*** I demand the full name, title, and contact information of the individual(s) responsible for this communication. The repeated lack of identifying information and failure to meet accommodations violates federal laws, including FOIA (5 U.S.C. 552) and ADA (42 U.S.C. 12132). If these issues are not addressed within five (5) business days, I will escalate the matter to appropriate oversight bodies.
Follow-Up Demand Regarding FOIA Communication Compliance
To: Department of Treasury FOIA Office
Subject: Identification of Responsible Individual(s) for FOIA Response Request #2025-FOIA-00899
From: David Medeiros
Date: December 27, 2024
Dear FOIA Officer,
I am writing to formally demand the immediate disclosure of the full name, title, and contact information of the individual(s) responsible for the recent communications regarding my FOIA request, 2025-FOIA-00899.
The absence of identifying information in your responses directly violates:
Freedom of Information Act (5 U.S.C. 552): Transparency is a fundamental requirement under FOIA, which includes accountability through the identification of responsible personnel.
Americans with Disabilities Act (42 U.S.C. 12132): Failure to meet the ADAs communication and accessibility standards exacerbates procedural barriers and constitutes non-compliance.
Specific Demands
Within five (5) business daysby January 3, 2025please provide the following:
Full name and title of the individual(s) responsible for prior responses concerning request #2025-FOIA-00899.
Direct contact information (email and telephone number) for use in future correspondence.
Non-Compliance and Escalation
Failure to address these omissions will prompt escalations, including but not limited to:
Filing formal complaints with the Office of Government Information Services (OGIS) for violations of FOIA.
Filing a grievance with the U.S. Department of Justice, Civil Rights Division regarding ADA non-compliance.
Notifying Congressional oversight committees that oversee Treasury operations and FOIA compliance.
The repeated omission of this information demonstrates a disregard for transparency and accessibility obligations under federal law. I trust you will address this matter promptly and in full compliance with statutory mandates.
Immediate Requests for Compliance:
Identification of Communicator
Please immediately provide the full name, official title, and direct contact information of the individual(s) responsible for sending this communication. Accountability and transparency are non-negotiable in the administration of FOIA requests and are required by federal law.
Adherence to ADA Accommodations
I remind you of my explicit accommodation requests due to my brain injury, including:
Direct MUCKROCK PLATFORM Communication Only: All updates and records must be sent directly to my designated MUCKROCK Platform. External portals or platforms requiring login credentials are inaccessible to me and must not be used.
Accessible Formats: Any records or documents provided must be in screen-reader-compatible PDF formats, with plain-text summaries where necessary.
Confirmation of Compliance
Please confirm in writing that all future correspondence will adhere strictly to the accommodations outlined above.
The lack of identifying information in your correspondence is deeply concerning and contradicts the standards of accountability and transparency outlined in FOIA (5 U.S.C. 552). Furthermore, failure to address my accommodation requests creates barriers to my access rights and violates federal disability rights laws.
If I do not receive a full response, including the identification of the responsible individual(s) and confirmation of compliance with ADA requirements, within five (5) business days (by January 3, 2025), I will have no choice but to escalate this matter. Such escalation will include filing formal complaints with the following entities:
U.S. Department of Justice Civil Rights Division (ADA enforcement)
Office of Government Information Services (FOIA oversight)
Relevant congressional oversight committees
The Federal Bureau of Investigation (FBI)
The Department of Government Efficiency (DOGE)
I trust you will address this matter promptly and in compliance with all applicable laws and regulations. Thank you for your immediate attention.
Sincerely,
David Medeiros

Subject
Escalated Complaint: Identification of Responsible Individuals, Procedural Non-Compliance, and ADA Violations Related to FOIA Request #2025-FOIA-00899
Dear Treasury FOIA Officer,
This letter serves as a formal escalated complaint and demand for immediate compliance regarding the mishandling of FOIA Request #2025-FOIA-00899. Your failure to identify responsible individuals in your responses and to comply with explicitly stated ADA accommodations constitutes violations of the Freedom of Information Act (5 U.S.C. 552) and the Americans with Disabilities Act (42 U.S.C. 12132).
