Introduction My name is David Medeiros, and I submit this testimony on behalf of adults and children living with disabilities, taxpayers, civil rights advocates, and whistleblowers who depend on constitutional protections, government transparency, and lawful accountability. The bills under review present grave constitutional, legal, and ethical violations that demand immediate rejection or substantial amendment to prevent infractions of FOIA rights, due process, ADA compliance, election integrity, and financial accountability. This testimony is unassailable, based on binding Supreme Court precedent, federal statutory protections, and constitutional law, ensuring that no legislation violating these rights can withstand judicial scrutiny or lawful challenge. II. FOIA, Government Transparency & Accountability Bills Violating FOIA & Public Oversight: - S.B. No. 1226 – FOIA Exemptions for Public Universities - S.B. No. 1229 – Fees on Police Body Cam & Dashboard Footage - H.B. No. 6850 – Restricting Public Employee Address Disclosures Legal Authority: FOIA (5 U.S.C. § 552), First & Fourteenth Amendments The First Amendment protects public access to government records as an essential component of free speech and the right to petition the government (New York Times Co. v. United States, 403 U.S. 713 (1971)). The Fourteenth Amendment guarantees due process and equal protection, prohibiting arbitrary restrictions on public records (Tennessee v. Lane, 541 U.S. 509 (2004)). NARA v. Favish (541 U.S. 157 (2004)) affirms the public's right to government transparency, establishing that access to government documents cannot be denied without compelling justification. Department of Justice v. Reporters Committee for Freedom of the Press (489 U.S. 749 (1989)) further cements the constitutional mandate for government transparency. IMPACT: These bills directly violate federal FOIA laws and established Supreme Court precedent, creating an unconstitutional barrier to public records and government accountability. Legislative Demand: ✅ Mandate full FOIA compliance and permanently prohibit financial barriers to public records requests. ✅ Reject any legislation that obstructs access to taxpayer-funded government operations and transparency. III. ADA Compliance, Disability Rights & Medicaid Oversight Bills Threatening Disability & Taxpayer Protections: - S.B. No. 1231 – State Contracts with Nonprofit Human Services Providers Legal Authority: ADA (42 U.S.C. § 12132), Section 504 of the Rehabilitation Act, Medicaid Act (42 U.S.C. § 1396a), Civil Rights Act (42 U.S.C. § 1983) The ADA prohibits discrimination in all state-funded programs, including Medicaid services (Olmstead v. L.C., 527 U.S. 581 (1999)). The Medicaid Act mandates that taxpayer funds be lawfully allocated and must not support discrimination or fraud (South Dakota v. Dole, 483 U.S. 203 (1987)). Alexander v. Choate (469 U.S. 287 (1985)) enforces the requirement that Medicaid services must be provided in a nondiscriminatory and accessible manner. IMPACT: This bill must enforce strict ADA compliance to prevent Medicaid fraud, ensure accessibility, and protect taxpayer funds from abuse. Legislative Demand: ✅ Implement federally mandated audits for all Medicaid-funded contracts. ✅ Ensure full ADA compliance in Medicaid services, with automatic penalties for violations. IV. Whistleblower Protections & Civil Rights Violations Bills Undermining Public Oversight & Civil Rights: - S.B. No. 1233 – Restricting FOIA Access to Reports on Bias & Bigotry Legal Authority: Whistleblower Protection Act (5 U.S.C. § 2302), Civil Rights Act (42 U.S.C. § 1983), First Amendment Protections Lane v. Franks (573 U.S. 228 (2014)) affirms whistleblower protections under the First Amendment. Garcetti v. Ceballos (547 U.S. 410 (2006)) confirms that public employees cannot be retaliated against for reporting government misconduct. IMPACT: Shielding reports on bias allows government agencies to conceal civil rights violations and retaliate against whistleblowers. Legislative Demand: ✅ Strengthen whistleblower protections under state law and prevent FOIA exemptions that enable retaliation. ✅ Mandate federal intervention if state agencies attempt to conceal bias or discrimination reports. Final Legislative Action Required: 1️⃣ Reject all bills that violate FOIA, ADA, civil rights, and whistleblower protections. 2️⃣ Enforce strict federal compliance on disability rights, election integrity, and public accountability. 3️⃣ Conduct mandatory constitutional reviews before advancing any amendments. 4️⃣ Establish independent oversight committees to audit and enforce compliance with federal protections.
