Dear FOIA Officers and Supervisory Officers,

Pursuant to the Connecticut Freedom of Information Act (Conn. Gen. Stat. 1-200 et seq.) and the federal Freedom of Information Act (5 U.S.C. 552), I respectfully request access to all records from January 1, 2012, to the present related to communications, funding, agreements, policy analysis, and compliance oversight involving Connecticuts Medicaid programs, particularly focusing on the Acquired Brain Injury (ABI) Waiver Program. This request pertains to records involving the following entities:

Connecticut Department of Social Services (DSS)
Accenture and Manatt, Phelps & Phillips, LLP (Manatt), in their roles as consultants to DSS

Federal agencies involved in Medicaid program oversight, including CMS, HHS, OIG, GAO, CDC, and DOJs Civil Rights Division
This request supports transparency, accountability, and oversight of Medicaid programs affecting vulnerable populations, particularly those involved in the ABI Waiver Program, managed care models, and accessibility initiatives.

Scope and Objectives of the Request
The objective of this request is to capture comprehensive records to allow for independent review, transparency, and the protection of vulnerable Medicaid populations in the following areas:

Records of amendments to the ABI Waiver Program and other Medicaid waivers managed by Connecticut DSS in consultation with Accenture and Manatt, as reviewed by federal agencies (CMS, HHS).

Federal Oversight, Accountability, and Compliance
Documentation from federal agencies related to funding compliance, regulatory oversight, or audits, evaluations, or investigations assessing DSSs Medicaid program management, especially regarding the ABI Waiver and the involvement of Accenture and Manatt.

Detailed Records Requested
Please provide copies of the following documents:

Connecticut DSS: Contracts, MOUs, agreements, and scope of work documents between DSS and Accenture or Manatt.

Expedited processing is requested based on the following compelling factors:

Significant Public Interest in Government Transparency: Medicaid programs are taxpayer-funded and affect a large segment of the public. Ensuring that DSSs activities and collaborations with consulting firms like Accenture and Manatt align with federal and state standards is of great public interest. Expedited processing will allow public scrutiny and foster informed dialogue on the management and ethical administration of Medicaid services. The requested information will help assess whether any waste, fraud, or abuse has occurred within DSSs partnerships. Prompt access to these records is essential to identify any potential misconduct and prevent ongoing misuse of taxpayer dollars, particularly within critical programs affecting vulnerable populations.

Time-Sensitive Advocacy Needs: This information is critical for advocacy efforts that inform stakeholders, ensure consumer protection, and foster transparency. Any delay could impede the ability of stakeholders, including advocacy groups and affected individuals, to respond adequately to Medicaid policy changes.

Justification for Fee Waiver
This information will serve the public interest by supporting oversight, transparency, and protection for Medicaid recipients, particularly Connecticuts ABI Waiver participants. The release of these records will contribute to the ethical and accountable administration of taxpayer-funded programs. Accordingly, I request a waiver of fees for processing this request.

Delivery and Accessibility Requirements
To accommodate disability-related needs, please provide all records in digital format via email and avoid using external portals. If records cannot be provided within statutory timeframes, or if any information is withheld, please notify me promptly with legal justifications at AabiWR@live.com

Thank you for your attention and assistance in providing these records to facilitate public understanding and oversight of Connecticut Medicaid services.

Sincerely,
David Medeiros
ABI Resources

I also request that, if possible and pursuant to Conn. Gen. Stat. 1-212(d), fees be waived as I believe this request is in the public interest and not made for commercial gain. The requested documents will be made available to the public at MuckRock.com.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 4 business days, as the statute requires.

Sincerely,

DAVID MEDEIROS

On January 3, 2025, David Medeiros submitted a formal complaint to the Connecticut Attorney Generals Office and FOIA officers, addressing systemic failures to comply with federal and state transparency laws, ADA standards, and whistleblower protections. The complaint arises from the mishandling of his October 29, 2024, FOIA request regarding oversight of Medicaid programs, particularly the ABI Waiver, and related contracts with DSS, Accenture, and Manatt. Despite claims of compliance, the requested records remain undisclosed without valid exemptions, obstructing accountability and transparency.

