Pursuant to the Freedom of Information Act, I hereby request the following records:

April Freeman, FOIA Public Liaison
U.S. Department of Justice, Civil Rights Division
Phone: 202-514-4210
Subject: Request for Estimated Completion Date and ADA Accommodation Confirmation for FOIA Request No. 25-00044-F
Dear Ms. Freeman,
I am following up on my FOIA request No. 25-00044-F, submitted to the DOJ Civil Rights Division on October 24, 2024, and acknowledged on October 25, 2024. This request seeks access to the Connecticut Medicaid ABI Waiver Program provider registry, including provider details, enrollment dates, and any records of complaints or violations associated with providers.
Based on guidance from the Office of Government Information Services (OGIS), I am reaching out to request an estimated date of completion (EDC) for this request, per 5 U.S.C. 552(a)(7)(B)(ii). Given the public interest in these records for Medicaid transparency and oversight, I respectfully ask that this request be processed as promptly as possible.
Additionally, I reiterate my request for ADA accommodations to ensure accessibility. Please conduct all correspondence for this FOIA request exclusively via email (without requiring portal access, phone calls, or alternate communication methods), as this ensures I can effectively manage and review the information.
Thank you for your attention to this matter. Please confirm receipt of this message and, if possible, provide an EDC and confirmation of ADA-compliant communication.
Sincerely,
David Medeiros

Subject: FOIA Mediation Request for Case No. 25-00044-F
To: ogis@nara.gov
Dear OGIS Team,
I am seeking mediation assistance regarding my Freedom of Information Act (FOIA) request, case
number 25-00044-F, submitted to the Civil Rights Division on October 24, 2024. This request seeks
access to records for a comprehensive and up-to-date provider registry associated with the
Connecticut Medicaid Acquired Brain Injury (ABI) Waiver Program, specifically including provider
details, areas of specialty, enrollment statuses, and any records related to complaints or actions taken.
The Civil Rights Division acknowledged my request on October 25, 2024, but noted that processing
might be delayed due to a high volume of FOIA requests. Given the importance of these records in
supporting transparency and accountability in Medicaid program administration, I believe there may be
ways to expedite or better track the status of my request through your mediation services.
Please note my basic accommodation request: All communication for this matter should be
conducted exclusively via email, without the use of external portals, alternate websites, or phone
calls, as this ensures I can fully manage and review the information provided.
Thank you for your assistance in pursuing a complete and timely response.
Sincerely,
David Medeiros

Dear David Medeiros:
Thank you for contacting the Office of Government Information Services (OGIS), an office of
the National Archives and Records Administration. As you are aware, Congress created OGIS to
serve as the federal Freedom of Information Act (FOIA) Ombudsman. We assist the public and
federal agencies by helping them resolve their FOIA disputes, and by addressing their questions
and concerns about the FOIA process.
It appears that you are seeking assistance with a FOIA request currently pending with the U.S.
Department of Justices Civil Rights Division. Please note, OGIS cannot compel an agency to
process a request more quickly or ahead of others in the queue. However, in working cases
similar to yours, we have learned that some requesters have had success receiving a more timely
response by refining the scope of a request. If you would like to discuss narrowing your
requestwhich may allow it to be processed more efficiently you may wish to contact the
agency's FOIA Public Liaison (FPL). All federal agencies have an FPL, whose role is to explain
the FOIA process and assist requesters with their FOIA requests at any stage of the
administrative process.
Additionally, it is important to know that all federal agencies are required to provide an estimated
date of completion (EDC) when asked (5 U.S.C. 552(a)(7)(B)(ii)). In order to obtain an
estimated date of completion for your request, we recommend that you contact the agency
directly. The FOIA Public Liaison (FPL) for the Civil Rights Division, April Freeman, can be
reached at 202-514-4210.
We hope you find this information useful. At this time, we will take no further action. If you
have questions or concerns that we have not addressed, please contact us again.
Best regards,
The OGIS Staff
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.
Sincerely,
DAVID MEDEIROS

