Dear Freedom of Information Officers,

I am writing to formally request access to all records under the Freedom of Information Act (FOIA) (5 U.S.C. 552) and relevant Connecticut state laws, specifically related to the Connecticut Medicaid Acquired Brain Injury (ABI) Waiver Program. This information is critical to my participation in the oversight and administration of this program.

In accordance with Section 504 of the Rehabilitation Act of 1973 (29 U.S.C. 794) and the Americans with Disabilities Act (ADA) (42 U.S.C. 12101 et seq.), I am requesting accommodations due to my condition. I respectfully request that all records be provided electronically via email, as opposed to portals or complex delivery methods, to ensure full and equal access to the information.

Scope of Request:
Legislative Records:

All bills, amendments, resolutions, legislative proposals, and legislative history related to the Connecticut Medicaid ABI Waiver Program.
Voting records of all state and federal legislators on any legislation affecting the Medicaid ABI Waiver Program.

Correspondence:

All emails, letters, and other forms of communication, including internal and external, regarding the Medicaid ABI Waiver Program.
Internal memoranda, briefing documents, policy directives, and decision-making correspondence related to the oversight and implementation of the program.

Special Requests:
Expedited Processing: Pursuant to Executive Order 13392, which mandates the improvement of agency disclosure processes, and the Freedom of Information Act (5 U.S.C. 552), I request expedited processing of this FOIA request due to the public interest and personal impact of the information.

Electronic Records: In compliance with my rights under Section 504 of the Rehabilitation Act and the ADA, I request that all records be provided in electronic format and sent directly to my email address. This will ensure that I can access the information without unnecessary barriers or delays.

Fee Waiver Request:
I request a waiver of all fees associated with this FOIA request under 5 U.S.C. 552(a)(4)(A)(iii). This request is made in the public interest and not for commercial use. The disclosure of the requested information will significantly contribute to public understanding of government operations, particularly concerning the Connecticut Medicaid ABI Waiver Program, which impacts a vulnerable population. Subject: Appeal of FOIA Request Determination Connecticut Medicaid ABI Waiver Program Records
FOIA Tracking Number: 2025-F-01035

To the FOIA Appeals Officer,

I am submitting this appeal regarding my FOIA request (Tracking Number 2025-F-01035) with the U.S. Department of Labors Boston Regional Office of OSHA, which sought comprehensive records on the Connecticut Medicaid Acquired Brain Injury (ABI) Waiver Program. The response from the Boston Regional Office, dated October 24, 2024, stated that no responsive records exist within OSHAs files and has closed the request(2025-F-01035_No_Records). However, I am seeking additional clarification on this determination.

Basis for Appeal
This appeal aims to clarify the scope of the record search and to determine if any further documentation within the Department of Labor may be accessible or if referrals to other relevant departments might assist in my search for responsive records.

Scope Clarification on Workforce and Rehabilitation Support:
Given the Medicaid ABI Waiver Programs focus on healthcare and employment rehabilitation, there may be potential for records within OSHA or other Department of Labor divisions related to workforce support, vocational training, or employment assistance for program beneficiaries. If such records exist in other divisions, I request a referral or expanded search.

Interagency Communication Records:
If any interagency communications or coordination efforts related to the ABI Waiver Program have involved OSHA or other departments within the U.S. Department of Labor, such as exchanges with the Department of Health and Human Services (HHS) or the Centers for Medicare & Medicaid Services (CMS), I respectfully request access to these documents. A confirmation of interdepartmental involvement would aid the comprehensiveness of this search.

Confirmation of Fee Waiver and Expedited Processing:
Given that this request is made solely to advance public understanding of Medicaid program operations, I renew my request for a fee waiver and expedited processing to ensure prompt access.

Relief Requested
I respectfully request that the Department of Labor consider a supplemental review of records potentially related to the Connecticut Medicaid ABI Waiver Program, including referrals to other departments as necessary. If it is confirmed that no responsive records exist, guidance on further agencies to contact would be appreciated.

