Subject: Formal Appeal of FOIA Request #F-2025-03145: Violations of Constitutional Rights, ADA Compliance, and Procedural Obligations
Dear FOIA Officer,
This formal appeal addresses procedural, statutory, and constitutional violations in the handling of FOIA Request #F-2025-03145. The Department of State has failed to uphold its obligations under the Freedom of Information Act (FOIA), the Americans with Disabilities Act (ADA), and related federal statutes, compromising my constitutional rights under the First, Fifth, and Fourteenth Amendments.
Constitutional Violations
First Amendment Right to Public Information
The First Amendment guarantees the public's right to access government information to ensure transparency and accountability (DOJ v. Reporters Committee for Freedom of the Press, 1989).
The Department's actions, including marking my request as "Closed" without substantive response, obstruct this fundamental right, particularly for records tied to taxpayer-funded Medicaid programs that directly impact vulnerable populations.
Fifth Amendment Due Process Clause
Failing to provide a substantive response, ADA-mandated accommodations, or procedural clarity violates my due process rights under the Fifth Amendment (Mathews v. Eldridge, 1976).
The refusal to provide clear justifications for the premature closure of my request constitutes a procedural failure, denying me meaningful participation in the FOIA process.
Fourteenth Amendment Equal Protection Clause
Denying ADA-mandated accommodations discriminates against individuals with disabilities, violating my rights to equal protection under the law (Tennessee v. Lane, 2004). Government agencies are required to ensure equitable access to public services, including FOIA processes.
Supremacy Clause Federal Law Preeminence
FOIA and ADA obligations are federal mandates that supersede any conflicting state laws, agency policies, or internal practices. Non-compliance violates the Supremacy Clause, undermining the constitutional priority of federal law.
Key Procedural Violations
Premature and Procedurally Deficient Closure
Marking my FOIA request "Closed" without providing records, a valid exemption under 5 U.S.C. 552(b), or any explanation violates procedural requirements.
The Department's failure to clarify this status undermines transparency and due process.
ADA Non-Compliance
Despite explicit accommodations outlined in my request, the Department has failed to:
Provide email-only communication.
Embed responses in the email body.
Ensure accessible document formats.
These failures obstruct access and violate 42 U.S.C. 12101 (ADA) and 29 U.S.C. 794 (Section 504 of the Rehabilitation Act).
Failure to Identify Responsible Personnel
FOIA requires transparency in identifying the individuals involved in processing requests. The Department's omission of this information hinders accountability and violates procedural obligations.
Lack of Justification for Redactions or Denials
FOIA mandates detailed explanations for any withheld records under 5 U.S.C. 552(b). The absence of such justifications constitutes non-compliance.
Requested Corrective Actions
Reopen FOIA Request
Reopen Request #F-2025-03145 and provide a substantive response to the records requested, ensuring compliance with all statutory and constitutional obligations.
Implement ADA-Compliant Accommodations
Confirm in writing that the following accommodations will be applied:
Email-Only Communication via MuckRock Platform: No external links, portals, or alternative methods.
Direct Text in Email Body: Embed all substantive responses in the email body for accessibility.
Accessible PDFs: Provide documents in screen-reader-compatible PDF format.
Simplified Summaries for Complex Records: Include plain-language summaries for dense legal, procedural, or financial documents.
Identification of FOIA Personnel: Name all personnel responsible for processing the request.
Clarify Closed Status
Provide a detailed explanation for the "Closed" status, including whether any records were identified, processed, or denied and on what basis.
Provide an Updated Timeline
Share an Estimated Date of Completion (EDC) for the reopened request, as required under 5 U.S.C. 552(a)(7)(B).
Detailed Justifications for Denials
For any withheld records, provide statutory explanations under 5 U.S.C. 552(b) with Vaughn Index-style documentation.
Escalation Framework
If these deficiencies are not addressed, I will escalate to the following oversight bodies:
Office of Government Information Services (OGIS): FOIA mediation and dispute resolution.
Office for Civil Rights (OCR): ADA compliance enforcement.
Federal Court: Judicial remedies for FOIA and ADA violations.
Response Deadline
I request acknowledgment of this appeal within 5 business days and a detailed corrective plan within 10 business days. Continued non-compliance will necessitate further legal and administrative action.
