To Whom It May Concern:
I wanted to follow up on the following Freedom of Information Act request, copied below, and originally submitted on Dec. 3, 2024. Please let me know when I can expect to receive a response.
Thanks for your help, and let me know if further clarification is needed.
This complaint addresses violations of federal laws protecting transparency, accessibility, and whistleblower rights. It demands the release of government records related to ADA accommodations, Medicaid oversight, and whistleblower complaints, including DOJ cases. Agencies have failed to meet legal obligations under the Freedom of Information Act (FOIA) and the Americans with Disabilities Act (ADA) by not providing timely responses, accessible documents, or clear justifications for delays. This obstructs my constitutional rights to due process and government accountability. I am requesting immediate corrective actions, including the release of all requested records, compliance with ADA accommodations, and expedited processing to address urgent public interest concerns about government transparency, civil rights protections, and the ethical use of taxpayer funds.

Introduction and Background
This formal complaint and appeal address widespread non-compliance with FOIA (5 U.S.C. 552), ADA Title II (42 U.S.C. 12132), Section 504 of the Rehabilitation Act (29 U.S.C. 794), and whistleblower protection laws (5 U.S.C. 2302(b)(8)).
On November 22, 2024, I submitted a FOIA request for comprehensive records regarding the handling of DOJ Complaints #534659-XGL, #539298-RJM, #534060-HWM, and #539330-JBZ. The request also included ADA accommodation requirements for accessible communication. Despite the statutory timeframe of 20 business days, no substantive response has been provided, violating federal law and infringing upon my constitutional and statutory rights.
Violations Identified
1. FOIA Non-Compliance
Failure to Provide Responsive Records:
Agencies have failed to produce records, provide interim updates, or deliver even partial responses. This violates 5 U.S.C. 552(a)(6)(A), which requires agencies to process requests within 20 business days.
Absence of Justifications for Denials or Delays:
FOIA mandates detailed statutory justifications for any redactions or withheld information (5 U.S.C. 552(b)). None have been provided.
No Identification of Personnel:
Agencies are required to identify responsible personnel to ensure transparency (5 U.S.C. 552(a)(6)(C)). This requirement has been ignored.
2. ADA Non-Compliance
Failure to Provide Accessible Formats:
Requested documents have not been provided in screen-reader-compatible formats as required under ADA Title II (42 U.S.C. 12132) and Section 504 of the Rehabilitation Act (29 U.S.C. 794).
Inaccessible Communication Methods:
Lack of Simplified Summaries:
Agencies have failed to provide plain-language summaries of complex records, hindering accessibility for individuals with cognitive impairments.
ADA Accommodations Request
This request includes explicit ADA accommodations to address cognitive processing challenges resulting from my traumatic brain injury (TBI). These accommodations are legally required under Title II of the ADA (42 U.S.C. 12132) and Section 504 of the Rehabilitation Act (29 U.S.C. 794).
Requested ADA Accommodations
To ensure accessibility and compliance with ADA standards (42 U.S.C. 12101 et seq.), I request the following accommodations for all communications and records:
Screen-Reader Compatible Formats
All documents must be provided in properly labeled PDFs or plain-text files.
Ensure the documents are screen-reader compatible and retain clear formatting.
Exclusive MuckRock Platform Communication
All communications must occur via the MuckRock platform.
Do not send external links, emails, portals, passwords, codes, or require phone calls for access.
Text Embedded in Email Bodies
Key information must be embedded directly in the email body to facilitate comprehension.
Simplified Summaries
Provide plain-language summaries for complex or legal documents to ensure clarity.
Identification of Responsible Officers
Include the full name, title, and contact information of all responsible officers handling this request.
Non-Negotiable Compliance
These accommodations are non-negotiable and are essential for ensuring equal access to information. Any failure to provide the requested accommodations may constitute a violation of the ADA and the Rehabilitation Act. Thank you for ensuring compliance and accessibility in addressing this request.