Medeiros highlights violations including failure to meet FOIA deadlines, lack of ADA-compliant records, non-responsiveness to whistleblower-related inquiries, and negligence in addressing taxpayer oversight concerns. Demands include full disclosure of records, a Vaughn Index for withheld materials, ADA-compliant document delivery, and the identification of officials managing the request. He warns that failure to comply by January 10, 2025, will result in formal complaints to the Connecticut Freedom of Information Commission, ADA enforcement by the DOJ Civil Rights Division, legal action, and escalation to Congressional oversight committees and advocacy organizations.

Formal Complaint and Appeal Regarding FOIA Non-Compliance, ADA Violations, and Constitutional Breaches

Date: January 3, 2025
01.03.2025

To: Office of the Attorney General - Connecticut, and Relevant FOIA Officers

Subject: Escalated Complaint for FOIA Non-Compliance, ADA Violations, and Procedural Mismanagement
This formal complaint is submitted to address the continued failure to comply with the Connecticut Freedom of Information Act (Conn. Gen. Stat. 1-200 et seq.) and the federal Freedom of Information Act (5 U.S.C. 552) regarding my FOIA request dated October 29, 2024.

Your office has claimed prior compliance, yet has failed to produce the requested records or substantiate any legally valid exemption. This persistent failure violates federal and state transparency laws, undermines whistleblower protections, and denies me procedural rights guaranteed under the U.S. Constitution and the Americans with Disabilities Act (ADA).

Violations and Supporting Legal Grounds
1. Constitutional Violations
First Amendment
The First Amendment guarantees the right to petition the government for redress of grievances, which includes access to public records necessary for transparency and accountability. By failing to respond substantively to my FOIA request, your office has obstructed this right.

Relevant Case Law:
Sherrill v. Knight, 569 F.2d 124 (D.C. Cir. 1977): Access to public records is critical for holding government officials accountable.
Richmond Newspapers, Inc. v. Virginia, 448 U.S. 555 (1980): Open access to information supports informed public discourse.
Fifth and Fourteenth Amendments
The delays and incomplete responses violate procedural due process rights under the Fifth and Fourteenth Amendments by denying timely access to government records impacting public welfare.

Relevant Case Law:
Mathews v. Eldridge, 424 U.S. 319 (1976): Procedural fairness is mandatory in administrative processes.
Goldberg v. Kelly, 397 U.S. 254 (1970): Ensures timely access to essential government resources.
2. Violations of Whistleblower Protections
The requested records involve federal and state oversight of Connecticut Medicaid programs, particularly the Acquired Brain Injury (ABI) Waiver, and potential mismanagement involving Accenture and Manatt. Non-disclosure impedes accountability and transparency critical to safeguarding whistleblower rights.

Relevant Case Law:
Lane v. Franks, 573 U.S. 228 (2014): Protects whistleblower disclosures related to governmental misconduct.
Wilburn v. Robinson, 480 F.3d 1140 (D.C. Cir. 2007): Ensures transparency in whistleblower investigations.
Demand:
Full disclosure of all records involving whistleblower complaints, federal oversight, and any retaliatory actions or fraud investigations concerning DSS, Accenture, or Manatt.
3. Violations of Taxpayer Accountability Laws
Connecticut Medicaid programs, including the ABI Waiver, are taxpayer-funded and must be subject to rigorous public scrutiny to ensure proper allocation and ethical management. Non-compliance with FOIA obstructs this oversight.

Relevant Case Law:
Citizens for Responsibility and Ethics in Washington v. DOJ, 846 F.3d 1235 (D.C. Cir. 2017): FOIA ensures accountability in taxpayer-funded programs.
Tax Analysts v. IRS, 294 F.3d 71 (D.C. Cir. 2002): Requires public access to records related to the use of public funds.
Demand:
Release all records pertaining to contracts, agreements, and funding oversight involving DSS, Accenture, and Manatt.
Produce federal audit reports and compliance evaluations specific to Medicaid ABI Waiver programs.
4. Violations of ADA Compliance Standards
Your office has failed to provide ADA-compliant records, despite my explicit request for accessible formats under Title II of the ADA. This failure constitutes discrimination under federal law.

