Subject: FOIA Mediation Request for Case No. 25-00044-F
To: ogis@nara.gov
Dear OGIS Team,
I am seeking mediation assistance regarding my Freedom of Information Act (FOIA) request, case
number 25-00044-F, submitted to the Civil Rights Division on October 24, 2024. This request seeks
access to records for a comprehensive and up-to-date provider registry associated with the
Connecticut Medicaid Acquired Brain Injury (ABI) Waiver Program, specifically including provider
details, areas of specialty, enrollment statuses, and any records related to complaints or actions taken.
The Civil Rights Division acknowledged my request on October 25, 2024, but noted that processing
might be delayed due to a high volume of FOIA requests. Given the importance of these records in
supporting transparency and accountability in Medicaid program administration, I believe there may be
ways to expedite or better track the status of my request through your mediation services.
Please note my basic accommodation request: All communication for this matter should be
conducted exclusively via email, without the use of external portals, alternate websites, or phone
calls, as this ensures I can fully manage and review the information provided.
Thank you for your assistance in pursuing a complete and timely response.
Sincerely,
David Medeiros

Dear David Medeiros:
Thank you for contacting the Office of Government Information Services (OGIS), an office of
the National Archives and Records Administration. As you are aware, Congress created OGIS to
serve as the federal Freedom of Information Act (FOIA) Ombudsman. We assist the public and
federal agencies by helping them resolve their FOIA disputes, and by addressing their questions
and concerns about the FOIA process.
It appears that you are seeking assistance with a FOIA request currently pending with the U.S.
Department of Justices Civil Rights Division. Please note, OGIS cannot compel an agency to
process a request more quickly or ahead of others in the queue. However, in working cases
similar to yours, we have learned that some requesters have had success receiving a more timely
response by refining the scope of a request. If you would like to discuss narrowing your
requestwhich may allow it to be processed more efficiently you may wish to contact the
agency's FOIA Public Liaison (FPL). All federal agencies have an FPL, whose role is to explain
the FOIA process and assist requesters with their FOIA requests at any stage of the
administrative process.
Additionally, it is important to know that all federal agencies are required to provide an estimated
date of completion (EDC) when asked (5 U.S.C. 552(a)(7)(B)(ii)). In order to obtain an
estimated date of completion for your request, we recommend that you contact the agency
directly. The FOIA Public Liaison (FPL) for the Civil Rights Division, April Freeman, can be
reached at 202-514-4210.
We hope you find this information useful. At this time, we will take no further action. If you
have questions or concerns that we have not addressed, please contact us again.
Best regards,
The OGIS Staff
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.
Sincerely,
DAVID MEDEIROS

Purpose of Appeal
This letter serves as a formal FOIA appeal under the Freedom of Information Act (5 U.S.C. 552), the Americans with Disabilities Act (42 U.S.C. 12101 et seq.), and Section 504 of the Rehabilitation Act (29 U.S.C. 794). It seeks a comprehensive, legally compliant response to my FOIA request (No. 25-00044-F) submitted on October 24, 2024, and acknowledged on October 25, 2024.
This request underscores the urgent need for transparency, accountability, and compliance in the administration of Medicaid Acquired Brain Injury (ABI) Waiver Program records, with particular focus on ADA accommodations, whistleblower protections, and the safeguarding of taxpayer rights.
Scope of Request
To ensure clarity and completeness, I reiterate the specific categories of records sought. This appeal also reinforces the critical importance of meeting ADA accommodation requirements and statutory deadlines.
1. Records Requested
Provider Registry Details: Complete and current registry, including provider names, contact details (physical and email addresses), areas of specialty, enrollment dates, and current status.
Complaints and Violations: Records related to complaints, violations, or actions taken against providers participating in the Medicaid ABI Waiver Program.
Policies and Procedures: Internal and external guidelines governing provider inclusion, monitoring, and removal from the registry.
Correspondence: Internal and external communications related to the ABI Waiver Program, including emails, memos, decision-making records, and inter-agency communications.
Legal Basis for Request
This request is grounded in the following constitutional principles, statutory mandates, and case law precedents:
Constitutional Principles:
First Amendment: Protects the right to petition the government and access public records for oversight.
Fifth Amendment: Ensures due process in government actions, including transparency in public programs.