3. Whistleblower Retaliation and Suppression of Records
The failure to release records related to DOJ Complaints #534659-XGL, #539298-RJM, #534060-HWM, and #539330-JBZ suggests retaliation against whistleblower activities. This violates 5 U.S.C. 2302(b)(8), which protects employees and citizens who report agency misconduct.
4. Constitutional Violations
First Amendment:
By obstructing access to public records, agencies infringe on my right to petition the government for redress of grievances.
Fifth and Fourteenth Amendments:
Agencies failures to provide ADA accommodations and timely responses violate due process and equal protection guarantees.
Demands for Corrective Action
1. FOIA Compliance
Release of Responsive Records:
Provide all requested records related to DOJ Complaints #534659-XGL, #539298-RJM, #534060-HWM, and #539330-JBZ, including correspondence, decisions, and ADA compliance policies.
Detailed Vaughn Index:
Justify any redactions or withholdings by providing a Vaughn index citing specific statutory exemptions under 5 U.S.C. 552(b).
Identification of Responsible Personnel:
Disclose the names, titles, and roles of all personnel involved in processing these requests.
2. ADA Compliance
Accessible Document Formatting:
Reformat all records into screen-reader-compatible PDFs with proper tagging and indexing.
Simplified Summaries:
Accompany complex records with plain-language explanations for accessibility.
Exclusive MuckRock Use:
Transition all communications to the MuckRock platform to eliminate barriers created by inaccessible portals or external systems.
3. Oversight and Accountability
Audit of FOIA and ADA Practices:
Request GAO and OIG to conduct a full audit of DOJ, CMS, OPM, and DSS practices regarding FOIA and ADA compliance.
Bi-Weekly Status Updates:
Provide bi-weekly updates on the status of this FOIA request until its completion.
4. Expedited Processing
Confirm expedited processing under 5 U.S.C. 552(a)(6)(E) based on significant public interest in ADA compliance, government transparency, and whistleblower protections.
Consequences of Continued Non-Compliance
1. Administrative Complaints
File complaints with the Office of Government Information Services (OGIS) and DOJ Civil Rights Division (OCR) for mediation and enforcement of ADA and FOIA obligations.
2. Judicial Action
Initiate litigation under 5 U.S.C. 552(a)(4)(B) and 42 U.S.C. 12133 to compel compliance and seek damages for violations of statutory and constitutional rights.
3. Public Advocacy
Engage transparency organizations, civil rights advocates, and media outlets to expose systemic non-compliance with FOIA and ADA laws.
Request for Expedited Processing Justifications
Expedited processing is warranted under 5 U.S.C. 552(a)(6)(E) due to:
Public Interest: This request addresses systemic failures in ADA compliance, FOIA practices, and whistleblower protectionsissues of significant public concern.
Civil Rights Concerns: Delays exacerbate potential violations of ADA Title II and suppress transparency around government handling of whistleblower complaints.
Fifth Amendment Due Process: Failure to provide timely information obstructs legal and public advocacy efforts critical to safeguarding rights.
Conclusion
This submission demands immediate corrective action to uphold transparency, accessibility, and accountability in government practices. Failure to comply with FOIA, ADA, and whistleblower protection laws undermines public trust and constitutional guarantees.

David Medeiros

Legal Basis for FOIA Request and Compliance Mandates
1. FOIA Compliance (5 U.S.C. 552)
FOIA mandates timely responses, full disclosure of non-exempt records, and explicit justifications for any redactions or denials. Any failure by DSS, CMS, or other federal agencies to meet these statutory requirements will constitute non-compliance. All denials must include precise statutory citations under FOIA, and records must be provided in their entirety unless exemptions are clearly and legally justified.
2. ADA Compliance Obligations (42 U.S.C. 12132; 28 C.F.R. 35.160)
Under Title II of the ADA, public entities must ensure effective communication with individuals with disabilities. This includes providing accessible documents in screen-reader-compatible formats and meeting specific requests for auxiliary aids. DSS and CMSs failure to meet these requests for ADA accommodations in communications constitutes non-compliance under federal ADA statutes.
