Include the full text of each response within the email body, and attach all supporting documents as labeled PDFs, organized by category and date.
Ensure documents are screen reader-compatible to maintain accessibility.
Clear Justifications for Redactions and Denials:

Request for Expedited Processing

Delayed access to these records obstructs effective oversight and hinders efforts to protect vulnerable populations.
Justification for Fee Waiver
This request seeks information critical to the public interest regarding ADA enforcement, civil rights protections, and DSSs handling of Medicaid-related complaints. Disclosure will directly benefit public understanding and support governmental accountability. Therefore, I request a waiver of all associated fees, as this request is not for commercial purposes.
Timeline for Response
Under FOIA, I request acknowledgment within the statutory timeframe, along with a timeline for compliance. Please notify me promptly if clarifications or additional processing time are needed. Contact me exclusively at AabiWR@live.com.
Legal Basis for This Request
This request and appeal are grounded in the following statutes:
5 U.S.C. 552 (Federal FOIA) Governing the publics right to access federal records.
Connecticut FOIA (C.G.S. 1-200 to 1-242) Requiring prompt, transparent access to state records.
Americans with Disabilities Act (ADA) (42 U.S.C. 12101 et seq.) Ensuring reasonable accommodations for individuals with disabilities.
Section 504 of the Rehabilitation Act (29 U.S.C. 794) Mandating equal access and accommodation for individuals with disabilities in federally funded programs.
Thank you for your attention to this important matter. Full and prompt disclosure of these records is crucial for ensuring transparency, ADA compliance, and public accountability within the governments handling of ADA-related complaints and civil rights protections.
Sincerely,
David Medeiros

Subject: FOIA Appeal for OCR Transaction Number 01-25-592844 ADA Non-Compliance, Obstruction, and Demand for Comprehensive Disclosure
To: FOIA Appeals Officer, Centers for Medicare & Medicaid Services (CMS)
Date: November 8, 2024
Appeal of FOIA Response Incomplete Compliance with ADA Requirements and FOIA Standards
I am filing a formal appeal regarding CMSs inadequate handling of my FOIA request related to OCR Transaction Number: 01-25-592844. CMS has not complied with ADA-mandated accommodations, failed to conduct a transparent FOIA process, and imposed unnecessary procedural barriers, which hinder public transparency and accessibility.
Background and Key Individuals Involved
My initial FOIA request was submitted to the CMS FOIA Division, OSORA, Division of FOIA Analysis A. In response, I received communication from Doris Davis, Government Information Specialist (email: doris.davis@cms.hhs.gov, phone: +1 410-786-5915), redirecting my request to FOIA_Request@cms.hhs.gov. This redirection, rather than transparent processing, has delayed and obstructed access to requested records.
Further involved personnel include:
Karen Jackson, Deputy Director, CMS OSORA, Division of FOIA Analysis, and
Mary E. Greene, Director of the Office of Strategic Operations and Regulatory Affairs, who is accountable for CMSs FOIA compliance and ADA accessibility.
Legal Violations and Procedural Failures
1. Non-Compliance with ADA Standards (42 U.S.C. 12101 et seq.; Section 504 of the Rehabilitation Act, 29 U.S.C. 794)
CMSs refusal to provide my requested ADA accommodations constitutes a clear violation of the ADA and Section 504. These statutes require federal agencies to make reasonable accommodations to ensure individuals with disabilities have equal access. CMSs imposition of procedural barriers and refusal to honor my accommodation requests amounts to a discriminatory denial of access to public records.
2. Failure to Conduct a Reasonable Search (5 U.S.C. 552(a)(3)(C))
FOIA mandates a reasonable search designed to locate all relevant documents (see Oglesby v. U.S. Dept of the Army, 920 F.2d 57, 68 (D.C. Cir. 1990)). CMS has not demonstrated a complete search across the relevant CMS divisions and OCR, nor provided assurance that all records have been examined. This is a failure to fulfill FOIAs basic requirements.
3. Obstructive Referral to Non-transparent Channels
Redirecting my FOIA request to a separate email creates an unjustified procedural barrier, delaying and obscuring access. FOIA requires agencies to respond promptly and transparently, not to redirect or impose indirect channels that hinder access. CMSs actions impede my ability to monitor and engage in the FOIA process fully.
