Administrative Appeal for FOIA Determination
Date: December 5, 2024
To: Douglas R. Hibbard
Chief, Initial Request Staff
Office of Information Policy (OIP)
United States Department of Justice
441 G Street, NW, Sixth Floor
Washington, DC 20530-0001
Subject: Appeal of FOIA Request Denial ADA Accommodations and Handling of Complaints (DOJ Complaints #534659-XGL, #539298-RJM, #534060-HWM, and #539330-JBZ)
Dear Mr. Hibbard,
This letter serves as a formal administrative appeal under the Freedom of Information Act (FOIA), 5 U.S.C. 552(a)(6)(A)(i), regarding the response to my FOIA request dated November 22, 2024, and acknowledged on December 4, 2024. The denial of my request or failure to adequately address critical elements of my submission, including ADA accommodations, compliance with statutory obligations, and the requested scope of records, warrants immediate reconsideration.
Grounds for Appeal
1. Inadequate Search Scope
Your response indicates that records concerning my complaints are not maintained by the Office of Information Policy (OIP) or associated leadership offices. However, this assertion fails to:
Demonstrate a comprehensive search for responsive records, particularly those involving ADA compliance, FOIA handling, and inter-agency communications.
Identify any referral efforts to other DOJ components likely to maintain such records, including the Civil Rights Division (CRT).
Relief Requested:
A detailed explanation of the search terms, databases, and offices consulted during the initial processing.
A comprehensive search of DOJ components, including CRT, OIG, and other relevant offices.
2. Failure to Address ADA Accommodations
My FOIA request explicitly requested ADA accommodations under Title II of the ADA (42 U.S.C. 12132) and Section 504 of the Rehabilitation Act (29 U.S.C. 794). These accommodations include:
Communication via the MuckRock platform.
Accessible formats (screen-reader compatible PDFs, embedded text).
Simplified summaries for complex records.
Identification of all personnel involved.
Your office did not acknowledge these accommodations, violating my rights as a person with a disability and undermining procedural fairness.
Relief Requested:
Full compliance with all ADA accommodations outlined in my initial request.
An explicit acknowledgment of ADA requirements and their application to FOIA processes.
3. Failure to Provide Statutory Justifications
Your response did not provide adequate statutory explanations under FOIAs exemption framework (5 U.S.C. 552(b)) for any withheld or unprocessed records. Additionally, there was no indication of efforts to refer the request to DOJ components likely to hold responsive records.
Relief Requested:
A Vaughn Index or similar detailed justification for any withheld or redacted records.
Evidence of referral to appropriate DOJ components, including CRT and OIG.
4. Public Interest and Urgency
The records requested pertain to systemic failures in FOIA and ADA compliance, including potential violations impacting taxpayer accountability, transparency, and civil rights. The denial or delay of these records undermines public trust and impedes necessary oversight.
Relief Requested:
Expedited processing of this appeal due to its significant public interest, as provided under 5 U.S.C. 552(a)(6)(E).
Immediate release of non-exempt records to fulfill the governments obligations under FOIA.
Specific Records at Issue
The following records remain outstanding and require immediate attention:
Correspondence and Communications
All communications regarding DOJ Complaints #534659-XGL, #539298-RJM, #534060-HWM, and #539330-JBZ.
Inter-agency communications involving DOJ, CRT, OPM, DSS, and CMS.
ADA Compliance Records
Policies and internal guidance on ADA accommodations for FOIA requests.
Personnel Accountability
Identification of personnel responsible for FOIA processing and ADA accommodations related to my request.
Statutory and Constitutional Basis for Appeal
This appeal is grounded in the following legal and constitutional mandates:
Freedom of Information Act (5 U.S.C. 552): Requires agencies to conduct reasonable searches and provide detailed justifications for withheld records.
Americans with Disabilities Act (42 U.S.C. 12132) and Rehabilitation Act (29 U.S.C. 794): Mandate equal access and reasonable accommodations for individuals with disabilities.
First Amendment: Protects the publics right to access government records for accountability and oversight.
Fifth and Fourteenth Amendments: Guarantee due process and equal protection under the law.
Relief Requested
Conduct a Comprehensive Search
Expand the search to include CRT, OIG, and all relevant DOJ components.
Provide Full ADA Compliance
Implement all accommodations requested, including accessible formats, summaries, and personnel identification.
Justify Any Withholdings
Provide a Vaughn Index or equivalent documentation for withheld or redacted records.
Refer and Escalate
Ensure referral to other agencies or DOJ components as appropriate.