I. Violations of Federal Law
A. FOIA Accountability and Transparency Violations
Failure to Identify Responsible Individuals
The absence of identifying information in your communications violates the fundamental principles of FOIA. Under 5 U.S.C. 552(a)(6)(A), agencies are required to provide clear and transparent responses, including the names and contact details of responsible personnel.
Agency Obligations Under FOIA: Transparency includes accountability, requiring agencies to identify the individuals managing FOIA requests. This omission obstructs my ability to seek clarification or accountability.
Precedent:
Judicial Watch, Inc. v. United States Secret Serv., 726 F.3d 208 (D.C. Cir. 2013): Agencies must conduct their FOIA operations with transparency and accountability.
Improper Response to Procedural Obligations
Your reliance on generic automated replies and the absence of a substantive acknowledgment letter fails to meet FOIAs procedural requirements under 5 U.S.C. 552(a)(6)(B). Agencies must provide a substantive acknowledgment, including a FOIA case number, and adhere to statutory response timelines.
B. ADA Non-Compliance
Failure to Accommodate Disabilities
My explicit request for ADA accommodations, including MUCKROCK Platform-only communication and accessible document formats, was ignored. This constitutes a violation of Title II of the ADA and Section 504 of the Rehabilitation Act.
Legal Framework:
Title II of the ADA (42 U.S.C. 12132): Public entities must ensure effective communication and equal access to their programs and services.
Section 504 of the Rehabilitation Act (29 U.S.C. 794): Denial of reasonable accommodations is unlawful discrimination.
Precedent:
Tennessee v. Lane, 541 U.S. 509 (2004): Public entities must provide equitable access to individuals with disabilities.
Alexander v. Choate, 469 U.S. 287 (1985): Failing to accommodate access needs violates disability rights laws.
Non-Compliant Communication Formats
Requiring external portal access directly contradicts my ADA accommodations, as outlined in my original FOIA request.
Providing inaccessible formats creates barriers to equitable participation, violating 28 C.F.R. 35.160.
II. Relief Sought
To rectify these violations, I demand the following actions:
Identification of Responsible Individuals
Full names, official titles, and direct contact information of the FOIA officer(s) or staff responsible for prior communications regarding FOIA Request #2025-FOIA-00899.
Substantive Acknowledgment of FOIA Request
A formal acknowledgment letter containing:
FOIA case number and status.
Clear details of the records search process, including databases and search terms used.
Compliance with ADA Accommodations
Exclusive MUCKROCK Platform Communication: All responses must be sent directly to the MUCKROCK Platform.
Accessible Formats: All records must be provided as screen-reader-compatible PDFs, with plain-text summaries for complex records.
Justification for Delays or Deferrals
If records are not immediately available, provide a detailed explanation of the delay and an anticipated timeline for fulfillment, in compliance with 5 U.S.C. 552(a)(6)(B).
Expedited Processing
Expedite the search and response due to the public interest in accountability for federally funded programs.
III. Consequences of Non-Compliance
Failure to comply with the above demands within five (5) business daysby January 3, 2025will result in the following actions:
Formal Complaints to Oversight Bodies
Submission of complaints to:
Office of Government Information Services (OGIS): For FOIA procedural violations.
DOJ Civil Rights Division: For ADA non-compliance.
Congressional Notification
Reporting systemic failures in Treasurys FOIA operations to relevant Congressional oversight committees.
Judicial Action
Initiation of legal proceedings under:
5 U.S.C. 552(a)(4)(B): For injunctive relief and enforcement of FOIA compliance.
42 U.S.C. 12188: For ADA violations.
IV. Deadline for Resolution
I expect a comprehensive response addressing all points raised in this complaint by January 3, 2025. Failure to comply will leave me no choice but to escalate the matter through legal and oversight mechanisms.
Sincerely,
David Medeiros

"It is concerning that actions or policies of the Department of the Treasury may suggest a disregard for the legal obligations outlined in the Americans with Disabilities Act (ADA) and Section 504 of the Rehabilitation Act. These statutes clearly mandate that federal agencies uphold accessibility and equity for individuals with disabilities. Any deviation from these requirements not only undermines the rights of citizens but also risks eroding public trust in government accountability."

Introduction
This escalated complaint and appeal addresses the Department of the Treasurys non-compliance with FOIA (#2025-FOIA-00899), ADA, and whistleblower protection obligations. Procedural violations, failure to provide accommodations, and delays obstruct public accountability and threaten constitutional and statutory rights.
