Question 63. Were conflicts disclosed in writing to participants, families, DSS, and other decision-makers? The 2023 report raises a concern, not a finding. People served: Person-centered planning requires informed options and conflict safeguards; disability law may protect meaningful participation. David Medeiros: Reporting possible conflicts may be protected under speech or retaliation rules only when coverage and proof align. ABI Resources: ABI may challenge unequal governmental treatment or contract action, but competition alone is not a constitutional violation. Constitutional claims need state action; beneficiary choice does not guarantee ABI referrals or a contract. Classify the issue before choosing a remedy. Preserve ownership, employment, referrals, alternatives, disclosures, clinical need, authorizations, claims, and outcomes. Apply Constitution, statute, regulation, contract, then record.