Grant Expedited Processing
Prioritize this appeal given the significant public interest and urgency.

OIP also adjudicates administrative appeals of denials of FOIA/PA requests made to the Department. Moreover, the FOIA does not apply to records that are maintained by states, counties, or cities, or by the legislative or judicial branches of the government. For your information, the FOIA operation for both the Department of Justice and the federal government is decentralized and each Department component and federal entity maintains and handles FOIA requests for its own records. Accordingly, you need to direct your letter to the office(s) you believe have records pertaining to the subject of your request. Escalated Legal Complaint and Appeal for Systemic Violations of Constitutional Rights, FOIA, ADA, Whistleblower Protections, and Taxpayer Oversight
Subject: Freedom of Information Act Request: ADA Accommodations and Handling of Complaints (DOJ Complaints #534659-XGL, #539298-RJM, #534060-HWM, and #539330-JBZ) (Department Of Justice)
Whats Happening and How David Medeiros and ABI Resources are Advocating for Change
David Medeiros is a person who cares deeply about helping others. He runs ABI Resources, an organization in Connecticut that supports people with disabilities, especially those who have experienced brain injuries. David himself has a brain injury, so he understands the challenges people face. He works hard to make sure government programs treat everyone fairly and follow the rules.
Whats the Problem?
David has seen some serious problems in government programs, like Medicaid (a program that helps pay for healthcare for people who need it). These problems include:
Unfair Treatment: After David spoke up about issues he noticed, some government offices made things harder for him and ABI Resources, like stopping payments and ignoring problems he reported.
Lack of Transparency: David has asked the government for documents to show how theyre handling things, but theyve delayed or refused to share them. These delays make it harder to figure out whats really going on.
Ignoring Disability Rights: David asked for simple accommodations (like making sure documents are easy to read on a computer) because of his brain injury, but some offices didnt provide the help they are legally required to give.
Taxpayer Concerns: The government is using taxpayer money for these programs, and David wants to make sure its being spent the right way.
What is David Doing About It?
David is advocating for solutions by speaking up and asking for changes that help everyone. Heres how:
Requesting Records (FOIA): David has submitted formal requests for documents under a law called FOIA (Freedom of Information Act). These documents will show whether the government is following the rules and treating people fairly.
Raising Awareness: By filing complaints with government offices, David is making sure that problems like unfair treatment and wasted money are addressed.
Protecting Disability Rights: David is reminding the government of its legal responsibility to make sure people with disabilities can access information and services without barriers.
Holding Programs Accountable: David wants to make sure that Medicaid, which helps people with disabilities, is run properly and that taxpayer money is used as intended.
Why Does This Matter?
This is important for everyone because:
Fairness for People with Disabilities: Everyone should have equal access to government services, no matter their abilities.
Protecting Whistleblowers: People like David who point out problems should not face negative consequences. Instead, their concerns should lead to better solutions.
Making Sure Tax Dollars Are Spent Right: Government programs should use money responsibly, and the public has a right to know how its being used.
Building a Better System: When the government fixes problems, it helps everyone who depends on these programs.
What Can We Learn from This?
Davids work shows that when people speak up for whats right, it can lead to important changes. Hes not just standing up for himselfhes advocating for better programs, fair treatment, and responsible use of public money. His efforts show that everyone deserves a fair chance, especially those who are vulnerable or face challenges.
How Can You Help?
You can support efforts like Davids by:
Learning More: Stay informed about how programs like Medicaid work and why transparency matters.
Sharing Information: Help others understand why its important to speak up when things arent fair.
Encouraging Accountability: Ask leaders to make sure government programs are run fairly and help the people theyre meant to serve.
David Medeiros and is showing how to stand up for fairness, accountability, and the rights of everyone. His work helps make sure government programs are fair, transparent, and accessible to all, especially people with disabilities.

I. Introduction
This is a formal legal complaint and appeal addressing systemic failures by the Department of Justice (DOJ), Connecticut Department of Social Services (DSS), Centers for Medicare & Medicaid Services (CMS), and related entities. These failures include violations of:
Constitutional rights under the First, Fifth, and Fourteenth Amendments.
Whistleblower protections under federal statutes.
FOIA obligations under 5 U.S.C. 552.
ADA and Rehabilitation Act requirements for individuals with disabilities.
Taxpayer transparency obligations under the Single Audit Act and related laws.
These actions collectively obstruct public accountability, discriminate against individuals with disabilities, retaliate against lawful whistleblowing, and mismanage taxpayer resources.
