In accordance with Section 504 of the Rehabilitation Act of 1973 (29 U.S.C. 794) and the Americans with Disabilities Act (ADA) (42 U.S.C. 12101 et seq.), I am requesting accommodations due to my condition. I respectfully request that all records be provided electronically via email, as opposed to portals or complex delivery methods, to ensure full and equal access to the information.

All bills, amendments, resolutions, legislative proposals, and legislative history related to the Connecticut Medicaid ABI Waiver Program.

Comprehensive data sets related to enrollment, utilization, demographic information, and outcomes of beneficiaries participating in the Medicaid ABI Waiver Program.
Special Requests:
Expedited Processing: Pursuant to Executive Order 13392, which mandates the improvement of agency disclosure processes, and the Freedom of Information Act (5 U.S.C. 552), I request expedited processing of this FOIA request due to the public interest and personal impact of the information.

Electronic Records: In compliance with my rights under Section 504 of the Rehabilitation Act and the ADA, I request that all records be provided in electronic format and sent directly to my email address. This will ensure that I can access the information without unnecessary barriers or delays.

Fee Waiver Request:
I request a waiver of all fees associated with this FOIA request under 5 U.S.C. 552(a)(4)(A)(iii). This request is made in the public interest and not for commercial use. Comprehensive Appeal for FOIA Requests OPM ID #24-81 and OPM ID #24-84
From: David Medeiros
Date: November 20, 2024
To: Office of Policy and Management (OPM)
CC: Listed State and Federal Agencies and Department Heads

Subject: Appeal for Legal and Constitutional Compliance with FOIA Requests OPM ID #24-81 and OPM ID #24-84 and Enforcement of ADA Accommodations
Introduction
This appeal addresses significant deficiencies in the responses to FOIA requests OPM ID #24-81 and #24-84 regarding records for the Connecticut Medicaid Acquired Brain Injury (ABI) Waiver Program. As a Medicaid recipient and an advocate for individuals with disabilities, I rely on the transparency mandated by state and federal FOIA laws to ensure accountability and equitable program administration. This appeal also highlights persistent violations of statutory ADA accommodation requirements and constitutional protections.

Summary of FOIA Requests
I requested:

Legislative Records:
Bills, amendments, legislative history, and meeting minutes related to the Medicaid ABI Waiver Program.
Public Records:
Financial statements, budget allocations, program assessments, contracts, and audits pursuant to Connecticuts transparency statutes (C.G.S. 4-66).
Correspondence:
Internal and external communication, directives, memoranda, and policies regarding the ABI Waiver Program.
Personnel Records:
Non-confidential job descriptions, resumes, performance evaluations, and organizational charts related to program oversight and administration.
Program Information:
Procedural documents, compliance reviews, demographic data, and performance outcomes required under federal CMS regulations (42 CFR 440.180).
Purpose:
To ensure compliance, transparency, and equitable administration of taxpayer-funded services critical to individuals with acquired brain injuries.

Legal Framework and Basis for Appeal
Federal and State FOIA Compliance
Federal FOIA (5 U.S.C. 552):
Guarantees access to federal records, mandates timely responses, and requires detailed explanations for delays or denials.
Connecticut FOIA (C.G.S. 1-200 to 1-242):
Ensures access to state-held records within four business days and prohibits unnecessary delays or redactions.
Medicaid Statute (42 U.S.C. 1396 et seq.):
Mandates accountability in Medicaid programs, including state compliance with CMS requirements.
Executive Order 13392:
Directs agencies to improve FOIA processing and transparency.
ADA and Section 504 Compliance
ADA (42 U.S.C. 12101 et seq.):
Prohibits discrimination and requires public entities to provide reasonable accommodations for individuals with disabilities.
Section 504 of the Rehabilitation Act (29 U.S.C. 794):
Guarantees equal access to federally funded programs and public records.
Violations and Deficiencies
1. Non-Compliance with FOIA Timelines
Connecticut Law (C.G.S. 1-210):
Requires confirmation of receipt and timeline estimates within four business days. OPM acknowledged receipt but failed to provide specific timelines for document production or updates on progress.
Federal FOIA (5 U.S.C. 552(a)(6)(A)):
Mandates prompt responses and proactive communication regarding delays. These requirements have not been met.
2. Inadequate Acknowledgment of ADA Accommodations
My request explicitly outlined Non-Negotiable ADA Accommodations, which were ignored:
Email-only communication.
Screen-reader-compatible PDF attachments.
Simplified summaries for complex records.
Identification of responsible FOIA personnel.
Expedited processing under 5 U.S.C. 552(a)(6)(E).
Failure to implement these accommodations violates both ADA Title II and Section 504, depriving me of equal access to the FOIA process.

