Overview
This document is an escalated complaint and formal appeal regarding the mishandling of my Freedom of Information Act (FOIA) request (Tracking Number EMRUFOIA122624) and associated violations of federal law, including constitutional rights, whistleblower protections, taxpayer rights, and the Americans with Disabilities Act (ADA).

Key Legal Grounds with Case Law References
Constitutional Protections:
First Amendment: Denial or delay in providing requested records obstructs my right to petition the government.

Sherrill v. Knight, 569 F.2d 124 (D.C. Cir. 1977): Recognizes access to records as vital for public accountability.
Richmond Newspapers, Inc. v. Virginia, 448 U.S. 555 (1980): Affirms access to government information as essential for informed public discourse.
Butterworth v. Smith, 494 U.S. 624 (1990): Protects the right to share information about public matters.
Fifth and Fourteenth Amendments: The absence of a substantive response infringes procedural due process rights.

Mathews v. Eldridge, 424 U.S. 319 (1976): Highlights the necessity of due process in administrative procedures.
Goldberg v. Kelly, 397 U.S. 254 (1970): Ensures fair access to governmental processes affecting public benefits.
Village of Willowbrook v. Olech, 528 U.S. 562 (2000): Protects against unequal government treatment.
Whistleblower Protections:
The Whistleblower Protection Act (5 U.S.C. 1213) ensures transparency and prohibits retaliation against whistleblowers.
Lane v. Franks, 573 U.S. 228 (2014): Protects disclosures exposing governmental misconduct.
Wilburn v. Robinson, 480 F.3d 1140 (D.C. Cir. 2007): Reinforces protections for whistleblowers who highlight systemic failures.
Bark v. U.S. Forest Serv., 37 F. Supp. 3d 41 (D.D.C. 2014): Ensures whistleblower-related information is not improperly withheld.
Taxpayer Rights:
Transparency in taxpayer-funded programs is a constitutional and fiduciary obligation under state and federal law.
Citizens for Responsibility and Ethics in Washington v. DOJ, 846 F.3d 1235 (D.C. Cir. 2017): Mandates compliance with FOIA to ensure public accountability.
Tax Analysts v. IRS, 294 F.3d 71 (D.C. Cir. 2002): Requires disclosure of records related to taxpayer-funded operations.
U.S. v. Mississippi, 380 U.S. 128 (1965): Confirms federal oversight in state use of public funds.
Americans with Disabilities Act (ADA) and Rehabilitation Act:
Title II of the ADA (42 U.S.C. 12132) mandates accessible communication for individuals with disabilities.
Olmstead v. L.C., 527 U.S. 581 (1999): Requires public programs to provide accommodations for individuals with disabilities.
Alexander v. Choate, 469 U.S. 287 (1985): Prohibits systemic barriers that deny access to programs.
Tennessee v. Lane, 541 U.S. 509 (2004): Affirms that failure to provide accessibility is a violation of federal law.
Violations and Issues
Failure to Identify Responsible Individuals:
FOIA regulations (5 U.S.C. 552(a)(6)(A)) and ADA standards require identification of personnel handling requests. The absence of names, titles, and contact information obstructs accountability and transparency.

Failure to Meet ADA Accommodation Requests:
I explicitly requested accessible formats and MUCKROCK Platform-only communication, as guaranteed under the ADA. Providing inaccessible methods violates 42 U.S.C. 12132 and 28 C.F.R. 35.160.

Improper Referrals and Delays:
The referral of my FOIA request to other agencies without substantive action violates the DOJ's obligation under 5 U.S.C. 552(a)(3) to conduct reasonable searches for responsive records.

Inadequate Response and Procedural Non-Compliance:
The lack of a Vaughn Index or clear justification for delays or redactions contravenes FOIA's requirements for transparency and procedural fairness.

Demands for Immediate Resolution
Identification of Responsible Individuals:
Provide the full name, title, and direct contact information of all personnel handling this FOIA request, as required by FOIA and ADA laws.

Immediate ADA Compliance:
All records must be delivered in screen-reader-compatible PDFs via the MUCKROCK platform. Include plain-language summaries for complex documents.

Complete and Transparent FOIA Response:

Conduct a thorough search for all requested records.
Provide a Vaughn Index if any records are withheld.
Explain the scope, methodology, and databases used in the search.
Expedited Processing:
Due to significant public interest and urgent advocacy needs, I demand expedited processing as per 5 U.S.C. 552(a)(6)(E).