4. Failure to Meet FOIAs Public Access Requirements (5 U.S.C. 552)
FOIA exists to facilitate public access to government records. CMSs denial of accessible formats and unnecessary referral practices runs contrary to FOIAs goal of transparency, especially for individuals requiring disability accommodations.
Corrective Actions Demanded
To address these statutory and procedural violations, I formally demand the following actions to ensure ADA and FOIA compliance:
1. Direct Processing of FOIA Request with ADA Accommodations
CMS must process my FOIA request (OCR Transaction Number: 01-25-592844) directly, honoring the following ADA-required accommodations:
Exclusive Email Communication to AabiWR@live.com.
Screen Reader-Compatible PDF Formatting with files labeled by category and date.
2. Comprehensive Search Confirmation Across CMS Divisions and OCR
I request written confirmation that CMS has conducted a thorough and complete search of all records related to ADA compliance and civil rights complaints across all relevant departments, including OSORA and OCR.
3. Verification of Contacts with Accountability and Oversight
Please provide the names, titles, and contact information of all FOIA officers, decision-makers, and supervisors responsible for this FOIA request. Required individuals include:
Doris Davis, Government Information Specialist, CMS FOIA Division
Karen Jackson, Deputy Director, OSORA, Division of FOIA Analysis
Mary E. Greene, Director, OSORA, CMS
4. Detailed Justification for Withheld or Redacted Records
For any records withheld or redacted, I require a detailed explanation citing specific FOIA exemptions. Please also include a summary of withheld content to maintain transparency and adhere to ADA requirements.
5. Immediate Confirmation of ADA-Compliant Procedures
Confirm in writing that CMS will adhere to my ADA-required accommodations in all future responses, specifically exclusive email communication and accessible PDF formatting.
Conclusion and Escalation Notification
CMSs actions reveal a troubling disregard for both FOIA and ADA standards, impacting individuals with disabilities access to public records and agency accountability. If these issues are not promptly resolved through the corrective actions outlined, I will escalate this matter to the Department of Justices Office of Civil Rights and additional federal oversight bodies.
I request acknowledgment of this appeal and a timeline for implementing these corrective actions within 20 business days, as required by FOIA.
Thank you for addressing this critical legal matter.
Sincerely,
David Medeiros

Subject: Escalated FOIA Complaint and Appeal for OCR Transaction Number: 01-25-592844
Introduction
This is a formal and escalated Freedom of Information Act (FOIA) complaint and appeal regarding CMS's handling of my FOIA request related to OCR Transaction Number: 01-25-592844. Your "No Records Response Letter" dated December 20, 2024, raises significant concerns about the adequacy of the search conducted and compliance with FOIA, ADA, and whistleblower protections.
CMS's actions have failed to meet the legal and procedural obligations required by FOIA, ADA (42 U.S.C. 12132), and whistleblower protection laws. This appeal seeks immediate corrective actions to address these violations and ensure full compliance.
Key Issues
1. Failure to Conduct a Reasonable FOIA Search
Your response states that CMS was "unable to locate any records responsive to [my] request." However, the records requested are known to exist, as they pertain to ADA compliance, civil rights enforcement, and whistleblower protections involving OCR Transaction Number: 01-25-592844.
Legal Basis:
FOIA requires agencies to conduct a "reasonable search" of all files likely to contain responsive records (see Oglesby v. U.S. Dept of the Army, 920 F.2d 57, 68 (D.C. Cir. 1990)). The search performed by CMS does not meet this standard.
Relief Requested:
A detailed explanation of the search methodology, including:
Databases, systems, and offices searched.
Search terms and parameters used.
Reasons why responsive records were not located.
A renewed, comprehensive search across all CMS divisions and external agencies, including the Office for Civil Rights (OCR).
2. ADA Non-Compliance in Processing and Communication
CMS failed to adhere to ADA-mandated accommodations in responding to this request. Specific violations include:
Ignoring explicit requests for screen-reader-compatible PDFs and email-only communication.
Failing to provide plain-language summaries of complex records.
Legal Basis:
Under 42 U.S.C. 12132 and Section 504 of the Rehabilitation Act (29 U.S.C. 794), federal agencies must ensure effective communication and accessibility for individuals with disabilities. CMSs non-compliance constitutes discriminatory denial of access.
Relief Requested:
Confirm in writing that all future responses will:
Be delivered exclusively via email to AabiWR@live.com.
