Mr. Medeiros,

Thank you for your recent Freedom of Information Act (FOIA) request seeking access to records at the Federal Communications Commission. We have determined that the records you seek are not under the Commission's authority. Therefore, we will not be able to process your request. The Federal Communications Commission (FCC) is an independent United States government agency established by the Communications Act of 1934 to regulate interstate and international communications by radio, television, wire, satellite and cable. The Commission's jurisdiction covers the 50 states, the District of Columbia, and U.S. possessions. While we are not sure where you can find the records sought, we provide the following link to find contact information for other federal FOIA offices: https://www.foia.gov/#agency-search.

If you consider this to be a denial of your FOIA request, you may seek review by filing an application for review with the Office of General Counsel. Subject: Appeal of FOIA Request Determination Connecticut Medicaid ABI Waiver Program Records
FOIA Control Number: FCC-FOIA-2025-000150

To the FOIA Appeals Officer,

I am submitting this appeal regarding my FOIA request (FCC-FOIA-2025-000150), which seeks comprehensive records related to the Connecticut Medicaid Acquired Brain Injury (ABI) Waiver Program. I acknowledge receipt of the FCCs response on October 20, 2024, which advised that the FCC does not maintain jurisdiction over the requested records. Given the complex nature of federal oversight and interagency communications, I am requesting clarification and any available assistance in accessing potentially relevant records(Request_Received_Acknow).

Basis for Appeal
The purpose of this appeal is to ensure that any records related to interagency communications, funding discussions, or public health policy that may intersect with the Medicaid program are thoroughly reviewed. Specifically:

Potential Communications or Oversight Records:
While the FCC primarily regulates communications, there may be instances where public health communications, federal funding oversight, or discussions on policies impacting state Medicaid programs intersect with FCC records. If the FCC holds any such records or has participated in related interagency communications, I request that they be included in a comprehensive search.

Interagency Coordination or Referral:
If the FCC confirms that no relevant records exist, I request guidance on further referrals to appropriate federal agencies, such as HHS or CMS, to assist in locating the necessary records on federal oversight, Medicaid funding, or communications policy related to the Medicaid ABI Waiver Program.

Expedited Processing and Fee Waiver:
Given the critical nature of this request for public oversight, I renew my request for expedited processing, as permitted under FOIA, and for a fee waiver under 5 U.S.C. 552(a)(4)(A)(iii), as this request is made solely in the public interest.

Relief Requested
I respectfully request that the FCC review any records or interagency communications it may hold that pertain to Medicaid program discussions, including any relevant to Connecticuts ABI Waiver Program. If no records exist, I would greatly appreciate any assistance the FCC can provide in directing me to other agencies that may hold the requested records.

Basic Accommodation Requests
To ensure my full participation in the FOIA process, I request the following accommodations:

Email-Only Communication: Please correspond exclusively via email at AabiWR@live.com.
Response in Email Body: Include the full substantive response directly in the email body, as attachments may be difficult to access.
Clear Identification of FOIA Representatives: Kindly include the names, titles, and contact information of representatives handling my request.
No Portals or External Links: Avoid portals or links that may limit direct access to information within the email.
Thank you for your attention to this matter. Please contact me at AabiWR@live.com should you require further details.

Subject: Appeal of FOIA Determination Request #FCC-FOIA-2025-000150

CC:
Stephanie Kost, FOIA Public Liaison
FOIA Public Liaison Office
Federal Communications Commission Jessica Rosenworcel

Introduction
This appeal addresses the Federal Communications Commissions (FCC) determination on October 20, 2024, regarding FOIA Request #FCC-FOIA-2025-000150. The FCC claimed it does not hold jurisdiction over records relevant to the Connecticut Medicaid Acquired Brain Injury (ABI) Waiver Program. I am appealing this determination on the grounds that the FCC may still possess records or interagency communications relevant to the request or may have knowledge of their location.

This appeal is filed in accordance with the Freedom of Information Act (5 U.S.C. 552(a)(6)(A)(i)) and related federal statutes to ensure compliance with FOIAs purpose of transparency, as well as accessibility under the Americans with Disabilities Act (ADA) (42 U.S.C. 12101 et seq.) and Section 504 of the Rehabilitation Act (29 U.S.C. 794).

