Dear Mr. O'Neill,

I am writing to escalate an appeal regarding Freedom of Information Act (FOIA) requests associated with DOJ Complaints #534659-XGL, #539298-RJM, #534060-HWM, and #539330-JBZ, submitted under 5 U.S.C. 552. Despite previous correspondence with the Office of Information Policy (OIP), the response provided fails to address critical deficiencies in ADA compliance and transparency requirements.

Appeal Summary
ADA Non-Compliance

The requested accommodations for processing this FOIA request, mandated under Title II of the ADA (42 U.S.C. 12132), have not been met. Specifically:
Responses were not routed through the MuckRock platform as requested.
Records were not provided as screen-reader compatible PDFs, nor were simplified summaries included for complex records.
Communications lacked identification of the responsible personnel, impeding accountability.
Inadequate Search Scope

The OIP response cites that relevant records are unlikely to exist without sufficient documentation of the search scope, terms, or responsible personnel consulted. This fails to meet FOIAs statutory obligation for a thorough and reasonable search.
Failure to Provide Statutory Justifications

The response does not include statutory justifications under 5 U.S.C. 552(b) for redactions or denials. This omission violates procedural fairness and transparency requirements.
Requested Action
To rectify these deficiencies, I request:

A documented search of all relevant DOJ offices, including the Civil Rights Division, as these are most likely to maintain the records in question.
Immediate compliance with ADA accommodations:
All responses routed through the MuckRock platform.
Records reformatted as screen-reader compatible PDFs with simplified summaries for technical documents.
Identification of all personnel responsible for processing this FOIA request and appeal.
Escalation Notice
If the deficiencies are not addressed promptly, I will pursue the following steps:

Formal Complaint: Filing with the DOJ Inspector General and the Office for Civil Rights for ADA violations.
Judicial Review: Seeking injunctive relief for procedural and statutory non-compliance under 5 U.S.C. 552(a)(4)(B).
Public Advocacy: Engaging oversight entities, congressional committees, and media outlets to highlight systemic failures in ADA enforcement and FOIA transparency.
This communication has also been shared with your direct superior, Kristen Clarke, Assistant Attorney General, Civil Rights Division, as well as Michael E. Horowitz, Inspector General, DOJ.

Conclusion
It is imperative that the Department of Justice adheres to its legal and constitutional obligations to ensure transparency, accountability, and accessibility for all individuals, particularly those with disabilities. I trust that your office will take the necessary steps to resolve these issues promptly.

Sincerely,
David Medeiros

From: David Medeiros
Subject: Administrative Appeal of FOIA Determination for DOJ Complaints #534659-XGL, #539298-RJM, #534060-HWM, and #539330-JBZ

To:
Douglas R. Hibbard

Email: oip.foia@usdoj.gov
Phone: (202) 514-3642

Introduction
I am appealing the Department of Justices (DOJ) December 4, 2024, determination regarding my FOIA requests FOIA-2025-01052 et. al. This appeal concerns records relating to ADA compliance and FOIA processes associated with DOJ Complaints #534659-XGL, #539298-RJM, #534060-HWM, and #539330-JBZ. The response fails to meet statutory obligations under the Freedom of Information Act (5 U.S.C. 552) and the Americans with Disabilities Act (ADA) (42 U.S.C. 12132).

Grounds for Appeal

Inadequate Search

The initial response states that the Office of Information Policy (OIP) does not maintain the requested records. However, FOIA mandates agencies to conduct a reasonable search across all divisions likely to have responsive records. This includes the Civil Rights Division and the Office of the Inspector General (OIG), where such records are reasonably expected to exist.
Failure to Comply with ADA Accommodations

My request explicitly outlined non-negotiable ADA accommodations: communication exclusively via the MuckRock platform, screen-reader-compatible PDFs, simplified summaries for complex records, and identification of responsible personnel. These accommodations were ignored, violating 42 U.S.C. 12132 and Section 504 of the Rehabilitation Act (29 U.S.C. 794).
Deficient Statutory Justifications

The response fails to provide statutory justifications for withholding or redacting information as required under FOIA (5 U.S.C. 552(b)).
Public Interest and Systemic Impact

