will be sent via email only, without reliance on portals, downloads, or attachments.
Request for Expedited Processing and Fee Waiver Review
As noted in my original appeal, this request is not for commercial purposes but is intended to benefit public understanding of government actions and policies related to Medicaid waiver programs impacting vulnerable populations. The requested records contribute to the public interest, as defined in 5 U.S.C. 552(a)(4)(A)(iii). Due to the public significance and personal impact of the information sought, I also reiterate my request for expedited processing under FOIA.

Non-Waiver of Rights
This response does not waive any rights I may have under FOIA, the ADA, the Rehabilitation Act, or any other applicable law. I reserve all rights regarding this matter and intend to pursue appropriate recourse if my requests continue to be disregarded.

Conclusion
I appreciate your prompt attention to these concerns and request a response within five business days confirming compliance with my accommodation needs. Please contact me solely by email at AabiWR@live.com if further clarification is required regarding this matter.

Thank you for your attention to accessibility and compliance.

Sincerely,
David Medeiros

Date: November 20, 2024
To:

Priscilla Jones, Supervisory Administrative Specialist, Office of Information Policy (OIP)
Michael G. Seidel, Section Chief, FBI Record/Information Dissemination Section

CC: below

Subject: Freedom of Information Act Appeal and Demand for Immediate Compliance Under Constitutional Law, FOIA, ADA, and Whistleblower Protections
FOIPA Request Number: NFP-166685
Appeal Number: A-2025-00307

Overview
This appeal demands immediate compliance with the constitutional, statutory, and regulatory obligations of the U.S. Department of Justice (DOJ), Federal Bureau of Investigation (FBI), and all relevant agencies in fulfilling my FOIA request for records related to the Connecticut Medicaid Acquired Brain Injury (ABI) Waiver Program.

This appeal addresses repeated non-compliance, administrative delays, and failures to accommodate requests for accessibility under the Americans with Disabilities Act (ADA) and Rehabilitation Act. It is designed to be legally unassailable and to maximize oversight agency leverage in enforcing transparency.

Legal Basis and Framework
This appeal is grounded in the following constitutional and statutory provisions:

1. Constitutional Protections
First Amendment: Right to petition the government for redress of grievances, ensuring transparency and accountability.
Fifth and Fourteenth Amendments: Guarantee of due process, preventing arbitrary denial of access to public records.
2. Federal Statutes
Freedom of Information Act (FOIA) (5 U.S.C. 552): Mandates full disclosure of public records unless exemptions apply, with transparency as the overriding presumption.
Americans with Disabilities Act (ADA) (42 U.S.C. 12101 et seq.): Requires public agencies to provide reasonable accommodations to ensure equitable access to programs and services.
Rehabilitation Act of 1973 (29 U.S.C. 794): Prohibits discrimination in federally funded programs, ensuring effective communication with individuals with disabilities.
Whistleblower Protection Act (5 U.S.C. 2302(b)): Protects individuals who report government inefficiencies, misconduct, or abuse.
3. Key Case Law
NARA v. Favish, 541 U.S. 157 (2004): Affirms the public's right to access government records, particularly when they serve accountability and transparency.
Lane v. Brown, 372 U.S. 477 (1963): Enforces due process in federal and state compliance with statutory obligations.
Schmidt v. Lessard, 414 U.S. 473 (1974): Upholds procedural safeguards in administrative processes.

Introduction and Basis for Appeal

I submit this formal appeal to challenge the improper denial of FOIA Request No. NFP-166685, related to records concerning the Connecticut Medicaid Acquired Brain Injury (ABI) Waiver Program.

This appeal underscores critical failures in upholding statutory obligations under FOIA, the ADA, and constitutional law. Transparency and accountability are non-negotiable cornerstones of our democracy, and I intend to ensure compliance through all legal and oversight mechanisms available.

"Pursuant to 5 U.S.C. 552(a)(3), the FBI must reasonably search all relevant records under its control, including inter-agency or intra-agency communications involving DOJ, CMS, HHS OCR, and Connecticut DSS. Blanket denials without initiating this search violate FOIA law."

"Under ADA and Rehabilitation Act statutes, I request acknowledgment of these accommodations within four (4) business days to ensure equitable access without further delay."

FBI Non-Referral Violation: The FBI must refer improperly denied requests to the correct DOJ component.
"Failure to refer this request to the DOJ Civil Rights Division, where relevant records may exist, constitutes procedural non-compliance under FOIA and DOJ policy."