Fourteenth Amendment: Mandates equal protection under the law, ensuring ADA compliance and nondiscrimination.
Supremacy Clause (Article VI): Reinforces federal authority over conflicting state practices, ensuring constitutional and statutory compliance.
Federal Statutes:
Freedom of Information Act (5 U.S.C. 552): Establishes public access to federal records, with requirements for timely and complete responses.
Americans with Disabilities Act (42 U.S.C. 12101 et seq.): Mandates equitable access to government processes for individuals with disabilities.
Rehabilitation Act (29 U.S.C. 794): Prohibits discrimination and ensures effective communication in federally funded programs.
State Statutes:
Connecticut Freedom of Information Act (Conn. Gen. Stat. 1-200 et seq.): Obligates state agencies to provide records within four business days.
Connecticut Budget Transparency Laws (C.G.S. 4-66): Mandates disclosure of public financial records and program audits.
Case Law:
NARA v. Favish, 541 U.S. 157 (2004): Reinforces the publics right to scrutinize government operations for accountability.
DOJ v. Reporters Committee, 489 U.S. 749 (1989): Establishes transparency as fundamental to FOIA.
Alexander v. Choate, 469 U.S. 287 (1985): Ensures equal access to benefits for individuals with disabilities.
Non-Negotiable ADA Accommodations
As a brain injury survivor, I request the following ADA accommodations:
MuckRock Platform Only: All communications must occur via MuckRock. No phone calls, physical mail, or external portals are permitted.
Accessible Formatting: All documents must be screen-reader compatible PDFs, with clear labeling and indexing.
Simplified Summaries: For complex records, include summaries in plain language.
Personnel Identification: Provide names, titles, and contact details of all FOIA officers and decision-makers.
Detailed Justifications for Redactions/Denials: Cite specific statutory exemptions and include summaries of withheld information.
Urgency and Expedited Processing
Under 5 U.S.C. 552(a)(6)(E) and Executive Order 13392, I request expedited processing. This appeal serves the public interest by ensuring transparency and accountability in Medicaid programs that impact vulnerable populations. Delays impede timely oversight, which is critical to safeguarding taxpayer funds and protecting ADA rights.
Anticipating Barriers and Addressing Noncompliance
To preempt procedural obstacles, I emphasize the following:
Statutory Timelines: FOIA mandates a 20-business-day response period. Noncompliance will prompt escalation to oversight bodies and potential legal action.
Coordination Across Agencies: Collaboration between DOJ, HHS, CMS, and state agencies is essential to avoid jurisdictional deferrals.
Oversight Notification: Noncompliance will be reported to the Office of Government Information Services (OGIS), the DOJ Office of Inspector General, and congressional oversight committees.
Escalation Plan
Failure to meet statutory obligations will necessitate:
Filing administrative appeals with the DOJ Office of Information Policy (OIP).
Pursuing mediation through OGIS.
Seeking judicial review in federal court under FOIA and ADA enforcement provisions.
Oversight Agencies and CC List
State Agencies:
William Tong, Attorney General, Connecticut.
Dr. Deidre S. Gifford, Commissioner, DSS.
Jeffrey Beckham, Secretary, Connecticut Office of Policy and Management.
Federal Agencies:
Merrick Garland, Attorney General, DOJ.
Xavier Becerra, Secretary, HHS.
Chiquita Brooks-LaSure, Administrator, CMS.
April Freeman, FOIA Public Liaison, DOJ Civil Rights Division.
Conclusion and Demand
This appeal demands:
Immediate acknowledgment of ADA accommodations and statutory timelines.
Full disclosure of all requested records in accessible formats.
Justifications for delays, redactions, or denials, with legal citations.
Failure to comply will prompt escalated oversight and enforcement actions to protect my constitutional rights, ensure ADA compliance, and uphold transparency for taxpayers.
Thank you for your immediate attention to this matter.
Sincerely,
David Medeiros

FOIA Reference: Request No. 25-00044-F
Introduction
This is a final escalated appeal for non-compliance regarding FOIA Request No. 25-00044-F, filed on October 24, 2024, and acknowledged by the Civil Rights Division on October 25, 2024. Your failure to respond, provide an estimated completion date (EDC), or comply with ADA accommodation requests violates:
Freedom of Information Act (5 U.S.C. 552);
Americans with Disabilities Act (42 U.S.C. 12101 et seq.) and Section 504 of the Rehabilitation Act;
Constitutional rights under the First, Fifth, and Fourteenth Amendments;
Whistleblower protections under the Whistleblower Protection Act and False Claims Act.
