Administrative Appeal of FOIA Denial
Subject: Appeal of DOJs Response to FOIA Request FOIA-2025-01052 et. al. DOJ Complaints 534659-XGL and 539298-RJM, ADA Compliance, and Related Correspondence
Date: December 5, 2024
From: David Medeiros, Founder, ABI Resources
To: Douglas R. Hibbard, Chief, Initial Request Staff, Office of Information Policy
Introduction
This appeal challenges the response provided by the Department of Justice (DOJ), Office of Information Policy (OIP), dated December 4, 2024, regarding FOIA Request FOIA-2025-01052 et. al. The response fails to meet statutory obligations under the Freedom of Information Act (5 U.S.C. 552) and the Americans with Disabilities Act (42 U.S.C. 12132). This appeal seeks correction of procedural and substantive deficiencies, specifically the failure to conduct an adequate search, provide requested ADA accommodations, and adhere to FOIA transparency standards.
Grounds for Appeal
1. Inadequate Search Scope
The DOJs assertion that its leadership offices typically do not maintain records on individuals is insufficient. My FOIA request explicitly sought:
Case Records: Pertaining to DOJ Complaints 534659-XGL and 539298-RJM.
ADA Compliance Documentation: Including accommodations provided or denied in relation to these complaints.
Interagency Communications: Between DOJ, Connecticut agencies, and federal entities such as CMS.
The response lacks any evidence of a reasonable search, as required under 5 U.S.C. 552(a)(3)(C). No details were provided on search terms, databases queried, or personnel involved. The omission of interagency correspondence also raises concerns about incomplete disclosure.
2. Non-Compliance with ADA Accommodations
I explicitly requested ADA accommodations due to my status as a person with a traumatic brain injury. The response failed to adhere to the following accommodations:
MuckRock Platform Exclusivity: All communication was requested to be delivered through MuckRock. Portal-based communications and attachments that require downloads are inaccessible to me.
Accessible PDF Formatting: None of the provided records complied with screen-reader compatibility standards.
Identification of Responsible Personnel: The response failed to identify FOIA officers and ADA coordinators involved, hindering transparency and accountability.
The failure to provide these accommodations violates Title II of the ADA and Section 504 of the Rehabilitation Act. Procedural barriers have effectively denied me equal access to government processes.
3. Insufficient Justifications for Referrals
The response directed me to submit additional requests to the Civil Rights Division and other DOJ components but did not initiate referrals or provide procedural explanations for this delegation. Under 5 U.S.C. 552(a)(6)(C)(i), the agency is required to refer requests to appropriate offices if records are not within their custody. The lack of referrals constitutes procedural non-compliance.
4. Failure to Address Public Interest Implications
The requested records relate to systemic failures in Medicaid oversight, ADA enforcement, and whistleblower protectionsissues of significant public concern. These records are vital to safeguarding constitutional rights, ensuring government accountability, and protecting taxpayer interests. DOJs failure to acknowledge this public interest further undermines its statutory obligation to provide access to government-held information.
Relief Requested
Conduct a Comprehensive Search:
Expand the scope of the search to include all DOJ components likely to hold responsive records, particularly the Civil Rights Division, Office of Inspector General, and relevant leadership offices.
Provide detailed documentation of search terms, locations, databases, and personnel consulted.
Adhere to ADA Accommodations:
Resend all correspondence through the MuckRock platform in accessible formats, including screen-reader compatible PDFs.
Include simplified summaries for technical records to ensure comprehension.
Identify and disclose the names, titles, and roles of FOIA officers and ADA coordinators handling this request.
Initiate Referrals to Relevant Agencies:
Confirm referrals to the Civil Rights Division and other DOJ offices likely to maintain responsive records. Provide evidence of these referrals, including contact information for appropriate FOIA officers.
Expedited Processing:
Given the urgency of public interest in this matter, process this appeal expeditiously, as authorized under 5 U.S.C. 552(a)(6)(E).