The requested records pertain to systemic ADA violations, Medicaid oversight, and whistleblower protections, issues of substantial public interest. Denying access to these records undermines transparency and accountability in federal and state programs.
Requested Relief

Conduct a Comprehensive Search

Require all relevant DOJ components, including the Civil Rights Division, OIG, and other entities, to conduct a thorough search for records responsive to my request.
Fulfill ADA Accommodations

Provide all documents via the MuckRock platform, formatted as accessible PDFs with simplified summaries for technical records.
Clarify Search Scope

Document and disclose the search terms, locations, and personnel involved in processing this request to ensure compliance with FOIA requirements.
Expedited Processing

Expedite the appeal due to the public interest in ADA enforcement, Medicaid transparency, and systemic accountability.
Legal Basis for Appeal

Freedom of Information Act

FOIA mandates transparency and prohibits arbitrary withholding of records. Agencies must provide detailed explanations for exemptions under 5 U.S.C. 552(b).
Americans with Disabilities Act and Section 504 of the Rehabilitation Act

Title II of the ADA and Section 504 require effective communication and reasonable accommodations for individuals with disabilities.
Executive Order 13392

This order requires agencies to strengthen their FOIA operations and improve public disclosure.
Attachments

Escalated Legal Complaint and Appeal

Explanation of the Situation
David Medeiros is addressing a serious issue that affects not just him but countless others who depend on government systems to work fairly, legally, and transparently. Lets break this down clearly so everyone understands whats happening and why it matters.

The Problem
Lack of Transparency

David requested critical records from government agencies under the Freedom of Information Act (FOIA). These records are essential for understanding how public money, including Medicaid funds, is being managed. Instead of cooperating, the agencies delayed, denied, or redacted information without proper explanation.
Disregard for Disability Accommodations

David, a brain injury survivor, requested reasonable accommodations under the Americans with Disabilities Act (ADA). These included simple adjustments like screen-reader-compatible documents and accessible formats. The agencies failed to comply, which is not only unfair but also illegal.
Retaliation Against Whistleblowing

As a whistleblower highlighting mismanagement in Medicaid programs, David faces unnecessary barriers. This undermines protections designed to encourage people to expose fraud and inefficiencies in taxpayer-funded programs.
Mismanagement of Public Funds

Medicaid is funded by taxpayer dollars. Without transparency or accountability, theres no way to ensure these funds are being used as intendedto support those who need it most.
What David Is Asking For
David isnt making unreasonable demands. Hes holding these agencies accountable to the same laws and standards theyre supposed to uphold. Heres what hes seeking:

Transparency

Provide the records he requested and explain any reasons for withholding information, as required by FOIA.
Compliance with ADA

Deliver documents in accessible formats that meet legal standards for individuals with disabilities.
Protections for Whistleblowers

Ensure that individuals who expose government mismanagement or wrongdoing are protected, not penalized.
Accountability for Public Funds

Prove that Medicaid money is being used responsibly and not wasted or mismanaged.

Why It Matters to Everyone
Its a broader issue that affects all of us:

Fairness and Justice: If the government can sidestep its obligations to people with disabilities or whistleblowers, it sets a dangerous precedent for everyone.
Your Tax Dollars: Mismanagement of Medicaid funds means less money for those who need it and more waste of your contributions.
Systemic Accountability: Government agencies must follow the law, or they lose credibility and trust. Accountability benefits everyone.

What Happens Next?
David is taking steps to ensure these problems are addressed. If the agencies dont act:

Mediation and Oversight

He will escalate the issue to federal oversight bodies like the Office of Government Information Services (OGIS).
Legal Action

David is prepared to take this matter to court, ensuring the agencies comply with FOIA, ADA, and other laws.
Public Awareness

By engaging Congress, the media, and advocacy groups, David will expose these systemic failures to bring about broader change.
The Bigger Picture

Davids efforts go beyond his personal case. Hes advocating for a system that is fair, transparent, and accountable. This is about ensuring:

Disability Rights Are Respected: People with disabilities should not have to fight for accommodations that are already required by law.
Whistleblowers Are Protected: Transparency only works when people feel safe to speak out about problems.
Taxpayer Dollars Are Accounted For: Every dollar wasted is a dollar that could help someone in need.
David Medeiros isnt just raising complaintshes standing up for principles that matter to all of us. By holding the government to its own rules, hes pushing for a system that serves the people fairly and responsibly. His work reminds us that accountability and justice are worth pursuingfor everyones benefit.