3. Unjustified Redactions and Potential Fee Assessments
Fee Waiver Denial:
The request meets public interest criteria under C.G.S. 1-212(d) and 5 U.S.C. 552(a)(4)(A)(iii). No statutory basis has been provided for proposed fees.
Failure to Justify Redactions:
Federal FOIA (5 U.S.C. 552(b)) requires detailed explanations for exemptions, including statutory citations. These justifications have not been provided.
Non-Negotiable ADA Accommodations (Updated)
MuckRock Platform Only:

All responses must be sent through the MuckRock platform to ensure accessibility and compliance.
Direct Text in Email Body:

Full text of responses embedded in the email body to enhance readability and accessibility.
Screen-Reader-Compatible PDFs:

Clearly labeled, properly formatted PDFs must accompany email responses.
Simplified Summaries:

Provide simplified explanations for technical, financial, or legal documents.
Identification of Responsible Personnel:

Full names, titles, and contact information for FOIA officers and supervisory personnel.
Detailed Justifications for Denials:

Cite specific exemptions for any withheld or redacted information.
Expedited Processing:

Requests must be processed urgently, as mandated under 5 U.S.C. 552(a)(6)(E) and Executive Order 13392.
Constitutional Violations
1. First Amendment (Right to Petition the Government)
The refusal to provide timely and accessible information infringes upon my constitutional right to petition for redress of grievances.

2. Fourteenth Amendment (Equal Protection Clause)
Denial of ADA accommodations constitutes unequal treatment of individuals with disabilities, violating federal law and constitutional protections.

3. Fifth Amendment (Due Process Clause)
The lack of transparency, failure to justify delays, and insufficient responses deprive me of my right to procedural due process.

4. Supremacy Clause (Article VI, Clause 2)
State practices inconsistent with federal FOIA and ADA standards violate the Supremacy Clause, which establishes the primacy of federal law.

Requested Actions
Full Compliance with FOIA Requests OPM ID #24-81 and #24-84:

Provide all responsive documents promptly and in adherence to the updated accommodations.
Confirmation of Accommodations:

Explicit acknowledgment that all updated accommodations will be applied moving forward.
Justifications for Redactions and Fees:

Provide detailed statutory justifications for any redactions or fees.

ADA (42 U.S.C. 12101 et seq.) and Section 504 (29 U.S.C. 794)

Mandate reasonable accommodations for individuals with disabilities, ensuring equitable access to public records.
First Amendment

Protects the right to petition the government for redress of grievances, including access to information.
Fourteenth Amendment

Guarantees equal protection under the law, which includes equal access to public services for individuals with disabilities.
Fifth Amendment

Ensures due process rights, which are infringed by delayed or inaccessible responses.
Consequences of Continued Non-Compliance
Failure to comply with statutory and constitutional obligations will result in the following:

Administrative Complaints

Subject: Final Assertion of Legal Obligations Under FOIA, ADA, and Constitutional Law
Subject: 10/17/2024 Connecticut Freedom of Information Act Request: Subject: Comprehensive FOIA Request for Connecticut Medicaid Acquired Brain Injury Waiver Program Records (Office Of Policy And Management)

01.08.2025

To all It May Concern in All Relevant Departments and Divisions,

Office Of Policy And Management
Office of Legal Affairs Office of Policy and Management
450 Capitol Avenue MS# 55 SEC Hartford, CT 06106-1379 OPM.FOI@ct.gov

This correspondence pertains to my Freedom of Information Act (FOIA) request. Your handling of this matter raises critical concerns under FOIA (5 U.S.C. 552), the Americans with Disabilities Act (ADA, 42 U.S.C. 12132), and constitutional principles of government accountability.