3. Federal Whistleblower Protection Standards
Whistleblower protections prohibit retaliation against individuals who report agency misconduct. The actions taken against ABI Resources and David Medeiros, including billing suspension, premature ticket resolution, and operational disruptions following his whistleblower report, are viewed as retaliatory actions that must be substantiated and documented by all relevant agencies.
Specific Demands for Compliance
To ensure adherence to FOIA and ADA mandates, and to facilitate the transparency required by federal and state law, I formally request:
Delivery of ADA-Compliant Records in Full:
Email-Only Communication via MuckRock Platform: All responses, updates, and records must be sent exclusively via email to eliminate accessibility barriers. CMS must refrain from using phone calls, physical mail, or portal-based responses.
Direct Text in Email Body: Embed response text directly in the email body for immediate readability and accessibility.
PDF Attachments for Documents: All records should be provided as clearly labeled PDF attachments, organized by date and document type, with original formatting preserved for clarity and navigability.
Identification of Responsible Personnel: Each response must include names, titles, and contact information of all FOIA officers, decision-makers, and supervisory personnel responsible for processing my request, ensuring transparency and accountability.
Detailed Justifications for Redactions and Denials: Any information withheld or redacted must include detailed explanations citing specific statutory exemptions, in accordance with 5 U.S.C. 552(b). These explanations must include enough detail to verify the legal basis for each exemption claimed.
Request for Expedited Processing of FOIA Request
Pursuant to 5 U.S.C. 552(a)(6)(E), I formally request expedited processing of this FOIA request. This demand is based on critical statutory factors, including significant public interest, imminent risks to the rights of individuals with disabilities, and the need for urgent transparency to prevent ongoing retaliatory actions by public agencies.
Failure to grant expedited processing within the statutory 10-day review period will constitute non-compliance with FOIAs provisions, necessitating formal escalation of this request to administrative or legal authorities.
Consequences of Non-Compliance
Failure to respond to this FOIA request in full compliance, or any delays without proper statutory explanation, may result in formal escalation through administrative, legal, or public channels. DSS, CMS, and other involved agencies are expected to adhere strictly to statutory timelines, ensuring transparency and adherence to ADA and FOIA standards. Non-compliance will be documented and pursued through all available legal remedies.
Conclusion
This FOIA request seeks full and unambiguous access to records necessary to verify and substantiate claims of retaliation, ADA non-compliance, and procedural violations following the December 18, 2023, whistleblower report. I expect each agency to adhere strictly to both FOIA and ADA standards, ensuring prompt and thorough disclosure of all relevant documentation.
Sincerely,
David Medeiros

Subject: Escalated Complaint and Appeal for FOIA Non-Compliance, ADA Violations, and Whistleblower Retaliation
Summary of the Complaint
This formal complaint and appeal address the failure of the Department of State, Office of the Inspector General (OIG) to respond to my Freedom of Information Act (FOIA) request submitted on November 13, 2024. This request seeks records on Medicaid billing actions, ADA compliance, and retaliation against ABI Resources, LLC, following a whistleblower report submitted on December 18, 2023 (Ticket #539494).
The non-compliance and lack of acknowledgment violate FOIA statutory obligations, the Americans with Disabilities Act (ADA), and federal whistleblower protections. This failure hinders transparency and accountability, obstructing access to public records and whistleblower protections guaranteed by law.
Violations Identified
1. FOIA Non-Compliance
Statutory Obligation: Agencies must acknowledge FOIA requests within 20 business days per 5 U.S.C. 552(a)(6)(A) and provide an Estimated Date of Completion (EDC) within 10 business days under 5 U.S.C. 552(a)(7)(B)(ii).
Violation: No acknowledgment, EDC, or substantive response has been provided as of January 1, 2025.
2. ADA Non-Compliance
Statutory Obligation: Title II of the ADA (42 U.S.C. 12132) and implementing regulations (28 C.F.R. 35.160) require public entities to ensure effective communication with individuals with disabilities, including reasonable accommodations.
Violation: The agency has failed to meet explicit ADA accommodations requested, including:
Communication via the MuckRock platform.
Delivery of documents as screen-reader-compatible PDFs.
Simplified summaries for complex records.