Relevant Case Law:
Tennessee v. Lane, 541 U.S. 509 (2004): Public programs must accommodate individuals with disabilities.
Alexander v. Choate, 469 U.S. 287 (1985): Prohibits systemic barriers denying access to public services.
Demand:
Provide all records in ADA-compliant, screen-reader-compatible formats.
Include plain-language summaries for complex or technical documents.
5. FOIA Procedural Violations
Statutory Non-Compliance
Your office has violated FOIA by failing to:

Respond within statutory time limits.
Provide a Vaughn Index justifying withheld records.
Demonstrate good faith in the search and review process.
Relevant Case Law:
Judicial Watch, Inc. v. U.S. DOJ, 365 F.3d 1108 (D.C. Cir. 2004): Agencies must justify exemptions with specificity.
Open America v. Watergate Special Prosecution Force, 547 F.2d 605 (D.C. Cir. 1976): Timely responses are critical to FOIAs purpose.
Demand:
Conduct a comprehensive search of all responsive records.
Produce a Vaughn Index for any withheld materials.
Provide a detailed explanation of search methods, including databases reviewed.
Remedies and Escalation
Immediate Actions Required
Identification of Responsible Personnel:
Provide names, titles, and direct contact information for all officials handling this FOIA request.

Comprehensive Response:

Deliver all requested records without further delay.
Include a Vaughn Index for any withheld or redacted materials.
ADA-Compliant Delivery:

Ensure all documents are accessible and include plain-language summaries.
Expedited Processing and Fee Waiver Approval:

Approve expedited processing under 5 U.S.C. 552(a)(6)(E) due to compelling public interest.
Waive fees under 5 U.S.C. 552(a)(4)(A)(iii), as this request is non-commercial and serves the public interest.
Escalation Path for Non-Compliance
Failure to comply with this appeal by January 10, 2025, will result in the following actions:

Formal Complaints:

File complaints with the Connecticut Freedom of Information Commission and the DOJs Office of Information Policy (OIP).
ADA Enforcement:

Submit a formal complaint to the DOJ Civil Rights Division for ADA non-compliance.
Judicial Action:

Pursue injunctive relief and attorneys fees under:
FOIA (5 U.S.C. 552(a)(4)(B), (E))
ADA (42 U.S.C. 12188)
Congressional Oversight:

Notify Congressional oversight committees and public advocacy organizations of systemic transparency failures.
Conclusion
This appeal demands immediate corrective actions to address the cited violations and provide all requested records. Please confirm receipt within two (2) business days and deliver a complete response by January 10, 2025.

Sincerely,
David Medeiros
Founder, ABI Resources

01.07.2025 Appeal 10/29/2024

Subject: Connecticut Freedom of Information Act Request: Records Regarding Connecticut Medicaid Programs, ABI Waiver, Amendments, and Federal Agency Oversight and Communications with Accenture and Manatt (2012Present) (Office of the Attorney General - C

Request for Assistance Medicaid Oversight, ADA Compliance, Retaliation, and Civil Rights

Dear Senator Richard Blumenthal, Senator Chris Murphy, Governor Ned Lamont, and Attorney General William Tong,

I am reaching out to request your support in addressing urgent concerns related to Medicaid oversight, ADA compliance failures, whistleblower retaliation, and civil rights violations within the State of Connecticut. As leaders committed to justice and equity, your intervention is critical to ensuring transparency, accountability, and the protection of vulnerable individuals who rely on federally funded programs.

These systemic issues not only harm individuals but also undermine public trust in programs designed to serve our most vulnerable populations. I respectfully ask for your assistance in holding HHS, CMS, DOJ, FBI, DSS, CHRO, and other relevant agencies accountable for their responsibilities under federal and state law.

Your leadership and dedication to justice are invaluable in advancing these efforts. Please let me know how I can provide further information or collaborate to address these critical issues.

*** Federal Bureau of Investigation (FBI)
Subject: Urgent Request for Investigation into OSC Case Records, Altered Decisions, and Suppressed Reports

Dear FBI Team,

I am formally requesting your assistance to investigate systemic failures, misconduct, and potential criminal activity surrounding the handling of my submissions to the Office of Special Counsel (OSC). These failures directly impact whistleblower protections, Medicaid oversight, and public accountability.

Issues to Investigate

1. Case Numbers and Records Management

Case Numbers Requiring Investigation:

DI-25-000310

DI-25-000325

DI-25-000379

DI-12192024714

OSCFiling-MedeirosDavid-DI-12202024300

OSCFiling-MedeirosDavid-DI-112620241121

2. Anonymity and Lack of Accountability in Decision-Making

Unsigned Determination Letters:

Many determination letters from OSC lack identifiable signatures, names, or clear authorship.