Sincerely,
David Medeiros

Appeal Immediate Compliance Required with ADA Accommodations and FOIA Obligations
Dear FOIA Officer
I am writing to formally reiterate my request for specific ADA accommodations and compliance with FOIA obligations, which are essential for my full participation in this process. These accommodations were explicitly requested to address accessibility needs stemming from my traumatic brain injury and to ensure compliance with federal law. To date, your office has failed to meet these requirements, resulting in undue barriers and systemic non-compliance.
Accommodations Previously Requested
The following accommodations, explicitly outlined in prior communications, remain unfulfilled:
Exclusive Use of MuckRock Platform
Requested: All communications must be routed exclusively through the MuckRock platform. No external portals, password-protected links, or alternate communication methods are acceptable.
Non-Compliance: Communications have directed me to use external portals and password-protected links, violating ADA guidelines and my explicit requests.
Accessible Document Formatting
Requested: All documents must be provided as screen-reader compatible PDFs, properly labeled and indexed for ease of navigation and accessibility.
Non-Compliance: Provided documents have not adhered to accessibility standards, preventing effective access to critical information.
Simplified Summaries for Complex Records
Requested: Simplified summaries must accompany all complex or technical records to enhance comprehension and ensure equitable participation.
Non-Compliance: No summaries have been provided, creating unnecessary barriers to understanding the records.
Identification of Responsible Personnel
Requested: Each communication must include the name, title, and role of the individual responsible for processing or responding to my requests.
Non-Compliance: Correspondence has consistently lacked this information, hindering accountability and effective follow-up.
Immediate Action Required
To rectify these ongoing failures and ensure compliance with federal laws, I demand the following actions be taken without delay:
Transition All Communications to MuckRock
Immediately cease the use of external portals or non-compliant communication methods and ensure all responses are routed exclusively through the MuckRock platform.
Provide Accessible Documents
Reformat and resend all previously provided documents as screen-reader compatible PDFs, properly labeled and indexed to ensure accessibility.
Include Simplified Summaries
Provide simplified summaries for all complex or technical records, both previously shared and in future communications, to ensure accessibility and equitable participation.
Identify Responsible Personnel
Include the name, title, and role of the individual responsible for every communication moving forward to ensure transparency and accountability.
Legal Basis for Compliance
Your office is legally obligated to comply with these accommodations under the following statutes and principles:
Americans with Disabilities Act (ADA): Title II, 42 U.S.C. 12132, and Section 504 of the Rehabilitation Act mandate reasonable accommodations and accessibility in communications for individuals with disabilities.
Freedom of Information Act (FOIA): 5 U.S.C. 552 requires transparency, accessibility, and adherence to procedural fairness.
Constitutional Protections: The First, Fifth, and Fourteenth Amendments to the U.S. Constitution safeguard my rights to petition the government, due process, and equal protection under the law.
Executive Order 13392: Mandates improved agency disclosure of information to enhance transparency and accountability.
Deadline for Compliance
Your office must confirm compliance with these accommodations and provide the requested corrective actions within five (5) business days of this notice. Continued non-compliance will be documented as a violation of the ADA and FOIA and may result in escalation, including:
Formal Complaints: Filing with the U.S. Department of Justice and the Office for Civil Rights.
Judicial Remedies: Seeking injunctive relief and damages for ADA and FOIA violations.
Public Advocacy: Reporting systemic failures to oversight agencies, media, and advocacy organizations.
Conclusion
This communication serves as a final request for compliance. It is imperative that your office address these deficiencies promptly to restore transparency, accessibility, and adherence to federal law.
Thank you for your immediate attention to this matter. I look forward to your response and resolution by the stated deadline.
Sincerely,
David Medeiros

Formal Demand for Immediate Compliance with FOIA and ADA Obligations Appeal for Corrective Action (Case No. F-2025-03145)

Xavier Becerra, HHS Secretary
Dear Mr. Stein,
This communication serves as a formal response to the decision to reject my FOIA request (Case No. F-2025-03145) as outlined in the Department of States correspondence dated December 5, 2024. Your determination that the requested records do not exist in the Departments possession does not absolve the agency of its procedural and statutory obligations under FOIA and the ADA.
