Appeal Submission Overview
This appeal is submitted to address significant deficiencies in the DOJ's response to FOIA Request FOIA-2025-01052 and related requests. The response fails to meet the legal standards established under the Freedom of Information Act (5 U.S.C. 552) and the Americans with Disabilities Act (ADA, Title II). These deficiencies undermine public trust, hinder oversight, and fail to address systemic issues of national significance.

Grounds for Appeal
Inadequate Search Scope

The response indicates that the records sought are not typically maintained by the DOJ Office of Information Policy (OIP). However, it does not confirm that a search was conducted within the Civil Rights Division, relevant sub-agencies, or other DOJ offices likely to hold responsive records.
Requested Action: Conduct a comprehensive search of the Civil Rights Division and all DOJ sub-agencies, including correspondence, internal memoranda, and inter-agency communications.
Failure to Address ADA Accommodations

The DOJ failed to honor ADA accommodations explicitly requested in the original submission, including:
Delivering responses via the MuckRock platform.
Providing screen-reader compatible PDFs.
Including simplified summaries for technical records.
Identifying all personnel responsible for processing the request.
Legal Basis: Title II of the ADA (42 U.S.C. 12132) and Section 504 of the Rehabilitation Act mandate reasonable accommodations to ensure equitable access for individuals with disabilities.
Requested Action: Immediately apply all non-negotiable ADA accommodations to this appeal and future responses.
Non-Compliance with FOIA Standards

The DOJ's response fails to include a Vaughn index or equivalent documentation justifying the denial or withholding of records, as required by FOIA.
Legal Basis: FOIA (5 U.S.C. 552(b)) mandates detailed explanations for redactions or denials, citing specific statutory exemptions.
Requested Action: Provide a Vaughn index detailing withheld records and legal justifications for each redaction or denial.
Referral Obligations

The response does not confirm whether the request was referred to other DOJ components or federal agencies, such as the Centers for Medicare & Medicaid Services (CMS) or the Department of Health and Human Services (HHS).
Requested Action: Refer this FOIA request to all relevant agencies and confirm the referral process in writing.
Public Interest Impact

The requested records pertain to issues of urgent public interest, including:
ADA enforcement in Medicaid programs.
Whistleblower protections for reporting systemic non-compliance.
Oversight of taxpayer funds used in Medicaid programs.
Legal Basis: Expedited processing is warranted under FOIA (5 U.S.C. 552(a)(6)(E)) due to the significant public interest involved.
Relief Requested
Comprehensive Search and Disclosure:

Conduct a thorough search of all DOJ offices, including the Civil Rights Division, for responsive records.
Ensure all responsive records are disclosed promptly, with statutory justifications for any redactions or exclusions.
ADA Compliance:

Fulfill all requested ADA accommodations, including exclusive communication via MuckRock, accessible document formatting, and detailed summaries.
Vaughn Index:

Provide a detailed index of withheld records, including statutory exemptions cited.
Referral Confirmation:

Confirm and document referrals to other DOJ components or federal agencies holding relevant records.
Expedited Processing:

Grant expedited processing to address the urgent public interest involved in this request.
Certification of Completeness:

Certify that all relevant records have been searched, reviewed, and disclosed unless legally exempt.
Escalation and Oversight
This appeal will be escalated to oversight bodies, including:

Office of Government Information Services (OGIS):
Request mediation to address non-compliance and accessibility issues.
Contact: ogis@nara.gov
Congressional Oversight Committees:
Notify relevant committees of systemic FOIA non-compliance and accessibility violations.
Media and Advocacy Organizations:
Engage public advocacy to amplify the systemic issues raised by this request.
Conclusion
This appeal demands immediate corrective action to ensure compliance with FOIA, ADA, and constitutional obligations. Failure to address these issues will result in further escalation, including formal complaints to the Office of the Inspector General, judicial remedies, and public advocacy initiatives.

Thank you for your prompt attention to this matter. I look forward to your response within 20 business days, as required by law.

Escalated Legal Complaint and Appeal
What David Medeiros and ABI Resources Are Doing, Why It Matters, and Whats at Stake
David Medeiros, the founder of ABI Resources, is working to uncover and address serious issues in government programs that affect everyday people, especially those with disabilities. Here's a simple explanation of whats happening:

What Is David Doing?
David submitted official requests under a law called the Freedom of Information Act (FOIA). This law allows anyone to ask the government for records to understand how decisions are made and if laws are being followed. Hes focused on three major areas:

Medicaid Programs: Looking into how funds are being used, especially in a program that helps people with brain injuries. He wants to ensure the money is used correctly and not wasted or mismanaged.
Disability Rights (ADA): Checking whether the government is following rules that make information and services accessible to people with disabilities, like himself.
Whistleblower Protections: Making sure people who report fraud or wrongdoing in government programs are protected from retaliation.
What Is He Asking For?
David wants:

Records and Emails: To see how government agencies are handling complaints, especially those involving Medicaid and disability rights.
Clear and Accessible Responses: Hes asking the government to provide the information in a way thats easy to read and accessible for people with disabilities.
Accountability: He wants to know whos responsible for handling these issues and whether theyre doing their job correctly.