This practice raises serious concerns about accountability and compliance with transparency laws.

3. Suppressed or Altered Records

Evidence suggests discrepancies between the whistleblower reports I submitted and how they were recorded or handled by OSC.

Specific issues include:

Alterations or removal of content from submitted complaints.

Suppression of reports that exposed systemic failures in Medicaid oversight and retaliation against whistleblowers.

4. Lack of FOIA Compliance

Despite repeated Freedom of Information Act (FOIA) requests, OSC and related agencies have failed to provide:

Complete case files and communication logs.

Justification for withheld or redacted information.

Clear timelines for compliance.

Specific Questions to Investigate

1. Who is Responsible for Managing These Records?

Identify the individuals, teams, or automated systems involved in creating, altering, and assigning these case numbers and reports.

2. What Decisions Were Made and Why?

Determine how decisions were reached, why some reports were closed without action, and why letters were sent anonymously.

3. Were There Violations of Federal Law?

Investigate potential obstruction of justice, retaliation, or misuse of authority under whistleblower protection laws and FOIA.

Key Agencies and Officials Involved

This matter spans multiple federal and state agencies, including:

 Office of Special Counsel (OSC)

 Department of Justice (DOJ)

Centers for Medicare & Medicaid Services (CMS)

Department of Health and Human Services (HHS)

 Office of Inspector General (OIG)

Why This Matters

1. Whistleblower Protections:

Retaliation against whistleblowers and suppression of reports undermine federal protections designed to safeguard transparency and accountability.

2. Impact on Vulnerable Populations:

These failures harm Medicaid consumers, particularly those with disabilities, by allowing systemic mismanagement to persist unchecked.

3. Misuse of Taxpayer Funds:

Lack of oversight and accountability results in waste and misuse of federal funds meant to serve the public.

Requested Actions

1. Investigate Record Management:

Audit all OSC records, emails, and internal communications related to these case numbers.

Identify responsible individuals or systems.

2. Subpoena Additional Evidence:

Secure all suppressed or altered reports to ensure a complete and accurate investigation.

3. Hold Accountable Those Involved in Misconduct:

Recommend prosecution or disciplinary action for any individuals found to have violated federal laws.

4. Ensure Compliance with FOIA and Whistleblower Protections:

Mandate OSC and related agencies to comply fully with FOIA requests and whistleblower laws.

Attachments

I have attached all available documentation, including:

Correspondence with OSC, including determination letters and emails.

FOIA requests and responses (or lack thereof).

Detailed reports submitted to OSC and other federal agencies.

This issue demands immediate attention to uphold the principles of transparency, accountability, and justice. I am available to provide additional information or documentation as needed.

Sincerely,
David Medeiros

As recognized in National Archives and Records Administration v. Favish, 541 U.S. 157 (2004), transparency is fundamental to democracy and public trust. Your agencys obligations are not discretionary, and failure to meet them constitutes a violation of statutory and constitutional law. This letter establishes your duties, addresses deficiencies, and anticipates and counters all potential deflection strategies.

1. FOIA Obligations: Statutory Mandates and Required Actions
FOIA establishes an enforceable right of access to federal agency records. Your response must meet the following requirements:

A. Timeliness
Under 5 U.S.C. 552(a)(6)(A), you are required to provide a determination within 20 business days. Delays beyond this timeframe, absent legitimate extension requests, constitute a violation of FOIA.
Countermeasure: Delays are actionable under Citizens for Responsibility and Ethics in Washington v. DOJ, 711 F.3d 180 (D.C. Cir. 2013).
Required Action: Provide the requested records or a lawful determination.

B. Adequacy of Search
FOIA requires a thorough and reasonable search for records, as established in Campbell v. DOJ, 164 F.3d 20 (D.C. Cir. 1998). This includes:
Identifying the databases, locations, and terms used.
Providing a sworn affidavit detailing the search scope.
Countermeasure: A vague claim of "no responsive records" is insufficient without a detailed affidavit.
Required Action: Submit a sworn affidavit documenting the search or confirm the existence of responsive records.