II. Violations
A. Constitutional Violations
First Amendment Violations
Denial of access to public records impedes my ability to oversee government activity and petition for redress. This obstructs transparency, a cornerstone of democratic accountability (New York Times Co. v. United States, 403 U.S. 713 (1971)).
Fifth and Fourteenth Amendments
Denial of ADA accommodations and systemic delays deprive me of procedural due process and equal protection under the law (Tennessee v. Lane, 541 U.S. 509 (2004); Mathews v. Eldridge, 424 U.S. 319 (1976)).
B. Whistleblower Retaliation Violations (5 U.S.C. 2302; 31 U.S.C. 3730(h))
Actions taken after my whistleblower report (December 18, 2023) include:
Suspension of Medicaid billing privileges.
Premature closure of Sandata EVV Ticket #539494.
Operational disruptions targeting ABI Resources.
These retaliatory actions violate protections under the Whistleblower Protection Act and False Claims Act.
C. FOIA Non-Compliance (5 U.S.C. 552)
Failure to Conduct Reasonable Searches:
Agencies failed to conduct thorough and good-faith searches for records related to DOJ complaints #534659-XGL, #539298-RJM, #534060-HWM, and #539330-JBZ.
Relevant offices (e.g., Civil Rights Division, Office of Inspector General) were not consulted.
Failure to Justify Withholdings:
No Vaughn Index was provided to explain withheld or redacted records, violating precedent set in Vaughn v. Rosen, 484 F.2d 820 (D.C. Cir. 1973).
Improper Application of Exemptions:
FOIA Exemption 5 (deliberative process privilege) does not apply to records of agency misconduct, where public interest overrides privilege (DOJ v. Reporters Committee, 489 U.S. 749 (1989)).
Untimely Responses:
Statutory deadlines under 5 U.S.C. 552(a)(6) were exceeded repeatedly, delaying justice.
D. ADA and Rehabilitation Act Violations (42 U.S.C. 12132; 29 U.S.C. 794)
Failure to Provide Accommodations:
Agencies ignored requests for ADA-compliant communication formats (e.g., MuckRock-exclusive responses, screen-reader-compatible PDFs).
Non-compliance violates 28 C.F.R. 35.160 and the Rehabilitation Acts mandate for equitable access.
Failure to Engage in the Interactive Process:
Agencies neglected their obligation to address accommodations collaboratively, constituting discriminatory practices.
E. Taxpayer Oversight Violations (31 U.S.C. 7501-7507)
Program Mismanagement:
Abrupt termination of ABI Waiver Program companion authorizations without justification breaches public accountability.
Suspension of Medicaid billing for ABI Resources lacks transparency, violating Single Audit Act standards.
III. Demands for Corrective Actions
1. FOIA Compliance
Conduct a comprehensive search of DOJ, CMS, DSS, and all relevant offices, including the Civil Rights Division and Office of Inspector General.
Provide a Vaughn Index or similar justification for any withheld or redacted records, citing statutory exemptions.
Comply with FOIA timelines to expedite pending requests.
2. ADA Compliance
Deliver ADA-compliant records in screen-reader-compatible formats with simplified summaries for complex documents.
Respond exclusively through the MuckRock platform to ensure accessibility.
Document steps taken to implement ADA accommodations.
3. Whistleblower Protections
Investigate retaliatory actions against ABI Resources and myself.
Disclose all records related to Medicaid billing suspensions and Sandata EVV Ticket #539494.
Provide assurances against future retaliatory measures.
4. Taxpayer Accountability
Justify program changes affecting the ABI Waiver Program.
Release all communications and assessments related to Medicaid billing and program terminations.
5. Individual Accountability
Investigate individuals named in complaints, including DSS Commissioner Andrea Barton Reeves, CMS officials, and other involved personnel.
IV. Escalation Path if Non-Compliance Persists
If these demands are not fulfilled within 10 business days, I will pursue the following remedies:
Judicial Remedies
File federal claims under FOIA, ADA, Rehabilitation Act, Whistleblower Protection Act, and related statutes.
Seek injunctive relief to compel compliance.
Administrative Oversight
Submit formal complaints to the Office of Government Information Services (OGIS), Office of Special Counsel (OSC), and relevant Inspectors General.
Congressional Notification
Notify House Oversight and Senate Judiciary Committees regarding systemic violations impacting whistleblowers and taxpayers.
Public Advocacy
Engage media outlets and watchdog groups to highlight violations and demand transparency.
V. Legal Basis for Appeal
Constitutional Protections
First Amendment: Ensures access to public records for government oversight.