Inter-Agency Collaboration Expected: the DOJ Civil Rights Division and HHS OCR are critical players in Medicaid oversight.
"Records related to oversight of Medicaid programs, ADA compliance investigations, and civil rights complaints fall within the jurisdiction of the DOJ Civil Rights Division, HHS OCR, and CMS. The refusal to involve these components obstructs legal access to responsive records."

Closing Accountability Statement: Strengthen the closing with a firm escalation path:
"Non-compliance with this appeal will trigger immediate escalation to judicial enforcement under FOIA (5 U.S.C. 552) and ADA statutes, alongside formal reporting to congressional oversight bodies and public advocacy organizations to ensure full accountability."

The FBIs claim that my request does not meet FOIA standards or falls outside their jurisdiction is legally unsound. This response violates:

The Freedom of Information Act (5 U.S.C. 552) Duty to search for and produce responsive records.
The Americans with Disabilities Act (42 U.S.C. 12101) Failure to provide reasonable accommodations I explicitly requested.
Constitutional Rights:
First Amendment: Right to access public information for transparency and oversight.
Fifth Amendment: Deprivation of due process through arbitrary denial.
Fourteenth Amendment: Failure to accommodate disability constitutes discriminatory treatment.

Scope of Appeal and Legal Basis
1. Clarification of Records Requested
The following records are specific, existing, and reasonably described:

Complete Provider Registry: Names, contact details, specialties, enrollment dates, and statuses.
Policies and Criteria: Documents governing inclusion, oversight, and removal of providers.
Complaints and Oversight Records: Civil rights complaints, ADA reviews, whistleblower investigations.
Correspondence: Communications between DOJ, HHS, CMS, and Connecticut DSS.
The FBI cannot dismiss this request without conducting a search or referring it to the appropriate DOJ components, per FOIA regulations.

2. Failure to Conduct a Reasonable Search
5 U.S.C. 552(a)(3) mandates that agencies conduct a thorough, reasonable search. The FBI's blanket rejection lacks legal merit.
Records may exist within FBI investigative divisions, DOJ Civil Rights Division, or inter-agency communications tied to Medicaid oversight.

3. ADA Non-Compliance
Under Title II of the ADA and Section 504 of the Rehabilitation Act, I requested:
Delivery via MuckRock.
Records in screen-reader-compatible formats.
This failure constitutes discrimination, violating my right to reasonable accommodations as a brain injury survivor.

4. Constitutional Violations
First Amendment: Government accountability requires transparency; denial obstructs oversight.
Fifth Amendment: The arbitrary rejection deprives me of due process rights.
Fourteenth Amendment: The failure to provide accommodations under the ADA amounts to discriminatory treatment.
Relief Sought
Immediate Reconsideration:
Conduct a thorough search for responsive records or refer my request to the appropriate DOJ components.

ADA-Compliant Delivery:

Respond exclusively via MuckRock.
Provide records in screen-reader-compatible formats, clearly labeled and categorized.
Detailed Justifications:
Provide specific legal exemptions for any denials (5 U.S.C. 552(b)) with a Vaughn Index.

Accountability:

Identify all personnel involved in processing and denying this request.
Confirm whether this request was referred to DOJ Civil Rights Division or HHS OCR.
Failure to Comply
Failure to meet statutory obligations will result in:

Administrative Complaints:

Filed with HHS OCR, DOJ Civil Rights Division, and Connecticut FOIC.
Judicial Enforcement:

Litigation under FOIA (5 U.S.C. 552), ADA, and constitutional protections.
Public Accountability:

Reporting violations to oversight bodies, media, and public advocacy organizations.
Conclusion
This appeal is submitted to uphold transparency, accessibility, and constitutional rights. Failure to provide a full and timely response will escalate this matter to all legal and oversight channels.

Per FOIA statutory obligations, I expect a substantive response within 20 business days and acknowledgment of my ADA accommodations within four (4) business days.

Sincerely,
David Medeiros

This FOIA appeal challenges systemic failures in government transparency, ADA compliance, and whistleblower protections regarding the Connecticut Medicaid Acquired Brain Injury (ABI) Waiver Program. The FBI and related agencies have failed to fulfill their legal obligations under the Freedom of Information Act (5 U.S.C. 552), the Americans with Disabilities Act (42 U.S.C. 12101), and constitutional protections guaranteed by the First, Fifth, and Fourteenth Amendments.

The request seeks specific, clearly defined records, including the ABI Provider Registry, policies, civil rights oversight, complaints, and inter-agency communications, delivered in screen-reader-compatible formats as a reasonable ADA accommodation. Denials, delays, and procedural failures undermine transparency, accountability, and equal access to informationrights essential to government oversight and public trust.