Key Issues with the Rejection
Failure to Redirect Appropriately
FOIA mandates agencies to refer requests to the appropriate entities when the requested records fall outside their purview (5 U.S.C. 552(a)(6)(B)(iii)).
Your response failed to clarify whether referrals to relevant agencies, such as the DOJ or HHS, were made.
Violation of ADA Accommodations
My request explicitly required ADA-compliant accommodations under 42 U.S.C. 12132, including direct email communication, accessible document formatting, and simplified summaries.
The response provided failed to meet these standards, causing undue burden.
Procedural Violations Under FOIA
The Department did not provide sufficient justification for denying the request or guidance on further action beyond vague references to external websites. This constitutes a procedural deficiency under FOIA.
Corrective Actions Demanded
To resolve these deficiencies promptly and in accordance with federal law, I request the following actions:
Reopen and Reprocess the FOIA Request
Redirect the request to the appropriate federal entities, including HHS, CMS, and the DOJ, and provide detailed acknowledgment of these referrals.
Confirm in writing whether any records within the Departments scope exist but were not processed due to misclassification.
ADA-Compliant Communication Standards
Resend all communications in a format that adheres to my ADA accommodations, including:
Direct inclusion of all response text in the email body.
Accessible PDFs with plain-language summaries for complex legal or procedural content.
Detailed Justification for Rejection
Provide specific citations of FOIA exemptions or statutory limitations that justify the decision to deny records, as required under 5 U.S.C. 552(b).
Include the names, titles, and contact information of all officials involved in processing this request.
Immediate Escalation to Oversight Bodies
Notify OGIS of the current status and allow mediation to address systemic issues in your FOIA and ADA compliance processes.
Legal Basis for Corrective Actions
Freedom of Information Act (FOIA), 5 U.S.C. 552
Your rejection violates statutory obligations for transparency and proper referral mechanisms.
Americans with Disabilities Act (ADA), 42 U.S.C. 12132
Failing to adhere to outlined accommodations constitutes a violation of federal disability rights law.
Constitutional Violations
The denial of my FOIA request impedes my First, Fifth, and Fourteenth Amendment rights, including access to public records and equal protection under the law.
Escalation Plan
If these corrective actions are not confirmed within 5 business days, I will take the following steps:
Formal Complaints:
File complaints with the DOJ Civil Rights Division, the Office of Government Information Services (OGIS), and the Department of Justice Inspector General.
Judicial Remedies:
Initiate legal action under 5 U.S.C. 552(a)(4)(B) for judicial review of your determination and procedural violations.
Public Disclosure and Advocacy:
Engage advocacy organizations, congressional oversight committees, and media outlets to highlight systemic non-compliance with federal transparency and accessibility laws.
Conclusion
This matter demands immediate attention to address the systemic deficiencies in FOIA and ADA compliance reflected in your response. Please confirm receipt of this communication and outline a corrective plan no later than December 12, 2024.
Thank you for your immediate attention to this critical issue.
Sincerely,
David Medeiros

This correspondence pertains to my Freedom of Information Act (FOIA) request. Your handling of this matter raises critical concerns under FOIA (5 U.S.C. 552), the Americans with Disabilities Act (ADA, 42 U.S.C. 12132), and constitutional principles of government accountability.
As recognized in National Archives and Records Administration v. Favish, 541 U.S. 157 (2004), transparency is fundamental to democracy and public trust. Your agencys obligations are not discretionary, and failure to meet them constitutes a violation of statutory and constitutional law. This letter establishes your duties, addresses deficiencies, and anticipates and counters all potential deflection strategies.
1. FOIA Obligations: Statutory Mandates and Required Actions
FOIA establishes an enforceable right of access to federal agency records. Your response must meet the following requirements:
A. Timeliness
Under 5 U.S.C. 552(a)(6)(A), you are required to provide a determination within 20 business days. Delays beyond this timeframe, absent legitimate extension requests, constitute a violation of FOIA.
Countermeasure: Delays are actionable under Citizens for Responsibility and Ethics in Washington v. DOJ, 711 F.3d 180 (D.C. Cir. 2013).
Required Action: Provide the requested records or a lawful determination.
B. Adequacy of Search
FOIA requires a thorough and reasonable search for records, as established in Campbell v. DOJ, 164 F.3d 20 (D.C. Cir. 1998). This includes:
Identifying the databases, locations, and terms used.