3. Whistleblower Protection Violations
Statutory Obligation: The Whistleblower Protection Act (5 U.S.C. 2302(b)(8)) prohibits retaliation against whistleblowers and ensures protections for reporting government misconduct.
Violation: Lack of response and obstruction in providing requested records impedes my ability to investigate retaliatory actions and hold agencies accountable.
4. Constitutional Violations
First Amendment: Suppression of public records undermines my right to petition the government for redress of grievances.
Fifth Amendment: Denying access to requested records impairs procedural due process rights.
Fourteenth Amendment: Systemic exclusion through non-compliance with ADA accommodations constitutes discrimination.
Specific Records Requested
Medicaid Billing and Sandata EVV Ticket #539494:
All communications, directives, and notes related to billing restrictions for ABI Resources, LLC, and documentation of the resolution process for Ticket #539494.
Retaliatory Actions Following Whistleblower Report:
Correspondence, memos, directives, and investigative actions linked to the whistleblower report submitted on December 18, 2023.
ADA Accommodation Requests and Compliance Records:
Documentation of ADA accommodation requests and responses, internal communications, and policies on ADA compliance.
Program Changes Impacting ABI Resources:
Policies, correspondence, and decisions related to the termination of companion authorizations under the ABI Waiver Program.
Named Individuals Records:
Communications and directives involving Andrea Barton Reeves (DSS Commissioner), Matthew S. Antonetti (DSS Legal Director), and CMS officials overseeing Medicaid compliance.
ADA Accommodation Requirements (Non-Negotiable)
To ensure compliance and equitable access, I reiterate the following:
Exclusive MuckRock Platform Communication: All responses must be delivered through MuckRock. No external portals, emails, or physical mail are acceptable.
Screen-Reader-Compatible Formats: Records must be provided as accessible PDFs with clear labeling.
Simplified Summaries: Complex records must include plain-language summaries.
Identification of Personnel: Names, titles, and contact details of FOIA officers and decision-makers must accompany all responses.
Legal Basis for Appeal
Freedom of Information Act (5 U.S.C. 552): Requires timely acknowledgment, explicit justifications for denials, and transparency in the release of public records.
Americans with Disabilities Act (42 U.S.C. 12132; 28 C.F.R. 35.160): Mandates accessibility and effective communication for individuals with disabilities.
Whistleblower Protection Act (5 U.S.C. 2302(b)(8)): Protects individuals from retaliation and ensures accountability in addressing government misconduct.
Constitutional Protections: The First, Fifth, and Fourteenth Amendments safeguard access to public processes and prohibit discrimination.
Demands for Compliance
Immediate Acknowledgment of FOIA Request: Confirm receipt of the November 13, 2024, request and provide an Estimated Date of Completion (EDC) within two business days.
Expedited Processing: Grant expedited processing per 5 U.S.C. 552(a)(6)(E) due to significant public interest and the urgent need to address retaliation and ADA violations.
Comprehensive Release of Records: Deliver all requested records, adhering to FOIA and ADA standards, without improper redactions.
Justifications for Denials or Delays: Any redactions or withholdings must include detailed statutory justifications per 5 U.S.C. 552(b).
Preservation of Responsive Records: Confirm preservation of all responsive records to prevent spoliation or deletion.
Escalation and Consequences of Non-Compliance
Failure to address this complaint will result in:
Formal Complaints: Filing with oversight bodies, including OGIS, DOJ Civil Rights Division, and Connecticut FOIC.
Legal Remedies: Initiating litigation to compel compliance under FOIA and ADA statutes.
Public Advocacy: Engaging media outlets, advocacy organizations, and public forums to expose systemic failures and non-transparency.
Conclusion
This complaint reinforces the need for transparency, accessibility, and whistleblower protections in government operations. I expect immediate acknowledgment of this appeal and full compliance with the requested remedies by January 10, 2025.

Subject: Request for Reassignment and Formal Complaint Regarding FOIA Request Handling
To Whom It May Concern,
I am writing regarding my Freedom of Information Act (FOIA) request submitted on November 22, 2024, which seeks records related to ADA accommodations, Medicaid oversight, and whistleblower complaints, including DOJ cases #534659-XGL, #539298-RJM, #534060-HWM, and #539330-JBZ.