Fee Waiver:
Approve a fee waiver under 5 U.S.C. 552(a)(4)(A)(iii), as this request serves the public interest.

Escalation Path
Failure to address this complaint will result in:

Administrative Appeals: Submitting appeals to the DOJ's OIP and OGIS.
Formal ADA Complaints: Filing complaints with the DOJ Civil Rights Division for failure to meet accessibility standards.
Judicial Remedies: Pursuing injunctive relief and attorneys fees under:
FOIA (5 U.S.C. 552(a)(4)(B), (E)).
ADA (42 U.S.C. 12188).
Congressional and Media Escalation: Reporting systemic failures to oversight committees and public media outlets.
Anticipated Response
Please confirm receipt of this complaint within two (2) business days and provide a timeline for compliance by January 10, 2025. Non-compliance will trigger immediate escalation.

Sincerely,
David Medeiros

On January 2, 2025, David Medeiros submitted a formal complaint to the U.S. Department of Justice (DOJ) regarding the mishandling of FOIA request EMRUFOIA122624. The complaint highlights violations of FOIA, ADA, whistleblower protections, and constitutional rights. The DOJ failed to meet FOIA deadlines, provide requested records, or justify redactions with a Vaughn Index, obstructing transparency and accountability. Additionally, the DOJ ignored ADA accommodation requests for screen-reader-compatible formats and plain-language summaries, violating ADA Title II obligations. The complaint also notes the lack of disclosure of whistleblower-related records, which undermines protections against retaliation and discourages reporting of government misconduct. Furthermore, the failure to release Medicaid oversight audits, particularly concerning the ABI Waiver Program, raises concerns about taxpayer fund misuse and systemic mismanagement.

Medeiros demands immediate corrective actions, including full disclosure of records, ADA-compliant formats, identification of personnel responsible for handling the request, and expedited processing. He warns that failure to comply by January 10, 2025, will result in administrative appeals, ADA complaints, legal action, and public advocacy through Congressional oversight and media outlets. This appeal seeks to ensure compliance with federal laws and restore accountability and transparency in public governance.

Formal Escalated Complaint and Appeal Regarding FOIA Non-Compliance, ADA Violations, and Constitutional Breaches
Date: January 2, 2025
From: David Medeiros
To: FOIA/PA Mail Referral Unit, U.S. Department of Justice
Subject: Escalated Complaint for FOIA Request EMRUFOIA122624

Introduction and Context
This document constitutes a formal complaint and appeal concerning the Department of Justice's mishandling of my FOIA request, tracking number EMRUFOIA122624. The issues involve significant violations of federal law, including but not limited to the following:

Constitutional Rights Violations
Failure to Protect Whistleblower Rights
Neglect of Taxpayer Accountability Obligations
Americans with Disabilities Act (ADA) Non-Compliance
I assert that the mishandling of my request constitutes systemic disregard for established legal requirements and obstructs accountability and transparency.

1. Constitutional Violations
First Amendment
The First Amendment guarantees the right to petition the government for redress of grievances. Denial or unreasonable delay in access to government records impedes this right.
Case Law:
Sherrill v. Knight, 569 F.2d 124 (D.C. Cir. 1977): Recognized access to records as critical for public accountability.
Richmond Newspapers, Inc. v. Virginia, 448 U.S. 555 (1980): Affirmed that public access to government information underpins democratic governance.
Fifth and Fourteenth Amendments
The denial or delay in FOIA compliance undermines procedural due process rights protected by these amendments.
Case Law:
Mathews v. Eldridge, 424 U.S. 319 (1976): Highlighted the importance of procedural fairness in administrative actions.
Goldberg v. Kelly, 397 U.S. 254 (1970): Reinforced the necessity of timely access to governmental procedures that impact public rights.
Demand:
Immediate substantive response to FOIA Request EMRUFOIA122624.
Clear identification of responsible officials managing this request.
2. Whistleblower Protection Act Violations
The Whistleblower Protection Act (5 U.S.C. 1213) prohibits retaliation and mandates transparent investigation of whistleblower disclosures. Mishandling whistleblower-related FOIA requests undermines public trust and discourages future disclosures.