I. Summary of Violations
This complaint addresses systemic failures by the U.S. Department of Justice (DOJ), Centers for Medicare & Medicaid Services (CMS), and related agencies to comply with constitutional, statutory, and procedural obligations. These failures include violations under:

Constitutional Rights: First, Fifth, and Fourteenth Amendments.
FOIA: Failure to comply with 5 U.S.C. 552, including inadequate searches and redaction explanations.
ADA and Section 504 Compliance: Denial of reasonable accommodations under 42 U.S.C. 12132 and 29 U.S.C. 794.

Whistleblower Protections: Obstructing whistleblower disclosures under 5 U.S.C. 2302(b)(8).

Taxpayer Accountability: Suppressing oversight of taxpayer-funded programs under the False Claims Act (31 U.S.C. 3729).
II. Specific Legal Failures

1. Constitutional Rights Violations
First Amendment: Obstructing access to records undermines the right to petition for government accountability (New York Times Co. v. United States, 1971).
Fifth Amendment: Procedural delays and inadequate responses violate due process rights (Mathews v. Eldridge, 1976).
Fourteenth Amendment: Denial of ADA accommodations constitutes discrimination and violates equal protection guarantees (Tennessee v. Lane, 2004).

2. FOIA Non-Compliance
Inadequate Searches:

DOJ failed to conduct comprehensive searches across all relevant components, including the Civil Rights Division, CMS, and state agency communications.
No documentation of search terms, databases, or personnel involved was provided, breaching FOIA's reasonableness standard.
Failure to Provide a Vaughn Index:

Redactions and withholdings lack specific statutory justifications under 5 U.S.C. 552(b).
The absence of a Vaughn Index violates FOIA precedents (Vaughn v. Rosen, 1973).
Missed Timelines:

DOJ failed to comply with FOIA timelines under 5 U.S.C. 552(a)(6), amounting to constructive denial.
3. ADA Accommodations Violations
ADA Accommodations Request
This request includes explicit ADA accommodations to address cognitive processing challenges resulting from my traumatic brain injury (TBI). These accommodations are legally required under Title II of the ADA (42 U.S.C. 12132) and Section 504 of the Rehabilitation Act (29 U.S.C. 794).

Requested ADA Accommodations
To ensure accessibility and compliance with ADA standards (42 U.S.C. 12101 et seq.), I request the following accommodations for all communications and records:

Screen-Reader Compatible Formats

All documents must be provided in properly labeled PDFs or plain-text files.
Ensure that the documents are screen-reader compatible and retain clear, accessible formatting.
Exclusive MuckRock Platform Communication

All communications must occur exclusively via the MuckRock platform.
Do not send external links, emails, portals, passwords, codes, or require phone calls for access.
Text Embedded in Email Bodies

Key information must be embedded directly in the email body to facilitate comprehension and accessibility.
Simplified Summaries

Provide plain-language summaries for complex or legal documents to ensure clarity and understanding.
Identification of Responsible Officers

Include the full name, title, and contact information of all responsible officers handling this request.
Non-Negotiable Compliance
These accommodations are non-negotiable and are essential for ensuring equal access to information. Failure to provide the requested accommodations may constitute a violation of the ADA and the Rehabilitation Act. Thank you for ensuring compliance and accessibility in addressing this request.
Despite explicitly requested accommodations:

Communications were not routed through the MuckRock platform as requested.
Records were not provided in screen-reader-compatible PDFs or with text embedded in communications for accessibility.
Simplified summaries for complex records were omitted, breaching procedural equity obligations.
The DOJ failed to identify personnel responsible for ADA compliance in communications.

4. Whistleblower Retaliation
Access to records necessary for whistleblowing activities under 5 U.S.C. 2302(b)(8) has been obstructed.
Procedural delays undermine protections afforded by the False Claims Act (31 U.S.C. 3729).

5. Taxpayer Accountability Failures
Denial of records regarding Medicaid oversight prevents public accountability for taxpayer funds misused in the ABI Waiver Program.

