To: FOIA Officer, Connecticut Department of Social Services (DSS)

Subject: FOIA Request for NPI Numbers and Provider Information under Connecticut Medicaid ABI Waiver Program
Dear FOIA Officers,
Pursuant to the Connecticut Freedom of Information Act (C.G.S. 1-200 to 1-242) and the Federal Freedom of Information Act (5 U.S.C. 552), I am requesting access to records containing the National Provider Identifier (NPI) numbers and provider information for all entities approved to deliver services under Connecticuts Medicaid Acquired Brain Injury (ABI) Waiver Program. This request is submitted to both the Connecticut Department of Social Services (DSS) and the Centers for Medicare & Medicaid Services (CMS) to ensure a full and accurate compilation of records related to the Medicaid ABI Waiver providers.
Scope of Request
1.	Provider Information for Medicaid ABI Waiver Program:
o	A complete list of NPI numbers, along with corresponding provider names and addresses, for all entities authorized under Connecticuts Medicaid ABI Waiver Program. This includes all providers in the Medicaid Acquired Brain Injury Approved Provider Registry managed by DSS and recognized by CMS.
2.	Provider Registry Documentation:
o	Any official registries, directories, or databases maintained by CMS or DSS that list the approved ABI Waiver providers and their associated NPI numbers.

Purpose and Public Interest Justification
The requested information is essential to support transparency, public accountability, and accessibility in Medicaid-funded services. Access to these records will enable stakeholders and beneficiaries to verify approved providers, ensuring that taxpayer-funded services are administered equitably and with oversight. This request serves the public interest by facilitating oversight of Medicaid resources and supporting beneficiaries in making informed provider choices.

Legal Basis for Request
This request is supported by state and federal laws governing public access to records and ensuring Medicaid program transparency:
Connecticut Freedom of Information Act (C.G.S. 1-200 to 1-242): Provides public access to state-held records, including Medicaid-related data.
Connecticut Public Records Law (Conn. Gen. Stat. 1-210): Requires prompt access to public agency records, ensuring transparency for taxpayer-funded programs.
Freedom of Information Act (5 U.S.C. 552): Governs access to federal records, ensuring transparency and accountability for CMS-administered programs.
Social Security Act Title XIX (Medicaid) (42 U.S.C. 1396 et seq.): Mandates federal and state oversight of Medicaid-funded programs.
Connecticut Non-Discrimination Law (Conn. Gen. Stat. 46a-58(a)), Americans with Disabilities Act (ADA) (42 U.S.C. 12101 et seq.), and Section 504 of the Rehabilitation Act of 1973 (29 U.S.C. 794): Require that individuals with disabilities receive accommodations for full access to information, ensuring compliance in FOIA processes.

Disability and Accessibility Accommodations
In accordance with ADA and Section 504 requirements, please apply the following accommodations to ensure my full access to these records:
1.	Email-Only Communication:
o	All responses, updates, and records should be sent exclusively via email to AabiWR@live.com. No physical mail, phone calls, portal-based communications, external links, or alternative platforms are permitted.
2.	Electronic and Accessible Format:
o	Provide all documents in accessible electronic formats (e.g., PDFs compatible with screen readers).
3.	Complete Documentation:
o	Provide all records without redactions unless legally required. For any necessary redactions, cite the specific legal exemption applied and include a summary.
4.	Detailed Explanations for Any Denials:
o	If any portion of this request is denied, provide a clear and detailed explanation for each denied item, citing relevant statutes or exemptions.
5.	Guidance for Complex Records:
o	For records containing complex financial, legal, or procedural language, please include summaries or simplified explanations to ensure comprehension.
6.	Identification of FOIA Officer Handling This Request:
o	Provide the full name, title, and direct contact information of the FOIA officer assigned to my request. This information is necessary for transparency and documentation.
7.	Confirmation of Accommodations:
o	Confirm receipt of this request and explicitly acknowledge that each accommodation listed will be fully applied in all responses and communications.