What Hasnt Been Provided?
The government hasnt fully responded to Davids requests. Theyve delayed, denied access to certain records, and havent provided information in accessible formats. This violates federal laws, including the Americans with Disabilities Act (ADA) and the Freedom of Information Act (FOIA).

Why Does This Matter?
Fair Use of Taxpayer Money:
Programs like Medicaid use taxpayer dollars to help vulnerable people. If theres fraud, waste, or mismanagement, it affects everyone.

Protecting Rights:
People with disabilities, like David, have the right to access government information and services. Ignoring these rights is discriminatory and illegal.

Whistleblower Protection:
Whistleblowers are critical for exposing problems in government programs. If theyre not protected, corruption and mismanagement can continue unchecked.

Whats David Advocating For?
David is advocating for transparency, fairness, and accountability. He believes the government should:

Be open about how taxpayer money is used.
Follow laws that protect people with disabilities.
Support whistleblowers who expose problems.

Why Should You Care?
This isnt just about David or ABI Resourcesits about all of us. Ensuring government programs work properly and fairly protects everyone. It ensures that:

Tax dollars are spent responsibly.
Vulnerable people get the help they need.
Everyone, regardless of ability, is treated equally under the law.

The Big Picture
David is standing up to hold the government accountable, not just for himself, but for millions of others who rely on programs like Medicaid. His work highlights the importance of transparency, fairness, and justice in a system that serves us all.

Relevant Law: 31 U.S.C. 3729-3733 (False Claims Act).

Public Interest
Denial of access to critical Medicaid records undermines efforts to combat systemic fraud and protect taxpayer investments.

IV. ADA Rights and Civil Rights
Non-Compliance with ADA
DOJ failed to provide reasonable accommodations in responding to my FOIA requests:

Use of the MuckRock platform only.
Accessible screen-reader-compatible PDFs.
Simplified summaries for complex records.
Identification of personnel responsible for ADA compliance.

Statutes Violated:
Title II of the ADA (42 U.S.C. 12132).
Section 504 of the Rehabilitation Act (29 U.S.C. 794).

Systemic Discrimination
DOJ's practices disproportionately impact individuals with disabilities, compounding the challenges of ADA enforcement.

V. Relief Requested
A. Comprehensive Records Search

Conduct a thorough search across DOJ divisions, including:

Civil Rights Division.
Office of Disability Rights.
Inter-agency communications with CMS and Connecticut DSS.
Certify the search with:

Search terms and methods used.
Databases and personnel involved.
B. ADA Accommodations Compliance

Reissue all responses via the MuckRock platform.
Provide screen-reader-compatible PDFs with simplified summaries for technical documents.
C. Vaughn Index and Statutory Justifications

Provide a Vaughn Index for all redactions or withholdings.
Cite specific FOIA exemptions for withheld records.
D. Whistleblower Protections

Investigate retaliation against whistleblowers linked to Medicaid fraud cases.
Publish DOJ policies safeguarding whistleblowers.
E. Expedited Processing
Grant expedited processing due to significant public interest.

VI. Legal and Procedural Framework
Statutes and Precedents:

5 U.S.C. 552 (FOIA): Mandates transparency and justifications for exemptions.
42 U.S.C. 12132 (ADA Title II): Prohibits discrimination against individuals with disabilities.
5 U.S.C. 2302(b)(8) (Whistleblower Protection Act): Protects employees reporting violations.
31 U.S.C. 3729-3733 (False Claims Act): Ensures accountability for misuse of taxpayer funds.
New York Times Co. v. United States (1971): Right to petition for redress.
Tennessee v. Lane (2004): Equal access under ADA.

VII. Escalation Plan
If these requests are not resolved within 10 business days, I will escalate as follows:

OGIS Mediation: Formal complaint to the Office of Government Information Services.
Judicial Action: File federal lawsuits under FOIA, ADA, and whistleblower statutes.
Congressional Oversight: Notify Senate and House Committees about systemic non-compliance.
Public Advocacy: Engage media outlets and advocacy organizations.
VIII. Conclusion
The DOJ's systemic failures violate constitutional protections, federal transparency mandates, and disability rights. Immediate corrective action is necessary to restore accountability and public trust.