Basis for Appeal
1. Incomplete Record Search by FCC
While the FCC's primary jurisdiction pertains to communications regulation, it is not unreasonable to anticipate that public health-related communications, federal funding oversight, or interagency discussions on Medicaid may intersect with FCC records. Specifically:

Interagency Communications: FCC may have been included in discussions involving broadband access, telehealth policies, or communications infrastructure relevant to Medicaid programs, including Connecticuts ABI Waiver Program.
Oversight of Communications Policies Impacting Public Health Programs: FCC records may include guidance, internal communications, or reports relevant to infrastructure supporting Medicaid programs.
2. Inadequate Assistance with Referrals
The FCCs response did not include adequate guidance or referrals to other agencies that may hold relevant records. Under FOIA (5 U.S.C. 552(a)(6)(C)(i)), agencies must notify requesters if they do not possess the requested records and assist by directing them to agencies that might. As an independent agency, the FCC often collaborates with federal and state agencies. I am requesting clarification of potential interagency referrals to:

HHS Office for Civil Rights (OCR): Ensuring Medicaid providers comply with accessibility and anti-discrimination policies.
Centers for Medicare & Medicaid Services (CMS): Overseeing Medicaid funding, regulatory compliance, and provider participation.
Department of Justice (DOJ), Civil Division: Investigating fraud or mismanagement involving Medicaid funds.
Relief Requested
To resolve this matter, I request the following:

Conduct a Comprehensive Search:

Interagency Records: Search for records involving interagency communications or oversight impacting Medicaid programs.
Infrastructure Records: Identify any FCC involvement in telecommunication or broadband policies linked to the ABI Waiver Program or Medicaid programs generally.
Issue Referrals if Necessary:

Referrals: Identify and notify agencies that are likely to possess the requested records.
Confirmation of Referrals: Provide written confirmation of all referrals made.
Provide an Estimated Completion Date (EDC):

Under 5 U.S.C. 552(a)(7)(B)(ii), provide a specific EDC for processing this appeal.
Adhere to ADA Accommodations:

Communication via Email Only: All correspondence must be sent to AabiWR@live.com.
Include Text in Email Body: Embed all responses directly within the email body, with properly formatted attachments.
Identify FOIA Representatives: Include the full name, title, and contact information of the FOIA representatives processing this appeal.
Avoid Portals or External Links: Refrain from requiring portal-based communication or linking to external websites that create accessibility barriers.
Approve Expedited Processing and Fee Waiver:

Expedited Processing: Approve expedited processing as provided under 5 U.S.C. 552(a)(6)(E), as the request involves matters of urgent public interest, including Medicaid program oversight and public health accountability.
Fee Waiver: Confirm the fee waiver request under 5 U.S.C. 552(a)(4)(A)(iii), as the request is not for commercial use and serves a significant public interest.
Legal and Policy Support
1. FOIA Statutory Obligations (5 U.S.C. 552)
Agency Assistance Obligation ( 552(a)(6)(C)(i)): FOIA requires that agencies without relevant records assist requesters by referring them to agencies likely to possess such records.
Estimated Completion Date ( 552(a)(7)(B)(ii)): Agencies must provide requesters with an EDC upon request to ensure transparency and accountability.
2. ADA and Rehabilitation Act Compliance
Under the ADA (42 U.S.C. 12101 et seq.) and Section 504 of the Rehabilitation Act (29 U.S.C. 794), federal agencies must provide reasonable accommodations to ensure accessibility for individuals with disabilities. This includes adherence to my communication and document format requests.
3. Executive Order 13392
This Executive Order mandates federal agencies to prioritize improvements in FOIA processing to ensure timely and equitable disclosure of records.
Consequences of Continued Non-Compliance
Failure to address this appeal promptly and adequately may result in escalation to the Office of Government Information Services (OGIS) for mediation or formal legal action to enforce compliance with FOIA and ADA requirements.

Conclusion
I trust the FCC will recognize the importance of this appeal and take immediate action to fulfill its obligations under FOIA and ADA laws. Please provide a substantive response no later than 20 business days from the date of this letter.

Thank you for your attention to this matter.

Appeal Pattern of Non-Compliance by the FOIA officer
I must emphasize FOIA officers repeatedly and willfully failed to comply with clearly outlined ADA accommodation requests, including:

****** Failure to Identify FOIA Officers: FOIA officers continually fail to disclose the names, titles, and roles of FOIA officers and decision-makers responsible for processing previous requests. This omission is concerning and raises significant issues regarding transparency, accountability, and compliance with FOIA mandates.

These repeated failures directly violate the Americans with Disabilities Act (ADA), Rehabilitation Act, and FOIA transparency requirements. It is imperative FOIA officers address these concerns immediately and provide the requested accommodations without further obstruction.

Subject: Final Assertion of Legal Obligations Under FOIA, ADA, and Constitutional Law
Subject: 10/17/2024 Freedom of Information Act Request: Subject: Comprehensive FOIA Request for Connecticut Medicaid Acquired Brain Injury Waiver Program Records ( Federal Communications Commission Office of the Inspector General )

01.08.2025

To all It May Concern in All Relevant Departments and Divisions,
Federal Communications Commission Office of the Inspector General

This correspondence pertains to my Freedom of Information Act (FOIA) request. Your handling of this matter raises critical concerns under FOIA (5 U.S.C. 552), the Americans with Disabilities Act (ADA, 42 U.S.C. 12132), and constitutional principles of government accountability.