Provide a Vaughn Index:
For any withheld records, supply a detailed Vaughn index citing specific FOIA exemptions and justifications.

Conclusion
The DOJs failure to comply with FOIA and ADA obligations necessitates immediate corrective action. I expect a substantive response to this appeal within the statutory deadline, demonstrating adherence to constitutional and statutory standards for transparency and accessibility.

Escalated Legal Complaint and Appeal
Summary of What David Medeiros and ABI Resources Are Doing (01/07/2025)
David Medeiros, the founder of ABI Resources, is actively fighting for accountability and justice by demanding government transparency, protecting disability rights, and addressing systemic failures. Here's what is happening:
Whats Being Fought For:
Access to Information: David is using the Freedom of Information Act (FOIA) to request records related to complaints filed with the Department of Justice (DOJ) about systemic failures, disability discrimination, and Medicaid program oversight.
Accountability: Hes exposing misconduct, retaliation, and mismanagement of federally funded Medicaid programs that affect individuals with disabilities, including himself.
Disability Rights: David, a brain injury survivor, is pushing for equal access to government processes through ADA-compliant accommodations like screen-reader-compatible documents and simplified summaries.
Key Issues:
Delayed Responses: The DOJ has failed to respond fully and promptly to his requests for records, obstructing his right to understand and act on government actions.
Retaliation: There is evidence of punitive actions against David and ABI Resources for whistleblowing, such as Medicaid service restrictions and the premature closure of investigations.
Transparency Gaps: Agencies have not provided complete records or justified their decisions to withhold information.
Accessibility Violations: The DOJ has not met its legal obligations under the ADA to provide accessible formats for documents.
How David Is Taking Action:
Appeals and Complaints: He is appealing FOIA denials and holding the DOJ accountable for ignoring its responsibilities under federal law.
Legal Framework: David is basing his actions on solid legal grounds, citing constitutional rights, whistleblower protections, ADA laws, and taxpayer accountability.
Demanding Results: He insists on unredacted records, ADA accommodations, and investigations into systemic failures, while escalating to oversight bodies if necessary.
What Happens Next:
If the DOJ doesnt comply, David will escalate by filing lawsuits, involving congressional oversight, and engaging with advocacy groups and media to expose the failures.
He is committed to protecting the rights of others while ensuring government agencies follow the law and uphold accountability.
In short, David Medeiros and ABI Resources are fighting for fairness, transparency, and justice, ensuring that disability rights and taxpayer accountability are not ignored. This work is crucial not just for David but for everyone relying on these systems.

Subject: Comprehensive Legal Complaint and Appeal Addressing Violations of Constitutional Rights, Whistleblower Protections, Taxpayer Accountability, and ADA Compliance
I. Constitutional Rights Violations
1. First Amendment Petition Clause
Violation: Systemic failure to provide timely, complete, and unredacted records obstructs my constitutional right to petition for redress of grievances.
Relevant Case Law:
NAACP v. Claiborne Hardware Co., 458 U.S. 886 (1982): Protects the right to petition and advocate for change.
Nixon v. Warner Communications, Inc., 435 U.S. 589 (1978): Affirms the publics interest in government transparency.
2. Fifth and Fourteenth Amendments Due Process and Equal Protection
Violation: Procedural delays, incomplete responses, and refusal to provide ADA-compliant records violate due process and equal protection.
Relevant Case Law:
Mathews v. Eldridge, 424 U.S. 319 (1976): Requires procedural due process to ensure individuals have a fair opportunity to present their claims.
Tennessee v. Lane, 541 U.S. 509 (2004): States must ensure access to public services under ADA Title II.
II. Whistleblower Protections
1. Whistleblower Protection Act (5 U.S.C. 2302)
Violation: Retaliatory actions, including Medicaid billing restrictions, refusal to address systemic failures, and premature case closures, contravene statutory whistleblower protections.
