To Whom It May Concern:
I wanted to follow up on the following Freedom of Information Act request, copied below, and originally submitted on Dec. 3, 2024. Please let me know when I can expect to receive a response.
Thanks for your help, and let me know if further clarification is needed.
On January 2, 2025, David Medeiros, founder of ABI Resources, submitted an escalated legal complaint addressing systemic violations of FOIA, ADA, whistleblower protections, and constitutional rights. The complaint highlights government agencies failures to respond to FOIA requests filed in November 2024 regarding DOJ complaints, neglecting statutory deadlines, providing inaccessible records, and honoring ADA accommodation requests. Key violations include withholding records without proper justification, using inaccessible communication methods, and failing to identify responsible personnel. Medeiros demands unredacted records, ADA-compliant formats, exclusive communication through MuckRock, bi-weekly updates, and audits of compliance practices. If unresolved, he plans to escalate through administrative complaints, judicial action, and public advocacy. He also outlines explicit ADA accommodations required due to his traumatic brain injury, emphasizing that non-compliance constitutes a legal violation. This complaint underscores the need for immediate action to uphold transparency, accessibility, and accountability.

Key Issues Addressed
This complaint and appeal address systemic non-compliance with the Freedom of Information Act (FOIA) (5 U.S.C. 552), the Americans with Disabilities Act (ADA) (42 U.S.C. 12132), Section 504 of the Rehabilitation Act (29 U.S.C. 794), and constitutional protections under the First, Fifth, and Fourteenth Amendments.
Despite submission of my FOIA request on November 22, 2024, seeking records associated with DOJ Complaints #534659-XGL, #539298-RJM, #534060-HWM, and #539330-JBZ, there has been no meaningful response, acknowledgment of ADA accommodations, or statutory compliance.
Violations Identified
1. FOIA Violations
Failure to Meet Deadlines: Agencies failed to respond within the statutory 20-business-day deadline under 5 U.S.C. 552(a)(6)(A)(i).
No Vaughn Index: Withheld or redacted records lack proper legal justifications or a Vaughn Index, violating 5 U.S.C. 552(b).
Opaque Accountability: Agencies failed to identify FOIA officers or personnel responsible for processing the request, breaching transparency requirements under 5 U.S.C. 552(a)(6)(C).
2. ADA Non-Compliance
Non-Accessible Formats: Failure to deliver records in screen-reader-compatible PDFs with appropriate formatting contravenes 42 U.S.C. 12132 and 29 U.S.C. 794.
Exclusive MuckRock Use Ignored: Agencies improperly routed communications through inaccessible portals and external platforms, violating explicit accommodation requests.
No Simplified Summaries: Complex records were not accompanied by simplified summaries, breaching 28 C.F.R. 35.160.
3. Whistleblower Suppression
Delays in processing FOIA requests and ADA accommodations hinder access to critical information for cases alleging misconduct, potentially violating the Whistleblower Protection Act (5 U.S.C. 2302(b)(8)).
4. Constitutional Violations
First Amendment: Obstructing access to public records interferes with the right to petition the government and oversee public accountability.
Fifth and Fourteenth Amendments: Denial of ADA accommodations and FOIA access deprives individuals of due process and equal protection under the law.
Corrective Actions Demanded
1. FOIA Compliance
Full Disclosure: Provide unredacted records for all documents related to complaints #534659-XGL, #539298-RJM, #534060-HWM, and #539330-JBZ.
Legal Justifications: Issue a Vaughn Index detailing statutory exemptions for any withheld or redacted records under 5 U.S.C. 552(b).
Personnel Transparency: Identify all FOIA officers and decision-makers involved, including contact information and roles.
2. ADA Compliance
Accessible Formats: Reformat and provide all records as screen-reader-compatible PDFs with proper tagging and indexing.
Simplified Summaries: Accompany all complex records with plain-language summaries.
Exclusive MuckRock Use: Deliver all responses exclusively through the MuckRock platform as explicitly requested.
3. Oversight and Accountability
Audits: Conduct a formal audit of systemic failures in FOIA and ADA compliance, involving the DOJ OIG and GAO.
Regular Updates: Provide bi-weekly status updates on the progress of this request and related investigations.
4. Expedited Processing
Public Interest: Justify and expedite this request under 5 U.S.C. 552(a)(6)(E) due to its critical public importance and impact on civil rights.
Legal Basis for Complaint and Appeal
Freedom of Information Act (5 U.S.C. 552)
Mandates timely responses, legal justifications for redactions, and identification of responsible personnel.
Americans with Disabilities Act (42 U.S.C. 12132) and Section 504 (29 U.S.C. 794)
Requires accessible government services and responses for individuals with disabilities.
Whistleblower Protection Act (5 U.S.C. 2302(b)(8))
Prohibits retaliation or obstruction against individuals reporting misconduct or requesting transparency.
Constitutional Protections
First Amendment: Guarantees the right to access public information.
Fifth and Fourteenth Amendments: Protect against discrimination and ensure due process.
Request for Expedited Processing Justifications
Public Accountability: Ensuring oversight and ethical compliance in DOJ and related agencies regarding whistleblower protections and ADA enforcement.
Civil Rights Urgency: Addressing ADA accommodation violations has immediate implications for public trust and equal access.
Precedent: Expedited processing is supported under Al-Fayed v. CIA, 254 F.3d 300 (D.C. Cir. 2001), which prioritizes requests of significant public interest.
Escalation and Remedies for Non-Compliance
Administrative Escalation
File formal complaints with OGIS, DOJ OIG, and the Office for Civil Rights (OCR) for failure to meet FOIA and ADA obligations.
Judicial Remedies
Pursue legal action under 5 U.S.C. 552(a)(4)(B) for FOIA enforcement and 42 U.S.C. 12133 for ADA violations.
Public Disclosure
Engage media, advocacy groups, and oversight organizations to ensure systemic accountability.
Conclusion
This complaint and appeal aim to enforce statutory and constitutional obligations, ensuring FOIA transparency and ADA compliance. Immediate corrective actions are required to address ongoing violations and safeguard public trust.
ADA Accommodations Request
This request includes explicit ADA accommodations to address cognitive processing challenges resulting from my traumatic brain injury (TBI). These accommodations are legally required under Title II of the ADA (42 U.S.C. 12132) and Section 504 of the Rehabilitation Act (29 U.S.C. 794).
Requested ADA Accommodations
To ensure accessibility and compliance with ADA standards (42 U.S.C. 12101 et seq.), I request the following accommodations for all communications and records:
Screen-Reader Compatible Formats
All documents must be provided in properly labeled PDFs or plain-text files.
Ensure the documents are screen-reader compatible and retain clear formatting.
Exclusive MuckRock Platform Communication
All communications must occur via the MuckRock platform.
Do not send external links, emails, portals, passwords, codes, or require phone calls for access.
Text Embedded in Email Bodies
Key information must be embedded directly in the email body to facilitate comprehension.
Simplified Summaries
Provide plain-language summaries for complex or legal documents to ensure clarity.
Identification of Responsible Officers
Include the full name, title, and contact information of all responsible officers handling this request.
Non-Negotiable Compliance
These accommodations are non-negotiable and are essential for ensuring equal access to information. Any failure to provide the requested accommodations may constitute a violation of the ADA and the Rehabilitation Act. Thank you for ensuring compliance and accessibility in addressing this request.
Sincerely,
David Medeiros