Request for Expedited Processing
Due to the pressing public interest in transparency and accountability in Medicaid-funded services for vulnerable populations, I request expedited processing under Conn. Gen. Stat. 1-210(a), which mandates prompt availability of public records, and 5 U.S.C. 552(a)(6)(E), which allows expedited FOIA processing when there is an urgent need to inform the public.
Fee Waiver Request
I request a waiver of all associated fees under Conn. Gen. Stat. 1-212(d) and 5 U.S.C. 552(a)(4)(A)(iii), as this request is in the public interest and not for commercial use. The disclosure of the requested information will contribute significantly to the publics understanding of Medicaid operations and beneficiary access to services under the ABI Waiver Program.
Timeline Expectation
Please confirm receipt of this request within four business days as required by Connecticut FOIA laws. Additionally, I request an estimated timeline for fulfillment.
Thank you for your attention to this matter and for upholding transparency and accountability in Connecticuts Medicaid system.

Subject: Re: Connecticut Freedom of Information Act Request - Confirmation of Accommodations, Expedited Processing, and Timeline

Dear Ms. Bartomioli,

Thank you for your prompt acknowledgment of my Freedom of Information Act (FOIA) request regarding the NPI numbers and provider information for entities under Connecticuts Medicaid Acquired Brain Injury (ABI) Waiver Program.

To facilitate the Department of Social Services compliance with the Connecticut FOIA and to ensure that my legal rights to public access are fully preserved, I respectfully request confirmation of the following key elements outlined in my original request:

Accommodations under ADA and Section 504 Compliance:
I request explicit confirmation that the Department will implement the accessibility accommodations enumerated in my initial request, including the exclusive use of electronic email communication and provision of all responsive documents in accessible electronic formats compatible with screen readers. Furthermore, I request that all records be provided unredacted unless subject to a statutory exemption, and that any exemptions applied are cited with specific statutory references and explanatory summaries.

Expedited Processing Justification:
Given the public interest in transparent administration of Medicaid-funded services, I request confirmation as to whether the Department has granted expedited processing under Conn. Gen. Stat. 1-210(a) and 5 U.S.C. 552(a)(6)(E). If expedited processing is not granted, please provide the rationale and specific statutory basis for the denial.

Fee Waiver under Public Interest Provisions:
Pursuant to Conn. Gen. Stat. 1-212(d) and 5 U.S.C. 552(a)(4)(A)(iii), I requested a waiver of all fees associated with this FOIA request on the grounds of public interest and non-commercial use. Please confirm if the Department will waive all fees accordingly. Should the Department determine that a fee is required, I respectfully request that a detailed estimate be provided prior to any action incurring costs.

Timeline for Fulfillment:
Consistent with the statutory timeline under Conn. Gen. Stat. 1-210(a), I request an estimated timeframe for the Departments fulfillment of this request. Connecticut FOIA requires that all public records be made available promptly, and I look forward to your estimate of the anticipated date of production.

Thank you for your attention to these procedural and substantive elements of my request. Please confirm each of these items at your earliest convenience to ensure compliance with state and federal FOIA obligations and accommodation requirements.

Sincerely,
David Medeiros

Legal Context and Appeal Basis
This is a formal appeal regarding the failure of the Department of Social Services (DSS) to fully comply with my Freedom of Information Act (FOIA) request filed on November 5, 2024. This request pertains to transparency and accountability regarding NPI numbers and provider information for entities delivering services under Connecticuts Medicaid Acquired Brain Injury (ABI) Waiver Program. The issues at hand encompass FOIA non-compliance, violations of the Americans with Disabilities Act (ADA), and potential constitutional rights infringements.