Immediate compliance is required to resolve this matter, ensure legal accountability, and uphold transparency in public oversight.
Grounds for Appeal
1. FOIA Violations Statutory Non-Compliance
Federal law mandates:
A substantive response within 20 business days (5 U.S.C. 552(a)(6)(A));
Provision of an estimated completion date (EDC) upon request (5 U.S.C. 552(a)(7)(B)(ii)).
Your continued delay without proper communication obstructs lawful oversight of publicly funded programs and compromises transparency.
Legal Precedent:
Citizens for Responsibility and Ethics in Washington v. DOJ, 846 F.3d 1235 (D.C. Cir. 2017) Agencies must adhere to FOIA timelines.
Remedy:
Acknowledge this appeal in 5 business days;
Provide a written estimated completion date for FOIA Request No. 25-00044-F.
2. ADA and Section 504 Violations Denial of Reasonable Accommodations
Despite my explicit accommodation requests, your agency failed to:
Muckrock Platform Communicate Exclusively: All responses must be through Muckrock Platform no portals, phone calls, or physical mail.
Provide Accessible Formats: Records must be screen-reader compatible (PDF).
Simplify Complex Content: Summarize complex records in plain language.
Identify FOIA Personnel: Names, titles, and contact details of those managing this request.
Failure to comply violates:
Title II of the ADA (42 U.S.C. 12132);
Section 504 of the Rehabilitation Act (29 U.S.C. 794).
Legal Precedent:
Lane v. Brown, 841 F.3d 1098 (9th Cir. 2016) Agencies must provide meaningful access to individuals with disabilities.
Remedy:
Confirm compliance with ADA accommodations immediately;
Re-issue all communications in screen-reader compatible formats with simplified summaries.
3. Constitutional Rights Violations
Non-compliance infringes on my constitutional rights:
First Amendment: Obstructing access to public records suppresses my right to petition the government for redress.
Fifth and Fourteenth Amendments: Denying ADA accommodations deprives me of due process and equal protection.
Legal Basis:
Richmond Newspapers v. Virginia, 448 U.S. 555 (1980) Public access is fundamental to government accountability.
Alexander v. Choate, 469 U.S. 287 (1985) Equal access for individuals with disabilities is guaranteed.
Remedy:
Acknowledge these violations;
Immediately comply with FOIA obligations and ADA requirements.
4. Whistleblower Protections Obstruction of Oversight
My FOIA request relates to oversight of the Connecticut Medicaid ABI Waiver Program, a federally funded program with potential:
Systemic fraud, waste, and abuse;
Non-compliance with ADA protections;
Failure to protect taxpayer resources.
Your delays obstruct lawful whistleblower activities protected under:
Whistleblower Protection Act (5 U.S.C. 2302);
False Claims Act (31 U.S.C. 3729).
Remedy:
Release all requested records without further delay to ensure taxpayer oversight.
Requested Remedies and Actions
Violation Legal Basis Remedy Sought
Delayed Response FOIA 552(a)(6)(A) Written acknowledgment and EDC confirmation.
ADA Non-Compliance ADA Title II; Section 504 Implement ADA accommodations immediately.
Failure to Provide Records FOIA 552(a)(3) Produce all records in accessible formats.

Screen-Reader Compatible PDFs: All records must be ADA-compliant.
Simplified Summaries: Include plain-language explanations for complex data.
Personnel Identification: Names, titles, and contact details for all FOIA personnel involved.
Escalation Path for Non-Compliance
If you fail to comply with this appeal, I will escalate to:
DOJ Office of Information Policy (OIP) Administrative oversight for FOIA compliance;
Office of Government Information Services (OGIS) Mediation services for systemic delays;
DOJ Civil Rights Division ADA Enforcement Unit For violations of ADA and Section 504;
Federal Courts Judicial review to compel compliance and enforce statutory penalties;
Congressional Committees and Media Notification of systemic non-compliance and whistleblower suppression.