As recognized in National Archives and Records Administration v. Favish, 541 U.S. 157 (2004), transparency is fundamental to democracy and public trust. Your agencys obligations are not discretionary, and failure to meet them constitutes a violation of statutory and constitutional law. This letter establishes your duties, addresses deficiencies, and anticipates and counters all potential deflection strategies.

1. FOIA Obligations: Statutory Mandates and Required Actions
FOIA establishes an enforceable right of access to federal agency records. Your response must meet the following requirements:

A. Timeliness
Under 5 U.S.C. 552(a)(6)(A), you are required to provide a determination within 20 business days. Delays beyond this timeframe, absent legitimate extension requests, constitute a violation of FOIA.

Countermeasure: Delays are actionable under Citizens for Responsibility and Ethics in Washington v. DOJ, 711 F.3d 180 (D.C. Cir. 2013).
Required Action: Provide the requested records or a lawful determination.

B. Adequacy of Search
FOIA requires a thorough and reasonable search for records, as established in Campbell v. DOJ, 164 F.3d 20 (D.C. Cir. 1998). This includes:

Identifying the databases, locations, and terms used.
Providing a sworn affidavit detailing the search scope.
Countermeasure: A vague claim of "no responsive records" is insufficient without a detailed affidavit.
Required Action: Submit a sworn affidavit documenting the search or confirm the existence of responsive records.

C. Proper Use of Exemptions
Exemptions under 5 U.S.C. 552(b) must be narrowly applied and justified with specific explanations. Blanket or vague exemptions are impermissible.

Countermeasure: A Vaughn index (Vaughn v. Rosen, 484 F.2d 820 (D.C. Cir. 1973)) is required to justify each withholding.
Required Action: Submit a Vaughn index detailing each exemption and its justification within 10 business days.

D. Decentralization and Referrals
Referrals or decentralization excuses do not absolve your agency of its responsibility to provide a consolidated response. As held in McGehee v. CIA, 697 F.2d 1095 (D.C. Cir. 1983), agencies must coordinate internally to ensure compliance.

Countermeasure: Require assurance of continuity and coordination across divisions.
Required Action: Consolidate records from all relevant offices and provide a unified response.

2. ADA and Rehabilitation Act Compliance: Equal Access as a Legal Right
As a person with a documented disability, I am entitled to reasonable accommodations under the ADA and Section 504 of the Rehabilitation Act. Your failure to provide accessible formats for requested records constitutes discrimination and violates federal law.

Case Law:
Tennessee v. Lane, 541 U.S. 509 (2004): Agencies must ensure meaningful access to government services.
Alexander v. Choate, 469 U.S. 287 (1985): Denial of reasonable accommodations creates barriers that violate civil rights.
Required Action:

Provide all requested records in accessible formats, including plain-language summaries or electronic files compatible with assistive technologies.
Confirm compliance with ADA requirements by [specific date].
3. Mandated Reporting and Whistleblower Protections
Your handling of this request implicates broader concerns, including potential fraud, misuse of federal funds, or retaliation against whistleblowers. Under the Whistleblower Protection Act (5 U.S.C. 2302), you are required to report and address systemic violations.

Countermeasure: Reference Misprision of Felony (18 U.S.C. 4), which requires the reporting of observed violations of law.
Required Action: Document and escalate evidence of misconduct to oversight bodies, including the Office of Inspector General (OIG).