Summary of Legal Violations
1. FOIA Non-Compliance
Failure to Grant Expedited Processing (5 U.S.C. 552(a)(6)(E)):
The request meets the statutory criteria for expedited processing due to its significance to the public interest and immediate implications for Medicaid beneficiaries. DSS has failed to confirm expedited processing.
Failure to Provide a Timeline for Records (Conn. Gen. Stat. 1-210):
The Connecticut FOIA mandates prompt responses to requests, with an obligation to provide a timeline for fulfillment. DSS has not met this requirement.
Failure to Identify Responsible Personnel (5 U.S.C. 552(a)(6)(B)(ii)):

Non-compliance impedes my right to petition the government for information about public programs, violating the First Amendment.
Due Process (Fifth and Fourteenth Amendments):
The lack of transparency and delay in fulfilling this FOIA request infringes upon my due process rights to access public records necessary for oversight.
Legal Authorities and Supporting Case Law

Date: December 31, 2024
To: Connecticut Department of Social Services (DSS) FOIA Office
Subject: FOIA Appeal: NPI Numbers and Provider Information under Connecticut Medicaid ABI Waiver Program

Introduction
This is a formal appeal regarding the failure of the Department of Social Services (DSS) to fully comply with my Freedom of Information Act (FOIA) request filed on November 5, 2024. The request pertains to National Provider Identifier (NPI) numbers and provider information for entities delivering services under Connecticuts Medicaid Acquired Brain Injury (ABI) Waiver Program. This appeal highlights non-compliance with FOIA requirements, Americans with Disabilities Act (ADA) mandates, and fundamental constitutional rights.

Legal Violations
1. FOIA Non-Compliance
Failure to Grant Expedited Processing (5 U.S.C. 552(a)(6)(E)):
Despite the urgent public interest in Medicaid-funded services and the potential harm to vulnerable populations, DSS has not granted expedited processing or provided justification for denial.

Failure to Provide a Timeline for Records (Conn. Gen. Stat. 1-210):
The Connecticut FOIA requires prompt responses and the provision of an estimated timeline for fulfillment. DSS has not met this statutory obligation.

Failure to Identify Responsible Personnel (5 U.S.C. 552(a)(6)(B)(ii)):
FOIA mandates that agencies identify the officials managing the request. DSS has failed to provide the full names, roles, or contact details of responsible officers.

2. ADA and Section 504 Violations
Denial of Accessibility Accommodations (42 U.S.C. 12132; 29 U.S.C. 794):
DSS has not confirmed adherence to my non-negotiable ADA accommodations, such as electronic-only communication and accessible document formatting.

Failure to Provide Accessible Formats (28 C.F.R. 35.160):
The ADA requires agencies to provide public records in formats compatible with assistive technologies. DSSs initial response did not address this obligation.

3. Constitutional Violations
First Amendment Right to Petition:
Delays and non-compliance impede my right to access public information necessary for government oversight and grievance redress.

Due Process (Fifth and Fourteenth Amendments):
The lack of timely response and transparency infringes on my right to procedural fairness in accessing public records.

Legal Authorities and Case Law
FOIA Compliance
U.S. DOJ v. Reporters Committee for Freedom of the Press (1989): Emphasizes FOIAs purpose to ensure transparency and accountability.
Milner v. Department of the Navy (2011): Reinforces narrow application of FOIA exemptions to maximize public access.

ADA and Section 504 Compliance
Lane v. Brown (2014): Establishes that public programs must provide reasonable accommodations to individuals with disabilities.
Constitutional Protections
NARA v. Favish (2004): Upholds the publics right to oversee government actions, especially regarding programs affecting vulnerable populations.
Relief Requested
Expanded Record Search:

Conduct a thorough search across all relevant DSS divisions, including Provider Enrollment, Medicaid Compliance, and Contracting.
Timeline for Compliance:

Provide an estimated timeline for fulfilling the request, as required by Conn. Gen. Stat. 1-210.
Confirmation of ADA Accommodations:

Commit to providing all records in screen-reader-compatible formats and exclusive email communication with no external links or portals.
Detailed Explanation of Search Efforts:

Disclose the scope of the original search, including:
Divisions and databases queried.
Search terms used.
Timeframes covered.
Referral to Relevant Agencies:

If DSS lacks responsive records, formally refer the request to the appropriate state or federal entities, including CMS and HHS.
Non-Negotiable ADA Accommodations
Screen-Reader Compatible Formats:
All records must be provided in screen-reader-compatible formats (e.g., properly labeled PDFs or plain-text files).