Compliance Timeline
5 Business Days: Acknowledge receipt of this appeal and confirm ADA accommodations.
10 Business Days: Fulfill all requested records or provide a legally sufficient Vaughn Index justifying any redactions/denials.
Conclusion
Your agencys failure to comply with FOIA, ADA, and whistleblower protections undermines legal accountability, transparency, and equal access. Immediate corrective action is required to fulfill your statutory and constitutional obligations. Continued non-compliance will trigger formal escalation and judicial enforcement.
Thank you for your prompt attention to this matter.

Subject: Urgent Request for Investigation into OSC Case Records, Altered Decisions, and Suppressed Reports
Dear FBI Team,
I am formally requesting your assistance to investigate systemic failures, misconduct, and potential criminal activity surrounding the handling of my submissions to the Office of Special Counsel (OSC). These failures directly impact whistleblower protections, Medicaid oversight, and public accountability.
Issues to Investigate
1. Case Numbers and Records Management
Case Numbers Requiring Investigation:

OSCFiling-MedeirosDavid-DI-12202024300
OSCFiling-MedeirosDavid-DI-112620241121
2. Anonymity and Lack of Accountability in Decision-Making
Unsigned Determination Letters:
Many determination letters from OSC lack identifiable signatures, names, or clear authorship.
This practice raises serious concerns about accountability and compliance with transparency laws.
3. Suppressed or Altered Records
Evidence suggests discrepancies between the whistleblower reports I submitted and how they were recorded or handled by OSC.
Specific issues include:
Alterations or removal of content from submitted complaints.
Suppression of reports that exposed systemic failures in Medicaid oversight and retaliation against whistleblowers.
4. Lack of FOIA Compliance
Despite repeated Freedom of Information Act (FOIA) requests, OSC and related agencies have failed to provide:
Complete case files and communication logs.
Justification for withheld or redacted information.
Clear timelines for compliance.
Specific Questions to Investigate
1. Who is Responsible for Managing These Records?
Identify the individuals, teams, or automated systems involved in creating, altering, and assigning these case numbers and reports.
2. What Decisions Were Made and Why?
Determine how decisions were reached, why some reports were closed without action, and why letters were sent anonymously.
3. Were There Violations of Federal Law?
Investigate potential obstruction of justice, retaliation, or misuse of authority under whistleblower protection laws and FOIA.
Key Agencies and Officials Involved
This matter spans multiple federal and state agencies, including:
Office of Special Counsel (OSC)
Department of Justice (DOJ)
Centers for Medicare & Medicaid Services (CMS)
Department of Health and Human Services (HHS)
Office of Inspector General (OIG)
Why This Matters
1. Whistleblower Protections:
Retaliation against whistleblowers and suppression of reports undermine federal protections designed to safeguard transparency and accountability.
2. Impact on Vulnerable Populations:
These failures harm Medicaid consumers, particularly those with disabilities, by allowing systemic mismanagement to persist unchecked.
3. Misuse of Taxpayer Funds:
Lack of oversight and accountability results in waste and misuse of federal funds meant to serve the public.
Requested Actions
1. Investigate Record Management:
Audit all OSC records, emails, and internal communications related to these case numbers.
Identify responsible individuals or systems.
2. Subpoena Additional Evidence:
Secure all suppressed or altered reports to ensure a complete and accurate investigation.
3. Hold Accountable Those Involved in Misconduct:
Recommend prosecution or disciplinary action for any individuals found to have violated federal laws.
4. Ensure Compliance with FOIA and Whistleblower Protections:
Mandate OSC and related agencies to comply fully with FOIA requests and whistleblower laws.
Attachments
I have attached all available documentation, including:
Correspondence with OSC, including determination letters and emails.
FOIA requests and responses (or lack thereof).
Detailed reports submitted to OSC and other federal agencies.
Conclusion
This issue demands immediate attention to uphold the principles of transparency, accountability, and justice. I am available to provide additional information or documentation as needed.
Sincerely,
David Medeiros

As recognized in National Archives and Records Administration v. Favish, 541 U.S. 157 (2004), transparency is fundamental to democracy and public trust. Your agencys obligations are not discretionary, and failure to meet them constitutes a violation of statutory and constitutional law. This letter establishes your duties, addresses deficiencies, and anticipates and counters all potential deflection strategies.