4. Consequences of Non-Compliance
Failure to comply with your statutory obligations knowingly constitutes violations of:

Obstruction of Justice (18 U.S.C. 1505): Delaying lawful access to records obstructs public accountability.
Civil Rights Violations (42 U.S.C. 1983): Denying ADA accommodations constitutes a deprivation of federally protected rights.
Misprision of Felony (18 U.S.C. 4): Concealing or failing to report observed violations is a criminal act.
Countermeasure: Prepare for judicial review, oversight complaints, and public advocacy if compliance fails.
5. Escalation Pathways
If your office does not comply within the specified timeframe, I will escalate this matter through:

Judicial Review: Filing a lawsuit under 5 U.S.C. 552(a)(4)(B) to compel disclosure.
Oversight Complaints: Submitting formal complaints to OGIS, OIG, and the DOJ Civil Rights Division.
Public Advocacy: Engaging investigative journalists, transparency advocates, and public interest organizations to ensure accountability.

6. Final Statement: Upholding Transparency and Accountability
This matter reflects the publics right to transparency and the preservation of trust in government institutions. Your actions will either affirm your agencys commitment to accountability or further evidence systemic disregard for these principles.

Introduction
This appeal addresses deficiencies in the response to FOIA requests OPM ID #24-81 and #24-84 regarding the Connecticut Medicaid Acquired Brain Injury (ABI) Waiver Program. The documents provided fail to satisfy the scope of my request and do not comply with state and federal Freedom of Information Act (FOIA) obligations, as well as statutory ADA accommodation requirements.

Grounds for Appeal
1. Failure to Provide Complete Records
The records provided are insufficient and omit critical components of the request, including:

Consequences of Non-Compliance
Failure to resolve this matter will result in escalation through the following avenues:

Administrative Complaints: Filing with the Connecticut Freedom of Information Commission and the Department of Justice Civil Rights Division.
Judicial Remedies: Pursuing litigation to compel compliance with FOIA and ADA obligations.
Public Advocacy: Engaging transparency organizations and media outlets to highlight systemic non-compliance.
Conclusion
This appeal serves as an opportunity for OPM to correct these deficiencies and demonstrate a commitment to transparency, accountability, and accessibility. I expect a response within ten (10) business days outlining your corrective actions.

Request for Assistance Medicaid Oversight, ADA Compliance, Retaliation, and Civil Rights

Dear Senator Richard Blumenthal, Senator Chris Murphy, Governor Ned Lamont, and Attorney General William Tong,

I am reaching out to request your support in addressing urgent concerns related to Medicaid oversight, ADA compliance failures, whistleblower retaliation, and civil rights violations within the State of Connecticut. As leaders committed to justice and equity, your intervention is critical to ensuring transparency, accountability, and the protection of vulnerable individuals who rely on federally funded programs.

These systemic issues not only harm individuals but also undermine public trust in programs designed to serve our most vulnerable populations. I respectfully ask for your assistance in holding HHS, CMS, DOJ, FBI, DSS, CHRO, and other relevant agencies accountable for their responsibilities under federal and state law.

Your leadership and dedication to justice are invaluable in advancing these efforts. Please let me know how I can provide further information or collaborate to address these critical issues.

I am formally requesting your assistance to investigate systemic failures, misconduct, and potential criminal activity surrounding the handling of my submissions to the Office of Special Counsel (OSC). These failures directly impact whistleblower protections, Medicaid oversight, and public accountability.

Issues to Investigate

1. Case Numbers and Records Management

Case Numbers Requiring Investigation:

DI-25-000310

DI-25-000325

DI-25-000379

DI-12192024714

DI-12112024134

OSCFiling-MedeirosDavid-DI-11272024158

OSCFiling-MedeirosDavid-DI-11282024737

OSCFiling-MedeirosDavid-DI-12022024333

OSCFiling-MedeirosDavid-DI-12032024933

OSCFiling-MedeirosDavid-DI-12042024718

OSCFiling-MedeirosDavid-DI-12052024838

OSCFiling-MedeirosDavid-DI-12062024939

OSCFiling-MedeirosDavid-DI-12072024240

OSCFiling-MedeirosDavid-DI-12112024134

OSCFiling-MedeirosDavid-DI-12202024300

OSCFiling-MedeirosDavid-DI-112620241121

2. Anonymity and Lack of Accountability in Decision-Making

Unsigned Determination Letters:

Many determination letters from OSC lack identifiable signatures, names, or clear authorship.

