12.04.2024 Subject: Immediate Compliance Required with ADA Accommodations and FOIA Obligations
Dear FOIA Officer
I am writing to formally reiterate my request for specific ADA accommodations and compliance with FOIA obligations, which are essential for my full participation in this process. These accommodations were explicitly requested to address accessibility needs stemming from my traumatic brain injury and to ensure compliance with federal law. To date, your office has failed to meet these requirements, resulting in undue barriers and systemic non-compliance.
Accommodations Previously Requested
The following accommodations, explicitly outlined in prior communications, remain unfulfilled:
Exclusive Use of MuckRock Platform
Requested: All communications must be routed exclusively through the MuckRock platform. No external portals, password-protected links, or alternate communication methods are acceptable.
Non-Compliance: Communications have directed me to use external portals and password-protected links, violating ADA guidelines and my explicit requests.
Accessible Document Formatting
Requested: All documents must be provided as screen-reader compatible PDFs, properly labeled and indexed for ease of navigation and accessibility.
Non-Compliance: Provided documents have not adhered to accessibility standards, preventing effective access to critical information.
Simplified Summaries for Complex Records
Requested: Simplified summaries must accompany all complex or technical records to enhance comprehension and ensure equitable participation.
Non-Compliance: No summaries have been provided, creating unnecessary barriers to understanding the records.
Identification of Responsible Personnel
Requested: Each communication must include the name, title, and role of the individual responsible for processing or responding to my requests.
Non-Compliance: Correspondence has consistently lacked this information, hindering accountability and effective follow-up.
Immediate Action Required
To rectify these ongoing failures and ensure compliance with federal laws, I demand the following actions be taken without delay:
Transition All Communications to MuckRock
Immediately cease the use of external portals or non-compliant communication methods and ensure all responses are routed exclusively through the MuckRock platform.
Provide Accessible Documents
Reformat and resend all previously provided documents as screen-reader compatible PDFs, properly labeled and indexed to ensure accessibility.
Include Simplified Summaries
Provide simplified summaries for all complex or technical records, both previously shared and in future communications, to ensure accessibility and equitable participation.
Identify Responsible Personnel
Include the name, title, and role of the individual responsible for every communication moving forward to ensure transparency and accountability.
Legal Basis for Compliance
Your office is legally obligated to comply with these accommodations under the following statutes and principles:
Americans with Disabilities Act (ADA): Title II, 42 U.S.C. 12132, and Section 504 of the Rehabilitation Act mandate reasonable accommodations and accessibility in communications for individuals with disabilities.
Freedom of Information Act (FOIA): 5 U.S.C. 552 requires transparency, accessibility, and adherence to procedural fairness.
Constitutional Protections: The First, Fifth, and Fourteenth Amendments to the U.S. Constitution safeguard my rights to petition the government, due process, and equal protection under the law.
Executive Order 13392: Mandates improved agency disclosure of information to enhance transparency and accountability.
Deadline for Compliance
Your office must confirm compliance with these accommodations and provide the requested corrective actions within five (5) business days of this notice. Continued non-compliance will be documented as a violation of the ADA and FOIA and may result in escalation, including:
Formal Complaints: Filing with the U.S. Department of Justice and the Office for Civil Rights.
Judicial Remedies: Seeking injunctive relief and damages for ADA and FOIA violations.
Public Advocacy: Reporting systemic failures to oversight agencies, media, and advocacy organizations.
Conclusion
This communication serves as a final request for compliance. It is imperative that your office address these deficiencies promptly to restore transparency, accessibility, and adherence to federal law.
Thank you for your immediate attention to this matter. I look forward to your response and resolution by the stated deadline.
Sincerely,
David Medeiros

Introduction
This complaint escalates the ongoing failures to comply with FOIA obligations, whistleblower protection laws, and the Americans with Disabilities Act (ADA). This formal action follows the systemic mishandling of FOIA Request #2025-01079-FOIA-PHS submitted on November 23, 2024, seeking transparency on Medicaid oversight failures, ADA enforcement lapses, and retaliation against whistleblowers. Despite repeated communications, the request has been met with inadequate responses, inaccessibility, and violations of statutory and constitutional rights.
This appeal aims to compel immediate compliance, transparency, and accountability while safeguarding my legal rights as a whistleblower, taxpayer, and individual requiring ADA accommodations.