1. FOIA Obligations: Statutory Mandates and Required Actions
FOIA establishes an enforceable right of access to federal agency records. Your response must meet the following requirements:
A. Timeliness
Under 5 U.S.C. 552(a)(6)(A), you are required to provide a determination within 20 business days. Delays beyond this timeframe, absent legitimate extension requests, constitute a violation of FOIA.
Countermeasure: Delays are actionable under Citizens for Responsibility and Ethics in Washington v. DOJ, 711 F.3d 180 (D.C. Cir. 2013).
Required Action: Provide the requested records or a lawful determination.
B. Adequacy of Search
FOIA requires a thorough and reasonable search for records, as established in Campbell v. DOJ, 164 F.3d 20 (D.C. Cir. 1998). This includes:
Identifying the databases, locations, and terms used.
Providing a sworn affidavit detailing the search scope.
Countermeasure: A vague claim of "no responsive records" is insufficient without a detailed affidavit.
Required Action: Submit a sworn affidavit documenting the search or confirm the existence of responsive records.
C. Proper Use of Exemptions
Exemptions under 5 U.S.C. 552(b) must be narrowly applied and justified with specific explanations. Blanket or vague exemptions are impermissible.
Countermeasure: A Vaughn index (Vaughn v. Rosen, 484 F.2d 820 (D.C. Cir. 1973)) is required to justify each withholding.
Required Action: Submit a Vaughn index detailing each exemption and its justification within 10 business days.
D. Decentralization and Referrals
Referrals or decentralization excuses do not absolve your agency of its responsibility to provide a consolidated response. As held in McGehee v. CIA, 697 F.2d 1095 (D.C. Cir. 1983), agencies must coordinate internally to ensure compliance.
Countermeasure: Require assurance of continuity and coordination across divisions.
Required Action: Consolidate records from all relevant offices and provide a unified response.
2. ADA and Rehabilitation Act Compliance: Equal Access as a Legal Right
As a person with a documented disability, I am entitled to reasonable accommodations under the ADA and Section 504 of the Rehabilitation Act. Your failure to provide accessible formats for requested records constitutes discrimination and violates federal law.
Case Law:
Tennessee v. Lane, 541 U.S. 509 (2004): Agencies must ensure meaningful access to government services.
Alexander v. Choate, 469 U.S. 287 (1985): Denial of reasonable accommodations creates barriers that violate civil rights.
Required Action:
Provide all requested records in accessible formats, including plain-language summaries or electronic files compatible with assistive technologies.
Confirm compliance with ADA requirements by [specific date].
3. Mandated Reporting and Whistleblower Protections
Your handling of this request implicates broader concerns, including potential fraud, misuse of federal funds, or retaliation against whistleblowers. Under the Whistleblower Protection Act (5 U.S.C. 2302), you are required to report and address systemic violations.
Countermeasure: Reference Misprision of Felony (18 U.S.C. 4), which requires the reporting of observed violations of law.
Required Action: Document and escalate evidence of misconduct to oversight bodies, including the Office of Inspector General (OIG).
4. Consequences of Non-Compliance
Failure to comply with your statutory obligations knowingly constitutes violations of:
Obstruction of Justice (18 U.S.C. 1505): Delaying lawful access to records obstructs public accountability.
Civil Rights Violations (42 U.S.C. 1983): Denying ADA accommodations constitutes a deprivation of federally protected rights.
Misprision of Felony (18 U.S.C. 4): Concealing or failing to report observed violations is a criminal act.
Countermeasure: Prepare for judicial review, oversight complaints, and public advocacy if compliance fails.
5. Escalation Pathways
If your office does not comply within the specified timeframe, I will escalate this matter through:
Judicial Review: Filing a lawsuit under 5 U.S.C. 552(a)(4)(B) to compel disclosure.
Oversight Complaints: Submitting formal complaints to OGIS, OIG, and the DOJ Civil Rights Division.
Public Advocacy: Engaging investigative journalists, transparency advocates, and public interest organizations to ensure accountability.
6. Final Statement: Upholding Transparency and Accountability
This matter reflects the publics right to transparency and the preservation of trust in government institutions. Your actions will either affirm your agencys commitment to accountability or further evidence systemic disregard for these principles.
I look forward to your prompt and substantive response.