Exclusive MUCKROCK Platform Communications:
All communications and records must be delivered exclusively through the MuckRock platform. No external links, emails, portals, passwords, phone calls or physical mail are acceptable.

Simplified Summaries:
For complex or technical records, include plain-language summaries.

Identification of Responsible Officers:
Provide the full name, title, and contact information of all officers handling the request.

Detailed Redaction Justifications:
If redactions are necessary, cite specific statutory exemptions with detailed explanations.

Expedited Processing Justification
Under 5 U.S.C. 552(a)(6)(E) and Conn. Gen. Stat. 1-210(a), expedited processing is justified due to:

Urgency to Inform the Public: Medicaid administration is of significant public interest, particularly regarding the oversight of taxpayer funds.
Potential Harm to Vulnerable Populations: Delays could result in inadequate services or oversight failures affecting individuals with disabilities.
Escalation Plan
If DSS fails to comply promptly, this matter will be escalated to:

Federal Oversight Authorities:

Centers for Medicare & Medicaid Services (CMS)
U.S. Department of Health and Human Services (HHS)
U.S. Department of Justice (DOJ) Civil Rights Division
Judicial Review:

File a federal court complaint seeking injunctive relief and attorney fees under FOIA.
Conclusion
DSS must fulfill its legal obligations promptly. Failure to address this appeal will result in further escalation to oversight bodies and potential litigation to enforce compliance. Transparency and accessibility are non-negotiable requirements under state and federal law.

Please confirm receipt of this complaint within two (2) business days and provide a timeline for compliance by January 10, 2025. Non-compliance will trigger immediate escalation.

Request for Assistance Medicaid Oversight, ADA Compliance, Retaliation, and Civil Rights

Dear Senator Richard Blumenthal, Senator Chris Murphy, Governor Ned Lamont, and Attorney General William Tong,

I am reaching out to request your support in addressing urgent concerns related to Medicaid oversight, ADA compliance failures, whistleblower retaliation, and civil rights violations within the State of Connecticut. As leaders committed to justice and equity, your intervention is critical to ensuring transparency, accountability, and the protection of vulnerable individuals who rely on federally funded programs.

These systemic issues not only harm individuals but also undermine public trust in programs designed to serve our most vulnerable populations. I respectfully ask for your assistance in holding HHS, CMS, DOJ, FBI, DSS, CHRO, and other relevant agencies accountable for their responsibilities under federal and state law.

Your leadership and dedication to justice are invaluable in advancing these efforts. Please let me know how I can provide further information or collaborate to address these critical issues.

Subject: Urgent Request for Investigation into OSC Case Records, Altered Decisions, and Suppressed Reports

Dear FBI Team,

I am formally requesting your assistance to investigate systemic failures, misconduct, and potential criminal activity surrounding the handling of my submissions to the Office of Special Counsel (OSC). These failures directly impact whistleblower protections, Medicaid oversight, and public accountability.

Issues to Investigate

1. Case Numbers and Records Management

Case Numbers Requiring Investigation:

DI-25-000310

DI-25-000325

DI-25-000379

DI-12192024714

DI-12112024134

OSCFiling-MedeirosDavid-DI-12202024300

OSCFiling-MedeirosDavid-DI-112620241121

2. Anonymity and Lack of Accountability in Decision-Making

Unsigned Determination Letters:

Many determination letters from OSC lack identifiable signatures, names, or clear authorship.

This practice raises serious concerns about accountability and compliance with transparency laws.

3. Suppressed or Altered Records

Evidence suggests discrepancies between the whistleblower reports I submitted and how they were recorded or handled by OSC.

Specific issues include:

Alterations or removal of content from submitted complaints.

Suppression of reports that exposed systemic failures in Medicaid oversight and retaliation against whistleblowers.

4. Lack of FOIA Compliance

Despite repeated Freedom of Information Act (FOIA) requests, OSC and related agencies have failed to provide:

Complete case files and communication logs.

