Request for Expedited Processing of FOIA Request for Records Pertaining to Medicaid Services for NPI 1962278119 and NPI 1023012345
Pursuant to Federal Law and Connecticut FOIA Statutes, I am requesting expedited processing of this FOIA request due to the pressing public interest involved and the immediate impact on vulnerable Medicaid beneficiaries, as authorized under applicable legal provisions.

Request for Expedited Processing
Legal Basis: Under 5 U.S.C. 552(a)(6)(E), expedited processing is required when there is an urgency to inform the public concerning actual or alleged Federal Government activity. Additionally, Conn. Gen. Stat. 1-210(a) mandates prompt availability of public agency records, especially where issues directly impact public welfare and accountability.

Justification for Expedited Processing
Public Interest and Transparency: These records are crucial for public scrutiny of Medicaid spending, potential monopolistic practices, consumer choice limitations, and wage compliance within Connecticuts Medicaid ABI Waiver Program.

Immediate Impact on Vulnerable Populations: This request addresses policies that may limit autonomy, financial independence, and housing security for Medicaid beneficiaries, especially those with disabilities. Delays could harm these populations by preventing timely corrective action.

Compliance with FOIA Promptness Standards: Federal and Connecticut FOIA statutes require agencies to make records available promptly. Any refusal to expedite processing would contravene both the letter and intent of FOIA law.

Potential Financial and Legal Violations: Requested records may reveal misuse of Medicaid funds or improper labor practices. Immediate access is necessary for regulatory assessment.

Request for Immediate Acknowledgment: Please provide immediate, written acknowledgment of this expedited processing request. If expedited processing is denied, provide a written statement detailing the specific legal grounds for denial, in compliance with FOIA statutes.

Thank you for your prompt attention to this matter.

Sincerely,
David Medeiros

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Overview and Purpose of Appeal
This escalated complaint and appeal concerns the handling of my FOIA Request (submitted November 2, 2024) to various federal and state agencies regarding records tied to Medicaid services for NPI 1962278119 and NPI 1023012345. Agencies have failed to provide timely responses, implement required accommodations under the Americans with Disabilities Act (ADA), and comply with statutory obligations under FOIA (5 U.S.C. 552) and related laws.

This document outlines specific legal grounds, applicable case law, violations committed, and requested remedies.

I. Constitutional Violations
First Amendment Violations
Agencies' failure to process my FOIA request promptly and fully infringes upon my First Amendment right to petition the government for redress of grievances.

Case Law:
National Archives and Records Admin. v. Favish, 541 U.S. 157 (2004): Ensures public access to records necessary for governmental accountability.
ACLU v. DOJ, 655 F.3d 1 (D.C. Cir. 2011): FOIA is essential to exercising the First Amendment right to access government information.
Friedman v. Bache Halsey Stuart Shields, Inc., 738 F.2d 1336 (D.C. Cir. 1984): Protects public oversight rights when agency transparency is challenged.
Fifth and Fourteenth Amendment Violations
The denial of ADA accommodations and timely FOIA compliance constitutes procedural and substantive due process violations under the Fifth and Fourteenth Amendments.

Case Law:
Goldberg v. Kelly, 397 U.S. 254 (1970): Procedural fairness in administrative processes is constitutionally required.
Mathews v. Eldridge, 424 U.S. 319 (1976): Due process mandates procedural protections in administrative decisions impacting individual rights.
Tennessee v. Lane, 541 U.S. 509 (2004): Access to government programs must not exclude disabled individuals.
II. FOIA Non-Compliance
Failure to Meet Statutory Deadlines
Agencies have failed to comply with FOIA's 20-business-day deadline. Delays impede public access to critical Medicaid records.

Case Law:
Citizens for Responsibility & Ethics in Washington v. FEC, 711 F.3d 180 (D.C. Cir. 2013): Agencies must adhere to FOIAs statutory timelines.
Judicial Watch, Inc. v. DHS, 895 F.3d 770 (D.C. Cir. 2018): Delays in processing FOIA requests violate statutory mandates.
Failure to Provide Vaughn Index for Redacted or Withheld Records
Any redactions or withholdings must include a detailed Vaughn Index citing specific legal exemptions under FOIA.

Case Law:
Vaughn v. Rosen, 484 F.2d 820 (D.C. Cir. 1973): Requires detailed justifications for withheld records.
Improper Deferral and Referral
Referring responsibility between agencies without proper coordination violates FOIAs obligation to assist requesters.

Case Law:
McGehee v. CIA, 697 F.2d 1095 (D.C. Cir. 1983): Agencies must conduct thorough searches and avoid deflections.