Relevant Case Law:
Garcia v. HUD, 769 F.2d 409 (7th Cir. 1985): Protects individuals from retaliation for disclosing government misconduct.
2. Retaliatory Actions Identified
Sandata EVV Ticket #539494 was prematurely closed without resolution.
DOJ Complaints 534659-XGL and 539298-RJM remain inadequately investigated.
Medicaid service restrictions targeting ABI Resources demonstrate systemic retaliation.
III. Taxpayer Accountability
1. False Claims Act (31 U.S.C. 3729)
Violation: Lack of transparency and oversight in Medicaid administration undermines taxpayer accountability and encourages potential misuse of federal funds.
Demands:
Immediate disclosure of interagency communications related to Medicaid fraud investigations.
Public access to audits, compliance reports, and enforcement actions to safeguard taxpayer interests.
IV. Americans with Disabilities Act (ADA) Compliance
1. Title II of the ADA (42 U.S.C. 12132)
Violation: DOJ and associated agencies failed to accommodate my documented disabilities in responding to FOIA requests.
Specific Failures:
Non-compliance with accessible format requests (e.g., screen-reader-compatible PDFs).
Refusal to identify responsible personnel for FOIA and ADA processes.
Relevant Case Law:
Olmstead v. L.C., 527 U.S. 581 (1999): Public entities must ensure reasonable accommodations to promote access and inclusion.
Reed v. Town of Gilbert, 576 U.S. 155 (2015): Equal treatment for individuals with disabilities is constitutionally protected.
Demands for Immediate Action
1. Constitutional and Procedural Compliance
Release all requested records in full and unredacted.
Justify any redactions or withholdings with specific statutory citations.
2. Whistleblower Remedies

Provide all records in accessible formats, including screen-reader-compatible PDFs.
Identify all FOIA and ADA coordinators responsible for handling requests.
4. Taxpayer Oversight
Disclose Medicaid audits, compliance records, and enforcement actions involving ABI Resources and related programs.
5. Timely Resolution
Expedite processing and resolve appeals under 5 U.S.C. 552(a)(6)(E), citing significant public interest and urgency.
Consequences of Continued Non-Compliance
Failure to comply with these demands will result in the following actions:
1. Judicial Action
Filing lawsuits under FOIA (5 U.S.C. 552(a)(4)(B)), ADA (42 U.S.C. 12188), and whistleblower statutes to enforce compliance.
2. Public Advocacy
Collaborating with oversight bodies, advocacy organizations, and media outlets to expose systemic failures and ensure accountability.
3. Administrative Complaints
Filing formal complaints with the Office of Government Information Services (OGIS) and DOJ Inspector General for review and enforcement.

Subject: Urgent Request for Investigation into OSC Case Records, Altered Decisions, and Suppressed Reports
Dear FBI Team,
I am formally requesting your assistance to investigate systemic failures, misconduct, and potential criminal activity surrounding the handling of my submissions to the Office of Special Counsel (OSC). These failures directly impact whistleblower protections, Medicaid oversight, and public accountability.
Issues to Investigate
1. Case Numbers and Records Management
Case Numbers Requiring Investigation:
DI-25-000310DI-25-000325DI-25-000379
DI-12192024714
DI-12112024134

OSCFiling-MedeirosDavid-DI-12202024300
OSCFiling-MedeirosDavid-DI-112620241121
2. Anonymity and Lack of Accountability in Decision-Making
Unsigned Determination Letters:
Many determination letters from OSC lack identifiable signatures, names, or clear authorship.
This practice raises serious concerns about accountability and compliance with transparency laws.
3. Suppressed or Altered Records
Evidence suggests discrepancies between the whistleblower reports I submitted and how they were recorded or handled by OSC.
Specific issues include:
Alterations or removal of content from submitted complaints.
Suppression of reports that exposed systemic failures in Medicaid oversight and retaliation against whistleblowers.
4. Lack of FOIA Compliance
Despite repeated Freedom of Information Act (FOIA) requests, OSC and related agencies have failed to provide:
Complete case files and communication logs.