Subject: Formal Demand for Immediate Remedial Action for Non-Compliance with ADA Accommodations and FOIA Legal Obligations (FOIA Request No. 25-00044-F)
Dear FOIA Officer,
I am submitting this formal demand to address and rectify specific, documented non-compliances related to ADA accommodations and FOIA requirements associated with FOIA request No. 25-00044-F. These non-compliances represent failures to meet federally mandated ADA standards and statutory requirements under both federal and Connecticut FOIA regulations. To ensure compliance with the law, I require immediate corrective action on each point detailed below.
1. Non-Compliance with ADA-Requested Email-Only Communication
Date of Non-Compliance: November 10, 2024
Details: Despite my explicit ADA request for communications to be conducted solely via direct email (not through any portals, links, or external systems), the agency responded through a digital portal. This action contravenes my rights under Title II of the ADA (42 U.S.C. 12132) and disregards the duty to provide accessible, reasonable accommodations. Federal ADA standards prohibit agencies from imposing communication methods that are inaccessible or unduly burdensome, particularly for individuals with disabilities that affect cognitive or visual processing.
Required Action: Effective immediately, all communications related to FOIA request No. 25-00044-F must be provided exclusively via email, with no external links, portals, or ancillary access requirements. Failure to adopt this modification constitutes a denial of access under ADA standards.
2. Requirement for Direct Text Embedding in Email Body
Date of Non-Compliance: November 8, 2024
Details: On this date, the agency provided a PDF attachment rather than embedding relevant information directly within the email body. Under ADA Title II and Connecticut General Statutes 1-210 and 1-211, I am entitled to receive information in an accessible format. Embedding the text within the email body ensures compatibility with screen readers, thereby allowing full, unimpeded access to requested information, in compliance with the ADA.
Required Action: All future communications must embed relevant content directly within the body of the email to meet ADA and FOIA accessibility requirements. This modification is essential to ensure I receive information in a format that accommodates my ADA-protected disability.
3. Obligation to Provide Properly Formatted PDF Attachments
Date of Non-Compliance: November 8, 2024
Details: The provided PDF lacked labeling for date and document type, and did not conform to accessible design standards mandated by ADA Title II and Section 508 of the Rehabilitation Act. Specifically, the PDF failed to meet navigability requirements under the Web Content Accessibility Guidelines (WCAG), which are incorporated into Section 508 requirements for electronic and information technology.
Required Action: All PDF attachments must be fully accessible, labeled by date and document type, and formatted for screen reader compatibility. Failure to adhere to these standards is a violation of ADA accommodations as well as Section 508s accessibility standards.
4. Mandatory Disclosure of FOIA Officer Identity and Signature
Date of Non-Compliance: November 8, 2024
Details: The response provided by the agency failed to include the full name, title, and signature of the responsible officer, in direct contravention of Connecticut General Statutes 1-212 and 1-213, which require public officers handling FOIA requests to identify themselves. This is essential for transparency and accountability under both FOIA and ADA.
Required Action: The agency must provide full identificationincluding name, title, and a clear signatureof the officer responsible for handling and responding to my FOIA request. Non-compliance with this requirement obstructs transparency and violates statutory obligations for public accountability.
5. Provision of Simplified Summaries for Complex Information
Date of Non-Compliance: November 8, 2024
Details: The agency did not provide a simplified summary for a document containing procedural information. ADA regulations (28 C.F.R. 35.160) require that communications are as effective for individuals with disabilities as they are for those without, which includes offering simplified summaries when complex information is presented.
Required Action: For all documents containing technical or complex information, a simplified summary must accompany the original text to meet ADA requirements for effective communication. This accommodation is critical for ensuring equitable access to public records as guaranteed by federal law.
6. Requirement for Statutory Justification of Redactions
Details: While no redactions were made in the latest response, it is essential to establish that if any records are redacted in the future, statutory justification will be provided. Under 5 U.S.C. 552 (federal FOIA) and Connecticut General Statutes Chapter 14, 1-200 to 1-242, any withholding of information requires specific statutory citations and explicit explanations for each redaction.
Required Action: The agency must ensure that any future redactions in records are accompanied by clear statutory justifications in compliance with federal and state FOIA regulations. This action will uphold transparency and guarantee the legal accountability of redaction decisions.
7. Confirmation of ADA Accommodation Compliance
Date of Non-Compliance: November 8, 2024
Details: The agency has not confirmed compliance with the specific ADA accommodations I have requested. Title II of the ADA and Section 508 of the Rehabilitation Act obligate public entities to demonstrate their adherence to accommodation requests and to confirm that all legal requirements are being met.
Required Action: A formal, written confirmation of ADA accommodation compliance is required immediately. This confirmation must address each of my requests and affirm the agencys commitment to provide effective accommodations in all future communications regarding FOIA request No. 25-00044-F.
Request for Immediate Remedial Action and Legal Adherence
I demand immediate and full compliance with the outlined legal standards for all future responses related to FOIA request No. 25-00044-F. Each issue specified above must be addressed to ensure unqualified adherence to both ADA and FOIA requirements. Further failure to comply with these mandates will be regarded as a continued violation of federal and state law, necessitating formal action to secure my rights under ADA Title II, Section 508 of the Rehabilitation Act, federal FOIA, and Connecticut FOIA statutes.
Please confirm receipt of this demand and provide a precise timeline for completion and correction of each item listed. I expect all future communications to meet the highest standards of accessibility, transparency, and compliance with applicable statutes, as required by law.
Sincerely,
David Medeiros