This appeal demands immediate compliance, full disclosure, and accountability while escalating non-compliance to administrative oversight bodies, judicial remedies, and public advocacy channels. Transparency, accessibility, and constitutional rights are non-negotiable.

This correspondence pertains to my Freedom of Information Act (FOIA) request. Your handling of this matter raises critical concerns under FOIA (5 U.S.C. 552), the Americans with Disabilities Act (ADA, 42 U.S.C. 12132), and constitutional principles of government accountability.

As recognized in National Archives and Records Administration v. Favish, 541 U.S. 157 (2004), transparency is fundamental to democracy and public trust. Your agencys obligations are not discretionary, and failure to meet them constitutes a violation of statutory and constitutional law. This letter establishes your duties, addresses deficiencies, and anticipates and counters all potential deflection strategies.

1. FOIA Obligations: Statutory Mandates and Required Actions
FOIA establishes an enforceable right of access to federal agency records. Your response must meet the following requirements:

A. Timeliness
Under 5 U.S.C. 552(a)(6)(A), you are required to provide a determination within 20 business days. Delays beyond this timeframe, absent legitimate extension requests, constitute a violation of FOIA.

Countermeasure: Delays are actionable under Citizens for Responsibility and Ethics in Washington v. DOJ, 711 F.3d 180 (D.C. Cir. 2013).
Required Action: Provide the requested records or a lawful determination.

B. Adequacy of Search
FOIA requires a thorough and reasonable search for records, as established in Campbell v. DOJ, 164 F.3d 20 (D.C. Cir. 1998). This includes:

Identifying the databases, locations, and terms used.
Providing a sworn affidavit detailing the search scope.
Countermeasure: A vague claim of "no responsive records" is insufficient without a detailed affidavit.
Required Action: Submit a sworn affidavit documenting the search or confirm the existence of responsive records.

C. Proper Use of Exemptions
Exemptions under 5 U.S.C. 552(b) must be narrowly applied and justified with specific explanations. Blanket or vague exemptions are impermissible.

Countermeasure: A Vaughn index (Vaughn v. Rosen, 484 F.2d 820 (D.C. Cir. 1973)) is required to justify each withholding.
Required Action: Submit a Vaughn index detailing each exemption and its justification within 10 business days.

D. Decentralization and Referrals
Referrals or decentralization excuses do not absolve your agency of its responsibility to provide a consolidated response. As held in McGehee v. CIA, 697 F.2d 1095 (D.C. Cir. 1983), agencies must coordinate internally to ensure compliance.

Countermeasure: Require assurance of continuity and coordination across divisions.
Required Action: Consolidate records from all relevant offices and provide a unified response.

2. ADA and Rehabilitation Act Compliance: Equal Access as a Legal Right
As a person with a documented disability, I am entitled to reasonable accommodations under the ADA and Section 504 of the Rehabilitation Act. Your failure to provide accessible formats for requested records constitutes discrimination and violates federal law.

Case Law:
Tennessee v. Lane, 541 U.S. 509 (2004): Agencies must ensure meaningful access to government services.
Alexander v. Choate, 469 U.S. 287 (1985): Denial of reasonable accommodations creates barriers that violate civil rights.
Required Action:

Provide all requested records in accessible formats, including plain-language summaries or electronic files compatible with assistive technologies.
Confirm compliance with ADA requirements by [specific date].
3. Mandated Reporting and Whistleblower Protections
Your handling of this request implicates broader concerns, including potential fraud, misuse of federal funds, or retaliation against whistleblowers. Under the Whistleblower Protection Act (5 U.S.C. 2302), you are required to report and address systemic violations.

Countermeasure: Reference Misprision of Felony (18 U.S.C. 4), which requires the reporting of observed violations of law.
Required Action: Document and escalate evidence of misconduct to oversight bodies, including the Office of Inspector General (OIG).

4. Consequences of Non-Compliance
Failure to comply with your statutory obligations knowingly constitutes violations of:

Obstruction of Justice (18 U.S.C. 1505): Delaying lawful access to records obstructs public accountability.
Civil Rights Violations (42 U.S.C. 1983): Denying ADA accommodations constitutes a deprivation of federally protected rights.
Misprision of Felony (18 U.S.C. 4): Concealing or failing to report observed violations is a criminal act.
Countermeasure: Prepare for judicial review, oversight complaints, and public advocacy if compliance fails.
5. Escalation Pathways
If your office does not comply within the specified timeframe, I will escalate this matter through:

Judicial Review: Filing a lawsuit under 5 U.S.C. 552(a)(4)(B) to compel disclosure.
Oversight Complaints: Submitting formal complaints to OGIS, OIG, and the DOJ Civil Rights Division.
Public Advocacy: Engaging investigative journalists, transparency advocates, and public interest organizations to ensure accountability.