III. Requested Relief
A. FOIA Compliance
Comprehensive Records Search:

Conduct searches across all relevant DOJ components, including:
Civil Rights Division for ADA-related enforcement records.
CMS and DSS for interagency communications on Medicaid fraud investigations.
Provide documentation of search terms, databases consulted, and personnel involved.
Vaughn Index:

Deliver a detailed Vaughn Index for all withheld or redacted records, specifying exemptions under 5 U.S.C. 552(b).
Expedited Processing:

Expedite appeals under 5 U.S.C. 552(a)(6)(E), citing urgent public interest in systemic ADA and Medicaid oversight failures.
B. ADA Compliance
Reformat Responses:

Resend records in accessible formats:
Screen-reader-compatible PDFs, meeting WCAG 2.1 standards.
Embedded text for all email communications.
Provide simplified summaries for complex records.
Ensure Future Accessibility:

Route all future communications through the MuckRock platform exclusively.
Accountability Measures:

Identify personnel responsible for ADA compliance in all communications.

C. Whistleblower Protections
Safeguard Whistleblower Disclosures:
Affirm policies protecting whistleblower disclosures under 5 U.S.C. 2302(b)(8).
Investigate Retaliation Risks:
Examine delays and procedural obstacles for potential retaliation.

D. Taxpayer Accountability
Ensure Medicaid Oversight:
Provide all audits, investigations, and compliance reports related to Medicaid ABI Waiver Program fraud.
Document Interagency Actions:
Disclose records of coordination between DOJ, CMS, and state agencies regarding Medicaid transparency.

IV. Anticipated Defenses and Rebuttals
Agency Defense: Claims of undue burden or overbroad scope.
Rebuttal:

Requests are narrowly tailored to specific complaints and cases, citing DOJs own identifiers (#534659-XGL, #539298-RJM, #534060-HWM, #539330-JBZ).
Search parameters are reasonable and focus on likely custodians, ensuring compliance with DOJs FOIA Manual.
Agency Defense: Exemptions under 5 U.S.C. 552(b) (e.g., deliberative process privilege).

Rebuttal:

Withholding based on Exemption 5 or others must still comply with Vaughn Index requirements, specifying reasons for applicability.
Agency Defense: Delays justified by resource constraints.
Rebuttal:

FOIAs statutory deadlines are mandatory, and systemic delays impede public oversight. Expedited processing criteria are met due to public interest.

V. Consequences of Non-Compliance
Failure to resolve this appeal within 10 business days will result in:

OGIS Mediation: Filing a complaint with the Office of Government Information Services.
Judicial Action: Pursuing federal court litigation under FOIA, ADA, and whistleblower statutes, seeking injunctive relief and damages.
Congressional Oversight: Reporting systemic failures through oversight committees and media outlets.

VI. Legal and Procedural Framework
Freedom of Information Act (5 U.S.C. 552): Ensures transparency and mandates compliance with statutory deadlines.
ADA Title II (42 U.S.C. 12132): Requires effective communication and accommodations for individuals with disabilities.
Rehabilitation Act (29 U.S.C. 794): Prohibits discrimination in federally funded programs.
Whistleblower Protection Act (5 U.S.C. 2302(b)(8)): Protects against retaliation for exposing systemic violations.
False Claims Act (31 U.S.C. 3729): Facilitates public oversight of fraud involving taxpayer funds.

VII. Conclusion

The DOJ and associated agencies have demonstrated systemic non-compliance with statutory, constitutional, and procedural obligations. This appeal seeks immediate corrective action to restore transparency, accessibility, and accountability.

Sincerely,
David Medeiros

*** Federal Bureau of Investigation (FBI)
Subject: Urgent Request for Investigation into OSC Case Records, Altered Decisions, and Suppressed Reports

Dear FBI Team,

I am formally requesting your assistance to investigate systemic failures, misconduct, and potential criminal activity surrounding the handling of my submissions to the Office of Special Counsel (OSC). These failures directly impact whistleblower protections, Medicaid oversight, and public accountability.

Issues to Investigate

1. Case Numbers and Records Management

Case Numbers Requiring Investigation:

DI-25-000310

DI-25-000325

DI-25-000379

DI-12192024714

DI-12112024134

OSCFiling-MedeirosDavid-DI-12202024300

OSCFiling-MedeirosDavid-DI-112620241121

2. Anonymity and Lack of Accountability in Decision-Making

Unsigned Determination Letters:

Many determination letters from OSC lack identifiable signatures, names, or clear authorship.

