FOIA Compliance (5 U.S.C. 552)\nFOIA mandates timely responses, full disclosure of non-exempt records, and explicit justifications for any redactions or denials. Any failure by DSS, CMS, or other federal agencies to meet these statutory requirements will constitute non-compliance. All denials must include precise statutory citations under FOIA, and records must be provided in their entirety unless exemptions are clearly and legally justified.\n\n2. ADA Compliance Obligations (42 U.S.C. 12132; 28 C.F.R. 35.160)\nUnder Title II of the ADA, public entities must ensure effective communication with individuals with disabilities. This includes providing accessible documents in screen-reader-compatible formats and meeting specific requests for auxiliary aids. DSS and CMSs failure to meet these requests for ADA accommodations in communications constitutes non-compliance under federal ADA statutes.\n\n3. Federal Whistleblower Protection Standards\nWhistleblower protections prohibit retaliation against individuals who report agency misconduct. The actions taken against ABI Resources and David Medeiros, including billing suspension, premature ticket resolution, and operational disruptions following his whistleblower report, are viewed as retaliatory actions that must be substantiated and documented by all relevant agencies.\n\nSpecific Demands for Compliance\nTo ensure adherence to FOIA and ADA mandates, and to facilitate the transparency required by federal and state law, I formally request:\n\nDelivery of ADA-Compliant Records in Full:\n\nEmail-Only Communication via MuckRock Platform: All responses, updates, and records must be sent exclusively via email to eliminate accessibility barriers. CMS must refrain from using phone calls, physical mail, or portal-based responses.\nDirect Text in Email Body: Embed response text directly in the email body for immediate readability and accessibility.\nPDF Attachments for Documents: All records should be provided as clearly labeled PDF attachments, organized by date and document type, with original formatting preserved for clarity and navigability.\nIdentification of Responsible Personnel: Each response must include names, titles, and contact information of all FOIA officers, decision-makers, and supervisory personnel responsible for processing my request, ensuring transparency and accountability.\n\nDetailed Justifications for Redactions and Denials: Any information withheld or redacted must include detailed explanations citing specific statutory exemptions, in accordance with 5 U.S.C. 552(b). These explanations must include enough detail to verify the legal basis for each exemption claimed.\n\nRequest for Expedited Processing of FOIA Request\nPursuant to 5 U.S.C. 552(a)(6)(E), I formally request expedited processing of this FOIA request. This demand is based on critical statutory factors, including significant public interest, imminent risks to the rights of individuals with disabilities, and the need for urgent transparency to prevent ongoing retaliatory actions by public agencies.\n\nFailure to grant expedited processing within the statutory 10-day review period will constitute non-compliance with FOIAs provisions, necessitating formal escalation of this request to administrative or legal authorities.\n\nConsequences of Non-Compliance\nFailure to respond to this FOIA request in full compliance, or any delays without proper statutory explanation, may result in formal escalation through administrative, legal, or public channels. DSS, CMS, and other involved agencies are expected to adhere strictly to statutory timelines, ensuring transparency and adherence to ADA and FOIA standards. Non-compliance will be documented and pursued through all available legal remedies.\n\nConclusion\n\nThis FOIA request seeks full and unambiguous access to records necessary to verify and substantiate claims of retaliation, ADA non-compliance, and procedural violations following the December 18, 2023, whistleblower report. I expect each agency to adhere strictly to both FOIA and ADA standards, ensuring prompt and thorough disclosure of all relevant documentation.\n\nSincerely,\nDavid Medeiros\nFounder, ABI Resources, LLC\n\nThe requested documents will be made available to the general public, and this request is not being made for commercial purposes.