As you are aware, Congress created OGIS to\nserve as the federal Freedom of Information Act (FOIA) Ombudsman. We assist the public and\nfederal agencies by helping them resolve their FOIA disputes, and by addressing their questions\nand concerns about the FOIA process.\nIt appears that you are seeking assistance with a FOIA request currently pending with the U.S.\nDepartment of Justices Civil Rights Division. Please note, OGIS cannot compel an agency to\nprocess a request more quickly or ahead of others in the queue. However, in working cases\nsimilar to yours, we have learned that some requesters have had success receiving a more timely\nresponse by refining the scope of a request. If you would like to discuss narrowing your\nrequestwhich may allow it to be processed more efficiently you may wish to contact the\nagency's FOIA Public Liaison (FPL). All federal agencies have an FPL, whose role is to explain\nthe FOIA process and assist requesters with their FOIA requests at any stage of the\nadministrative process.\nAdditionally, it is important to know that all federal agencies are required to provide an estimated\ndate of completion (EDC) when asked (5 U.S.C. 552(a)(7)(B)(ii)). In order to obtain an\nestimated date of completion for your request, we recommend that you contact the agency\ndirectly. The FOIA Public Liaison (FPL) for the Civil Rights Division, April Freeman, can be\nreached at 202-514-4210.\nWe hope you find this information useful. At this time, we will take no further action. If you\nhave questions or concerns that we have not addressed, please contact us again.\nBest regards,\nThe OGIS Staff\n\nThe requested documents will be made available to the general public, and this request is not being made for commercial purposes.\n\nIn the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.\n\nThank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.\n\nSincerely,\n\nDAVID MEDEIROS"

This request seeks records related to the Connecticut Medicaid Acquired Brain Injury (ABI) Waiver Program provider registry, including provider names, contact details, enrollment statuses, and any complaints or violations associated with their participation.\n\nThis follow-up serves three purposes:\n\nRequest for Estimated Completion Date (EDC): Pursuant to 5 U.S.C. 552(a)(7)(B)(ii), I am formally requesting an estimated date of completion for this request.\nADA Accommodation Confirmation: I reiterate my request for accommodations under Title II of the Americans with Disabilities Act (42 U.S.C. 12132) and Section 504 of the Rehabilitation Act (29 U.S.C. 794), ensuring that all correspondence and records are provided in accessible formats.\nRequest for Expedited Processing: Given the significant public interest and Medicaid oversight implications, I am requesting expedited processing in accordance with 5 U.S.C. 552(a)(6)(E).\nLegal Basis for Request\nStatutory Obligation to Provide an Estimated Completion Date\nUnder FOIA (5 U.S.C. 552(a)(7)(B)(ii)), federal agencies must provide an estimated date of completion upon request. This is a critical transparency measure that allows requesters to track progress and plan accordingly.\n\nADA Accommodation Requirements\nTitle II of the ADA and Section 504 of the Rehabilitation Act mandate that public entities ensure effective communication with individuals with disabilities. This includes providing documents in accessible formats and adhering to specific accommodation requests. Non-compliance violates federal disability rights laws and denies my right to equal access.\n\nExpedited Processing Standards\nUnder 5 U.S.C. 552(a)(6)(E), expedited processing is warranted when a request involves matters of urgent public interest or significant delays risk undermining the rights of individuals or public accountability.\n\nSpecific Demands\nProvide an Estimated Completion Date (EDC):\nPlease confirm the estimated completion date for FOIA request No. 25-00044-F.\n\nAdhere to ADA Accommodations:\nI reiterate the following non-negotiable accommodations:\n\nEmail-Only Communication: All responses and updates must be sent exclusively via email. Portal access, phone calls, or physical mail are not accessible.\nAccessible Document Formats: Records must be provided as clearly labeled, screen-reader-compatible PDF attachments, retaining original formatting for clarity.