Recent correspondence from Ms. Doris Davis has raised concerns about the handling of this request. Specifically:
Failure to Acknowledge Responsibility: Ms. Davis requested a control number for my FOIA submission, despite the obligation of the agency to assign and communicate such identifiers under FOIA regulations (5 U.S.C. 552(a)(7)(A)).
Failure to Address ADA Accommodations: My request explicitly included legally mandated accommodations under the ADA (42 U.S.C. 12132), including the use of the MuckRock platform, accessible screen-reader-compatible documents, and simplified summaries. These requirements have not been addressed, constituting non-compliance with federal disability rights laws.
Given these deficiencies, I respectfully request:
1. Immediate Reassignment of My FOIA Request
Reassign my FOIA request to another Government Information Specialist or supervisory official within the CMS FOIA Division to ensure compliance with statutory obligations, ADA requirements, and professional standards.
2. Oversight by CMS FOIA Public Liaison
Ensure direct oversight by the CMS FOIA Public Liaison or a supervisory officer to facilitate timely and appropriate handling of my request.
3. Confirmation of Compliance with FOIA and ADA Obligations
Provide an acknowledgment of this escalation and confirm adherence to the following:
Timely and Transparent Processing: Fulfill my request within statutory deadlines, with immediate release of all available responsive records.
Accessible Communication: Deliver all records as screen-reader-compatible PDFs with plain-text summaries embedded in the email body.
Identification of Personnel: Disclose the names, titles, and contact information of all personnel involved in processing my request.
Legal Basis for This Escalation
FOIA Compliance (5 U.S.C. 552): Requires timely acknowledgment, assignment of tracking numbers, and explicit justification for redactions or denials.
ADA Compliance (42 U.S.C. 12132): Mandates effective communication and equitable access for individuals with disabilities.
Constitutional Protections: Failure to comply infringes upon my First Amendment right to petition the government and my Fifth and Fourteenth Amendment rights to due process and equal protection.
Next Steps
Failure to address this escalation promptly will result in further actions, including:
Administrative Complaints: Filing with the Office of Government Information Services (OGIS) and the DOJ Civil Rights Division.
Judicial Remedies: Initiating legal action under FOIA and ADA statutes to compel compliance and seek remedies for violations.
Public Advocacy: Engaging transparency organizations and media outlets to highlight systemic issues with FOIA and ADA compliance.
I trust that CMS will take swift corrective action to ensure proper handling of this matter. Please confirm receipt of this request and provide an update on the reassignment of my case within 5 business days.
Thank you for your attention to this matter.
Sincerely,
David Medeiros

Subject: Urgent Request for Investigation into OSC Case Records, Altered Decisions, and Suppressed Reports
Dear FBI Team,
I am formally requesting your assistance to investigate systemic failures, misconduct, and potential criminal activity surrounding the handling of my submissions to the Office of Special Counsel (OSC). These failures directly impact whistleblower protections, Medicaid oversight, and public accountability.
Issues to Investigate
1. Case Numbers and Records Management
Case Numbers Requiring Investigation:
DI-25-000310DI-25-000325DI-25-000379
DI-12192024714
DI-12112024134

OSCFiling-MedeirosDavid-DI-12202024300
OSCFiling-MedeirosDavid-DI-112620241121
2. Anonymity and Lack of Accountability in Decision-Making
Unsigned Determination Letters:
Many determination letters from OSC lack identifiable signatures, names, or clear authorship.
This practice raises serious concerns about accountability and compliance with transparency laws.
3. Suppressed or Altered Records
Evidence suggests discrepancies between the whistleblower reports I submitted and how they were recorded or handled by OSC.
Specific issues include:
Alterations or removal of content from submitted complaints.
Suppression of reports that exposed systemic failures in Medicaid oversight and retaliation against whistleblowers.