Subject: Formal Demand for Immediate Compliance: FOIA Request No. 25-00044-F and ADA Accommodation Confirmation
Date: November 22, 2024
Dear Ms. Freeman,
This correspondence addresses several documented violations of FOIA procedural requirements and federally mandated ADA accommodations concerning FOIA Request No. 25-00044-F. These actions represent an urgent need for immediate remediation to ensure legal compliance and eliminate unnecessary barriers to access for individuals with disabilities.
Summary of Violations and Corrective Actions Required
1. Non-Compliance with ADA Accommodations: Communication Channels
Violation:
Despite explicit instructions, communications regarding FOIA Request No. 25-00044-F have been conducted through inaccessible external portals and email systems requiring additional navigation steps.
Required Action:
Immediate adherence to ADA communication requirements, including exclusive use of direct email via the MuckRock platform.
Responses must include embedded content directly within the email body for compatibility with screen-reader technologies, per 42 U.S.C. 12132 and Section 508 of the Rehabilitation Act.
2. Procedural Non-Compliance: Estimated Date of Completion (EDC)
Violation:
As outlined under 5 U.S.C. 552(a)(7)(B)(ii), agencies must provide an estimated date of completion upon request. No EDC has been provided for FOIA Request No. 25-00044-F despite multiple requests.
Required Action:
Provide a written EDC for FOIA Request No. 25-00044-F by close of business within five (5) business days of this correspondence.
3. Lack of Officer Accountability: Identification and Signature
Violation:
Agency responses failed to include full identification (name, title, and signature) of FOIA officers or decision-makers responsible for processing the request, violating transparency requirements under FOIA.
Required Action:
Include full identification and contact information for responsible personnel in all responses.
4. Procedural Error: Misrouting of Request
Violation:
The U.S. Department of State has incorrectly administratively closed this request, citing a lack of jurisdiction. However, this FOIA request was correctly directed to the DOJ Civil Rights Division, and this determination should not delay the DOJ's responsibility to fulfill the request.
Required Action:
Reopen the FOIA request within the DOJ Civil Rights Division and confirm that processing will continue without unnecessary delays caused by misrouting.
5. Improper Handling of Attachments and Summaries
Violation:
PDFs and other attachments provided to date have lacked accessibility and proper formatting. Simplified summaries for complex content have not been included, contravening 28 C.F.R. 35.160, which mandates effective communication.
Required Action:
All attachments must be properly labeled and formatted for screen-reader compatibility in compliance with ADA and Section 508 standards.
For records containing technical or complex language, simplified summaries must accompany original documents.
6. Expedited Processing Denial Without Legal Justification
Violation:
Expedited processing was denied without addressing the statutory requirements under 5 U.S.C. 552(a)(6)(E). This FOIA request involves urgent public interest and critical Medicaid transparency issues.
Required Action:
Reevaluate the expedited processing determination and provide a legally justified response, including a full explanation under applicable statutory provisions.
Legal Foundation for Demands
This correspondence is governed by:
FOIA (5 U.S.C. 552): Ensuring timely, complete, and legally compliant disclosure.