This practice raises serious concerns about accountability and compliance with transparency laws.

3. Suppressed or Altered Records

Evidence suggests discrepancies between the whistleblower reports I submitted and how they were recorded or handled by OSC.

Specific issues include:

Alterations or removal of content from submitted complaints.

Suppression of reports that exposed systemic failures in Medicaid oversight and retaliation against whistleblowers.

4. Lack of FOIA Compliance

Despite repeated Freedom of Information Act (FOIA) requests, OSC and related agencies have failed to provide:

Complete case files and communication logs.

Justification for withheld or redacted information.

Clear timelines for compliance.

Specific Questions to Investigate

1. Who is Responsible for Managing These Records?

Identify the individuals, teams, or automated systems involved in creating, altering, and assigning these case numbers and reports.

2. What Decisions Were Made and Why?

Determine how decisions were reached, why some reports were closed without action, and why letters were sent anonymously.

3. Were There Violations of Federal Law?

Investigate potential obstruction of justice, retaliation, or misuse of authority under whistleblower protection laws and FOIA.

Key Agencies and Officials Involved

This matter spans multiple federal and state agencies, including:

 Office of Special Counsel (OSC)

 Department of Justice (DOJ)

Centers for Medicare & Medicaid Services (CMS)

Department of Health and Human Services (HHS)

 Office of Inspector General (OIG)

Why This Matters

1. Whistleblower Protections:

Retaliation against whistleblowers and suppression of reports undermine federal protections designed to safeguard transparency and accountability.

2. Impact on Vulnerable Populations:

These failures harm Medicaid consumers, particularly those with disabilities, by allowing systemic mismanagement to persist unchecked.

3. Misuse of Taxpayer Funds:

Lack of oversight and accountability results in waste and misuse of federal funds meant to serve the public.

Requested Actions

1. Investigate Record Management:

Audit all OSC records, emails, and internal communications related to these case numbers.

Identify responsible individuals or systems.

2. Subpoena Additional Evidence:

Secure all suppressed or altered reports to ensure a complete and accurate investigation.

3. Hold Accountable Those Involved in Misconduct:

Recommend prosecution or disciplinary action for any individuals found to have violated federal laws.

4. Ensure Compliance with FOIA and Whistleblower Protections:

Mandate OSC and related agencies to comply fully with FOIA requests and whistleblower laws.

Attachments

I have attached all available documentation, including:

Correspondence with OSC, including determination letters and emails.

FOIA requests and responses (or lack thereof).

Detailed reports submitted to OSC and other federal agencies.

This issue demands immediate attention to uphold the principles of transparency, accountability, and justice. I am available to provide additional information or documentation as needed.

Sincerely,
David Medeiros

I look forward to your prompt and substantive response.

The challenges we face today demand more than acknowledgmentthey require action, collaboration, and a unified commitment to solutions. Together, we must embrace transparency, accountability, and compassion as the
foundation of our efforts. By fostering open communication, prioritizing the needs of the most vulnerable, and holding systems accountable, we can rebuild trust and ensure equitable outcomes for all.

Solutions lie in unitywhen state and federal leaders, advocates, and communities work hand in hand to uphold justice and fairness. Transparency through accessible Freedom of Information processes, adherence to legal
mandates, and robust oversight are the pillars that support meaningful change. Each of us has a role to play in creating a system that serves and protects.

Our collective mission is clear: to build bridges between agencies and communities, ensure the dignity of every individual, and honor the principles that guide us toward progress. Together, with determination and unity, we can
overcome systemic failures and pave the way for a brighter, more inclusive future.

Americans living with disabilities and their families are Americansfull citizens of this nation, protected by the same Constitution that guarantees the rights and freedoms of every individual. We are not separate, lesser, or forgotten. We are Americans with the same unalienable rights to life, liberty, and the pursuit of happiness.

We stand firmly on the principles of equality, dignity, and justice. Our voices matter. Our contributions matter. And our rightsour Constitutional rightsmust be respected, upheld, and protected without exception or delay.