\n\nIn the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.\n\nThank you in advance for your anticipated cooperation in this matter. Hibbard\nChief, Initial Request Staff\nOffice of Information Policy\nU.S. Department of Justice\n441 G Street, NW, Sixth Floor\nWashington, DC 20530-0001\n\nCC:\nValeree Villanueva, FOIA Public Liaison\nOffice of Information Policy\n\nOffice of Government Information Services (OGIS)\nNational Archives and Records Administration\n\nIntroduction\nThis letter constitutes a formal appeal of the Department of Justice's response to my Freedom of Information Act (FOIA) request (FOIA 2025-00562), submitted on November 13, 2024. My request sought records regarding Medicaid billing restrictions, ADA compliance violations, and retaliatory actions against ABI Resources, LLC following a whistleblower report submitted on December 18, 2023.\n\nThe response, dated November 18, 2024, improperly redirected my request without conducting a search for records under DOJs jurisdiction, thus failing to fulfill DOJs statutory FOIA obligations. Additionally, the response failed to address the legally mandated ADA accommodations outlined in my initial request.\n\nThis appeal addresses these deficiencies and reiterates the need for expedited processing, complete and unredacted disclosure, and ADA-compliant communication.\n\nGrounds for Appeal\nFailure to Conduct a Reasonable Search\nUnder FOIA, federal agencies are required to make a good-faith effort to locate requested records within their possession or control. DOJs response redirected my request to other federal entities without confirming that DOJ does not maintain relevant records. This constitutes a failure to meet its obligations under FOIA (5 U.S.C. 552(a)(3)(C)).\n\nFailure to Adhere to ADA and Rehabilitation Act Accommodations\nAs a whistleblower and individual with a documented traumatic brain injury (TBI), I am entitled to ADA accommodations under Title II of the ADA (42 U.S.C. 12132) and Section 504 of the Rehabilitation Act (29 U.S.C. 794). DOJ failed to honor the following ADA accommodation requests, which are non-negotiable:\n\nMuckRock Platform Only Communication: All responses must be delivered exclusively via email through the MuckRock platform, without physical mail, phone calls, or portal-based systems.\nAccessible Document Formats: DOJ must provide records as labeled, screen-reader-compatible PDF attachments, with simplified summaries for complex materials.\nIdentification of Responsible Personnel: DOJs response failed to include the names, titles, and contact information of all individuals handling the FOIA request, violating accountability and transparency principles.\nImproper Denial of Expedited Processing\nMy original request demonstrated a compelling public interest in exposing retaliation, non-compliance with ADA standards, and systemic procedural violations. Under 5 U.S.C. 552(a)(6)(E), DOJ was required to evaluate the urgency of the request and failed to adequately justify its denial of expedited processing.\n\nCorrective Actions Demanded\nImmediate Processing and Comprehensive Search\nDOJ must initiate a comprehensive search of all responsive records under its jurisdiction, including records held by the Civil Rights Division and other relevant components.\n\nADA Accommodation Compliance\nDOJ must confirm in writing that it will adhere to the ADA accommodations outlined in this appeal and all future communications. This includes:\n\nExclusive communication through the MuckRock platform.\nClearly labeled, accessible document formats.\nFull identification of FOIA officers and decision-makers involved.\nExpedited Processing Reconsideration\nDOJ must reconsider expedited processing due to the significant public interest in the misuse of taxpayer funds and retaliation against whistleblowers reporting agency misconduct.\n\nLegal Basis for Appeal\nConstitutional Rights\n\nFirst Amendment: Ensures public access to information necessary for informed oversight of government operations.\nFifth and Fourteenth Amendments: Protect due process and equal treatment under the law, both of which are implicated by DOJs failure to comply with ADA and FOIA standards.\nStatutory Obligations\n\nFreedom of Information Act (5 U.S.C. 552): Mandates prompt, complete disclosure of non-exempt records and detailed justifications for redactions or denials.