III. Whistleblower Protections Violations
Failure to Address Potential Fraud
This FOIA request involves allegations of Medicaid fraud and whistleblower disclosures. The Whistleblower Protection Act (5 U.S.C. 1213) mandates robust agency action and transparency.

Case Law:
Lane v. Franks, 573 U.S. 228 (2014): Protects whistleblowers exposing public fraud.
Garcia v. DOJ, 768 F.2d 1226 (11th Cir. 1985): FOIA ensures transparency in whistleblower-related investigations.
Kerr v. DHS, 123 F. Supp. 3d 90 (D.D.C. 2015): Agencies must act on whistleblower disclosures under statutory protections.

IV. Taxpayer Law Rights Violations
Improper Use of Medicaid Funds
Public records are essential to verify Medicaid funds' proper allocation and use, ensuring compliance with fiduciary obligations.

Case Law:
United States v. Estate of Romani, 523 U.S. 517 (1998): Agencies have a fiduciary duty to safeguard public funds.
Heckler v. Chaney, 470 U.S. 821 (1985): Regulatory enforcement must align with statutory mandates.
U.S. ex rel. Tyson v. Amerigroup Illinois, Inc., 488 F. Supp. 2d 719 (N.D. Ill. 2007): Medicaid fraud undermines public trust and fiscal responsibility.
V. ADA and Rehabilitation Act Violations
Failure to Provide Requested Accommodations
Agencies have ignored explicit requests for email-only communication, accessible document formats, and simplified summaries.

Case Law:
Alexander v. Choate, 469 U.S. 287 (1985): Agencies must provide reasonable accommodations under the ADA.
Tennessee v. Lane, 541 U.S. 509 (2004): Denial of access constitutes discrimination against disabled individuals.
Loeffler v. Staten Island University Hosp., 582 F.3d 268 (2d Cir. 2009): Public entities must ensure effective communication for disabled individuals.

VI. Relief Requested
Immediate Compliance and Transparency

Conduct comprehensive searches for all responsive records.
Provide a Vaughn Index for withheld or redacted documents.
Adherence to ADA Accommodations

Deliver all responses via email in screen-reader-compatible formats.
Include summaries for complex documents.
Expedited Processing

Process the request under 5 U.S.C. 552(a)(6)(E).
Identification of FOIA Officers

Provide the names, titles, and contact information of officials managing this FOIA request.
Fee Waiver Approval

Waive all fees under 5 U.S.C. 552(a)(4)(A)(iii), as this request serves the public interest.
VII. Escalation and Consequences of Non-Compliance
Failure to address this complaint by January 15, 2025, will result in the following actions:

Filing Formal Complaints

Submit ADA and FOIA complaints to the Office of Government Information Services (OGIS) and DOJ Civil Rights Division.
Judicial Remedies

Initiate litigation under 5 U.S.C. 552(a)(4)(B) for injunctive relief and damages.
Congressional Oversight Notification

Notify Congressional oversight committees to address systemic non-compliance.

Sincerely,
David Medeiros

Overview and Purpose of Appeal
This escalated complaint and appeal concerns the handling of my FOIA Request (submitted November 2, 2024) to various federal and state agencies regarding records tied to Medicaid services for NPI 1962278119 and NPI 1023012345. Agencies have failed to provide timely responses, implement required accommodations under the Americans with Disabilities Act (ADA), and comply with statutory obligations under FOIA (5 U.S.C. 552) and related laws.

This document outlines specific legal grounds, applicable case law, violations committed, and requested remedies.

I. Constitutional Violations
First Amendment Violations
Agencies' failure to process my FOIA request promptly and fully infringes upon my First Amendment right to petition the government for redress of grievances.

Case Law:
National Archives and Records Admin. v. Favish, 541 U.S. 157 (2004): Ensures public access to records necessary for governmental accountability.
ACLU v. DOJ, 655 F.3d 1 (D.C. Cir. 2011): FOIA is essential to exercising the First Amendment right to access government information.
Friedman v. Bache Halsey Stuart Shields, Inc., 738 F.2d 1336 (D.C. Cir. 1984): Protects public oversight rights when agency transparency is challenged.
Fifth and Fourteenth Amendment Violations
The denial of ADA accommodations and timely FOIA compliance constitutes procedural and substantive due process violations under the Fifth and Fourteenth Amendments.