*** Federal Bureau of Investigation (FBI)
Subject: Urgent Request for Investigation into OSC Case Records, Altered Decisions, and Suppressed Reports

Dear FBI Team,

I am formally requesting your assistance to investigate systemic failures, misconduct, and potential criminal activity surrounding the handling of my submissions to the Office of Special Counsel (OSC). These failures directly impact whistleblower protections, Medicaid oversight, and public accountability.

Issues to Investigate

1. Case Numbers and Records Management

Case Numbers Requiring Investigation:

DI-25-000310

DI-25-000325

DI-25-000379

DI-12192024714

DI-12112024134

OSCFiling-MedeirosDavid-DI-12202024300

OSCFiling-MedeirosDavid-DI-112620241121

2. Anonymity and Lack of Accountability in Decision-Making

Unsigned Determination Letters:

Many determination letters from OSC lack identifiable signatures, names, or clear authorship.

This practice raises serious concerns about accountability and compliance with transparency laws.

3. Suppressed or Altered Records

Evidence suggests discrepancies between the whistleblower reports I submitted and how they were recorded or handled by OSC.

Specific issues include:

Alterations or removal of content from submitted complaints.

Suppression of reports that exposed systemic failures in Medicaid oversight and retaliation against whistleblowers.

4. Lack of FOIA Compliance

Despite repeated Freedom of Information Act (FOIA) requests, OSC and related agencies have failed to provide:

Complete case files and communication logs.

Justification for withheld or redacted information.

Clear timelines for compliance.

Specific Questions to Investigate

1. Who is Responsible for Managing These Records?

Identify the individuals, teams, or automated systems involved in creating, altering, and assigning these case numbers and reports.

2. What Decisions Were Made and Why?

Determine how decisions were reached, why some reports were closed without action, and why letters were sent anonymously.

3. Were There Violations of Federal Law?

Investigate potential obstruction of justice, retaliation, or misuse of authority under whistleblower protection laws and FOIA.

Key Agencies and Officials Involved

This matter spans multiple federal and state agencies, including:

 Office of Special Counsel (OSC)

 Department of Justice (DOJ)

Centers for Medicare & Medicaid Services (CMS)

Department of Health and Human Services (HHS)

 Office of Inspector General (OIG)

Why This Matters

1. Whistleblower Protections:

Retaliation against whistleblowers and suppression of reports undermine federal protections designed to safeguard transparency and accountability.

2. Impact on Vulnerable Populations:

These failures harm Medicaid consumers, particularly those with disabilities, by allowing systemic mismanagement to persist unchecked.

3. Misuse of Taxpayer Funds:

Lack of oversight and accountability results in waste and misuse of federal funds meant to serve the public.

Requested Actions

1. Investigate Record Management:

Audit all OSC records, emails, and internal communications related to these case numbers.

Identify responsible individuals or systems.

2. Subpoena Additional Evidence:

Secure all suppressed or altered reports to ensure a complete and accurate investigation.

3. Hold Accountable Those Involved in Misconduct:

Recommend prosecution or disciplinary action for any individuals found to have violated federal laws.

4. Ensure Compliance with FOIA and Whistleblower Protections:

Mandate OSC and related agencies to comply fully with FOIA requests and whistleblower laws.

Attachments

I have attached all available documentation, including:

Correspondence with OSC, including determination letters and emails.

FOIA requests and responses (or lack thereof).

Detailed reports submitted to OSC and other federal agencies.

This issue demands immediate attention to uphold the principles of transparency, accountability, and justice. I am available to provide additional information or documentation as needed.

Sincerely,
David Medeiros

As recognized in National Archives and Records Administration v. Favish, 541 U.S. 157 (2004), transparency is fundamental to democracy and public trust. Your agencys obligations are not discretionary, and failure to meet them constitutes a violation of statutory and constitutional law. This letter establishes your duties, addresses deficiencies, and anticipates and counters all potential deflection strategies.

1. FOIA Obligations: Statutory Mandates and Required Actions
FOIA establishes an enforceable right of access to federal agency records. Your response must meet the following requirements:

A. Timeliness
Under 5 U.S.C. 552(a)(6)(A), you are required to provide a determination within 20 business days. Delays beyond this timeframe, absent legitimate extension requests, constitute a violation of FOIA.
Countermeasure: Delays are actionable under Citizens for Responsibility and Ethics in Washington v. DOJ, 711 F.3d 180 (D.C. Cir. 2013).
Required Action: Provide the requested records or a lawful determination.

B. Adequacy of Search
FOIA requires a thorough and reasonable search for records, as established in Campbell v. DOJ, 164 F.3d 20 (D.C. Cir. 1998). This includes:
Identifying the databases, locations, and terms used.
Providing a sworn affidavit detailing the search scope.
Countermeasure: A vague claim of "no responsive records" is insufficient without a detailed affidavit.
Required Action: Submit a sworn affidavit documenting the search or confirm the existence of responsive records.