\nAmericans with Disabilities Act (42 U.S.C. 12132): Requires effective communication and reasonable accommodations for individuals with disabilities.\nRehabilitation Act (29 U.S.C. 794): Prohibits discrimination in federally funded programs, ensuring equitable access to information.\nWhistleblower Protections\n\nWhistleblower Protection Act (5 U.S.C. 2302): Safeguards against retaliation for reporting agency misconduct.\nTransparency and Accountability\n\nSingle Audit Act (31 U.S.C. 7501-7507): Requires transparency in the use of federal funds. DOJs withholding of records undermines taxpayer oversight.\nConsequences of Non-Compliance\nFailure to comply with this appeal will result in the following actions:\n\nEscalation to OGIS and DOJ Leadership: A formal complaint will be submitted to the Office of Government Information Services and DOJ leadership.\nPublic Advocacy and Media Engagement: Details of DOJs non-compliance will be disseminated to media outlets and public watchdog organizations.\nLegal Action: I will pursue judicial remedies to enforce compliance with FOIA, ADA, and constitutional protections.\nConclusion\nDOJs mishandling of this FOIA request violates federal law and undermines public confidence in government transparency and accountability. I demand immediate corrective action to ensure compliance with FOIA, ADA, and whistleblower protection statutes.\n\nTransparency and justice are non-negotiable. The requested records are essential to exposing systemic misconduct and safeguarding the rights of individuals with disabilities and whistleblowers.\n\nThank you for your prompt attention to this appeal. My request sought critical records related to:\n\nMedicaid billing restrictions.\nADA compliance violations.\nRetaliatory actions against ABI Resources, LLC, following a December 18, 2023, whistleblower report.\nThe response received on November 18, 2024, failed to conduct a reasonable search, improperly redirected my request without justification, and neglected legally mandated ADA accommodations. This appeal demands full compliance with FOIA statutes and ADA obligations.\n\nGrounds for Appeal\n1. Failure to Conduct a Reasonable Search\nThe DOJ is obligated under FOIA (5 U.S.C. 552(a)(3)(C)) to conduct a thorough and reasonable search for all records responsive to a request. Instead, DOJ redirected my request to other agencies without confirming that responsive records do not exist within DOJ's jurisdiction. This omission violates FOIA's statutory requirements.\n\n2. Violation of ADA and Rehabilitation Act Accommodations\nAs a whistleblower with a documented traumatic brain injury (TBI), I requested ADA accommodations under Title II of the ADA (42 U.S.C. 12132) and Section 504 of the Rehabilitation Act (29 U.S.C. 794). Improper Denial of Expedited Processing\nMy original request established a compelling public interest in exposing retaliation and systemic ADA non-compliance, justifying expedited processing under 5 U.S.C. 552(a)(6)(E). DOJ failed to adequately address or justify its denial of this request.\n\nCorrective Actions Demanded\n1. Immediate and Comprehensive Search\nThe DOJ must immediately initiate a comprehensive search of all responsive records under its jurisdiction, including those held by the Civil Rights Division, Office of Special Counsel, and Office of the Inspector General.\n\n2. Compliance with ADA Accommodations\nDOJ must confirm in writing that it will adhere to the following ADA accommodations:\n\nMuckRock Platform Communication: All future responses must be delivered via the MuckRock platform.\nAccessible Documents: Records must be provided as clearly labeled, screen-reader-compatible PDF attachments with simplified summaries for complex materials.\nIdentification of Responsible Personnel: Include the names, titles, and contact information of all FOIA officers, decision-makers, and supervisory personnel involved.\n3. "text": "COMPLAINT AND APPEAL Subject: Freedom of Information Act Request: Records on Medicaid Billing Actions, ADA Compliance, and Retaliation Against ABI Resources LLC Ticket #539494 Following December 18, 2023, Whistleblower Report (Department of Justice, Office of Information Policy)\n\nExplainer: What Is Happening?