C. Proper Use of Exemptions
Exemptions under 5 U.S.C. 552(b) must be narrowly applied and justified with specific explanations. Blanket or vague exemptions are impermissible.
Countermeasure: A Vaughn index (Vaughn v. Rosen, 484 F.2d 820 (D.C. Cir. 1973)) is required to justify each withholding.
Required Action: Submit a Vaughn index detailing each exemption and its justification within 10 business days.

D. Decentralization and Referrals
Referrals or decentralization excuses do not absolve your agency of its responsibility to provide a consolidated response. As held in McGehee v. CIA, 697 F.2d 1095 (D.C. Cir. 1983), agencies must coordinate internally to ensure compliance.
Countermeasure: Require assurance of continuity and coordination across divisions.
Required Action: Consolidate records from all relevant offices and provide a unified response.

2. ADA and Rehabilitation Act Compliance: Equal Access as a Legal Right
As a person with a documented disability, I am entitled to reasonable accommodations under the ADA and Section 504 of the Rehabilitation Act. Your failure to provide accessible formats for requested records constitutes discrimination and violates federal law.

Case Law:
Tennessee v. Lane, 541 U.S. 509 (2004): Agencies must ensure meaningful access to government services.
Alexander v. Choate, 469 U.S. 287 (1985): Denial of reasonable accommodations creates barriers that violate civil rights.

Required Action:
Provide all requested records in accessible formats, including plain-language summaries or electronic files compatible with assistive technologies.
Confirm compliance with ADA requirements by [specific date].

3. Mandated Reporting and Whistleblower Protections
Your handling of this request implicates broader concerns, including potential fraud, misuse of federal funds, or retaliation against whistleblowers. Under the Whistleblower Protection Act (5 U.S.C. 2302), you are required to report and address systemic violations.
Countermeasure: Reference Misprision of Felony (18 U.S.C. 4), which requires the reporting of observed violations of law.
Required Action: Document and escalate evidence of misconduct to oversight bodies, including the Office of Inspector General (OIG).

4. Consequences of Non-Compliance
Failure to comply with your statutory obligations knowingly constitutes violations of:
Obstruction of Justice (18 U.S.C. 1505): Delaying lawful access to records obstructs public accountability.
Civil Rights Violations (42 U.S.C. 1983): Denying ADA accommodations constitutes a deprivation of federally protected rights.
Misprision of Felony (18 U.S.C. 4): Concealing or failing to report observed violations is a criminal act.
Countermeasure: Prepare for judicial review, oversight complaints, and public advocacy if compliance fails.

5. Escalation Pathways
If your office does not comply within the specified timeframe, I will escalate this matter through:
Judicial Review: Filing a lawsuit under 5 U.S.C. 552(a)(4)(B) to compel disclosure.
Oversight Complaints: Submitting formal complaints to OGIS, OIG, and the DOJ Civil Rights Division.
Public Advocacy: Engaging investigative journalists, transparency advocates, and public interest organizations to ensure accountability.

6. Final Statement: Upholding Transparency and Accountability
This matter reflects the publics right to transparency and the preservation of trust in government institutions. Your actions will either affirm your agencys commitment to accountability or further evidence systemic disregard for these principles.

I look forward to your prompt and substantive response.

The challenges we face today demand more than acknowledgmentthey require action, collaboration, and a unified commitment to solutions. Together, we must embrace transparency, accountability, and compassion as the
foundation of our efforts. By fostering open communication, prioritizing the needs of the most vulnerable, and holding systems accountable, we can rebuild trust and ensure equitable outcomes for all.

Solutions lie in unitywhen state and federal leaders, advocates, and communities work hand in hand to uphold justice and fairness. Transparency through accessible Freedom of Information processes, adherence to legal
mandates, and robust oversight are the pillars that support meaningful change. Each of us has a role to play in creating a system that serves and protects.

Our collective mission is clear: to build bridges between agencies and communities, ensure the dignity of every individual, and honor the principles that guide us toward progress. Together, with determination and unity, we can
overcome systemic failures and pave the way for a brighter, more inclusive future.

Americans living with disabilities and their families are Americansfull citizens of this nation, protected by the same Constitution that guarantees the rights and freedoms of every individual. We are not separate, lesser, or forgotten. We are Americans with the same unalienable rights to life, liberty, and the pursuit of happiness.

We stand firmly on the principles of equality, dignity, and justice. Our voices matter. Our contributions matter. And our rightsour Constitutional rightsmust be respected, upheld, and protected without exception or delay.