\nSimplified Summaries for Complex Records: For technical or lengthy documents, simplified summaries must be included to facilitate comprehension.\nReconsider Expedited Processing:\nThis request pertains to Medicaid provider oversight and taxpayer-funded programs, which are matters of significant public interest. Expedited processing will ensure timely access to critical records necessary for transparency and accountability.\n\nAdditional Notes\nYour acknowledgment letter dated October 25, 2024, indicated delays due to the volume of FOIA requests. While I understand these challenges, FOIA requires agencies to respond equitably and within statutory timeframes. Additionally, the Office of Government Information Services (OGIS) has advised that estimated completion dates and regular updates are mandatory under FOIA.\n\nConsequences of Non-Compliance\nFailure to provide an estimated completion date, adhere to ADA accommodations, or process this request promptly may result in the following actions:\n\nOGIS Mediation: Filing a mediation request with OGIS to address delays or procedural violations.\nFormal Appeals: Submitting an administrative appeal to the Office of Information Policy (OIP) at the DOJ.\nPublic Advocacy: Sharing delays and non-compliance with public interest groups and media outlets.\nConclusion\nI respectfully request confirmation of the estimated completion date for FOIA request No. 25-00044-F and written acknowledgment that all ADA accommodations will be strictly adhered to in future communications. Expedited processing of this request is critical to ensure timely transparency and accountability in Medicaid program administration.\n\nI look forward to receiving your response promptly and no later than the statutory timeframe.\n\nSincerely,\nDavid Medeiros\nFounder, ABI Resources"

"text": "Subject: FOIA Appeal and Demand for ADA Compliance - FOIA Request No. 25-00044-F (Department of Justice, Civil Rights Division)\nDate: November 19, 2024\n\nTo: FOIA Appeals Officer, U.S. Department of Justice, Civil Rights Division\nFrom: David Medeiros, Founder, ABI Resources\n\nI. INTRODUCTION\nI am submitting this formal appeal regarding FOIA request No. 25-00044-F, which was originally submitted on October 24, 2024, and acknowledged by the Department of Justice (DOJ) Civil Rights Division on October 25, 2024. The request pertains to the Connecticut Medicaid Acquired Brain Injury (ABI) Waiver Program provider registry and includes a request for provider names, contact details, enrollment statuses, and any records of complaints or violations associated with their participation.\n\nThis appeal seeks immediate compliance with FOIA and ADA accommodation requirements that have been ignored or delayed by the DOJ, which violates my constitutional rights to access public records and participate in government transparency processes. The failure to meet ADA accommodation requirements and FOIA deadlines has caused undue hardship and hindered my ability to effectively participate in the oversight of an important public program.\n\nII. BASIS FOR APPEAL\nThe DOJs response, dated November 15, 2024, and the correspondence from FOIA/PA Unit fail to address the following critical issues, which form the basis for my appeal:\n\n1. ADA Compliance and Non-Negotiable Accommodations\nThe ADA accommodations outlined in my original FOIA request are legally required under Section 504 of the Rehabilitation Act and Title II of the ADA. These accommodations are necessary for effective communication due to my traumatic brain injury (TBI). The DOJ's failure to confirm these accommodations in writing and their non-compliance with providing accessible communication formats (email-only communication, no use of portals, direct text in email body, and providing simplified summaries for complex documents) represents a clear violation of federal law.\n\nSpecifically, the requested ADA accommodations are as follows:\n\nEmail-Only Communication via the MuckRock Platform (all responses must be via email without external links, portals, or physical mail).\nDirect Text in Email Body (response text should be embedded directly in the email body, not in attachments).\nPDF Attachments for Documents that are clearly labeled, retaining the original format and ensuring accessibility.\nSimplified Summaries for Complex Records to ensure the comprehension of technical or legal language.