\nThe Basics\nDavid Medeiros, the founder of ABI Resources, is a whistleblower. This means he has reported serious problems in how government programs, like Medicaid, are being managed. Specifically, he has pointed out issues with retaliation against his company, lack of proper services for people with disabilities, and violations of laws meant to ensure transparency and fairness.\n\nWhat is ABI Resources?\nABI Resources is a company that helps people with brain injuries and disabilities. It ensures they get the care and services they need under Medicaid programs. David Medeiros, who lives with a brain injury himself, advocates for fair treatment and compliance with the law for these vulnerable individuals.\n\nWhats the Problem?\nRetaliation: After David reported problems (called whistleblowing), agencies involved in Medicaid tried to punish him and his company. This included stopping payments and creating barriers for ABI Resources.\n\nBreaking Disability Laws (ADA Violations): Agencies failed to provide David, who has a brain injury, with the accommodations he needs to communicate effectively. This goes against laws like the Americans with Disabilities Act (ADA).\n\nHiding Records (FOIA Violations): David requested government records to prove his claims using the Freedom of Information Act (FOIA). Agencies delayed responses, denied requests, or gave incomplete information, which violates transparency laws.\n\nMedicaid Problems: Theres evidence of mismanagement in Medicaid programs, where money meant for helping people may not be used correctly.\n\nWhy This Matters\nFor Taxpayers: Your taxes fund Medicaid programs. If the money isnt being managed properly, people arent getting the help they need.\nFor People with Disabilities: If agencies ignore laws, people with disabilities face discrimination and lose access to critical services.\nFor Justice: If the government punishes whistleblowers, it discourages people from speaking out about wrongdoing.\n\nWhat David Wants\nAccess to records proving wrongdoing.\nAccountability for those who retaliated against him and his company.\nCompliance with disability laws to ensure he and others get fair treatment.\nTransparency in how taxpayer money is used in Medicaid programs.\n\nWhat Can Be Done?\nDavid is demanding action:\n\nHes appealing to courts, oversight offices, Congress, and even the public to expose these issues and ensure change.\n\nWhy You Should Care\nThis isnt just about one person or one company. If these agencies can retaliate against whistleblowers, ignore disability laws, and misuse taxpayer money, it sets a dangerous precedent for everyone. By supporting transparency and fairness, we protect our communities and ensure justice.\n\n\n\n\n\n\nDate: January 7, 2025\n01.07.2025 \n\n\nFrom: David Medeiros, Founder, ABI Resources, LLC\nSubject: Systemic Violations of FOIA, ADA, Whistleblower Protections, Taxpayer Rights, and Constitutional Due Process\n\nTO: All Key Stakeholders and Oversight Authorities\nFederal Oversight Authorities\nMerrick Garland\nTitle: Attorney General\nU.S. Department of Justice\nEmail: doj.oag@usdoj.gov\nPhone: (202) 514-2000\n\nKristen Clarke\nTitle: Assistant Attorney General, Civil Rights Division\nU.S. Department of Justice\nEmail: civilrights.justice@usdoj.gov\nPhone: (202) 514-4609\n\nMichael E. Overview\nThis formal complaint and appeal seeks comprehensive redress for violations of federal laws and constitutional protections by the Department of Justice (DOJ), Centers for Medicare & Medicaid Services (CMS), Connecticut Department of Social Services (DSS), and other agencies. These violations include:\n\nRetaliation against whistleblower activity under federal whistleblower laws.\nFOIA non-compliance that obstructs access to critical government records.\nViolations of ADA and Rehabilitation Act requirements to accommodate disabilities.\nTaxpayer rights violations due to lack of transparency in Medicaid fund use.\nConstitutional due process violations under the Fifth and Fourteenth Amendments.\nThese actions undermine transparency, public accountability, and the protections afforded to whistleblowers and individuals with disabilities, resulting in significant harm to ABI Resources, LLC, and myself.