Violations and Legal Grounds
1. Constitutional Rights Violations
First Amendment: The delay and obstruction of public records undermine my right to petition the government for redress of grievances (New York Times Co. v. United States, 1971).
Fifth and Fourteenth Amendments: Denial of timely and accessible records violates due process and equal protection guarantees (Tennessee v. Lane, 2004).
2. FOIA Non-Compliance
Violations:
Failure to Meet Statutory Deadlines: No substantive response within 20 business days as required under 5 U.S.C. 552(a)(6)(A).
Failure to Provide an Estimated Date of Completion (EDC): Non-compliance with 5 U.S.C. 552(a)(7)(B)(ii).
Inadequate Justifications for Delays: Statutory exemptions and Vaughn Index are absent despite redactions and denials.
Legal Basis: FOIA mandates transparency, timely access, and explicit justification for exemptions (DOJ v. Reporters Committee for Freedom of the Press, 1989).
3. ADA Non-Compliance
Violations:
Refusal to provide accessible communication methods (MuckRock platform, screen-reader-compatible formats).
Denial of simplified summaries and text-embedded emails necessary for equitable access.
Legal Basis: Title II of the ADA (42 U.S.C. 12132) and Section 504 of the Rehabilitation Act (29 U.S.C. 794) mandate reasonable accommodations for individuals with disabilities.
4. Whistleblower Protection Violations
Violations:
Obstruction of information critical to exposing retaliation under the Whistleblower Protection Act (5 U.S.C. 2302(b)(8)).
Suppression of records related to systemic Medicaid fraud and retaliatory actions against ABI Resources LLC following the December 18, 2023, whistleblower report.
Legal Basis: The Whistleblower Protection Act prohibits retaliation and guarantees transparency for whistleblower claims.
Demands for Immediate Action
1. Compliance with FOIA Requirements
Provide All Requested Records: Fulfill FOIA Request #2025-01079-FOIA-PHS, including unredacted documentation on Medicaid oversight, ADA compliance, whistleblower retaliation, and associated matters.
Statutory Justifications for Redactions: If exemptions are invoked, provide a Vaughn Index detailing withheld documents and the legal basis for each.
2. ADA-Compliant Responses
ADA Accommodations Request
This request includes explicit ADA accommodations to address cognitive processing challenges resulting from my traumatic brain injury (TBI). These accommodations are legally required under Title II of the ADA (42 U.S.C. 12132) and Section 504 of the Rehabilitation Act (29 U.S.C. 794).
Requested ADA Accommodations
To ensure accessibility and compliance with ADA standards (42 U.S.C. 12101 et seq.), I request the following accommodations for all communications and records:
Screen-Reader Compatible Formats
All documents must be provided in properly labeled PDFs or plain-text files.
Ensure the documents are screen-reader compatible and retain clear formatting.
Exclusive MuckRock Platform Communication
All communications must occur via the MuckRock platform.
Do not send external links, emails, portals, passwords, codes, or require phone calls for access.
Text Embedded in Email Bodies
Key information must be embedded directly in the email body to facilitate comprehension.
Simplified Summaries
Provide plain-language summaries for complex or legal documents to ensure clarity.
Identification of Responsible Officers
Include the full name, title, and contact information of all responsible officers handling this request.
Non-Negotiable Compliance
These accommodations are non-negotiable and are essential for ensuring equal access to information. Any failure to provide the requested accommodations may constitute a violation of the ADA and the Rehabilitation Act. Thank you for ensuring compliance and accessibility in addressing this request.
3. Processing Transparency
Provide metadata and processing logs documenting the handling of this FOIA request, including timestamps and personnel involved.
Disclose the names, titles, and contact information of all FOIA officers and decision-makers.
4. Expedited Processing
Ensure immediate expedited processing under 5 U.S.C. 552(a)(6)(E), given significant public interest and ongoing harm to whistleblower protections and ADA rights.
Consequences for Continued Non-Compliance
Administrative Escalation
File formal complaints with oversight agencies, including OGIS, DOJ OIG, and HHS OIG.
Judicial Remedies
Seek injunctive relief and damages under FOIA and ADA statutes.
Public Advocacy
Report systemic failures to media outlets and advocacy organizations, emphasizing barriers to justice, transparency, and accountability.