\nIdentification of Responsible Personnel: Names, titles, and contact information of FOIA officers and all relevant personnel involved.\nThe DOJs failure to adhere to these requirements is unacceptable and directly contravenes my rights under the Americans with Disabilities Act and Rehabilitation Act.\n\n2. Non-Compliance with FOIA Deadlines and Failure to Provide Estimated Completion Date (EDC)\nThe FOIA processing time has exceeded statutory limits. According to 5 U.S.C. 552(a)(6)(A), federal agencies are required to respond to FOIA requests within 20 business days. CMS's response timeline is overdue. Additionally, 5 U.S.C. 552(a)(7)(B)(ii) mandates that agencies provide a reasonable estimated date of completion (EDC) when requested by the applicant.\n\nThe DOJ has failed to provide an EDC or any clarity regarding the status of my FOIA request, despite my repeated requests for this information. As set forth in my initial request, transparency and accountability in the Medicaid ABI Waiver Program are matters of urgent public interest, and timely processing is critical.\n\n3. Expedited Processing and Fee Waiver Request\nThis appeal also seeks confirmation that my request will be processed expeditiously, as mandated by 5 U.S.C. 552(a)(6)(E). Given the significant public interest in Medicaid oversight and taxpayer-funded programs, expedited processing is warranted. Additionally, a fee waiver should be granted as the request is non-commercial and directly contributes to public understanding of government activities.\n\nIII. RELIEF SOUGHT\n1. Immediate Action on ADA Accommodation Compliance\nImmediate confirmation that the DOJ will comply with the ADA accommodations Ive outlined. This includes email-only communication, direct text in email body, and ensuring that all documents are in accessible formats (PDF) with simplified summaries provided where necessary.\n2. Estimated Completion Date (EDC) and Processing Timeline\nProvide a reasonable Estimated Completion Date (EDC) for FOIA request No. 25-00044-F.\nIf delays are unavoidable, explain why and provide an updated processing timeline, keeping in mind the public interest and the need for transparency.\n3. Expedited Processing and Fee Waiver\nConfirm expedited processing for this request in compliance with 5 U.S.C. 552(a)(6)(E) and Executive Order 13392.\nConfirm fee waiver approval under 5 U.S.C. 552(a)(4)(A)(iii), as this request serves the public interest and will significantly enhance government transparency.\n4. Full Disclosure of Requested Records\nThe DOJ must immediately release the complete provider registry for the Medicaid ABI Waiver Program, including the requested provider names, contact details, specialties, enrollment statuses, and complaints/violations.\nIf any records are being withheld, detailed justifications must be provided in accordance with 5 U.S.C. 552(b), with full statutory citations.\n5. Accountability and Personnel Identification\nThe names and contact information of all FOIA officers and responsible personnel should be disclosed, ensuring transparency and accountability for the processing and handling of this request.\nIV. CONSEQUENCES OF NON-COMPLIANCE\nFailure to adhere to the FOIA and ADA compliance requirements within the statutory deadlines will result in the following actions:\n\nMediation via OGIS: If non-compliance continues, I will seek mediation assistance from the Office of Government Information Services (OGIS), who will work to resolve the dispute between myself and the DOJ.\n\nAppeal to OIP: I will file a formal administrative appeal with the Office of Information Policy (OIP) if the DOJ continues to fail in processing my request or granting accommodations.\n\nPublic Advocacy: If further delays or non-compliance persist, I will escalate this matter to public advocacy groups and media outlets that focus on government accountability and disability rights.\n\nV. CONCLUSION\nI demand the immediate processing of FOIA request No. 25-00044-F, in full compliance with FOIA regulations, and that the ADA accommodations I outlined are fully implemented. Failure to comply with these requirements within the statutory timeframe will leave me with no choice but to escalate this issue and seek legal action.\n\nI look forward to your prompt and full response, including confirmation of the Estimated Completion Date, expedited processing, and full ADA accommodation compliance.\n\nThank you for your prompt attention to this critical matter.\n\nSincerely,\nDavid Medeiros\nFounder, ABI Resources\n39 Kings HWY STE C\nGales Ferry, Connecticut, 06335\n\nDepartment Heads at the Department of Justice, Civil Rights Division:\n\nKristen Clarke, Assistant Attorney General\nAundra Luckey, FOIA Officer\nApril Freeman, FOIA Public Liaison"