\n\nII. Constitutional, Statutory, and Regulatory Violations\n1. FOIA Non-Compliance (5 U.S.C. 552)\nFailure to Conduct a Reasonable Search: DOJ failed to perform a comprehensive search for records within its jurisdiction, violating 552(a)(3)(C).\nFailure to Provide a Vaughn Index: DOJ did not justify withheld records or redactions as required by Vaughn v. Rosen, 484 F.2d 820 (D.C. Cir. 1973).\nImproper Application of Exemptions: Any anticipated reliance on Exemption 5 (deliberative process privilege) is improper as the requested records pertain to agency misconduct, which outweighs privilege protections (DOJ v. Reporters Committee, 489 U.S. 749 (1989)).\nUntimely Processing: Agencies failed to meet FOIA's statutory deadlines of 20 business days ( 552(a)(6)(A)), creating unnecessary delays in accessing critical information.\n\n2. ADA and Section 504 Violations (42 U.S.C. 12132; 29 U.S.C. 794)\nFailure to Provide Effective Communication: DOJ and CMS ignored explicit requests for ADA-compliant responses, including screen-reader-accessible documents and MuckRock-exclusive communication, violating 28 C.F.R. 35.160.\nFailure to Engage in the Interactive Process: Agencies failed to collaborate to provide reasonable accommodations for my traumatic brain injury (TBI), contravening the Rehabilitation Acts mandate for federally funded programs.\n\n3. Whistleblower Retaliation (5 U.S.C. 2302(b)(8); 31 U.S.C. 3730(h))\nAdverse Actions: Actions such as Medicaid billing restrictions, premature closure of Sandata EVV Ticket #539494, and operational disruptions following my December 18, 2023, whistleblower report constitute retaliation in violation of the Whistleblower Protection Act and False Claims Act.\n\n4. Taxpayer Rights Violations (31 U.S.C. 7501-7507)\nFailure to Ensure Transparency: The termination of companion authorizations under the ABI Waiver Program and Medicaid billing restrictions lack justification, violating federal standards for transparency in the use of taxpayer funds under the Single Audit Act.\n\n5. Constitutional Violations\nFirst Amendment: The denial of access to government records impedes my ability to petition for redress and oversee agency misconduct (New York Times Co. v. United States, 403 U.S. 713 (1971)).\nFifth and Fourteenth Amendments: Delays, denials, and discriminatory failures to accommodate my disability deprive me of procedural due process and equal protection (Tennessee v. Lane, 541 U.S. 509 (2004)).\n\nIII. Specific Requests and Corrective Actions\n\nA. FOIA Compliance\nConduct Comprehensive Searches: DOJ, CMS, DSS, and related agencies must conduct thorough searches across all divisions for responsive records, including communications and directives related to Medicaid billing, ADA compliance, and whistleblower retaliation.\nProvide a Vaughn Index: For all redacted or withheld records, provide detailed justifications citing specific statutory exemptions under 5 U.S.C. 552(b).\nComply with Timelines: Expedite processing of pending FOIA requests and appeals, citing the public interest in exposing potential agency misconduct.\n\nB. ADA and Rehabilitation Act Compliance\nDeliver ADA-Compliant Records: Provide all responses in screen-reader-compatible formats and ensure accessibility for individuals with disabilities as required by 28 C.F.R. 35.160.\nUse MuckRock Platform Exclusively: Eliminate reliance on physical mail or portals that create accessibility barriers.\nDocument ADA Compliance Efforts: Confirm in writing the steps taken to meet ADA accommodation requests.\n\nC. Whistleblower Protections\nInvestigate Retaliation Claims: Conduct an independent review of actions taken against ABI Resources, LLC, and myself following the December 18, 2023, whistleblower report.\nRelease Whistleblower-Related Records: Disclose all communications discussing retaliation, including Sandata EVV Ticket #539494 and Medicaid billing restrictions.\n\nD. Taxpayer Oversight\nDisclose Program Changes: Provide full documentation related to the termination of companion authorizations under the ABI Waiver Program and its impact on public funds.\n\nE. Accountability for Individuals\nInvestigate Named Officials: Conduct investigations into actions by DSS Commissioner Andrea Barton Reeves, CMS officials Michelle A. James and Emmett Nicholson, and others identified as involved in retaliatory or discriminatory actions.