C. Proper Use of Exemptions
Exemptions under 5 U.S.C. 552(b) must be narrowly applied and justified with specific explanations. Blanket or vague exemptions are impermissible.
Countermeasure: A Vaughn index (Vaughn v. Rosen, 484 F.2d 820 (D.C. Cir. 1973)) is required to justify each withholding.
Required Action: Submit a Vaughn index detailing each exemption and its justification within 10 business days.

D. Decentralization and Referrals
Referrals or decentralization excuses do not absolve your agency of its responsibility to provide a consolidated response. As held in McGehee v. CIA, 697 F.2d 1095 (D.C. Cir. 1983), agencies must coordinate internally to ensure compliance.
Countermeasure: Require assurance of continuity and coordination across divisions.
Required Action: Consolidate records from all relevant offices and provide a unified response.

2. ADA and Rehabilitation Act Compliance: Equal Access as a Legal Right
As a person with a documented disability, I am entitled to reasonable accommodations under the ADA and Section 504 of the Rehabilitation Act. Your failure to provide accessible formats for requested records constitutes discrimination and violates federal law.

Case Law:
Tennessee v. Lane, 541 U.S. 509 (2004): Agencies must ensure meaningful access to government services.
Alexander v. Choate, 469 U.S. 287 (1985): Denial of reasonable accommodations creates barriers that violate civil rights.

Required Action:
Provide all requested records in accessible formats, including plain-language summaries or electronic files compatible with assistive technologies.
Confirm compliance with ADA requirements by [specific date].

3. Mandated Reporting and Whistleblower Protections
Your handling of this request implicates broader concerns, including potential fraud, misuse of federal funds, or retaliation against whistleblowers. Under the Whistleblower Protection Act (5 U.S.C. 2302), you are required to report and address systemic violations.
Countermeasure: Reference Misprision of Felony (18 U.S.C. 4), which requires the reporting of observed violations of law.
Required Action: Document and escalate evidence of misconduct to oversight bodies, including the Office of Inspector General (OIG).

4. Consequences of Non-Compliance
Failure to comply with your statutory obligations knowingly constitutes violations of:
Obstruction of Justice (18 U.S.C. 1505): Delaying lawful access to records obstructs public accountability.
Civil Rights Violations (42 U.S.C. 1983): Denying ADA accommodations constitutes a deprivation of federally protected rights.
Misprision of Felony (18 U.S.C. 4): Concealing or failing to report observed violations is a criminal act.
Countermeasure: Prepare for judicial review, oversight complaints, and public advocacy if compliance fails.

5. Escalation Pathways
If your office does not comply within the specified timeframe, I will escalate this matter through:
Judicial Review: Filing a lawsuit under 5 U.S.C. 552(a)(4)(B) to compel disclosure.
Oversight Complaints: Submitting formal complaints to OGIS, OIG, and the DOJ Civil Rights Division.
Public Advocacy: Engaging investigative journalists, transparency advocates, and public interest organizations to ensure accountability.

6. Final Statement: Upholding Transparency and Accountability
This matter reflects the publics right to transparency and the preservation of trust in government institutions. Your actions will either affirm your agencys commitment to accountability or further evidence systemic disregard for these principles.

I look forward to your prompt and substantive response.

The challenges we face today demand more than acknowledgmentthey require action, collaboration, and a unified commitment to solutions. Together, we must embrace transparency, accountability, and compassion as the
foundation of our efforts. By fostering open communication, prioritizing the needs of the most vulnerable, and holding systems accountable, we can rebuild trust and ensure equitable outcomes for all.

Solutions lie in unitywhen state and federal leaders, advocates, and communities work hand in hand to uphold justice and fairness. Transparency through accessible Freedom of Information processes, adherence to legal
mandates, and robust oversight are the pillars that support meaningful change. Each of us has a role to play in creating a system that serves and protects.

Our collective mission is clear: to build bridges between agencies and communities, ensure the dignity of every individual, and honor the principles that guide us toward progress. Together, with determination and unity, we can
overcome systemic failures and pave the way for a brighter, more inclusive future.

Americans living with disabilities and their families are Americansfull citizens of this nation, protected by the same Constitution that guarantees the rights and freedoms of every individual. We are not separate, lesser, or forgotten. We are Americans with the same unalienable rights to life, liberty, and the pursuit of happiness.

We stand firmly on the principles of equality, dignity, and justice. Our voices matter. Our contributions matter. And our rightsour Constitutional rightsmust be respected, upheld, and protected without exception or delay.