Basic Accommodation Requests
To facilitate my full participation in this process, I request the following basic accommodations:

Email-Only Communication: Please correspond exclusively via email at AabiWR@live.com.
Response in Email Body: Include the full substantive response directly in the email body to ensure accessibility.
Identification of Representatives: Kindly include the full names, titles, and contact information of representatives handling my request.
No Portals or External Links: Please avoid using portals or external links for this response, ensuring all information is accessible within the email.
Thank you for your attention to this appeal. For any further information required to assist in locating these records, please contact me at AabiWR@live.com.

Sincerely,

Introduction
This appeal challenges the U.S. Department of Labors determination, dated October 24, 2024, regarding FOIA Request #2025-F-01035. This request sought critical records concerning the Connecticut Medicaid Acquired Brain Injury (ABI) Waiver Program. The response indicated that no responsive records exist within OSHAs files, and the request was subsequently closed.

This determination raises serious concerns about the adequacy of the search conducted, the failure to include other relevant DOL divisions, and the lack of referrals to other agencies that might possess relevant records. Pursuant to the Freedom of Information Act (5 U.S.C. 552), I request a thorough review of this decision and detailed clarification of the actions taken in processing my original request.

Basis for Appeal
1. Insufficient Scope of Record Search
The Medicaid ABI Waiver Program intersects directly with issues related to employment rights, workforce protections, and vocational rehabilitation. These areas fall within the jurisdiction of several DOL divisions beyond OSHA, including:

Wage and Hour Division (WHD): Responsible for enforcing wage standards, including 14(c) certificates for disabled individuals, which may be relevant for Medicaid program beneficiaries.
Employment and Training Administration (ETA): Oversees workforce development and vocational training initiatives that may involve Medicaid-funded services or beneficiaries.
Office of Disability Employment Policy (ODEP): Develops and oversees policies ensuring employment rights and support for individuals with disabilities.
A search restricted to OSHAs records ignores these critical divisions, and the scope of the search must be expanded to include these and any other relevant offices.

2. Failure to Identify Interagency Communications
Medicaid programs, including waiver initiatives like the ABI Waiver Program, frequently involve interagency collaboration and communication. It is reasonable to expect the Department of Labor to have participated in or retained records of coordination efforts involving:

The Department of Health and Human Services (HHS): Specifically, the Centers for Medicare & Medicaid Services (CMS), which oversees Medicaid waiver programs.
Connecticut State Agencies: Such as the Department of Social Services (DSS), which administers Medicaid at the state level.
I request that the appeal process include a comprehensive review of any interagency communications or policy directives related to:

Workforce protections for Medicaid beneficiaries.
Vocational rehabilitation programs under the ABI Waiver.
Funding allocations or policy development involving the DOL.
If no such records exist, the agency must make proper referrals under 5 U.S.C. 552(a)(6)(C)(i).

3. Non-Compliance with ADA and Rehabilitation Act Accommodations
As an individual with a traumatic brain injury (TBI), I requested reasonable accommodations under the Americans with Disabilities Act (ADA) (42 U.S.C. 12101 et seq.) and Section 504 of the Rehabilitation Act (29 U.S.C. 794). These accommodations included:

MuckRock Platform Exclusive Communication: Prohibiting phone calls, physical mail, or portal-based responses.
Direct Text in Email Body: Embedding the response text within the email body to ensure accessibility.
PDF Attachments: Submitting clearly labeled, screen-reader-compatible PDFs.
Simplified Summaries: Providing summaries of complex documents or data sets.
Identification of Responsible Personnel: Including the full names, titles, and contact details of all FOIA representatives.
The initial response failed to explicitly confirm compliance with these accommodations, which is a violation of my statutory rights under federal disability laws.

4. Expedited Processing and Fee Waiver Request
This request is made solely in the public interest to promote transparency in the administration of Medicaid programs. Delays in obtaining these records hinder public accountability and oversight of a program serving a highly vulnerable population.