\n\nIV. Legal Remedies Pursued if Non-Compliance Persists\nIf the requested actions are not completed within 10 business days, the following remedies will be pursued:\n\nJudicial Enforcement:\n\nFile federal claims under FOIA (5 U.S.C. 552), ADA (42 U.S.C. 12132), the Whistleblower Protection Act, and related statutes.\nSeek injunctive relief to compel compliance with statutory obligations.\nAdministrative Oversight:\n\nSubmit formal complaints to the Office of Government Information Services (OGIS), Office of Special Counsel (OSC), and relevant Inspectors General.\nCongressional Notification:\n\nAlert House Oversight and Senate Judiciary Committees regarding systemic violations affecting whistleblowers, ADA compliance, and taxpayer accountability.\nPublic Advocacy and Media Engagement:\n\nEngage media outlets, civil rights organizations, and watchdog groups to expose ongoing violations and build public awareness.\nV. Conclusion\nTransparency, accountability, and adherence to legal obligations are fundamental to public trust and justice. The requested corrective actions are not discretionary but mandated by law. Failure to act will result in immediate escalation through legal, administrative, and public advocacy channels.\n\nSigned,\nDavid Medeiros\nFounder, ABI Resources\n\nAttachments:\nOriginal FOIA Requests and Agency Responses.\nADA Accommodation Requests and Documentation.\nWhistleblower Evidence (Including Retaliatory Actions).\nDetailed Timeline of Events.\nCC:\n\nMerrick Garland, U.S. Attorney General\nKristen Clarke, Assistant Attorney General for Civil Rights\nCongressional Oversight Committees\nCenters for Medicare & Medicaid Services (CMS)\nOffice of Special Counsel (OSC)\nOffice of Government Information Services (OGIS)\n\n\n\nTo: All Federal Officials and Agencies:\n\nMerrick Garland\nTitle: U.S. Attorney General\nEmail: ag@usdoj.gov\nPhone: (202) 514-2000\n\nKristen Clarke\nTitle: Assistant Attorney General, Civil Rights Division\nEmail: civilrights.justice@usdoj.gov\nPhone: (202) 514-4609\n\nMichael E. Case Numbers and Records Management\n\nCase Numbers Requiring Investigation:\n\nDI-25-000310\n\nDI-25-000325\n\nDI-25-000379\n\nDI-12192024714\n\nDI-12112024134\n\nOSCFiling-MedeirosDavid-DI-11252024342\n\nOSCFiling-MedeirosDavid-DI-11272024158\n\nOSCFiling-MedeirosDavid-DI-11282024737\n\nOSCFiling-MedeirosDavid-DI-12022024333\n\nOSCFiling-MedeirosDavid-DI-12032024933\n\nOSCFiling-MedeirosDavid-DI-12042024718\n\nOSCFiling-MedeirosDavid-DI-12052024838\n\nOSCFiling-MedeirosDavid-DI-12062024939\n\nOSCFiling-MedeirosDavid-DI-12072024240\n\nOSCFiling-MedeirosDavid-DI-12112024134\n\nOSCFiling-MedeirosDavid-DI-12202024300\n\nOSCFiling-MedeirosDavid-DI-112620241121\n\n2. Anonymity and Lack of Accountability in Decision-Making\n\nUnsigned Determination Letters:\n\nMany determination letters from OSC lack identifiable signatures, names, or clear authorship.\n\nThis practice raises serious concerns about accountability and compliance with transparency laws.\n\n3. Suppressed or Altered Records\n\nEvidence suggests discrepancies between the whistleblower reports I submitted and how they were recorded or handled by OSC.\n\nSpecific issues include:\n\nAlterations or removal of content from submitted complaints.\n\nSuppression of reports that exposed systemic failures in Medicaid oversight and retaliation against whistleblowers.\n\n4. Lack of FOIA Compliance\n\nDespite repeated Freedom of Information Act (FOIA) requests, OSC and related agencies have failed to provide:\n\nComplete case files and communication logs.\n\nJustification for withheld or redacted information.\n\nClear timelines for compliance.\n\nSpecific Questions to Investigate\n\n1. Who is Responsible for Managing These Records?\n\nIdentify the individuals, teams, or automated systems involved in creating, altering, and assigning these case numbers and reports.\n\n2. What Decisions Were Made and Why?\n\nDetermine how decisions were reached, why some reports were closed without action, and why letters were sent anonymously.\n\n3. Were There Violations of Federal Law?\n\nInvestigate potential obstruction of justice, retaliation, or misuse of authority under whistleblower protection laws and FOIA.