Include accessible, screen-reader-compatible PDFs.
Provide plain-language summaries for technical records.
3. Whistleblower Protection Violations
This FOIA request concerns potential retaliatory actions following my December 18, 2023, whistleblower report. CMSs response does not address the existence of records documenting whistleblower complaints, investigations, or retaliatory measures, raising concerns about transparency and compliance.
Legal Basis:
Whistleblower protections under 5 U.S.C. 2302(b)(8) prohibit retaliatory actions and require federal agencies to fully document and investigate whistleblower claims. CMSs response suggests either a failure to investigate or a lack of transparency in disclosing relevant records.
Relief Requested:
Provide all records documenting whistleblower complaints and investigations related to OCR Transaction Number: 01-25-592844.
Disclose any actions or directives involving CMS personnel regarding retaliatory measures.
4. Inadequate Justifications for a "No Records" Response
CMS's "No Records Response Letter" fails to provide sufficient justification for the inability to locate records. The lack of transparency regarding search efforts and redaction justifications undermines FOIAs goal of ensuring public accountability.
Legal Basis:
FOIA requires agencies to provide specific justifications for any withheld or unavailable records, including detailed explanations of exemptions (see NARA v. Favish, 541 U.S. 157 (2004)).
Relief Requested:
A detailed justification for the "No Records" determination, including:
Explanation of why records were not located.
Identification of any exemptions applied to withheld records.
A summary of the content of any withheld records, as required under FOIAs foreseeable harm standard.
Specific Demands for Compliance
Renewed Comprehensive Search:
Conduct a new, thorough search of all CMS divisions and related agencies, including OCR and the DOJ Civil Rights Division.
ADA-Compliant Communication:
Deliver all future responses in accessible formats, as outlined in this appeal.
Personnel Accountability:
Identify all CMS personnel involved in processing this request, including their names, titles, and contact information.
Timeline for Resolution:
Provide a timeline for the completion of this appeal, including milestones for conducting a renewed search and issuing a substantive response.
Consequences of Non-Compliance
Failure to address this appeal within 10 business days will result in the following actions:
Administrative Complaints:
Filing complaints with OGIS, the DOJ Civil Rights Division, and the HHS Office for Civil Rights.
Judicial Remedies:
Pursuing litigation under FOIA (5 U.S.C. 552(a)(4)(B)) and ADA (42 U.S.C. 12188) to compel compliance and seek injunctive relief.
Public Advocacy:
Engaging media outlets and advocacy organizations to highlight systemic failures in CMSs FOIA and ADA compliance.
Conclusion
This appeal demands immediate corrective action to address CMSs violations of FOIA, ADA, and whistleblower protection statutes. Transparency, accountability, and accessibility are fundamental obligations that CMS must fulfill without further delay. I expect a substantive response within 10 business days to avoid escalation.
Thank you for your attention to this matter.
Sincerely,
David Medeiros

*** Federal Bureau of Investigation (FBI)
Subject: Urgent Request for Investigation into OSC Case Records, Altered Decisions, and Suppressed Reports
Dear FBI Team,
I am formally requesting your assistance to investigate systemic failures, misconduct, and potential criminal activity surrounding the handling of my submissions to the Office of Special Counsel (OSC). These failures directly impact whistleblower protections, Medicaid oversight, and public accountability.
Issues to Investigate
1. Case Numbers and Records Management
Case Numbers Requiring Investigation:
DI-25-000310DI-25-000325DI-25-000379
DI-12192024714
DI-12112024134

OSCFiling-MedeirosDavid-DI-11272024158
OSCFiling-MedeirosDavid-DI-11282024737
OSCFiling-MedeirosDavid-DI-12022024333
OSCFiling-MedeirosDavid-DI-12032024933
OSCFiling-MedeirosDavid-DI-12042024718
OSCFiling-MedeirosDavid-DI-12052024838
OSCFiling-MedeirosDavid-DI-12062024939
OSCFiling-MedeirosDavid-DI-12072024240
OSCFiling-MedeirosDavid-DI-12112024134
OSCFiling-MedeirosDavid-DI-12202024300
OSCFiling-MedeirosDavid-DI-112620241121
2. Anonymity and Lack of Accountability in Decision-Making
Unsigned Determination Letters:
Many determination letters from OSC lack identifiable signatures, names, or clear authorship.