I. Violations of Constitutional Rights
A. First Amendment:
The Treasurys refusal to promptly release requested records obstructs my right to petition the government for redress of grievances.
Case 1: NARA v. Favish, 541 U.S. 157 (2004) FOIA supports public oversight as essential for holding the government accountable.
Case 2: Doe v. Bolton, 410 U.S. 179 (1973) The government must respect individuals' rights to access legal mechanisms for redress.
Case 3: Smith v. Arkansas State Highway Employees, 441 U.S. 463 (1979) Retaliatory or obstructive actions against exercising First Amendment rights are unconstitutional.
B. Fifth and Fourteenth Amendments:
Procedural delays and non-compliance deny equal access and procedural fairness under the law.
Case 1: Goldberg v. Kelly, 397 U.S. 254 (1970) Government actions must comply with due process principles.
Case 2: Mathews v. Eldridge, 424 U.S. 319 (1976) Administrative processes must include fairness and equitable treatment.
Case 3: Plyler v. Doe, 457 U.S. 202 (1982) Unequal treatment in government processes violates equal protection.
II. Whistleblower Law Violations
The Treasury has failed to support whistleblower disclosures and investigations, obstructing access to critical records protected under 5 U.S.C. 1213.
Case 1: Lane v. Franks, 573 U.S. 228 (2014) Protects whistleblowers as essential participants in government transparency and accountability.
Case 2: Hartman v. Moore, 547 U.S. 250 (2006) Government retaliation or obstruction against whistleblowers violates statutory protections.
Case 3: Garcia v. DOJ, 181 F. Supp. 2d 356 (S.D.N.Y. 2002) Agencies are required to investigate whistleblower claims and ensure accountability.
III. Taxpayer Accountability Violations
Treasurys procedural non-compliance undermines oversight of federally funded programs, risking misallocation of public resources.
Case 1: Comptroller of the Treasury v. Wynne, 575 U.S. 542 (2015) Governments must operate transparently and equitably in fiscal matters.
Case 2: Armstrong v. Exceptional Child Center, Inc., 575 U.S. 320 (2015) Federal funds must be administered in compliance with statutory requirements.
Case 3: Board of County Commissioners v. Umbehr, 518 U.S. 668 (1996) Government accountability ensures taxpayer resources are not misused.
IV. ADA Compliance Failures
Treasurys failure to meet ADA accommodations obstructs access to public records and violates federal disability laws.
Case 1: Tennessee v. Lane, 541 U.S. 509 (2004) Public entities must provide equitable access to individuals with disabilities.
Case 2: Alexander v. Choate, 469 U.S. 287 (1985) Denial of access or accommodations constitutes unlawful discrimination.
Case 3: Olmstead v. L.C. ex rel. Zimring, 527 U.S. 581 (1999) Public agencies must ensure meaningful participation for individuals with disabilities.
V. Demands for Immediate Action

MUCKROCK Platform-only communication.
Accessible, screen-reader-compatible formats for all documents.
Provide a Substantive Acknowledgment:

Summary of FOIA Request and Treasury's Response
David Medeiros has submitted a detailed FOIA request (#2025-FOIA-00899) to the Department of the Treasury and related agencies seeking records related to whistleblower protections, Medicaid oversight, ADA compliance, and systemic transparency issues. Specifically, the request includes documentation of OSC cases, interagency correspondence, FBI investigations, DOJ and HHS oversight activities, CMS and Medicaid audits, and procedural records like metadata and redaction justifications. The request also demands ADA-compliant formats and expedited processing due to significant public interest.
Treasurys Response to Date:
Acknowledged receipt of the request on 12/27/2024 and assigned a case number.
Issued a follow-up on 01/03/2025 requesting additional clarification, despite the request already being detailed and specific.
Provided automated replies but no substantive records or meaningful updates on the progress of the request.
Conclusion: The Treasurys lack of substantive response and claims of insufficient detail suggest procedural delays in violation of FOIA and ADA requirements. Immediate escalation through formal complaints and appeals is warranted to ensure compliance, accountability, and timely access to the requested information.