"text": "Formal Legal Complaint and Appeal\n\n\n\nDate: 01/01/2025\n\n\nTo:\nKristen Clarke\nAssistant Attorney General\nDepartment of Justice, Civil Rights Division\n950 Pennsylvania Avenue NW\nWashington, DC 20530\n\nCC:\n\nAundra Luckey, FOIA Officer, DOJ Civil Rights Division\nApril Freeman, FOIA Public Liaison\nRelevant Federal and State Agency Heads (see below for full list)\nSubject:\nFormal Legal Complaint and Appeal for FOIA Non-Compliance and ADA Violations\nRe: FOIA Request No. 25-00044-F: Records Related to Medicaid ABI Waiver Program\n\nIntroduction\nThis appeal addresses the DOJ Civil Rights Division's failure to comply with:\n\nStatutory obligations under the Freedom of Information Act (5 U.S.C. 552).\nAccessibility requirements under the Americans with Disabilities Act (ADA, 42 U.S.C. 12101) and Section 504 of the Rehabilitation Act (29 U.S.C. 794).\nTransparency and accountability principles fundamental to constitutional protections and public oversight.\nThe Civil Rights Divisions delayed processing, lack of substantive updates, and refusal to honor my ADA accommodations are unacceptable and constitute violations of federal law. This appeal seeks immediate corrective action to ensure compliance with all applicable statutes and regulations.\n\nScope of Records Sought (Reiterated for Clarity)\nProvider Registry: Comprehensive records including provider names, contact details, specialties, enrollment dates, and statuses.\nComplaints and Disciplinary Actions: All documentation of complaints, violations, investigations, or disciplinary actions involving Medicaid ABI Waiver Program providers.\nPolicies and Criteria: Regulations and procedural documents governing provider inclusion, monitoring, and removal.\nRegistry Maintenance and Correspondence: Internal/external communications and documentation identifying personnel responsible for updates.\nLegal Grounds for Appeal\n\n1. FOIA Violations\nUnder 5 U.S.C. 552(a)(6)(A), agencies are required to:\n\nRespond to requests within 20 business days.\nProvide an estimated completion date (EDC) upon request, as mandated by 5 U.S.C. 552(a)(7)(B)(ii).\nJustify any delays or denials with specific statutory exemptions and detailed explanations.\n\nPrecedent:\nNARA v. Favish, 541 U.S. 157 (2004): Ensures public access to government records for accountability purposes.\nDOJ v. Reporters Committee, 489 U.S. 749 (1989): Reinforces the importance of transparency in public governance.\nThe DOJ has failed to adhere to these statutory obligations, as evidenced by the extended delays and vague responses received to date.\n\n2. ADA and Rehabilitation Act Violations\nTitle II of the ADA and Section 504 of the Rehabilitation Act require:\n\nEffective communication with individuals with disabilities, including reasonable accommodations such as accessible document formats and preferred communication methods.\nCompliance with accommodation requests unless a significant burden can be demonstrated.\nNon-Negotiable ADA Accommodations:\nADA Basic Accommodations Request\nTo ensure accessibility and compliance with ADA standards (42 U.S.C. 12101 et seq.), I request the following accommodations for all communications and records:\n\nScreen-Reader Compatible Formats:\nAll documents must be provided in properly labeled PDFs or plain-text files.\n\nExclusive MUCKROCK Platform Communication:\nDo not send external links, emails, portals, passwords, codes, or require phone calls for access.\n\nSimplified Summaries:\nProvide plain-language summaries for complex or legal documents.\n\nIdentification of Responsible Officers:\nInclude the full name, title, and contact information of all responsible officers.\n\nThese accommodations are critical to ensuring equitable access to the FOIA process.\nScreen-Reader-Compatible PDFs: Clearly labeled and organized PDFs must be provided.\n\nSimplified Summaries: Plain-language summaries must accompany complex or technical documents.