4. Lack of FOIA Compliance
Despite repeated Freedom of Information Act (FOIA) requests, OSC and related agencies have failed to provide:
Complete case files and communication logs.
Justification for withheld or redacted information.
Clear timelines for compliance.
Specific Questions to Investigate
1. Who is Responsible for Managing These Records?
Identify the individuals, teams, or automated systems involved in creating, altering, and assigning these case numbers and reports.
2. What Decisions Were Made and Why?
Determine how decisions were reached, why some reports were closed without action, and why letters were sent anonymously.
3. Were There Violations of Federal Law?
Investigate potential obstruction of justice, retaliation, or misuse of authority under whistleblower protection laws and FOIA.
Key Agencies and Officials Involved
This matter spans multiple federal and state agencies, including:
Office of Special Counsel (OSC)
Department of Justice (DOJ)
Centers for Medicare & Medicaid Services (CMS)
Department of Health and Human Services (HHS)
Office of Inspector General (OIG)
Why This Matters
1. Whistleblower Protections:
Retaliation against whistleblowers and suppression of reports undermine federal protections designed to safeguard transparency and accountability.
2. Impact on Vulnerable Populations:
These failures harm Medicaid consumers, particularly those with disabilities, by allowing systemic mismanagement to persist unchecked.
3. Misuse of Taxpayer Funds:
Lack of oversight and accountability results in waste and misuse of federal funds meant to serve the public.
Requested Actions
1. Investigate Record Management:
Audit all OSC records, emails, and internal communications related to these case numbers.
Identify responsible individuals or systems.
2. Subpoena Additional Evidence:
Secure all suppressed or altered reports to ensure a complete and accurate investigation.
3. Hold Accountable Those Involved in Misconduct:
Recommend prosecution or disciplinary action for any individuals found to have violated federal laws.
4. Ensure Compliance with FOIA and Whistleblower Protections:
Mandate OSC and related agencies to comply fully with FOIA requests and whistleblower laws.
Attachments
I have attached all available documentation, including:
Correspondence with OSC, including determination letters and emails.
FOIA requests and responses (or lack thereof).
Detailed reports submitted to OSC and other federal agencies.
This issue demands immediate attention to uphold the principles of transparency, accountability, and justice. I am available to provide additional information or documentation as needed.
Sincerely,
David Medeiros

As recognized in National Archives and Records Administration v. Favish, 541 U.S. 157 (2004), transparency is fundamental to democracy and public trust. Your agencys obligations are not discretionary, and failure to meet them constitutes a violation of statutory and constitutional law. This letter establishes your duties, addresses deficiencies, and anticipates and counters all potential deflection strategies.
1. FOIA Obligations: Statutory Mandates and Required Actions
FOIA establishes an enforceable right of access to federal agency records. Your response must meet the following requirements:
A. Timeliness
Under 5 U.S.C. 552(a)(6)(A), you are required to provide a determination within 20 business days. Delays beyond this timeframe, absent legitimate extension requests, constitute a violation of FOIA.
Countermeasure: Delays are actionable under Citizens for Responsibility and Ethics in Washington v. DOJ, 711 F.3d 180 (D.C. Cir. 2013).
Required Action: Provide the requested records or a lawful determination.
B. Adequacy of Search
FOIA requires a thorough and reasonable search for records, as established in Campbell v. DOJ, 164 F.3d 20 (D.C. Cir. 1998). This includes:
Identifying the databases, locations, and terms used.
Providing a sworn affidavit detailing the search scope.
Countermeasure: A vague claim of "no responsive records" is insufficient without a detailed affidavit.
Required Action: Submit a sworn affidavit documenting the search or confirm the existence of responsive records.
C. Proper Use of Exemptions
Exemptions under 5 U.S.C. 552(b) must be narrowly applied and justified with specific explanations. Blanket or vague exemptions are impermissible.
Countermeasure: A Vaughn index (Vaughn v. Rosen, 484 F.2d 820 (D.C. Cir. 1973)) is required to justify each withholding.
Required Action: Submit a Vaughn index detailing each exemption and its justification within 10 business days.