Expedited Processing: Justified under 5 U.S.C. 552(a)(6)(E), as the records pertain to urgent matters of public interest.
Fee Waiver: Requested under 5 U.S.C. 552(a)(4)(A)(iii), as the disclosure will significantly contribute to public understanding without any commercial intent.
Relief Requested
Expanded Record Search Across Relevant DOL Divisions:

Include WHD, ETA, and ODEP in a supplemental search for responsive records related to wage compliance, vocational rehabilitation, and employment policies tied to the Medicaid ABI Waiver Program.
Review of Interagency Communications:

Confirm whether the DOL holds or has participated in interagency communications involving HHS, CMS, or Connecticut state agencies. If records exist, ensure they are included in the search results.
Referral to Relevant Agencies:

If records are not found within the DOL, formally refer the request to the appropriate agencies, including HHS, CMS, and the Connecticut Department of Social Services.
Detailed Explanation of Initial Search:

Provide a description of the original search process, including:
Offices and databases queried.
Search terms used.
Timeframes covered by the search.
Confirmation of ADA and Rehabilitation Act Accommodations:

Commit to adhering to my requested accommodations in all future communications and confirm compliance with ADA and Section 504 requirements.
Provision of Estimated Completion Date (EDC):

Under 5 U.S.C. 552(a)(7)(B)(ii), provide an EDC for resolving this appeal and completing the expanded search.
Legal and Policy Basis
Freedom of Information Act (5 U.S.C. 552): Requires thorough searches, appropriate referrals, and transparency in determinations.
ADA (42 U.S.C. 12101 et seq.) and Section 504 of the Rehabilitation Act (29 U.S.C. 794): Mandate reasonable accommodations to ensure equitable access to federal processes.
Executive Order 13392: Prioritizes transparency and timeliness in FOIA responses.
Conclusion
I urge the Department of Labor to address this appeal comprehensively, ensuring compliance with federal transparency and accessibility laws. Please provide a substantive response to this appeal within 20 working days, including confirmation of any referrals or additional steps taken.

Thank you for your attention to this matter.

Introduction
This appeal addresses the denial of FOIA Request #2025-F-01035, which sought comprehensive records related to the Connecticut Medicaid Acquired Brain Injury (ABI) Waiver Program. The U.S. Department of Labors (DOL) Boston Regional Office of OSHA claimed no responsive records exist and closed the request on October 24, 2024.

This determination is flawed due to the following:

Failure to Conduct a Comprehensive Search Across Relevant DOL Divisions.
Lack of Referrals to Other Agencies Likely to Possess Responsive Records.
Violation of Statutory ADA Accommodations Requirements.
Insufficient Justification for Denial of Expedited Processing and Fee Waiver.
This appeal seeks a detailed review of the initial determination, expansion of the record search, and compliance with all applicable federal laws.

Key Legal and Procedural Failures
1. Insufficient Scope of Record Search
The Medicaid ABI Waiver intersects directly with wage compliance, vocational rehabilitation, and employment rights. These fall under multiple DOL divisions beyond OSHA, including:

Wage and Hour Division (WHD): Enforces wage standards, including 14(c) certificates for disabled individuals, relevant to Medicaid beneficiaries.
Employment and Training Administration (ETA): Oversees workforce development and vocational rehabilitation, integral to Medicaid-funded services.
Office of Disability Employment Policy (ODEP): Ensures employment rights for individuals with disabilities.
The DOLs assertion that no records exist is implausible without a supplemental search across all relevant divisions.

Relief Requested:
Expanded Search Parameters:
Ensure a supplemental search includes WHD, ETA, and ODEP. Search terms must include:
"Connecticut Medicaid ABI Waiver"
"vocational rehabilitation"
"14(c) certificates"
"provider compliance"
"interagency communications with DSS, CMS, or HHS."
2. Failure to Identify or Refer Interagency Communications
The ABI Waiver Program involves interagency coordination with:

HHS (CMS): Oversees Medicaid waiver programs.
Connecticut DSS: Administers Medicaid at the state level.
FOIA 552(a)(6)(C)(i) requires referrals to agencies likely to hold responsive records. A thorough search must include interagency communications addressing workforce protections, vocational rehabilitation, and compliance oversight.

Relief Requested:
Referral to Relevant Agencies: Formally refer this request to HHS, CMS, and Connecticut DSS if no responsive records are found within DOL.
3. Violation of ADA and Rehabilitation Act Accommodations
As an individual with a traumatic brain injury (TBI), I requested ADA accommodations under 42 U.S.C. 12101 et seq. and 29 U.S.C. 794. The DOLs response failed to confirm compliance. Accommodations requested include:

Screen-Reader Compatible Formats: Properly labeled PDFs or plain-text files.
Exclusive MUCKROCK Platform Communication: Prohibiting physical mail, portals, or phone calls.
Simplified Summaries: Plain-language explanations for complex documents.
Identification of Responsible Personnel: Names, titles, and contact details of FOIA officers.
Failure to comply with ADA requirements constitutes procedural discrimination and undermines accessibility.