Delivery of all communications and records in full compliance with ADA accommodations and FOIA procedural standards.

Subject: Formal Appeal and Immediate Demand for Compliance: FOIA Request No. 25-00044-F and ADA Accommodation Confirmation
Date: November 22, 2024
Introduction
This letter addresses critical failures in the handling, communication, and compliance with FOIA Request No. 25-00044-F, submitted on October 24, 2024. The violations outlined below represent breaches of FOIA procedural mandates, ADA accommodation obligations, and fundamental transparency requirements. This appeal and formal demand seek immediate remedial action, compliance with applicable federal laws, and unimpeded access to the requested records.
Documented Violations and Required Corrective Actions
1. Non-Compliance with ADA-Requested Communication Accommodations
Violation:
Despite my explicit ADA accommodation request for exclusive email-based communication, several responses have utilized inaccessible portals and failed to provide embedded text within the email body. These actions violate Title II of the ADA (42 U.S.C. 12132) and Section 508 of the Rehabilitation Act by imposing unnecessary barriers to access.
Corrective Action:
Effective immediately, all communications regarding FOIA Request No. 25-00044-F must:
Use direct email without portals, external links, or physical mail.
Embed all response text directly into the email body for compatibility with screen-reader technology.
Provide attachments in screen-reader-accessible PDF formats labeled by date and document type.
2. Failure to Provide an Estimated Date of Completion (EDC)
Violation:
Under 5 U.S.C. 552(a)(7)(B)(ii), FOIA requires agencies to provide an estimated date of completion (EDC) upon request. No EDC has been provided despite multiple inquiries, impeding transparency and accountability.
Corrective Action:
Deliver a written EDC for FOIA Request No. 25-00044-F within five (5) business days of this correspondence.
3. Lack of Personnel Identification and Accountability
Violation:
Agency responses have failed to include the names, titles, and signatures of responsible FOIA officers and decision-makers, violating FOIA transparency requirements and hindering accountability.
Corrective Action:
Include the full identification (name, title, and contact information) of all personnel responsible for handling this request in every future communication.
4. Misrouting and Administrative Closure Without Justification
Violation:
The U.S. Department of State improperly closed this FOIA request, claiming a lack of jurisdiction despite the request being directed to the DOJ Civil Rights Division. This error has caused unnecessary delays and procedural confusion.
Corrective Action:
The DOJ Civil Rights Division must immediately reopen FOIA Request No. 25-00044-F and confirm that processing will continue without delay.
Ensure no further misrouting or administrative closure of this request occurs.
5. Improper Handling of Attachments and Lack of Simplified Summaries
Violation:
Attachments provided to date lack proper labeling, accessibility, and simplified summaries for complex or technical documents, violating 28 C.F.R. 35.160 and Section 508 standards.
Corrective Action:
Ensure all attachments are properly labeled, formatted for screen-reader compatibility, and accompanied by simplified summaries for technical documents.
6. Unjustified Denial of Expedited Processing
Violation:
Expedited processing was denied without addressing the statutory requirements under 5 U.S.C. 552(a)(6)(E), despite the public interest and urgent need for transparency regarding Medicaid oversight and ADA compliance.
Corrective Action:
Reevaluate the expedited processing determination and provide a detailed explanation if denied, citing applicable statutory provisions.
Legal Foundation for Demands
This appeal is supported by the following legal mandates:
FOIA (5 U.S.C. 552): Ensuring timely and transparent disclosure of public records.
ADA (42 U.S.C. 12132; 28 C.F.R. 35.160): Requiring reasonable accommodations and effective communication for individuals with disabilities.
Section 508 of the Rehabilitation Act: Mandating accessible electronic and information technology.
Federal Whistleblower Protection Standards: Safeguarding individuals from retaliatory barriers in accessing public records.
Immediate Demands for Compliance
I formally demand the following actions:
Acknowledgment of this Correspondence: Confirm receipt of this appeal within two (2) business days.
Provision of ADA-Compliant Communication: Guarantee exclusive email communication, embedded text in the email body, and accessible attachments.
Delivery of EDC: Provide a clear and reasonable EDC for FOIA Request No. 25-00044-F.
Identification of Responsible Personnel: Include full identification of all FOIA officers and decision-makers in every response.
Reopening of Misrouted Requests: Confirm that processing of FOIA Request No. 25-00044-F has resumed within the DOJ Civil Rights Division.
Simplified Summaries and Proper Attachments: Ensure all future responses meet accessibility standards and include necessary summaries.
Reevaluation of Expedited Processing: Provide a legally justified response regarding expedited processing.
Consequences of Continued Non-Compliance
Failure to comply with the outlined demands will result in immediate escalation through:
Administrative Complaints: Formal complaints with the Office of Government Information Services (OGIS) and other oversight bodies.
Legal Action: Filing of a judicial review under FOIA and ADA statutes.
Public Advocacy: Engagement with advocacy groups and media outlets to ensure accountability and transparency.
Conclusion
This correspondence seeks unimpeded access to public records and adherence to federal laws ensuring accessibility and transparency. Your prompt response will demonstrate the agencys commitment to these principles.
Please confirm receipt of this appeal and the timeline for compliance within two (2) business days.