Providing a sworn affidavit detailing the search scope.
Countermeasure: A vague claim of "no responsive records" is insufficient without a detailed affidavit.
Required Action: Submit a sworn affidavit documenting the search or confirm the existence of responsive records.
C. Proper Use of Exemptions
Exemptions under 5 U.S.C. 552(b) must be narrowly applied and justified with specific explanations. Blanket or vague exemptions are impermissible.
Countermeasure: A Vaughn index (Vaughn v. Rosen, 484 F.2d 820 (D.C. Cir. 1973)) is required to justify each withholding.
Required Action: Submit a Vaughn index detailing each exemption and its justification within 10 business days.
D. Decentralization and Referrals
Referrals or decentralization excuses do not absolve your agency of its responsibility to provide a consolidated response. As held in McGehee v. CIA, 697 F.2d 1095 (D.C. Cir. 1983), agencies must coordinate internally to ensure compliance.
Countermeasure: Require assurance of continuity and coordination across divisions.
Required Action: Consolidate records from all relevant offices and provide a unified response.
2. ADA and Rehabilitation Act Compliance: Equal Access as a Legal Right
As a person with a documented disability, I am entitled to reasonable accommodations under the ADA and Section 504 of the Rehabilitation Act. Your failure to provide accessible formats for requested records constitutes discrimination and violates federal law.
Case Law:
Tennessee v. Lane, 541 U.S. 509 (2004): Agencies must ensure meaningful access to government services.
Alexander v. Choate, 469 U.S. 287 (1985): Denial of reasonable accommodations creates barriers that violate civil rights.
Required Action:
Provide all requested records in accessible formats, including plain-language summaries or electronic files compatible with assistive technologies.
Confirm compliance with ADA requirements by [specific date].
3. Mandated Reporting and Whistleblower Protections
Your handling of this request implicates broader concerns, including potential fraud, misuse of federal funds, or retaliation against whistleblowers. Under the Whistleblower Protection Act (5 U.S.C. 2302), you are required to report and address systemic violations.
Countermeasure: Reference Misprision of Felony (18 U.S.C. 4), which requires the reporting of observed violations of law.
Required Action: Document and escalate evidence of misconduct to oversight bodies, including the Office of Inspector General (OIG).
4. Consequences of Non-Compliance
Failure to comply with your statutory obligations knowingly constitutes violations of:
Obstruction of Justice (18 U.S.C. 1505): Delaying lawful access to records obstructs public accountability.
Civil Rights Violations (42 U.S.C. 1983): Denying ADA accommodations constitutes a deprivation of federally protected rights.
Misprision of Felony (18 U.S.C. 4): Concealing or failing to report observed violations is a criminal act.
Countermeasure: Prepare for judicial review, oversight complaints, and public advocacy if compliance fails.
5. Escalation Pathways
If your office does not comply within the specified timeframe, I will escalate this matter through:
Judicial Review: Filing a lawsuit under 5 U.S.C. 552(a)(4)(B) to compel disclosure.
Oversight Complaints: Submitting formal complaints to OGIS, OIG, and the DOJ Civil Rights Division.
Public Advocacy: Engaging investigative journalists, transparency advocates, and public interest organizations to ensure accountability.
6. Final Statement: Upholding Transparency and Accountability
This matter reflects the publics right to transparency and the preservation of trust in government institutions. Your actions will either affirm your agencys commitment to accountability or further evidence systemic disregard for these principles.
I look forward to your prompt and substantive response.
David Medeiros

The challenges we face today demand more than acknowledgmentthey require action, collaboration, and a unified commitment to solutions. Together, we must embrace transparency, accountability, and compassion as the foundation of our efforts. By fostering open communication, prioritizing the needs of the most vulnerable, and holding systems accountable, we can rebuild trust and ensure equitable outcomes for all.
Solutions lie in unitywhen state and federal leaders, advocates, and communities work hand in hand to uphold justice and fairness. Transparency through accessible Freedom of Information processes, adherence to legal mandates, and robust oversight are the pillars that support meaningful change. Each of us has a role to play in creating a system that serves and protects.
Our collective mission is clear: to build bridges between agencies and communities, ensure the dignity of every individual, and honor the principles that guide us toward progress.