Justification for withheld or redacted information.
Clear timelines for compliance.
Specific Questions to Investigate
1. Who is Responsible for Managing These Records?
Identify the individuals, teams, or automated systems involved in creating, altering, and assigning these case numbers and reports.
2. What Decisions Were Made and Why?
Determine how decisions were reached, why some reports were closed without action, and why letters were sent anonymously.
3. Were There Violations of Federal Law?
Investigate potential obstruction of justice, retaliation, or misuse of authority under whistleblower protection laws and FOIA.
Key Agencies and Officials Involved
This matter spans multiple federal and state agencies, including:
Office of Special Counsel (OSC)
Department of Justice (DOJ)
Centers for Medicare & Medicaid Services (CMS)
Department of Health and Human Services (HHS)
Office of Inspector General (OIG)
Why This Matters
1. Whistleblower Protections:
Retaliation against whistleblowers and suppression of reports undermine federal protections designed to safeguard transparency and accountability.
2. Impact on Vulnerable Populations:
These failures harm Medicaid consumers, particularly those with disabilities, by allowing systemic mismanagement to persist unchecked.
3. Misuse of Taxpayer Funds:
Lack of oversight and accountability results in waste and misuse of federal funds meant to serve the public.
Requested Actions
1. Investigate Record Management:
Audit all OSC records, emails, and internal communications related to these case numbers.
Identify responsible individuals or systems.
2. Subpoena Additional Evidence:
Secure all suppressed or altered reports to ensure a complete and accurate investigation.
3. Hold Accountable Those Involved in Misconduct:
Recommend prosecution or disciplinary action for any individuals found to have violated federal laws.
4. Ensure Compliance with FOIA and Whistleblower Protections:
Mandate OSC and related agencies to comply fully with FOIA requests and whistleblower laws.
Attachments
I have attached all available documentation, including:
Correspondence with OSC, including determination letters and emails.
FOIA requests and responses (or lack thereof).
Detailed reports submitted to OSC and other federal agencies.
This issue demands immediate attention to uphold the principles of transparency, accountability, and justice. I am available to provide additional information or documentation as needed.
Sincerely,
David Medeiros

As recognized in National Archives and Records Administration v. Favish, 541 U.S. 157 (2004), transparency is fundamental to democracy and public trust. Your agencys obligations are not discretionary, and failure to meet them constitutes a violation of statutory and constitutional law. This letter establishes your duties, addresses deficiencies, and anticipates and counters all potential deflection strategies.
1. FOIA Obligations: Statutory Mandates and Required Actions
FOIA establishes an enforceable right of access to federal agency records. Your response must meet the following requirements:
A. Timeliness
Under 5 U.S.C. 552(a)(6)(A), you are required to provide a determination within 20 business days. Delays beyond this timeframe, absent legitimate extension requests, constitute a violation of FOIA.
Countermeasure: Delays are actionable under Citizens for Responsibility and Ethics in Washington v. DOJ, 711 F.3d 180 (D.C. Cir. 2013).
Required Action: Provide the requested records or a lawful determination.
B. Adequacy of Search
FOIA requires a thorough and reasonable search for records, as established in Campbell v. DOJ, 164 F.3d 20 (D.C. Cir. 1998). This includes:
Identifying the databases, locations, and terms used.
Providing a sworn affidavit detailing the search scope.
Countermeasure: A vague claim of "no responsive records" is insufficient without a detailed affidavit.
Required Action: Submit a sworn affidavit documenting the search or confirm the existence of responsive records.
C. Proper Use of Exemptions
Exemptions under 5 U.S.C. 552(b) must be narrowly applied and justified with specific explanations. Blanket or vague exemptions are impermissible.
Countermeasure: A Vaughn index (Vaughn v. Rosen, 484 F.2d 820 (D.C. Cir. 1973)) is required to justify each withholding.
Required Action: Submit a Vaughn index detailing each exemption and its justification within 10 business days.