Justification for withheld or redacted information.

Clear timelines for compliance.

Specific Questions to Investigate

1. Who is Responsible for Managing These Records?

Identify the individuals, teams, or automated systems involved in creating, altering, and assigning these case numbers and reports.

2. What Decisions Were Made and Why?

Determine how decisions were reached, why some reports were closed without action, and why letters were sent anonymously.

3. Were There Violations of Federal Law?

Investigate potential obstruction of justice, retaliation, or misuse of authority under whistleblower protection laws and FOIA.

Key Agencies and Officials Involved

This matter spans multiple federal and state agencies, including:

 Office of Special Counsel (OSC)

 Department of Justice (DOJ)

Centers for Medicare & Medicaid Services (CMS)

Department of Health and Human Services (HHS)

 Office of Inspector General (OIG)

Why This Matters

1. Whistleblower Protections:

Retaliation against whistleblowers and suppression of reports undermine federal protections designed to safeguard transparency and accountability.

2. Impact on Vulnerable Populations:

These failures harm Medicaid consumers, particularly those with disabilities, by allowing systemic mismanagement to persist unchecked.

3. Misuse of Taxpayer Funds:

Lack of oversight and accountability results in waste and misuse of federal funds meant to serve the public.

Requested Actions

1. Investigate Record Management:

Audit all OSC records, emails, and internal communications related to these case numbers.

Identify responsible individuals or systems.

2. Subpoena Additional Evidence:

Secure all suppressed or altered reports to ensure a complete and accurate investigation.

3. Hold Accountable Those Involved in Misconduct:

Recommend prosecution or disciplinary action for any individuals found to have violated federal laws.

4. Ensure Compliance with FOIA and Whistleblower Protections:

Mandate OSC and related agencies to comply fully with FOIA requests and whistleblower laws.

Attachments

I have attached all available documentation, including:

Correspondence with OSC, including determination letters and emails.

FOIA requests and responses (or lack thereof).

Detailed reports submitted to OSC and other federal agencies.

This issue demands immediate attention to uphold the principles of transparency, accountability, and justice. I am available to provide additional information or documentation as needed.

Sincerely,
David Medeiros

As recognized in National Archives and Records Administration v. Favish, 541 U.S. 157 (2004), transparency is fundamental to democracy and public trust. Your agencys obligations are not discretionary, and failure to meet them constitutes a violation of statutory and constitutional law. This letter establishes your duties, addresses deficiencies, and anticipates and counters all potential deflection strategies.

1. FOIA Obligations: Statutory Mandates and Required Actions
FOIA establishes an enforceable right of access to federal agency records. Your response must meet the following requirements:

A. Timeliness
Under 5 U.S.C. 552(a)(6)(A), you are required to provide a determination within 20 business days. Delays beyond this timeframe, absent legitimate extension requests, constitute a violation of FOIA.
Countermeasure: Delays are actionable under Citizens for Responsibility and Ethics in Washington v. DOJ, 711 F.3d 180 (D.C. Cir. 2013).
Required Action: Provide the requested records or a lawful determination.

B. Adequacy of Search
FOIA requires a thorough and reasonable search for records, as established in Campbell v. DOJ, 164 F.3d 20 (D.C. Cir. 1998). This includes:
Identifying the databases, locations, and terms used.
Providing a sworn affidavit detailing the search scope.
Countermeasure: A vague claim of "no responsive records" is insufficient without a detailed affidavit.
Required Action: Submit a sworn affidavit documenting the search or confirm the existence of responsive records.

C. Proper Use of Exemptions
Exemptions under 5 U.S.C. 552(b) must be narrowly applied and justified with specific explanations. Blanket or vague exemptions are impermissible.
Countermeasure: A Vaughn index (Vaughn v. Rosen, 484 F.2d 820 (D.C. Cir. 1973)) is required to justify each withholding.
Required Action: Submit a Vaughn index detailing each exemption and its justification within 10 business days.