Conclusion
This complaint and appeal demand immediate rectification of systemic violations undermining transparency, ADA compliance, and whistleblower protections. The response to this matter will not only resolve ongoing legal breaches but also set a precedent for equitable governance, taxpayer accountability, and civil rights enforcement.
Failure to address these demands will compel escalated action through administrative, legal, and public advocacy channels.

David Medeiros

Introduction
This formal complaint escalates systemic violations of constitutional, statutory, and regulatory obligations associated with FOIA Request #2025-01079-FOIA-PHS. The ongoing failure to provide requested records, comply with ADA accommodations, and address whistleblower protections highlights a troubling pattern of obstruction and retaliation against ABI Resources following a December 18, 2023, whistleblower report.
This document outlines a comprehensive appeal to demand immediate corrective action, enforce compliance, and hold accountable all involved agencies for systemic failures in Medicaid oversight, ADA enforcement, and retaliation against whistleblowers.
Violations and Legal Framework
1. Constitutional Violations
First Amendment: Suppressing access to public records undermines my right to petition the government for redress of grievances (New York Times Co. v. United States, 1971).
Fifth and Fourteenth Amendments: The systemic denial of accessible records violates due process and equal protection guarantees (Tennessee v. Lane, 2004).
2. FOIA Non-Compliance
Violations:
Failure to Meet Deadlines: Agencies have not responded within the statutory 20-business-day period (5 U.S.C. 552(a)(6)(A)).
Failure to Provide Estimated Completion Dates: Agencies have failed to meet the transparency requirements of 5 U.S.C. 552(a)(7)(B)(ii).
Inadequate Justifications for Denials: No valid exemptions or Vaughn Index have been provided for withheld or redacted information.
Legal Precedent: FOIA guarantees timely responses, transparency, and public access to non-exempt information (DOJ v. Reporters Committee for Freedom of the Press, 1989).
3. ADA Non-Compliance
Violations:
Refusal to use accessible formats, such as screen-reader-compatible PDFs and embedded text in emails.
Denial of simplified summaries, preventing equitable access for individuals with disabilities.
Legal Basis: Title II of the ADA (42 U.S.C. 12132) and Section 504 of the Rehabilitation Act (29 U.S.C. 794) mandate public entities to ensure reasonable accommodations and effective communication.
4. Retaliation Against Whistleblower Protections
Violations:
Suppression of information critical to addressing retaliation under the Whistleblower Protection Act (5 U.S.C. 2302(b)(8)).
Obstruction of records exposing retaliatory Medicaid billing restrictions and procedural violations by DSS and CMS.
Legal Basis: Federal whistleblower protections prohibit retaliation and guarantee access to relevant documentation for whistleblowers.
Demands for Corrective Action
1. Immediate Compliance with FOIA Obligations
Deliver All Requested Records: Provide unredacted documentation related to Medicaid billing actions, ADA compliance, retaliation against ABI Resources, and all inter-agency communications.
Detailed Justifications for Redactions: If exemptions are claimed, provide a Vaughn Index citing specific statutes for each withheld document as per 5 U.S.C. 552(b).
2. ADA-Compliant Responses
Screen-Reader-Compatible Documents: Ensure all records are accessible and clearly labeled.
Simplified Summaries: Provide plain-language explanations for complex or technical records.
Embedded Text in Emails: Avoid inaccessible portals, links, or physical mail.
3. Processing Transparency
Metadata and Logs: Submit all internal records detailing the processing of this FOIA request, including timestamps, personnel involvement, and decision-making processes.
Accountability: Identify all FOIA officers and decision-makers responsible for handling this request, including names, titles, and contact information.
4. Expedited Processing and Resolution
Expedite the processing of this request based on public interest and the urgent need for transparency under 5 U.S.C. 552(a)(6)(E).
Consequences of Continued Non-Compliance
1. Formal Complaints
Complaints will be filed with oversight bodies, including OGIS, DOJ OIG, and HHS OIG, for review and enforcement of compliance.
2. Judicial Action
Legal proceedings will be initiated to compel compliance, enforce ADA accommodations, and address whistleblower retaliation.
3. Public Advocacy
Reports will be disseminated to media outlets and advocacy organizations to highlight systemic failures, barriers to transparency, and ADA non-compliance.
This legal complaint and appeal demand immediate rectification of all outlined violations to uphold constitutional rights, statutory mandates, and equitable access. Failure to respond appropriately will result in escalated action through administrative, judicial, and public advocacy channels.