Relief Requested:
Explicit Confirmation of ADA Accommodations Compliance: Ensure all future responses adhere to accommodations listed in the attached ADA Basic Accommodations Request section.
4. Insufficient Justification for Denial of Expedited Processing and Fee Waiver
The request meets the criteria for:

Expedited Processing: Records pertain to urgent public interest (5 U.S.C. 552(a)(6)(E)).
Medicaid ABI Waiver oversight directly impacts vulnerable populations. Delays in access risk further harm.
Fee Waiver: Records serve the public interest and are not for commercial use (5 U.S.C. 552(a)(4)(A)(iii)).
The DOL has not provided substantive justification for denying these requests.

Relief Requested:
Approval of Expedited Processing: Promptly process the request due to its urgent public interest.
Grant of Fee Waiver: Waive all fees as the request promotes government accountability and serves no commercial interest.
ADA Basic Accommodations Request
To ensure accessibility and compliance with ADA standards (42 U.S.C. 12101 et seq.), I request the following accommodations for all communications and records:

Screen-Reader Compatible Formats:
All documents must be provided in properly labeled PDFs or plain-text files.

Exclusive MUCKROCK Platform Communication:
Do not send external links, emails, portals, passwords, codes, or require phone calls for access.

Simplified Summaries:
Provide plain-language summaries for complex or legal documents.

Identification of Responsible Officers:
Include the full name, title, and contact information of all responsible officers.

These accommodations are critical to ensuring equitable access to the FOIA process.

Legal and Policy Basis
FOIA (5 U.S.C. 552): Requires agencies to conduct adequate searches, refer requests to appropriate agencies, and justify denials of records.
ADA (42 U.S.C. 12101 et seq.): Mandates reasonable accommodations for individuals with disabilities.
Section 504 of the Rehabilitation Act (29 U.S.C. 794): Prohibits discrimination based on disability in federally funded programs.
Executive Order 13392: Prioritizes transparency and prompt responses to FOIA requests.
Conclusion
This appeal seeks an expanded search, interagency referrals, ADA compliance, and expedited processing. These remedies are critical to ensuring transparency, protecting public trust, and upholding federal laws.

Please provide a substantive response within 20 business days, as required under FOIA.

*** Federal Bureau of Investigation (FBI)
Subject: Urgent Request for Investigation into OSC Case Records, Altered Decisions, and Suppressed Reports

Dear FBI Team,

I am formally requesting your assistance to investigate systemic failures, misconduct, and potential criminal activity surrounding the handling of my submissions to the Office of Special Counsel (OSC). These failures directly impact whistleblower protections, Medicaid oversight, and public accountability.

Issues to Investigate

1. Case Numbers and Records Management

Case Numbers Requiring Investigation:

DI-25-000310

DI-25-000325

DI-25-000379

DI-12192024714

DI-12112024134

OSCFiling-MedeirosDavid-DI-11252024342

OSCFiling-MedeirosDavid-DI-11272024158

OSCFiling-MedeirosDavid-DI-11282024737

OSCFiling-MedeirosDavid-DI-12022024333

OSCFiling-MedeirosDavid-DI-12032024933

OSCFiling-MedeirosDavid-DI-12042024718

OSCFiling-MedeirosDavid-DI-12052024838

OSCFiling-MedeirosDavid-DI-12062024939

OSCFiling-MedeirosDavid-DI-12072024240

OSCFiling-MedeirosDavid-DI-12112024134

OSCFiling-MedeirosDavid-DI-12202024300

OSCFiling-MedeirosDavid-DI-112620241121

2. Anonymity and Lack of Accountability in Decision-Making

Unsigned Determination Letters:
Many determination letters from OSC lack identifiable signatures, names, or clear authorship.
This practice raises serious concerns about accountability and compliance with transparency laws.