Subject: Immediate Compliance Demand for FOIA Request No. 25-00044-F: Addressing FOIA Violations, ADA Accommodation Non-Compliance, and Procedural Obstructions
I. Introduction
This formal complaint addresses significant legal violations in handling FOIA Request No. 25-00044-F, submitted on October 24, 2024. These issues span non-compliance with the Freedom of Information Act (FOIA), Americans with Disabilities Act (ADA), and whistleblower protections.
Despite the clear legal obligations to provide timely and accessible records, the Department of Justice (DOJ) Civil Rights Division and other agencies have engaged in repeated procedural delays, failed to adhere to ADA accommodations, and improperly routed or administratively closed requests. These failures obstruct the transparency, accountability, and accessibility guaranteed under federal law.
II. Violations and Required Corrective Actions
1. FOIA Violations and Delays
Missed Deadlines: The agency failed to meet the statutory 20-business-day response deadline under 5 U.S.C. 552(a)(6)(A).
Failure to Provide Estimated Completion Date (EDC): Agencies are legally obligated under 5 U.S.C. 552(a)(7)(B)(ii) to provide an EDC upon request. No EDC has been provided despite multiple inquiries.
Improper Administrative Closure: The U.S. Department of State incorrectly closed the FOIA request without forwarding it to the DOJ Civil Rights Division, causing unnecessary delays.
Corrective Action Required:
Provide a written EDC within five (5) business days for FOIA Request No. 25-00044-F.
Reopen and resume the FOIA request process without further administrative obstruction.
2. ADA Accommodation Failures
Communication Barriers: Responses have been issued through inaccessible portals and formats, violating 42 U.S.C. 12132 and 28 C.F.R. 35.160.
Improper Formatting: Attachments were not screen-reader compatible or properly labeled, breaching Section 508 of the Rehabilitation Act and WCAG accessibility standards.
Failure to Confirm Accommodations: No confirmation of ADA compliance has been provided, leaving accommodations unaddressed.
Corrective Action Required:
Transition all communications to email only, ensuring accessibility without portals or physical mail.
Embed substantive text in the email body and provide attachments in labeled, screen-reader-compatible PDFs.
Confirm ADA accommodation compliance and commit to implementing these measures for all future communications.
3. Procedural Errors in Records Management
Failure to Identify FOIA Personnel: Responses lacked the names, titles, and contact information of responsible officers, undermining transparency.
Improper Handling of Attachments: Attachments were inadequately labeled, making record review unnecessarily burdensome.
Corrective Action Required:
Provide full identification (name, title, and contact information) of all officers handling FOIA Request No. 25-00044-F.
Properly label all future records by date and type.
4. Denial of Expedited Processing
Expedited processing was unjustly denied, despite the public interest in the transparency of Medicaid oversight and ADA compliance. 5 U.S.C. 552(a)(6)(E) requires expedited review when a request involves significant public interest.
Corrective Action Required:
Reassess and approve expedited processing for FOIA Request No. 25-00044-F.
Provide a written explanation if expedited processing is denied, including a detailed justification under FOIA standards.
5. Failure to Provide Simplified Summaries for Complex Documents
Agencies did not provide plain-language summaries for records containing legal or technical content, violating ADA accessibility standards.
Corrective Action Required:
Include simplified summaries with all records containing complex or technical language.
III. Legal Foundation Supporting This Complaint
1. FOIA and Transparency Laws
5 U.S.C. 552: Mandates timely and transparent disclosure of public records.
Connecticut FOIA (C.G.S. 1-200 et seq.): Reinforces state-level obligations to ensure accessibility and compliance.
2. Americans with Disabilities Act (ADA)
42 U.S.C. 12132; 28 C.F.R. 35.160: Requires public entities to ensure effective communication and equal access for individuals with disabilities.
3. Rehabilitation Act (Section 508)
Mandates accessible electronic formats for documents to ensure usability for individuals with disabilities.
4. Whistleblower Protections
31 U.S.C. 3730: Protects individuals pursuing transparency and accountability in government programs.
5. Constitutional Protections
First Amendment: Guarantees the right to petition the government for grievances.
Fifth and Fourteenth Amendments: Protect due process and equal protection.
IV. Demands for Immediate Action