Fifth and Fourteenth Amendments: Protect due process and equal protection rights.
Statutory Obligations
FOIA (5 U.S.C. 552): Mandates transparency and timely responses.
ADA (42 U.S.C. 12132): Prohibits disability-based discrimination.
Rehabilitation Act (29 U.S.C. 794): Requires federally funded programs to provide equitable access.
Whistleblower Protections
Whistleblower Protection Act (5 U.S.C. 2302): Shields individuals from retaliation for lawful disclosures.
False Claims Act (31 U.S.C. 3730(h)): Prohibits employer retaliation against whistleblowers.
Taxpayer Oversight
Single Audit Act (31 U.S.C. 7501-7507): Demands transparency and accountability in federal spending.
VI. Conclusion
Transparency, accountability, and adherence to legal obligations are paramount. The requested corrective actions are legally mandated, not discretionary. Failure to act will result in immediate escalation through legal, administrative, and public advocacy channels.
Signed,
David Medeiros

Subject: Urgent Request for Investigation into OSC Case Records, Altered Decisions, and Suppressed Reports
Dear FBI Team,
I am formally requesting your assistance to investigate systemic failures, misconduct, and potential criminal activity surrounding the handling of my submissions to the Office of Special Counsel (OSC). These failures directly impact whistleblower protections, Medicaid oversight, and public accountability.
Issues to Investigate
1. Case Numbers and Records Management
Case Numbers Requiring Investigation:

DI-12192024714

OSCFiling-MedeirosDavid-DI-12202024300
OSCFiling-MedeirosDavid-DI-112620241121
2. Anonymity and Lack of Accountability in Decision-Making
Unsigned Determination Letters:
Many determination letters from OSC lack identifiable signatures, names, or clear authorship.
This practice raises serious concerns about accountability and compliance with transparency laws.
3. Suppressed or Altered Records
Evidence suggests discrepancies between the whistleblower reports I submitted and how they were recorded or handled by OSC.
Specific issues include:
Alterations or removal of content from submitted complaints.
Suppression of reports that exposed systemic failures in Medicaid oversight and retaliation against whistleblowers.
4. Lack of FOIA Compliance
Despite repeated Freedom of Information Act (FOIA) requests, OSC and related agencies have failed to provide:
Complete case files and communication logs.
Justification for withheld or redacted information.
Clear timelines for compliance.
Specific Questions to Investigate
1. Who is Responsible for Managing These Records?
Identify the individuals, teams, or automated systems involved in creating, altering, and assigning these case numbers and reports.
2. What Decisions Were Made and Why?
Determine how decisions were reached, why some reports were closed without action, and why letters were sent anonymously.
3. Were There Violations of Federal Law?
Investigate potential obstruction of justice, retaliation, or misuse of authority under whistleblower protection laws and FOIA.
Key Agencies and Officials Involved
This matter spans multiple federal and state agencies, including:
Office of Special Counsel (OSC)
Department of Justice (DOJ)
Centers for Medicare & Medicaid Services (CMS)
Department of Health and Human Services (HHS)
Office of Inspector General (OIG)
Why This Matters
1. Whistleblower Protections:
Retaliation against whistleblowers and suppression of reports undermine federal protections designed to safeguard transparency and accountability.
2. Impact on Vulnerable Populations:
These failures harm Medicaid consumers, particularly those with disabilities, by allowing systemic mismanagement to persist unchecked.
3. Misuse of Taxpayer Funds:
Lack of oversight and accountability results in waste and misuse of federal funds meant to serve the public.
Requested Actions
1. Investigate Record Management:
Audit all OSC records, emails, and internal communications related to these case numbers.
Identify responsible individuals or systems.
2. Subpoena Additional Evidence:
Secure all suppressed or altered reports to ensure a complete and accurate investigation.
3. Hold Accountable Those Involved in Misconduct:
Recommend prosecution or disciplinary action for any individuals found to have violated federal laws.
4. Ensure Compliance with FOIA and Whistleblower Protections:
Mandate OSC and related agencies to comply fully with FOIA requests and whistleblower laws.
Attachments
I have attached all available documentation, including:
Correspondence with OSC, including determination letters and emails.
FOIA requests and responses (or lack thereof).
Detailed reports submitted to OSC and other federal agencies.
Conclusion
This issue demands immediate attention to uphold the principles of transparency, accountability, and justice. I am available to provide additional information or documentation as needed.