3. Suppressed or Altered Records

Evidence suggests discrepancies between the whistleblower reports I submitted and how they were recorded or handled by OSC.
Specific issues include:
Alterations or removal of content from submitted complaints.
Suppression of reports that exposed systemic failures in Medicaid oversight and retaliation against whistleblowers.

4. Lack of FOIA Compliance
Despite repeated Freedom of Information Act (FOIA) requests, OSC and related agencies have failed to provide:
Complete case files and communication logs.
Justification for withheld or redacted information.

Clear timelines for compliance.

Specific Questions to Investigate

1. Who is Responsible for Managing These Records?
Identify the individuals, teams, or automated systems involved in creating, altering, and assigning these case numbers and reports.

2. What Decisions Were Made and Why?
Determine how decisions were reached, why some reports were closed without action, and why letters were sent anonymously.

3. Were There Violations of Federal Law?
Investigate potential obstruction of justice, retaliation, or misuse of authority under whistleblower protection laws and FOIA.

Key Agencies and Officials Involved

This matter spans multiple federal and state agencies, including:
 Office of Special Counsel (OSC)
 Department of Justice (DOJ)
Centers for Medicare & Medicaid Services (CMS)
Department of Health and Human Services (HHS)
 Office of Inspector General (OIG)

Why This Matters

1. Whistleblower Protections:
Retaliation against whistleblowers and suppression of reports undermine federal protections designed to safeguard transparency and accountability.

2. Impact on Vulnerable Populations:
These failures harm Medicaid consumers, particularly those with disabilities, by allowing systemic mismanagement to persist unchecked.

3. Misuse of Taxpayer Funds:
Lack of oversight and accountability results in waste and misuse of federal funds meant to serve the public.

Requested Actions

1. Investigate Record Management:
Audit all OSC records, emails, and internal communications related to these case numbers.
Identify responsible individuals or systems.

2. Subpoena Additional Evidence:
Secure all suppressed or altered reports to ensure a complete and accurate investigation.

3. Hold Accountable Those Involved in Misconduct:
Recommend prosecution or disciplinary action for any individuals found to have violated federal laws.

4. Ensure Compliance with FOIA and Whistleblower Protections:
Mandate OSC and related agencies to comply fully with FOIA requests and whistleblower laws.

Attachments

I have attached all available documentation, including:
Correspondence with OSC, including determination letters and emails.
FOIA requests and responses (or lack thereof).
Detailed reports submitted to OSC and other federal agencies.

This issue demands immediate attention to uphold the principles of transparency, accountability, and justice. I am available to provide additional information or documentation as needed.

Sincerely,
David Medeiros

As recognized in National Archives and Records Administration v. Favish, 541 U.S. 157 (2004), transparency is fundamental to democracy and public trust. Your agencys obligations are not discretionary, and failure to meet them constitutes a violation of statutory and constitutional law. This letter establishes your duties, addresses deficiencies, and anticipates and counters all potential deflection strategies.

1. FOIA Obligations: Statutory Mandates and Required Actions
FOIA establishes an enforceable right of access to federal agency records. Your response must meet the following requirements:

A. Timeliness
Under 5 U.S.C. 552(a)(6)(A), you are required to provide a determination within 20 business days. Delays beyond this timeframe, absent legitimate extension requests, constitute a violation of FOIA.
Countermeasure: Delays are actionable under Citizens for Responsibility and Ethics in Washington v. DOJ, 711 F.3d 180 (D.C. Cir. 2013).
Required Action: Provide the requested records or a lawful determination.

B. Adequacy of Search
FOIA requires a thorough and reasonable search for records, as established in Campbell v. DOJ, 164 F.3d 20 (D.C. Cir. 1998). This includes:
Identifying the databases, locations, and terms used.
Providing a sworn affidavit detailing the search scope.
Countermeasure: A vague claim of "no responsive records" is insufficient without a detailed affidavit.
Required Action: Submit a sworn affidavit documenting the search or confirm the existence of responsive records.

C. Proper Use of Exemptions
Exemptions under 5 U.S.C. 552(b) must be narrowly applied and justified with specific explanations. Blanket or vague exemptions are impermissible.
Countermeasure: A Vaughn index (Vaughn v. Rosen, 484 F.2d 820 (D.C. Cir. 1973)) is required to justify each withholding.
Required Action: Submit a Vaughn index detailing each exemption and its justification within 10 business days.