Case Law:
Lane v. Franks, 573 U.S. 228 (2014): Protects whistleblowers exposing government misconduct.
Wilburn v. Robinson, 480 F.3d 1140 (D.C. Cir. 2007): Reinforces that transparency safeguards whistleblower protections.
Specific Failures Identified
Lack of disclosure of records pertaining to OSC cases DI-25-000310, DI-25-000325, DI-25-000379, DI-12192024714, and DI-12112024134.
Absence of substantive updates regarding interagency whistleblower-related correspondence.
Demand:
Immediate release of all whistleblower-related records, including interagency correspondence, investigative findings, and compliance audits.
3. Taxpayer Accountability and Transparency
Federal and state taxpayer-funded programs, including Medicaid, require transparent oversight to prevent misuse and ensure ethical allocation of resources. FOIA ensures public accountability for these expenditures.

Case Law:
Citizens for Responsibility and Ethics in Washington v. DOJ, 846 F.3d 1235 (D.C. Cir. 2017): Mandates that FOIA serve as a tool for ensuring governmental accountability.
U.S. v. Mississippi, 380 U.S. 128 (1965): Confirms federal oversight in state-administered programs funded by federal taxpayers.
Specific Failures Identified
DOJ and HHS failure to produce records of Medicaid Acquired Brain Injury (ABI) Waiver Program audits and oversight.
Lack of accountability documentation for whistleblower-reported Medicaid fraud and misuse of funds.
Demand:
Full disclosure of CMS and Medicaid program audit reports, including whistleblower-reported fraud investigations.
4. ADA Non-Compliance
Title II of the ADA (42 U.S.C. 12132) mandates public entities to ensure accessible communication for individuals with disabilities. The failure to provide requested records in ADA-compliant formats, as explicitly outlined in my FOIA request, violates federal law.

Case Law:
Olmstead v. L.C., 527 U.S. 581 (1999): Public programs must provide accommodations ensuring accessibility.
Tennessee v. Lane, 541 U.S. 509 (2004): Reinforces the requirement for equal access under the ADA.
Specific Failures Identified
DOJs failure to confirm and adhere to my ADA accommodation requests.
Lack of screen-reader-compatible documents and plain-language summaries.
Demand:
Delivery of all requested documents in screen-reader-compatible formats.
Inclusion of plain-language summaries for complex records.
5. FOIA Procedural Non-Compliance
FOIA mandates prompt and complete responses unless statutory exemptions apply, accompanied by a Vaughn Index for redactions. DOJ has failed to:

Provide a substantive response to the FOIA request.
Issue a Vaughn Index or legal justification for withheld information.
Adhere to statutory deadlines.
Case Law:
Judicial Watch, Inc. v. U.S. DOJ, 365 F.3d 1108 (D.C. Cir. 2004): Agencies must clearly justify FOIA exemptions.
Open America v. Watergate Special Prosecution Force, 547 F.2d 605 (D.C. Cir. 1976): Agencies must prioritize urgent requests and avoid unnecessary delays.
Demand:
Immediate compliance with FOIA deadlines and full disclosure of responsive records.
Vaughn Index for any withheld or redacted information.
Demands for Immediate Resolution
Identification of Responsible Personnel:

Provide full names, titles, and contact details of all personnel handling FOIA Request EMRUFOIA122624.
ADA-Compliant Delivery:

Ensure all records are delivered in accessible formats with plain-language summaries.
Transparent FOIA Response:

Conduct a thorough search for all responsive records.
Include a detailed Vaughn Index for any exemptions claimed.
Expedited Processing:

Expedite processing as per 5 U.S.C. 552(a)(6)(E), due to significant public interest.
Fee Waiver:

Approve the fee waiver request, as the request serves the public interest.
Escalation Path for Non-Compliance
Failure to address this complaint by January 10, 2025, will result in the following:

Administrative Appeals: Escalation to the DOJs Office of Information Policy (OIP) and the Office of Government Information Services (OGIS).
ADA Complaints: Filing complaints with the DOJ Civil Rights Division for non-compliance with ADA requirements.
Judicial Remedies: Initiating litigation under:
FOIA (5 U.S.C. 552(a)(4)(B), (E))
ADA (42 U.S.C. 12188)
Congressional Oversight: Reporting non-compliance to Congressional oversight committees.
Public Reporting: Informing media and public interest organizations of systemic failures.
Acknowledgment and Timeline
Please confirm receipt of this complaint within two (2) business days and provide a timeline for compliance. Failure to meet the January 10, 2025, deadline will trigger immediate escalation.

Sincerely,
David Medeiros
Founder, ABI Resources