This practice raises serious concerns about accountability and compliance with transparency laws.

3. Suppressed or Altered Records

Evidence suggests discrepancies between the whistleblower reports I submitted and how they were recorded or handled by OSC.

Specific issues include:

Alterations or removal of content from submitted complaints.

Suppression of reports that exposed systemic failures in Medicaid oversight and retaliation against whistleblowers.

4. Lack of FOIA Compliance

Despite repeated Freedom of Information Act (FOIA) requests, OSC and related agencies have failed to provide:

Complete case files and communication logs.

Justification for withheld or redacted information.

Clear timelines for compliance.

Specific Questions to Investigate

1. Who is Responsible for Managing These Records?

Identify the individuals, teams, or automated systems involved in creating, altering, and assigning these case numbers and reports.

2. What Decisions Were Made and Why?

Determine how decisions were reached, why some reports were closed without action, and why letters were sent anonymously.

3. Were There Violations of Federal Law?

Investigate potential obstruction of justice, retaliation, or misuse of authority under whistleblower protection laws and FOIA.

Key Agencies and Officials Involved

This matter spans multiple federal and state agencies, including:

 Office of Special Counsel (OSC)

 Department of Justice (DOJ)

Centers for Medicare & Medicaid Services (CMS)

Department of Health and Human Services (HHS)

 Office of Inspector General (OIG)

Why This Matters

1. Whistleblower Protections:

Retaliation against whistleblowers and suppression of reports undermine federal protections designed to safeguard transparency and accountability.

2. Impact on Vulnerable Populations:

These failures harm Medicaid consumers, particularly those with disabilities, by allowing systemic mismanagement to persist unchecked.

3. Misuse of Taxpayer Funds:

Lack of oversight and accountability results in waste and misuse of federal funds meant to serve the public.

Requested Actions

1. Investigate Record Management:

Audit all OSC records, emails, and internal communications related to these case numbers.

Identify responsible individuals or systems.

2. Subpoena Additional Evidence:

Secure all suppressed or altered reports to ensure a complete and accurate investigation.

3. Hold Accountable Those Involved in Misconduct:

Recommend prosecution or disciplinary action for any individuals found to have violated federal laws.

4. Ensure Compliance with FOIA and Whistleblower Protections:

Mandate OSC and related agencies to comply fully with FOIA requests and whistleblower laws.

Attachments

I have attached all available documentation, including:

Correspondence with OSC, including determination letters and emails.

FOIA requests and responses (or lack thereof).

Detailed reports submitted to OSC and other federal agencies.

This issue demands immediate attention to uphold the principles of transparency, accountability, and justice. I am available to provide additional information or documentation as needed.

Sincerely,
David Medeiros

As recognized in National Archives and Records Administration v. Favish, 541 U.S. 157 (2004), transparency is fundamental to democracy and public trust. Your agencys obligations are not discretionary, and failure to meet them constitutes a violation of statutory and constitutional law. This letter establishes your duties, addresses deficiencies, and anticipates and counters all potential deflection strategies.

1. FOIA Obligations: Statutory Mandates and Required Actions
FOIA establishes an enforceable right of access to federal agency records. Your response must meet the following requirements:

A. Timeliness
Under 5 U.S.C. 552(a)(6)(A), you are required to provide a determination within 20 business days. Delays beyond this timeframe, absent legitimate extension requests, constitute a violation of FOIA.
Countermeasure: Delays are actionable under Citizens for Responsibility and Ethics in Washington v. DOJ, 711 F.3d 180 (D.C. Cir. 2013).
Required Action: Provide the requested records or a lawful determination.

B. Adequacy of Search
FOIA requires a thorough and reasonable search for records, as established in Campbell v. DOJ, 164 F.3d 20 (D.C. Cir. 1998). This includes:
Identifying the databases, locations, and terms used.
Providing a sworn affidavit detailing the search scope.
Countermeasure: A vague claim of "no responsive records" is insufficient without a detailed affidavit.
Required Action: Submit a sworn affidavit documenting the search or confirm the existence of responsive records.