\nIdentification of Personnel: Full names, titles, and contact details of all responsible personnel must be disclosed.\n\nPrecedent:\nTennessee v. Lane, 541 U.S. 509 (2004): Upholds the right to equal access to public programs for disabled individuals.\nAlexander v. Choate, 469 U.S. 287 (1985): Mandates equitable treatment in federally funded programs.\n\n3. Constitutional Protections\nThe First Amendment guarantees the right to petition the government and access public records, while the Fourteenth Amendment ensures equal protection and due process. The DOJs actions hinder my ability to exercise these constitutional rights.\n\nPrecedent:\nNew York Times v. Sullivan, 376 U.S. 254 (1964): Affirms transparency as a cornerstone of democracy.\n\n4. Whistleblower Protections and Public Interest\nUnder the Whistleblower Protection Act (5 U.S.C. 2302(b)(8)), exposing fraud, waste, or abuse in government programs is protected activity. Delays in processing my request obstruct critical oversight of Medicaid operations funded by taxpayer dollars.\n\nDemands for Immediate Action\n\n1. FOIA Compliance\nConduct a thorough and expedited search for all responsive records.\nProvide segregated records if exemptions are claimed, with detailed statutory justifications.\nDeliver records via email in screen-reader-compatible PDF format with accompanying metadata.\n\n2. ADA Compliance\nConfirm compliance with the outlined ADA accommodations.\nEnsure all future communications are sent via email with accessible document formats and simplified summaries.\n\n3. Transparency and Accountability\nIdentify the FOIA officers and supervisors responsible for processing this request.\nDisclose interagency coordination efforts to retrieve all responsive records.\n\n4. Expedited Processing and Fee Waiver\nExpedite processing under 5 U.S.C. 552(a)(6)(E) due to the significant public interest.\nApprove the fee waiver request under 5 U.S.C. 552(a)(4)(A)(iii), as this request serves the public interest.\nConsequences of Continued Non-Compliance\n\n1. Administrative Complaints\nFile complaints with the Office of Government Information Services (OGIS) and Office for Civil Rights (OCR) for procedural and ADA violations.\n\n2. Judicial Enforcement\nPursue litigation under 5 U.S.C. 552(a)(4)(B) and ADA provisions (42 U.S.C. 12133) for injunctive relief and damages.\n\n3. Public Advocacy\nShare delays and violations with advocacy organizations and media outlets to highlight the lack of transparency and accessibility.\n\nRelief Sought\nImmediate provision of an estimated completion date (EDC) and an updated processing timeline.\nFull ADA accommodation compliance, including email-only responses and accessible formats.\nExpedited release of all responsive records without further delay.\nTransparent identification of responsible personnel and interagency coordination efforts.\nTimeline for Response\nI expect written confirmation of compliance within four (4) business days. Failure to meet this deadline will result in immediate escalation to the outlined administrative and legal remedies.\n\nConclusion\nTransparency and accessibility are fundamental rights under FOIA, ADA, and the Constitution. I demand full compliance and resolution of these issues without further delay.\n\nSincerely,\nDavid Medeiros\nFounder, ABI Resources\n\n\nCC:\n\nState FOIA Officers\nFederal Oversight Agencies\nAdvocacy Groups\n\nCC: Congressional Oversight Committees, DOJ Civil Rights Division, OGIS, and relevant stakeholders.\nCopies To:\n\nOffice of the Attorney General, Connecticut\nConnecticut Department of Social Services\nCenters for Medicare & Medicaid Services\nOffice of Government Information Services (OGIS)\n\nCC: Oversight and Accountability Authorities\nRobert F. These failures directly impact whistleblower protections, Medicaid oversight, and public accountability.\n\nIssues to Investigate\n\n1. Case Numbers and Records Management\n\nCase Numbers Requiring Investigation:\n\nDI-25-000310\n\nDI-25-000325\n\nDI-25-000379\n\nDI-12192024714\n\nDI-12112024134\n\nOSCFiling-MedeirosDavid-DI-11252024342\n\nOSCFiling-MedeirosDavid-DI-11272024158\n\nOSCFiling-MedeirosDavid-DI-11282024737\n\nOSCFiling-MedeirosDavid-DI-12022024333\n\nOSCFiling-MedeirosDavid-DI-12032024933\n\nOSCFiling-MedeirosDavid-DI-12042024718\n\nOSCFiling-MedeirosDavid-DI-12052024838\n\nOSCFiling-MedeirosDavid-DI-12062024939\n\nOSCFiling-MedeirosDavid-DI-12072024240\n\nOSCFiling-MedeirosDavid-DI-12112024134\n\nOSCFiling-MedeirosDavid-DI-12202024300\n\nOSCFiling-MedeirosDavid-DI-112620241121\n\n2. Anonymity and Lack of Accountability in Decision-Making\n\nUnsigned Determination Letters:\n\nMany determination letters from OSC lack identifiable signatures, names, or clear authorship.