As recognized in National Archives and Records Administration v. Favish, 541 U.S. 157 (2004), transparency is fundamental to democracy and public trust. Your agencys obligations are not discretionary, and failure to meet them constitutes a violation of statutory and constitutional law. This letter establishes your duties, addresses deficiencies, and anticipates and counters all potential deflection strategies.

1. FOIA Obligations: Statutory Mandates and Required Actions
FOIA establishes an enforceable right of access to federal agency records. Your response must meet the following requirements:

A. Timeliness
Under 5 U.S.C. 552(a)(6)(A), you are required to provide a determination within 20 business days. Delays beyond this timeframe, absent legitimate extension requests, constitute a violation of FOIA.

Countermeasure: Delays are actionable under Citizens for Responsibility and Ethics in Washington v. DOJ, 711 F.3d 180 (D.C. Cir. 2013).
Required Action: Provide the requested records or a lawful determination.

B. Adequacy of Search
FOIA requires a thorough and reasonable search for records, as established in Campbell v. DOJ, 164 F.3d 20 (D.C. Cir. 1998). This includes:

Identifying the databases, locations, and terms used.
Providing a sworn affidavit detailing the search scope.
Countermeasure: A vague claim of "no responsive records" is insufficient without a detailed affidavit.
Required Action: Submit a sworn affidavit documenting the search or confirm the existence of responsive records.

C. Proper Use of Exemptions
Exemptions under 5 U.S.C. 552(b) must be narrowly applied and justified with specific explanations. Blanket or vague exemptions are impermissible.

Countermeasure: A Vaughn index (Vaughn v. Rosen, 484 F.2d 820 (D.C. Cir. 1973)) is required to justify each withholding.
Required Action: Submit a Vaughn index detailing each exemption and its justification within 10 business days.

D. Decentralization and Referrals
Referrals or decentralization excuses do not absolve your agency of its responsibility to provide a consolidated response. As held in McGehee v. CIA, 697 F.2d 1095 (D.C. Cir. 1983), agencies must coordinate internally to ensure compliance.

Countermeasure: Require assurance of continuity and coordination across divisions.
Required Action: Consolidate records from all relevant offices and provide a unified response.

2. ADA and Rehabilitation Act Compliance: Equal Access as a Legal Right
As a person with a documented disability, I am entitled to reasonable accommodations under the ADA and Section 504 of the Rehabilitation Act. Your failure to provide accessible formats for requested records constitutes discrimination and violates federal law.

Case Law:
Tennessee v. Lane, 541 U.S. 509 (2004): Agencies must ensure meaningful access to government services.
Alexander v. Choate, 469 U.S. 287 (1985): Denial of reasonable accommodations creates barriers that violate civil rights.
Required Action:

Provide all requested records in accessible formats, including plain-language summaries or electronic files compatible with assistive technologies.
Confirm compliance with ADA requirements by [specific date].
3. Mandated Reporting and Whistleblower Protections
Your handling of this request implicates broader concerns, including potential fraud, misuse of federal funds, or retaliation against whistleblowers. Under the Whistleblower Protection Act (5 U.S.C. 2302), you are required to report and address systemic violations.

Countermeasure: Reference Misprision of Felony (18 U.S.C. 4), which requires the reporting of observed violations of law.
Required Action: Document and escalate evidence of misconduct to oversight bodies, including the Office of Inspector General (OIG).

4. Consequences of Non-Compliance
Failure to comply with your statutory obligations knowingly constitutes violations of:

Obstruction of Justice (18 U.S.C. 1505): Delaying lawful access to records obstructs public accountability.
Civil Rights Violations (42 U.S.C. 1983): Denying ADA accommodations constitutes a deprivation of federally protected rights.
Misprision of Felony (18 U.S.C. 4): Concealing or failing to report observed violations is a criminal act.
Countermeasure: Prepare for judicial review, oversight complaints, and public advocacy if compliance fails.
5. Escalation Pathways
If your office does not comply within the specified timeframe, I will escalate this matter through:

Judicial Review: Filing a lawsuit under 5 U.S.C. 552(a)(4)(B) to compel disclosure.
Oversight Complaints: Submitting formal complaints to OGIS, OIG, and the DOJ Civil Rights Division.
Public Advocacy: Engaging investigative journalists, transparency advocates, and public interest organizations to ensure accountability.

6. Final Statement: Upholding Transparency and Accountability
This matter reflects the publics right to transparency and the preservation of trust in government institutions. Your actions will either affirm your agencys commitment to accountability or further evidence systemic disregard for these principles.

I look forward to your prompt and substantive response.
