Question 25. Did every plan contain measurable goals, desired outcomes, responsible parties, service amounts, and total costs? The 2023 report raises a concern, not a finding. People served: Plans must support informed participation, accessible language, consent, signatures, distribution, risk planning, and review. David Medeiros: Documenting plan failures may support petition or anti-retaliation theories, but protected activity and causation need proof. ABI Resources: ABI may hold contract or process interests; a missing plan does not automatically become ABI's constitutional injury. Constitutional claims need state action; beneficiary choice does not guarantee ABI referrals or a contract. Classify the issue before choosing a remedy. Preserve every plan version, signature, delivery receipt, authorization, revision, and back-up strategy. Apply Constitution, statute, regulation, contract, then record.