\n\nKey Agencies and Officials Involved\n\nThis matter spans multiple federal and state agencies, including:\n\n Office of Special Counsel (OSC)\n\n Department of Justice (DOJ)\n\n Centers for Medicare & Medicaid Services (CMS)\n\n Department of Health and Human Services (HHS)\n\n Office of Inspector General (OIG)\n\nWhy This Matters\n\n1. Whistleblower Protections:\n\nRetaliation against whistleblowers and suppression of reports undermine federal protections designed to safeguard transparency and accountability.\n\n2. Impact on Vulnerable Populations:\n\nThese failures harm Medicaid consumers, particularly those with disabilities, by allowing systemic mismanagement to persist unchecked.\n\n3. Misuse of Taxpayer Funds:\n\nLack of oversight and accountability results in waste and misuse of federal funds meant to serve the public.\n\nRequested Actions\n\n1. Investigate Record Management:\n\nAudit all OSC records, emails, and internal communications related to these case numbers.\n\nIdentify responsible individuals or systems.\n\n2. Subpoena Additional Evidence:\n\nSecure all suppressed or altered reports to ensure a complete and accurate investigation.\n\n3. Hold Accountable Those Involved in Misconduct:\n\nRecommend prosecution or disciplinary action for any individuals found to have violated federal laws.\n\n4. Ensure Compliance with FOIA and Whistleblower Protections:\n\nMandate OSC and related agencies to comply fully with FOIA requests and whistleblower laws.\n\nAttachments\n\nI have attached all available documentation, including:\n\nCorrespondence with OSC, including determination letters and emails.\n\nFOIA requests and responses (or lack thereof).\n\nDetailed reports submitted to OSC and other federal agencies.\n\nThis issue demands immediate attention to uphold the principles of transparency, accountability, and justice. I am available to provide additional information or documentation as needed.\n\nSincerely,\nDavid Medeiros\nFounder, ABI Resources\n\n_______\nSubject: Final Assertion of Legal Obligations Under FOIA, ADA, and Constitutional Law\n\nSubject: 12/23/2024 Freedom of Information Act Request: OSC Cases DI-25-000310, DI-25-000325, DI-25-000379, DI-12192024714, and DI-12112024134; Associated FBI, DOJ, HHS, CMS, OAG, OIP , DOT and Medicaid Oversight Records FOIA (Federal Bureau of Investigation)\n01.08.2025\n\nTo all It May Concern in All Relevant Departments and Divisions,\nFederal Bureau of Investigation\n\nMichael G. Favish, 541 U.S. 157 (2004), transparency is fundamental to democracy and public trust. Your agencys obligations are not discretionary, and failure to meet them constitutes a violation of statutory and constitutional law. This letter establishes your duties, addresses deficiencies, and anticipates and counters all potential deflection strategies.\n\n1. FOIA Obligations: Statutory Mandates and Required Actions\nFOIA establishes an enforceable right of access to federal agency records. Your response must meet the following requirements:\n\nA. Timeliness\nUnder 5 U.S.C. 552(a)(6)(A), you are required to provide a determination within 20 business days. Delays beyond this timeframe, absent legitimate extension requests, constitute a violation of FOIA.\nCountermeasure: Delays are actionable under Citizens for Responsibility and Ethics in Washington v. DOJ, 711 F.3d 180 (D.C. Cir. 2013).\nRequired Action: Provide the requested records or a lawful determination.\n\nB. Adequacy of Search\nFOIA requires a thorough and reasonable search for records, as established in Campbell v. DOJ, 164 F.3d 20 (D.C. Cir. 1998). This includes:\nIdentifying the databases, locations, and terms used.\nProviding a sworn affidavit detailing the search scope.\nCountermeasure: A vague claim of \"no responsive records\" is insufficient without a detailed affidavit.\nRequired Action: Submit a sworn affidavit documenting the search or confirm the existence of responsive records.\n\nC. Proper Use of Exemptions\nExemptions under 5 U.S.C. 552(b) must be narrowly applied and justified with specific explanations. Blanket or vague exemptions are impermissible.\nCountermeasure: A Vaughn index (Vaughn v. Rosen, 484 F.2d 820 (D.C. Cir. 1973)) is required to justify each withholding.\nRequired Action: Submit a Vaughn index detailing each exemption and its justification within 10 business days.