D. Decentralization and Referrals
Referrals or decentralization excuses do not absolve your agency of its responsibility to provide a consolidated response. As held in McGehee v. CIA, 697 F.2d 1095 (D.C. Cir. 1983), agencies must coordinate internally to ensure compliance.
Countermeasure: Require assurance of continuity and coordination across divisions.
Required Action: Consolidate records from all relevant offices and provide a unified response.
2. ADA and Rehabilitation Act Compliance: Equal Access as a Legal Right
As a person with a documented disability, I am entitled to reasonable accommodations under the ADA and Section 504 of the Rehabilitation Act. Your failure to provide accessible formats for requested records constitutes discrimination and violates federal law.
Case Law:
Tennessee v. Lane, 541 U.S. 509 (2004): Agencies must ensure meaningful access to government services.
Alexander v. Choate, 469 U.S. 287 (1985): Denial of reasonable accommodations creates barriers that violate civil rights.
Required Action:
Provide all requested records in accessible formats, including plain-language summaries or electronic files compatible with assistive technologies.
Confirm compliance with ADA requirements by [specific date].
3. Mandated Reporting and Whistleblower Protections
Your handling of this request implicates broader concerns, including potential fraud, misuse of federal funds, or retaliation against whistleblowers. Under the Whistleblower Protection Act (5 U.S.C. 2302), you are required to report and address systemic violations.
Countermeasure: Reference Misprision of Felony (18 U.S.C. 4), which requires the reporting of observed violations of law.
Required Action: Document and escalate evidence of misconduct to oversight bodies, including the Office of Inspector General (OIG).
4. Consequences of Non-Compliance
Failure to comply with your statutory obligations knowingly constitutes violations of:
Obstruction of Justice (18 U.S.C. 1505): Delaying lawful access to records obstructs public accountability.
Civil Rights Violations (42 U.S.C. 1983): Denying ADA accommodations constitutes a deprivation of federally protected rights.
Misprision of Felony (18 U.S.C. 4): Concealing or failing to report observed violations is a criminal act.
Countermeasure: Prepare for judicial review, oversight complaints, and public advocacy if compliance fails.
5. Escalation Pathways
If your office does not comply within the specified timeframe, I will escalate this matter through:
Judicial Review: Filing a lawsuit under 5 U.S.C. 552(a)(4)(B) to compel disclosure.
Oversight Complaints: Submitting formal complaints to OGIS, OIG, and the DOJ Civil Rights Division.
Public Advocacy: Engaging investigative journalists, transparency advocates, and public interest organizations to ensure accountability.
6. Final Statement: Upholding Transparency and Accountability
This matter reflects the publics right to transparency and the preservation of trust in government institutions. Your actions will either affirm your agencys commitment to accountability or further evidence systemic disregard for these principles.
I look forward to your prompt and substantive response.

The challenges we face today demand more than acknowledgmentthey require action, collaboration, and a unified commitment to solutions. Together, we must embrace transparency, accountability, and compassion as the
foundation of our efforts. By fostering open communication, prioritizing the needs of the most vulnerable, and holding systems accountable, we can rebuild trust and ensure equitable outcomes for all.
Solutions lie in unitywhen state and federal leaders, advocates, and communities work hand in hand to uphold justice and fairness. Transparency through accessible Freedom of Information processes, adherence to legal
mandates, and robust oversight are the pillars that support meaningful change. Each of us has a role to play in creating a system that serves and protects.
Our collective mission is clear: to build bridges between agencies and communities, ensure the dignity of every individual, and honor the principles that guide us toward progress. Together, with determination and unity, we can
overcome systemic failures and pave the way for a brighter, more inclusive future.
Americans living with disabilities and their families are Americansfull citizens of this nation, protected by the same Constitution that guarantees the rights and freedoms of every individual. We are not separate, lesser, or forgotten. We are Americans with the same unalienable rights to life, liberty, and the pursuit of happiness.