C. Proper Use of Exemptions
Exemptions under 5 U.S.C. 552(b) must be narrowly applied and justified with specific explanations. Blanket or vague exemptions are impermissible.
Countermeasure: A Vaughn index (Vaughn v. Rosen, 484 F.2d 820 (D.C. Cir. 1973)) is required to justify each withholding.
Required Action: Submit a Vaughn index detailing each exemption and its justification within 10 business days.

D. Decentralization and Referrals
Referrals or decentralization excuses do not absolve your agency of its responsibility to provide a consolidated response. As held in McGehee v. CIA, 697 F.2d 1095 (D.C. Cir. 1983), agencies must coordinate internally to ensure compliance.
Countermeasure: Require assurance of continuity and coordination across divisions.
Required Action: Consolidate records from all relevant offices and provide a unified response.

2. ADA and Rehabilitation Act Compliance: Equal Access as a Legal Right
As a person with a documented disability, I am entitled to reasonable accommodations under the ADA and Section 504 of the Rehabilitation Act. Your failure to provide accessible formats for requested records constitutes discrimination and violates federal law.

Case Law:
Tennessee v. Lane, 541 U.S. 509 (2004): Agencies must ensure meaningful access to government services.
Alexander v. Choate, 469 U.S. 287 (1985): Denial of reasonable accommodations creates barriers that violate civil rights.

Required Action:
Provide all requested records in accessible formats, including plain-language summaries or electronic files compatible with assistive technologies.
Confirm compliance with ADA requirements by [specific date].

3. Mandated Reporting and Whistleblower Protections
Your handling of this request implicates broader concerns, including potential fraud, misuse of federal funds, or retaliation against whistleblowers. Under the Whistleblower Protection Act (5 U.S.C. 2302), you are required to report and address systemic violations.
Countermeasure: Reference Misprision of Felony (18 U.S.C. 4), which requires the reporting of observed violations of law.
Required Action: Document and escalate evidence of misconduct to oversight bodies, including the Office of Inspector General (OIG).

4. Consequences of Non-Compliance
Failure to comply with your statutory obligations knowingly constitutes violations of:
Obstruction of Justice (18 U.S.C. 1505): Delaying lawful access to records obstructs public accountability.
Civil Rights Violations (42 U.S.C. 1983): Denying ADA accommodations constitutes a deprivation of federally protected rights.
Misprision of Felony (18 U.S.C. 4): Concealing or failing to report observed violations is a criminal act.
Countermeasure: Prepare for judicial review, oversight complaints, and public advocacy if compliance fails.

5. Escalation Pathways
If your office does not comply within the specified timeframe, I will escalate this matter through:
Judicial Review: Filing a lawsuit under 5 U.S.C. 552(a)(4)(B) to compel disclosure.
Oversight Complaints: Submitting formal complaints to OGIS, OIG, and the DOJ Civil Rights Division.
Public Advocacy: Engaging investigative journalists, transparency advocates, and public interest organizations to ensure accountability.

6. Final Statement: Upholding Transparency and Accountability
This matter reflects the publics right to transparency and the preservation of trust in government institutions. Your actions will either affirm your agencys commitment to accountability or further evidence systemic disregard for these principles.

I look forward to your prompt and substantive response.

The challenges we face today demand more than acknowledgmentthey require action, collaboration, and a unified commitment to solutions. Together, we must embrace transparency, accountability, and compassion as the
foundation of our efforts. By fostering open communication, prioritizing the needs of the most vulnerable, and holding systems accountable, we can rebuild trust and ensure equitable outcomes for all.

Solutions lie in unitywhen state and federal leaders, advocates, and communities work hand in hand to uphold justice and fairness. Transparency through accessible Freedom of Information processes, adherence to legal
mandates, and robust oversight are the pillars that support meaningful change. Each of us has a role to play in creating a system that serves and protects.

Our collective mission is clear: to build bridges between agencies and communities, ensure the dignity of every individual, and honor the principles that guide us toward progress. Together, with determination and unity, we can
overcome systemic failures and pave the way for a brighter, more inclusive future.

Americans living with disabilities and their families are Americansfull citizens of this nation, protected by the same Constitution that guarantees the rights and freedoms of every individual. We are not separate, lesser, or forgotten. We are Americans with the same unalienable rights to life, liberty, and the pursuit of happiness.