ADA Accommodations Request
This request includes explicit ADA accommodations to address cognitive processing challenges resulting from my traumatic brain injury (TBI). These accommodations are legally required under Title II of the ADA (42 U.S.C. 12132) and Section 504 of the Rehabilitation Act (29 U.S.C. 794).
Requested ADA Accommodations
To ensure accessibility and compliance with ADA standards (42 U.S.C. 12101 et seq.), I request the following accommodations for all communications and records:

Key information must be embedded directly in the email body to facilitate comprehension.
Simplified Summaries
Provide plain-language summaries for complex or legal documents to ensure clarity.
Identification of Responsible Officers
Include the full name, title, and contact information of all responsible officers handling this request.
Non-Negotiable Compliance
These accommodations are non-negotiable and are essential for ensuring equal access to information. Any failure to provide the requested accommodations may constitute a violation of the ADA and the Rehabilitation Act. Thank you for ensuring compliance and accessibility in addressing this request.

Identify Responsible Personnel: Include full identification of FOIA officers and decision-makers in every response.
Approve Expedited Processing: Reassess and approve expedited processing based on public interest.
Provide Simplified Summaries: Include summaries for all complex or technical records.
V. Consequences of Continued Non-Compliance
If these demands are not met within the specified timeframes, I will take the following actions:
File Administrative Complaints: Submit formal complaints to the Office of Government Information Services (OGIS) and the Office for Civil Rights (OCR).
Pursue Legal Action: Initiate litigation to enforce compliance with FOIA, ADA, and whistleblower protection laws.
Engage Public Advocacy: Collaborate with media outlets and advocacy organizations to highlight these violations.
VI. Conclusion
This complaint underscores the urgent need for transparency, accountability, and accessibility in government processes. I demand immediate corrective action to resolve these issues and uphold the legal and ethical standards governing FOIA and ADA compliance.