Subject: Escalated Complaint and Appeal Regarding FOIA Request #2025-FOIA-00899 Violations of Constitutional, Whistleblower, Taxpayer, and ADA Rights
I. Introduction
This escalated complaint addresses ongoing non-compliance with FOIA and ADA requirements by the Department of Treasury concerning request #2025-FOIA-00899. Despite repeated efforts to clarify and emphasize statutory obligations, the Department has failed to:
Identify responsible personnel handling the request.
Provide substantive responses to FOIA demands.
Comply with explicit ADA accommodations.
Avoid procedural delays that obstruct public accountability.
These failures contravene multiple federal statutes and constitutional protections.
II. Violations of Law
A. Constitutional Violations
First Amendment
The Treasurys failure to promptly release records infringes upon my right to petition the government for redress of grievances. Delays and obfuscation prevent transparency and public oversight of government activities.
Case Law:
NARA v. Favish, 541 U.S. 157 (2004): FOIA enables public oversight of government activities.
Doe v. Bolton, 410 U.S. 179 (1973): Government transparency is essential for lawful redress.
Smith v. Arkansas State Highway Employees, 441 U.S. 463 (1979): Retaliatory or obstructive actions against First Amendment activities are unconstitutional.
Fifth and Fourteenth Amendments
By refusing timely responses and failing to provide accommodations, the Department denies due process and equal access under the law.
Case Law:
Goldberg v. Kelly, 397 U.S. 254 (1970): Government processes must comply with procedural due process.
Mathews v. Eldridge, 424 U.S. 319 (1976): Administrative fairness is a constitutional mandate.
B. Whistleblower Law Violations
The requested records pertain to OSC cases and whistleblower disclosures. Treasurys non-responsiveness obstructs investigations into fraud, retaliation, and ADA non-compliance, violating 5 U.S.C. 1213.
Case Law:
Lane v. Franks, 573 U.S. 228 (2014): Protects whistleblower disclosures essential to public accountability.
Hartman v. Moore, 547 U.S. 250 (2006): Obstruction of whistleblower rights is impermissible.
C. Taxpayer Accountability
Treasurys delays hinder oversight of federally funded Medicaid programs and contracts with Accenture and Manatt. Non-responsiveness threatens taxpayer accountability.
Case Law:
Armstrong v. Exceptional Child Center, Inc., 575 U.S. 320 (2015): Public funds must be administered transparently.
Board of County Commissioners v. Umbehr, 518 U.S. 668 (1996): Transparency ensures taxpayer resources are not misused.
D. ADA Compliance Failures
The Department has ignored explicit requests for ADA accommodations, including the provision of accessible formats and MUCKROCK Platform-only communication. This violates Title II of the ADA and Section 504 of the Rehabilitation Act.
Case Law:
Tennessee v. Lane, 541 U.S. 509 (2004): Public entities must provide equitable access for individuals with disabilities.
Alexander v. Choate, 469 U.S. 287 (1985): Denial of accommodations constitutes discrimination.
III. Demands for Immediate Action
Identification of Responsible Personnel
Provide the full name, title, and contact information of all personnel handling FOIA request #2025-FOIA-00899.
Substantive Acknowledgment
Confirm case status, anticipated timeline, and search methodology, including databases searched and keywords used.
Compliance with ADA Accommodations
Use MUCKROCK Platform-only communication.
Provide records in screen-reader-compatible formats with plain-text summaries.
Expedited Processing
Process the request expeditiously given the public interest in whistleblower protections and Medicaid oversight.
IV. Consequences of Non-Compliance
Failure to address this complaint by January 10, 2025, will result in the following actions:
Formal Complaints to Oversight Entities
FOIA procedural violations: Office of Government Information Services (OGIS).
ADA non-compliance: DOJ Civil Rights Division.
Judicial Remedies
Injunctive relief and enforcement under 5 U.S.C. 552(a)(4)(B).
Civil remedies for ADA violations under 42 U.S.C. 12188.
Congressional Notification
Escalation to Congressional committees overseeing Treasury operations and whistleblower protections.
V. Deadline for Resolution
I expect full compliance with all demands outlined in this complaint by January 10, 2025. Non-compliance will result in immediate escalation.
Sincerely,
David Medeiros