D. Decentralization and Referrals
Referrals or decentralization excuses do not absolve your agency of its responsibility to provide a consolidated response. As held in McGehee v. CIA, 697 F.2d 1095 (D.C. Cir. 1983), agencies must coordinate internally to ensure compliance.
Countermeasure: Require assurance of continuity and coordination across divisions.
Required Action: Consolidate records from all relevant offices and provide a unified response.

2. ADA and Rehabilitation Act Compliance: Equal Access as a Legal Right
As a person with a documented disability, I am entitled to reasonable accommodations under the ADA and Section 504 of the Rehabilitation Act. Your failure to provide accessible formats for requested records constitutes discrimination and violates federal law.

Case Law:
Tennessee v. Lane, 541 U.S. 509 (2004): Agencies must ensure meaningful access to government services.
Alexander v. Choate, 469 U.S. 287 (1985): Denial of reasonable accommodations creates barriers that violate civil rights.

Required Action:
Provide all requested records in accessible formats, including plain-language summaries or electronic files compatible with assistive technologies.
Confirm compliance with ADA requirements by [specific date].

3. Mandated Reporting and Whistleblower Protections
Your handling of this request implicates broader concerns, including potential fraud, misuse of federal funds, or retaliation against whistleblowers. Under the Whistleblower Protection Act (5 U.S.C. 2302), you are required to report and address systemic violations.
Countermeasure: Reference Misprision of Felony (18 U.S.C. 4), which requires the reporting of observed violations of law.
Required Action: Document and escalate evidence of misconduct to oversight bodies, including the Office of Inspector General (OIG).

4. Consequences of Non-Compliance
Failure to comply with your statutory obligations knowingly constitutes violations of:
Obstruction of Justice (18 U.S.C. 1505): Delaying lawful access to records obstructs public accountability.
Civil Rights Violations (42 U.S.C. 1983): Denying ADA accommodations constitutes a deprivation of federally protected rights.
Misprision of Felony (18 U.S.C. 4): Concealing or failing to report observed violations is a criminal act.
Countermeasure: Prepare for judicial review, oversight complaints, and public advocacy if compliance fails.

5. Escalation Pathways
If your office does not comply within the specified timeframe, I will escalate this matter through:
Judicial Review: Filing a lawsuit under 5 U.S.C. 552(a)(4)(B) to compel disclosure.
Oversight Complaints: Submitting formal complaints to OGIS, OIG, and the DOJ Civil Rights Division.
Public Advocacy: Engaging investigative journalists, transparency advocates, and public interest organizations to ensure accountability.

6. Final Statement: Upholding Transparency and Accountability
This matter reflects the publics right to transparency and the preservation of trust in government institutions. Your actions will either affirm your agencys commitment to accountability or further evidence systemic disregard for these principles.

I look forward to your prompt and substantive response.

The challenges we face today demand more than acknowledgmentthey require action, collaboration, and a unified commitment to solutions. Together, we must embrace transparency, accountability, and compassion as the
foundation of our efforts. By fostering open communication, prioritizing the needs of the most vulnerable, and holding systems accountable, we can rebuild trust and ensure equitable outcomes for all.

Solutions lie in unitywhen state and federal leaders, advocates, and communities work hand in hand to uphold justice and fairness. Transparency through accessible Freedom of Information processes, adherence to legal
mandates, and robust oversight are the pillars that support meaningful change. Each of us has a role to play in creating a system that serves and protects.

Our collective mission is clear: to build bridges between agencies and communities, ensure the dignity of every individual, and honor the principles that guide us toward progress. Together, with determination and unity, we can
overcome systemic failures and pave the way for a brighter, more inclusive future.

Americans living with disabilities and their families are Americansfull citizens of this nation, protected by the same Constitution that guarantees the rights and freedoms of every individual. We are not separate, lesser, or forgotten. We are Americans with the same unalienable rights to life, liberty, and the pursuit of happiness.

We stand firmly on the principles of equality, dignity, and justice. Our voices matter. Our contributions matter. And our rightsour Constitutional rightsmust be respected, upheld, and protected without exception or delay.

We are Americans with rights. Period.