Case Law:
Goldberg v. Kelly, 397 U.S. 254 (1970): Procedural fairness in administrative processes is constitutionally required.
Mathews v. Eldridge, 424 U.S. 319 (1976): Due process mandates procedural protections in administrative decisions impacting individual rights.
Tennessee v. Lane, 541 U.S. 509 (2004): Access to government programs must not exclude disabled individuals.
II. FOIA Non-Compliance
Failure to Meet Statutory Deadlines
Agencies have failed to comply with FOIA's 20-business-day deadline. Delays impede public access to critical Medicaid records.

Case Law:
Citizens for Responsibility & Ethics in Washington v. FEC, 711 F.3d 180 (D.C. Cir. 2013): Agencies must adhere to FOIAs statutory timelines.
Judicial Watch, Inc. v. DHS, 895 F.3d 770 (D.C. Cir. 2018): Delays in processing FOIA requests violate statutory mandates.
Failure to Provide Vaughn Index for Redacted or Withheld Records
Any redactions or withholdings must include a detailed Vaughn Index citing specific legal exemptions under FOIA.

Case Law:
Vaughn v. Rosen, 484 F.2d 820 (D.C. Cir. 1973): Requires detailed justifications for withheld records.
Improper Deferral and Referral
Referring responsibility between agencies without proper coordination violates FOIAs obligation to assist requesters.

Case Law:
McGehee v. CIA, 697 F.2d 1095 (D.C. Cir. 1983): Agencies must conduct thorough searches and avoid deflections.

III. Whistleblower Protections Violations
Failure to Address Potential Fraud
This FOIA request involves allegations of Medicaid fraud and whistleblower disclosures. The Whistleblower Protection Act (5 U.S.C. 1213) mandates robust agency action and transparency.

Case Law:
Lane v. Franks, 573 U.S. 228 (2014): Protects whistleblowers exposing public fraud.
Garcia v. DOJ, 768 F.2d 1226 (11th Cir. 1985): FOIA ensures transparency in whistleblower-related investigations.
Kerr v. DHS, 123 F. Supp. 3d 90 (D.D.C. 2015): Agencies must act on whistleblower disclosures under statutory protections.

IV. Taxpayer Law Rights Violations
Improper Use of Medicaid Funds
Public records are essential to verify Medicaid funds' proper allocation and use, ensuring compliance with fiduciary obligations.

Case Law:
United States v. Estate of Romani, 523 U.S. 517 (1998): Agencies have a fiduciary duty to safeguard public funds.
Heckler v. Chaney, 470 U.S. 821 (1985): Regulatory enforcement must align with statutory mandates.
U.S. ex rel. Tyson v. Amerigroup Illinois, Inc., 488 F. Supp. 2d 719 (N.D. Ill. 2007): Medicaid fraud undermines public trust and fiscal responsibility.
V. ADA and Rehabilitation Act Violations
Failure to Provide Requested Accommodations
Agencies have ignored explicit requests for email-only communication, accessible document formats, and simplified summaries.

Case Law:
Alexander v. Choate, 469 U.S. 287 (1985): Agencies must provide reasonable accommodations under the ADA.
Tennessee v. Lane, 541 U.S. 509 (2004): Denial of access constitutes discrimination against disabled individuals.
Loeffler v. Staten Island University Hosp., 582 F.3d 268 (2d Cir. 2009): Public entities must ensure effective communication for disabled individuals.

VI. Relief Requested
Immediate Compliance and Transparency

Conduct comprehensive searches for all responsive records.
Provide a Vaughn Index for withheld or redacted documents.
Adherence to ADA Accommodations

ADA Basic Accommodations:
To ensure accessibility and compliance with ADA standards, provide:
Screen-Reader Compatible Formats: All documents must be labeled and accessible for assistive technologies.
Exclusive MUCKROCK Platform only communications: No emails, external links, portals, passwords, codes, physical mail, or phone calls.
Simplified Summaries: For complex or legal documents, include plain-language summaries.
Full name title of responsible officers and internal procedural for all communications.

Expedited Processing

Process the request under 5 U.S.C. 552(a)(6)(E).
Identification of FOIA Officers

Provide the names, titles, and contact information of officials managing this FOIA request.

Fee Waiver Approval

Waive all fees under 5 U.S.C. 552(a)(4)(A)(iii), as this request serves the public interest.
VII. Escalation and Consequences of Non-Compliance
Failure to address this complaint by January 15, 2025, will result in the following actions:

Filing Formal Complaints

Submit ADA and FOIA complaints to the Office of Government Information Services (OGIS) and DOJ Civil Rights Division.
Judicial Remedies

Initiate litigation under 5 U.S.C. 552(a)(4)(B) for injunctive relief and damages.
Congressional Oversight Notification

Notify Congressional oversight committees to address systemic non-compliance.

Sincerely,
David Medeiros