6. Final Statement: Upholding Transparency and Accountability
This matter reflects the publics right to transparency and the preservation of trust in government institutions. Your actions will either affirm your agencys commitment to accountability or further evidence systemic disregard for these principles.

I look forward to your prompt and substantive response.

To: Federal Bureau of Investigation (FBI)
Subject: Urgent Request for Investigation into OSC Case Records, Altered Decisions, and Suppressed Reports

Dear FBI Team,
I am formally requesting your assistance to investigate systemic failures, misconduct, and potential criminal activity surrounding the handling of my submissions to the Office of Special Counsel (OSC). These failures directly impact whistleblower protections, Medicaid oversight, and public accountability.
Issues to Investigate

1. Case Numbers and Records Management
 Case Numbers Requiring Investigation:

DI-25-000310
DI-25-000325
DI-25-000379
DI-12192024714
DI-12112024134

OSCFiling-MedeirosDavid-DI-12202024300
OSCFiling-MedeirosDavid-DI-112620241121

2. Anonymity and Lack of Accountability in Decision-Making
Unsigned Determination Letters:
Many determination letters from OSC lack identifiable signatures, names, or clear authorship.
This practice raises serious concerns about accountability and compliance with transparency laws.

3. Suppressed or Altered Records
Evidence suggests discrepancies between the whistleblower reports I submitted and how they were recorded or handled by OSC.
Specific issues include:
Alterations or removal of content from submitted complaints.
Suppression of reports that exposed systemic failures in Medicaid oversight and retaliation against whistleblowers.

4. Lack of FOIA Compliance
Despite repeated Freedom of Information Act (FOIA) requests, OSC and related agencies have failed to provide:
Complete case files and communication logs.
Justification for withheld or redacted information.
Clear timelines for compliance.

Specific Questions to Investigate
1. Who is Responsible for Managing These Records?
Identify the individuals, teams, or automated systems involved in creating, altering, and assigning these case numbers and reports.

2. What Decisions Were Made and Why?
Determine how decisions were reached, why some reports were closed without action, and why letters were sent anonymously.

3. Were There Violations of Federal Law?
Investigate potential obstruction of justice, retaliation, or misuse of authority under whistleblower protection laws and FOIA.

Key Agencies and Officials Involved
This matter spans multiple federal and state agencies, including:
 Office of Special Counsel (OSC)
 Department of Justice (DOJ)
Centers for Medicare & Medicaid Services (CMS)
Department of Health and Human Services (HHS)
 Office of Inspector General (OIG)

Why This Matters
1. Whistleblower Protections:
Retaliation against whistleblowers and suppression of reports undermine federal protections designed to safeguard transparency and accountability.

2. Impact on Vulnerable Populations:
These failures harm Medicaid consumers, particularly those with disabilities, by allowing systemic mismanagement to persist unchecked.

3. Misuse of Taxpayer Funds:
Lack of oversight and accountability results in waste and misuse of federal funds meant to serve the public.

Requested Actions
1. Investigate Record Management:
Audit all OSC records, emails, and internal communications related to these case numbers.

Identify responsible individuals or systems.
2. Subpoena Additional Evidence:

Secure all suppressed or altered reports to ensure a complete and accurate investigation.
3. Hold Accountable Those Involved in Misconduct:

Recommend prosecution or disciplinary action for any individuals found to have violated federal laws.
4. Ensure Compliance with FOIA and Whistleblower Protections:
Mandate OSC and related agencies to comply fully with FOIA requests and whistleblower laws.

Attachments
I have attached all available documentation, including:
Correspondence with OSC, including determination letters and emails.
FOIA requests and responses (or lack thereof).
Detailed reports submitted to OSC and other federal agencies.

Conclusion
This issue demands immediate attention to uphold the principles of transparency, accountability, and justice. I am available to provide additional information or documentation as needed.

Sincerely,
David Medeiros

Together, we must embrace transparency, accountability, and compassion as the foundation of our efforts. By fostering open communication, prioritizing the needs of the most vulnerable, and holding systems accountable, we can rebuild trust and ensure equitable outcomes for all.

Solutions lie in unitywhen state and federal leaders, advocates, and communities work hand in hand to uphold justice and fairness. Transparency through accessible Freedom of Information processes, adherence to legal mandates, and robust oversight are the pillars that support meaningful change. Each of us has a role to play in creating a system that serves and protects.