This practice raises serious concerns about accountability and compliance with transparency laws.
3. Suppressed or Altered Records
Evidence suggests discrepancies between the whistleblower reports I submitted and how they were recorded or handled by OSC.
Specific issues include:
Alterations or removal of content from submitted complaints.
Suppression of reports that exposed systemic failures in Medicaid oversight and retaliation against whistleblowers.
4. Lack of FOIA Compliance
Despite repeated Freedom of Information Act (FOIA) requests, OSC and related agencies have failed to provide:
Complete case files and communication logs.
Justification for withheld or redacted information.
Clear timelines for compliance.
Specific Questions to Investigate
1. Who is Responsible for Managing These Records?
Identify the individuals, teams, or automated systems involved in creating, altering, and assigning these case numbers and reports.
2. What Decisions Were Made and Why?
Determine how decisions were reached, why some reports were closed without action, and why letters were sent anonymously.
3. Were There Violations of Federal Law?
Investigate potential obstruction of justice, retaliation, or misuse of authority under whistleblower protection laws and FOIA.
Key Agencies and Officials Involved
This matter spans multiple federal and state agencies, including:
Office of Special Counsel (OSC)
Department of Justice (DOJ)
Centers for Medicare & Medicaid Services (CMS)
Department of Health and Human Services (HHS)
Office of Inspector General (OIG)
Why This Matters
1. Whistleblower Protections:
Retaliation against whistleblowers and suppression of reports undermine federal protections designed to safeguard transparency and accountability.
2. Impact on Vulnerable Populations:
These failures harm Medicaid consumers, particularly those with disabilities, by allowing systemic mismanagement to persist unchecked.
3. Misuse of Taxpayer Funds:
Lack of oversight and accountability results in waste and misuse of federal funds meant to serve the public.
Requested Actions
1. Investigate Record Management:
Audit all OSC records, emails, and internal communications related to these case numbers.
Identify responsible individuals or systems.
2. Subpoena Additional Evidence:
Secure all suppressed or altered reports to ensure a complete and accurate investigation.
3. Hold Accountable Those Involved in Misconduct:
Recommend prosecution or disciplinary action for any individuals found to have violated federal laws.
4. Ensure Compliance with FOIA and Whistleblower Protections:
Mandate OSC and related agencies to comply fully with FOIA requests and whistleblower laws.
Attachments
I have attached all available documentation, including:
Correspondence with OSC, including determination letters and emails.
FOIA requests and responses (or lack thereof).
Detailed reports submitted to OSC and other federal agencies.
This issue demands immediate attention to uphold the principles of transparency, accountability, and justice. I am available to provide additional information or documentation as needed.
Sincerely,
David Medeiros

As recognized in National Archives and Records Administration v. Favish, 541 U.S. 157 (2004), transparency is fundamental to democracy and public trust. Your agencys obligations are not discretionary, and failure to meet them constitutes a violation of statutory and constitutional law. This letter establishes your duties, addresses deficiencies, and anticipates and counters all potential deflection strategies.
1. FOIA Obligations: Statutory Mandates and Required Actions
FOIA establishes an enforceable right of access to federal agency records. Your response must meet the following requirements:
A. Timeliness
Under 5 U.S.C. 552(a)(6)(A), you are required to provide a determination within 20 business days. Delays beyond this timeframe, absent legitimate extension requests, constitute a violation of FOIA.
Countermeasure: Delays are actionable under Citizens for Responsibility and Ethics in Washington v. DOJ, 711 F.3d 180 (D.C. Cir. 2013).
Required Action: Provide the requested records or a lawful determination.
B. Adequacy of Search
FOIA requires a thorough and reasonable search for records, as established in Campbell v. DOJ, 164 F.3d 20 (D.C. Cir. 1998). This includes:
Identifying the databases, locations, and terms used.
Providing a sworn affidavit detailing the search scope.
Countermeasure: A vague claim of "no responsive records" is insufficient without a detailed affidavit.
Required Action: Submit a sworn affidavit documenting the search or confirm the existence of responsive records.
C. Proper Use of Exemptions
Exemptions under 5 U.S.C. 552(b) must be narrowly applied and justified with specific explanations. Blanket or vague exemptions are impermissible.