D. Decentralization and Referrals
Referrals or decentralization excuses do not absolve your agency of its responsibility to provide a consolidated response. As held in McGehee v. CIA, 697 F.2d 1095 (D.C. Cir. 1983), agencies must coordinate internally to ensure compliance.
Countermeasure: Require assurance of continuity and coordination across divisions.
Required Action: Consolidate records from all relevant offices and provide a unified response.

2. ADA and Rehabilitation Act Compliance: Equal Access as a Legal Right
As a person with a documented disability, I am entitled to reasonable accommodations under the ADA and Section 504 of the Rehabilitation Act. Your failure to provide accessible formats for requested records constitutes discrimination and violates federal law.

Case Law:
Tennessee v. Lane, 541 U.S. 509 (2004): Agencies must ensure meaningful access to government services.
Alexander v. Choate, 469 U.S. 287 (1985): Denial of reasonable accommodations creates barriers that violate civil rights.

Required Action:
Provide all requested records in accessible formats, including plain-language summaries or electronic files compatible with assistive technologies.
Confirm compliance with ADA requirements by [specific date].

3. Mandated Reporting and Whistleblower Protections
Your handling of this request implicates broader concerns, including potential fraud, misuse of federal funds, or retaliation against whistleblowers. Under the Whistleblower Protection Act (5 U.S.C. 2302), you are required to report and address systemic violations.
Countermeasure: Reference Misprision of Felony (18 U.S.C. 4), which requires the reporting of observed violations of law.
Required Action: Document and escalate evidence of misconduct to oversight bodies, including the Office of Inspector General (OIG).

4. Consequences of Non-Compliance
Failure to comply with your statutory obligations knowingly constitutes violations of:
Obstruction of Justice (18 U.S.C. 1505): Delaying lawful access to records obstructs public accountability.
Civil Rights Violations (42 U.S.C. 1983): Denying ADA accommodations constitutes a deprivation of federally protected rights.
Misprision of Felony (18 U.S.C. 4): Concealing or failing to report observed violations is a criminal act.
Countermeasure: Prepare for judicial review, oversight complaints, and public advocacy if compliance fails.

5. Escalation Pathways
If your office does not comply within the specified timeframe, I will escalate this matter through:
Judicial Review: Filing a lawsuit under 5 U.S.C. 552(a)(4)(B) to compel disclosure.
Oversight Complaints: Submitting formal complaints to OGIS, OIG, and the DOJ Civil Rights Division.
Public Advocacy: Engaging investigative journalists, transparency advocates, and public interest organizations to ensure accountability.

6. Final Statement: Upholding Transparency and Accountability
This matter reflects the publics right to transparency and the preservation of trust in government institutions. Your actions will either affirm your agencys commitment to accountability or further evidence systemic disregard for these principles.

I look forward to your prompt and substantive response.

The challenges we face today demand more than acknowledgmentthey require action, collaboration, and a unified commitment to solutions. Together, we must embrace transparency, accountability, and compassion as the
foundation of our efforts. By fostering open communication, prioritizing the needs of the most vulnerable, and holding systems accountable, we can rebuild trust and ensure equitable outcomes for all.

Solutions lie in unitywhen state and federal leaders, advocates, and communities work hand in hand to uphold justice and fairness. Transparency through accessible Freedom of Information processes, adherence to legal
mandates, and robust oversight are the pillars that support meaningful change. Each of us has a role to play in creating a system that serves and protects.

Our collective mission is clear: to build bridges between agencies and communities, ensure the dignity of every individual, and honor the principles that guide us toward progress. Together, with determination and unity, we can
overcome systemic failures and pave the way for a brighter, more inclusive future.

Americans living with disabilities and their families are Americansfull citizens of this nation, protected by the same Constitution that guarantees the rights and freedoms of every individual. We are not separate, lesser, or forgotten. We are Americans with the same unalienable rights to life, liberty, and the pursuit of happiness.

We stand firmly on the principles of equality, dignity, and justice. Our voices matter. Our contributions matter. And our rightsour Constitutional rightsmust be respected, upheld, and protected without exception or delay.

We are Americans with rights. Period.