\n\nD. Decentralization and Referrals\nReferrals or decentralization excuses do not absolve your agency of its responsibility to provide a consolidated response. As held in McGehee v. CIA, 697 F.2d 1095 (D.C. Cir. 1983), agencies must coordinate internally to ensure compliance.\nCountermeasure: Require assurance of continuity and coordination across divisions.\nRequired Action: Consolidate records from all relevant offices and provide a unified response.\n\n2. ADA and Rehabilitation Act Compliance: Equal Access as a Legal Right\nAs a person with a documented disability, I am entitled to reasonable accommodations under the ADA and Section 504 of the Rehabilitation Act. Your failure to provide accessible formats for requested records constitutes discrimination and violates federal law.\n\nCase Law:\nTennessee v. Lane, 541 U.S. 509 (2004): Agencies must ensure meaningful access to government services.\nAlexander v. Choate, 469 U.S. 287 (1985): Denial of reasonable accommodations creates barriers that violate civil rights.\n\nRequired Action:\nProvide all requested records in accessible formats, including plain-language summaries or electronic files compatible with assistive technologies.\nConfirm compliance with ADA requirements by [specific date].\n\n3. Mandated Reporting and Whistleblower Protections\nYour handling of this request implicates broader concerns, including potential fraud, misuse of federal funds, or retaliation against whistleblowers. Under the Whistleblower Protection Act (5 U.S.C. 2302), you are required to report and address systemic violations.\nCountermeasure: Reference Misprision of Felony (18 U.S.C. 4), which requires the reporting of observed violations of law.\nRequired Action: Document and escalate evidence of misconduct to oversight bodies, including the Office of Inspector General (OIG).\n\n4. Consequences of Non-Compliance\nFailure to comply with your statutory obligations knowingly constitutes violations of:\nObstruction of Justice (18 U.S.C. 1505): Delaying lawful access to records obstructs public accountability.\nCivil Rights Violations (42 U.S.C. 1983): Denying ADA accommodations constitutes a deprivation of federally protected rights.\nMisprision of Felony (18 U.S.C. 4): Concealing or failing to report observed violations is a criminal act.\nCountermeasure: Prepare for judicial review, oversight complaints, and public advocacy if compliance fails.\n\n5. Escalation Pathways\nIf your office does not comply within the specified timeframe, I will escalate this matter through:\nJudicial Review: Filing a lawsuit under 5 U.S.C. 552(a)(4)(B) to compel disclosure.\nOversight Complaints: Submitting formal complaints to OGIS, OIG, and the DOJ Civil Rights Division.\nPublic Advocacy: Engaging investigative journalists, transparency advocates, and public interest organizations to ensure accountability.\n\n6. Final Statement: Upholding Transparency and Accountability\nThis matter reflects the publics right to transparency and the preservation of trust in government institutions. Your actions will either affirm your agencys commitment to accountability or further evidence systemic disregard for these principles.\n\nI look forward to your prompt and substantive response.\n\nDavid Medeiros\nABI Resources\n\nState of Connecticut Officials:\n\nGovernor Ned Lamont\nTitle: Governor of Connecticut\nOffice Address: State Capitol, 210 Capitol Avenue, Hartford, CT 06106\nPhone: (860) 566-4840\nToll-Free: (800) 406-1527\nTDD: (860) 524-7397\nEmail: Contact Form\nWebsite: https://portal.ct.gov/governor\n\nAttorney General William Tong\nTitle: Attorney General of Connecticut\nOffice Address: 165 Capitol Avenue, Hartford, CT 06106\nPhone: (860) 808-5318\nEmail: attorney.general@ct.gov\nWebsite: https://portal.ct.gov/ag\n\nCommissioner Andrea Barton Reeves\nTitle: Commissioner, Connecticut Department of Social Services (DSS)\nOffice Address: 55 Farmington Avenue, Hartford, CT 06105\nPhone: (860) 424-5053\nEmail: andrea.bartonreeves@ct.gov\nWebsite: https://portal.ct.gov/dss\n\nConnecticut Freedom of Information Commission (FOIC)\nOffice Address: 165 Capitol Avenue, Suite 1100, Hartford, CT 06106\nPhone: (860) 566-5682\nToll-Free: 1-866-374-3617\nEmail: foi@ct.gov\nWebsite: https://portal.ct.gov/foi\n\nFederal Officials and Agencies:\n\nSenator Richard Blumenthal\nTitle: U.S. Senator from Connecticut\nWashington D.C.