Sincerely,
David Medeiros

As recognized in National Archives and Records Administration v. Favish, 541 U.S. 157 (2004), transparency is fundamental to democracy and public trust. Your agencys obligations are not discretionary, and failure to meet them constitutes a violation of statutory and constitutional law. This letter establishes your duties, addresses deficiencies, and anticipates and counters all potential deflection strategies.
1. FOIA Obligations: Statutory Mandates and Required Actions
FOIA establishes an enforceable right of access to federal agency records. Your response must meet the following requirements:
A. Timeliness
Under 5 U.S.C. 552(a)(6)(A), you are required to provide a determination within 20 business days. Delays beyond this timeframe, absent legitimate extension requests, constitute a violation of FOIA.
Countermeasure: Delays are actionable under Citizens for Responsibility and Ethics in Washington v. DOJ, 711 F.3d 180 (D.C. Cir. 2013).
Required Action: Provide the requested records or a lawful determination.
B. Adequacy of Search
FOIA requires a thorough and reasonable search for records, as established in Campbell v. DOJ, 164 F.3d 20 (D.C. Cir. 1998). This includes:
Identifying the databases, locations, and terms used.
Providing a sworn affidavit detailing the search scope.
Countermeasure: A vague claim of "no responsive records" is insufficient without a detailed affidavit.
Required Action: Submit a sworn affidavit documenting the search or confirm the existence of responsive records.
C. Proper Use of Exemptions
Exemptions under 5 U.S.C. 552(b) must be narrowly applied and justified with specific explanations. Blanket or vague exemptions are impermissible.
Countermeasure: A Vaughn index (Vaughn v. Rosen, 484 F.2d 820 (D.C. Cir. 1973)) is required to justify each withholding.
Required Action: Submit a Vaughn index detailing each exemption and its justification within 10 business days.
D. Decentralization and Referrals
Referrals or decentralization excuses do not absolve your agency of its responsibility to provide a consolidated response. As held in McGehee v. CIA, 697 F.2d 1095 (D.C. Cir. 1983), agencies must coordinate internally to ensure compliance.
Countermeasure: Require assurance of continuity and coordination across divisions.
Required Action: Consolidate records from all relevant offices and provide a unified response.
2. ADA and Rehabilitation Act Compliance: Equal Access as a Legal Right
As a person with a documented disability, I am entitled to reasonable accommodations under the ADA and Section 504 of the Rehabilitation Act. Your failure to provide accessible formats for requested records constitutes discrimination and violates federal law.
Case Law:
Tennessee v. Lane, 541 U.S. 509 (2004): Agencies must ensure meaningful access to government services.
Alexander v. Choate, 469 U.S. 287 (1985): Denial of reasonable accommodations creates barriers that violate civil rights.
Required Action:
Provide all requested records in accessible formats, including plain-language summaries or electronic files compatible with assistive technologies.
Confirm compliance with ADA requirements by [specific date].
3. Mandated Reporting and Whistleblower Protections
Your handling of this request implicates broader concerns, including potential fraud, misuse of federal funds, or retaliation against whistleblowers. Under the Whistleblower Protection Act (5 U.S.C. 2302), you are required to report and address systemic violations.
Countermeasure: Reference Misprision of Felony (18 U.S.C. 4), which requires the reporting of observed violations of law.
Required Action: Document and escalate evidence of misconduct to oversight bodies, including the Office of Inspector General (OIG).
4. Consequences of Non-Compliance
Failure to comply with your statutory obligations knowingly constitutes violations of:
Obstruction of Justice (18 U.S.C. 1505): Delaying lawful access to records obstructs public accountability.
Civil Rights Violations (42 U.S.C. 1983): Denying ADA accommodations constitutes a deprivation of federally protected rights.
Misprision of Felony (18 U.S.C. 4): Concealing or failing to report observed violations is a criminal act.
Countermeasure: Prepare for judicial review, oversight complaints, and public advocacy if compliance fails.
5. Escalation Pathways
If your office does not comply within the specified timeframe, I will escalate this matter through:
Judicial Review: Filing a lawsuit under 5 U.S.C. 552(a)(4)(B) to compel disclosure.
Oversight Complaints: Submitting formal complaints to OGIS, OIG, and the DOJ Civil Rights Division.
Public Advocacy: Engaging investigative journalists, transparency advocates, and public interest organizations to ensure accountability.
6. Final Statement: Upholding Transparency and Accountability
This matter reflects the publics right to transparency and the preservation of trust in government institutions. Your actions will either affirm your agencys commitment to accountability or further evidence systemic disregard for these principles.
I look forward to your prompt and substantive response.

DI-25-000310DI-25-000325DI-25-000379

David Medeiros