Countermeasure: A Vaughn index (Vaughn v. Rosen, 484 F.2d 820 (D.C. Cir. 1973)) is required to justify each withholding.
Required Action: Submit a Vaughn index detailing each exemption and its justification within 10 business days.
D. Decentralization and Referrals
Referrals or decentralization excuses do not absolve your agency of its responsibility to provide a consolidated response. As held in McGehee v. CIA, 697 F.2d 1095 (D.C. Cir. 1983), agencies must coordinate internally to ensure compliance.
Countermeasure: Require assurance of continuity and coordination across divisions.
Required Action: Consolidate records from all relevant offices and provide a unified response.
2. ADA and Rehabilitation Act Compliance: Equal Access as a Legal Right
As a person with a documented disability, I am entitled to reasonable accommodations under the ADA and Section 504 of the Rehabilitation Act. Your failure to provide accessible formats for requested records constitutes discrimination and violates federal law.
Case Law:
Tennessee v. Lane, 541 U.S. 509 (2004): Agencies must ensure meaningful access to government services.
Alexander v. Choate, 469 U.S. 287 (1985): Denial of reasonable accommodations creates barriers that violate civil rights.
Required Action:
Provide all requested records in accessible formats, including plain-language summaries or electronic files compatible with assistive technologies.
Confirm compliance with ADA requirements by [specific date].
3. Mandated Reporting and Whistleblower Protections
Your handling of this request implicates broader concerns, including potential fraud, misuse of federal funds, or retaliation against whistleblowers. Under the Whistleblower Protection Act (5 U.S.C. 2302), you are required to report and address systemic violations.
Countermeasure: Reference Misprision of Felony (18 U.S.C. 4), which requires the reporting of observed violations of law.
Required Action: Document and escalate evidence of misconduct to oversight bodies, including the Office of Inspector General (OIG).
4. Consequences of Non-Compliance
Failure to comply with your statutory obligations knowingly constitutes violations of:
Obstruction of Justice (18 U.S.C. 1505): Delaying lawful access to records obstructs public accountability.
Civil Rights Violations (42 U.S.C. 1983): Denying ADA accommodations constitutes a deprivation of federally protected rights.
Misprision of Felony (18 U.S.C. 4): Concealing or failing to report observed violations is a criminal act.
Countermeasure: Prepare for judicial review, oversight complaints, and public advocacy if compliance fails.
5. Escalation Pathways
If your office does not comply within the specified timeframe, I will escalate this matter through:
Judicial Review: Filing a lawsuit under 5 U.S.C. 552(a)(4)(B) to compel disclosure.
Oversight Complaints: Submitting formal complaints to OGIS, OIG, and the DOJ Civil Rights Division.
Public Advocacy: Engaging investigative journalists, transparency advocates, and public interest organizations to ensure accountability.
6. Final Statement: Upholding Transparency and Accountability
This matter reflects the publics right to transparency and the preservation of trust in government institutions. Your actions will either affirm your agencys commitment to accountability or further evidence systemic disregard for these principles.
I look forward to your prompt and substantive response.

The challenges we face today demand more than acknowledgmentthey require action, collaboration, and a unified commitment to solutions. Together, we must embrace transparency, accountability, and compassion as the
foundation of our efforts. By fostering open communication, prioritizing the needs of the most vulnerable, and holding systems accountable, we can rebuild trust and ensure equitable outcomes for all.
Solutions lie in unitywhen state and federal leaders, advocates, and communities work hand in hand to uphold justice and fairness. Transparency through accessible Freedom of Information processes, adherence to legal
mandates, and robust oversight are the pillars that support meaningful change. Each of us has a role to play in creating a system that serves and protects.
Our collective mission is clear: to build bridges between agencies and communities, ensure the dignity of every individual, and honor the principles that guide us toward progress. Together, with determination and unity, we can
overcome systemic failures and pave the way for a brighter, more inclusive future.
Americans living with disabilities and their families are Americansfull citizens of this nation, protected by the same Constitution that guarantees the rights and freedoms of every individual. We are not separate, lesser, or forgotten. We are Americans with the same unalienable rights to life, liberty, and the pursuit of happiness.
We stand firmly on the principles of equality, dignity, and justice. Our voices matter. Our contributions matter. And our rightsour Constitutional rightsmust be respected, upheld, and protected without exception or delay.
We are Americans with rights. Period.