D. Decentralization and Referrals
Referrals or decentralization excuses do not absolve your agency of its responsibility to provide a consolidated response. As held in McGehee v. CIA, 697 F.2d 1095 (D.C. Cir. 1983), agencies must coordinate internally to ensure compliance.
Countermeasure: Require assurance of continuity and coordination across divisions.
Required Action: Consolidate records from all relevant offices and provide a unified response.
2. ADA and Rehabilitation Act Compliance: Equal Access as a Legal Right
As a person with a documented disability, I am entitled to reasonable accommodations under the ADA and Section 504 of the Rehabilitation Act. Your failure to provide accessible formats for requested records constitutes discrimination and violates federal law.
Case Law:
Tennessee v. Lane, 541 U.S. 509 (2004): Agencies must ensure meaningful access to government services.
Alexander v. Choate, 469 U.S. 287 (1985): Denial of reasonable accommodations creates barriers that violate civil rights.
Required Action:
Provide all requested records in accessible formats, including plain-language summaries or electronic files compatible with assistive technologies.
Confirm compliance with ADA requirements by [specific date].
3. Mandated Reporting and Whistleblower Protections
Your handling of this request implicates broader concerns, including potential fraud, misuse of federal funds, or retaliation against whistleblowers. Under the Whistleblower Protection Act (5 U.S.C. 2302), you are required to report and address systemic violations.
Countermeasure: Reference Misprision of Felony (18 U.S.C. 4), which requires the reporting of observed violations of law.
Required Action: Document and escalate evidence of misconduct to oversight bodies, including the Office of Inspector General (OIG).
4. Consequences of Non-Compliance
Failure to comply with your statutory obligations knowingly constitutes violations of:
Obstruction of Justice (18 U.S.C. 1505): Delaying lawful access to records obstructs public accountability.
Civil Rights Violations (42 U.S.C. 1983): Denying ADA accommodations constitutes a deprivation of federally protected rights.
Misprision of Felony (18 U.S.C. 4): Concealing or failing to report observed violations is a criminal act.
Countermeasure: Prepare for judicial review, oversight complaints, and public advocacy if compliance fails.
5. Escalation Pathways
If your office does not comply within the specified timeframe, I will escalate this matter through:
Judicial Review: Filing a lawsuit under 5 U.S.C. 552(a)(4)(B) to compel disclosure.
Oversight Complaints: Submitting formal complaints to OGIS, OIG, and the DOJ Civil Rights Division.
Public Advocacy: Engaging investigative journalists, transparency advocates, and public interest organizations to ensure accountability.
6. Final Statement: Upholding Transparency and Accountability
This matter reflects the publics right to transparency and the preservation of trust in government institutions. Your actions will either affirm your agencys commitment to accountability or further evidence systemic disregard for these principles.
I look forward to your prompt and substantive response.

The challenges we face today demand more than acknowledgmentthey require action, collaboration, and a unified commitment to solutions. Together, we must embrace transparency, accountability, and compassion as the
foundation of our efforts. By fostering open communication, prioritizing the needs of the most vulnerable, and holding systems accountable, we can rebuild trust and ensure equitable outcomes for all.
Solutions lie in unitywhen state and federal leaders, advocates, and communities work hand in hand to uphold justice and fairness. Transparency through accessible Freedom of Information processes, adherence to legal
mandates, and robust oversight are the pillars that support meaningful change. Each of us has a role to play in creating a system that serves and protects.
Our collective mission is clear: to build bridges between agencies and communities, ensure the dignity of every individual, and honor the principles that guide us toward progress. Together, with determination and unity, we can
overcome systemic failures and pave the way for a brighter, more inclusive future.
Americans living with disabilities and their families are Americansfull citizens of this nation, protected by the same Constitution that guarantees the rights and freedoms of every individual. We are not separate, lesser, or forgotten. We are Americans with the same unalienable rights to life, liberty, and the pursuit of happiness.
We stand firmly on the principles of equality, dignity, and justice. Our voices matter. Our contributions matter. And our rightsour Constitutional rightsmust be respected, upheld, and protected without exception or delay.
We are Americans with rights. Period.