\n\nThis practice raises serious concerns about accountability and compliance with transparency laws.\n\n3. Suppressed or Altered Records\n\nEvidence suggests discrepancies between the whistleblower reports I submitted and how they were recorded or handled by OSC.\n\nSpecific issues include:\n\nAlterations or removal of content from submitted complaints.\n\nSuppression of reports that exposed systemic failures in Medicaid oversight and retaliation against whistleblowers.\n\n4. Lack of FOIA Compliance\n\nDespite repeated Freedom of Information Act (FOIA) requests, OSC and related agencies have failed to provide:\n\nComplete case files and communication logs.\n\nJustification for withheld or redacted information.\n\nClear timelines for compliance.\n\nSpecific Questions to Investigate\n\n1. Who is Responsible for Managing These Records?\n\nIdentify the individuals, teams, or automated systems involved in creating, altering, and assigning these case numbers and reports.\n\n2. What Decisions Were Made and Why?\n\nDetermine how decisions were reached, why some reports were closed without action, and why letters were sent anonymously.\n\n3. Were There Violations of Federal Law?\n\nInvestigate potential obstruction of justice, retaliation, or misuse of authority under whistleblower protection laws and FOIA.\n\nKey Agencies and Officials Involved\n\nThis matter spans multiple federal and state agencies, including:\n\n Office of Special Counsel (OSC)\n\n Department of Justice (DOJ)\n\n Centers for Medicare & Medicaid Services (CMS)\n\n Department of Health and Human Services (HHS)\n\n Office of Inspector General (OIG)\n\nWhy This Matters\n\n1. Whistleblower Protections:\n\nRetaliation against whistleblowers and suppression of reports undermine federal protections designed to safeguard transparency and accountability.\n\n2. Impact on Vulnerable Populations:\n\nThese failures harm Medicaid consumers, particularly those with disabilities, by allowing systemic mismanagement to persist unchecked.\n\n3. Misuse of Taxpayer Funds:\n\nLack of oversight and accountability results in waste and misuse of federal funds meant to serve the public.\n\nRequested Actions\n\n1. Investigate Record Management:\n\nAudit all OSC records, emails, and internal communications related to these case numbers.\n\nIdentify responsible individuals or systems.\n\n2. Favish, 541 U.S. 157 (2004), transparency is fundamental to democracy and public trust. Your agencys obligations are not discretionary, and failure to meet them constitutes a violation of statutory and constitutional law. This letter establishes your duties, addresses deficiencies, and anticipates and counters all potential deflection strategies.\n\n1. FOIA Obligations: Statutory Mandates and Required Actions\nFOIA establishes an enforceable right of access to federal agency records. Your response must meet the following requirements:\n\nA. Timeliness\nUnder 5 U.S.C. 552(a)(6)(A), you are required to provide a determination within 20 business days. Delays beyond this timeframe, absent legitimate extension requests, constitute a violation of FOIA.\nCountermeasure: Delays are actionable under Citizens for Responsibility and Ethics in Washington v. DOJ, 711 F.3d 180 (D.C. Cir. 2013).\nRequired Action: Provide the requested records or a lawful determination.\n\nB. Adequacy of Search\nFOIA requires a thorough and reasonable search for records, as established in Campbell v. DOJ, 164 F.3d 20 (D.C. Cir. 1998). This includes:\nIdentifying the databases, locations, and terms used.\nProviding a sworn affidavit detailing the search scope.\nCountermeasure: A vague claim of \"no responsive records\" is insufficient without a detailed affidavit.\nRequired Action: Submit a sworn affidavit documenting the search or confirm the existence of responsive records.\n\nC. Proper Use of Exemptions\nExemptions under 5 U.S.C. 552(b) must be narrowly applied and justified with specific explanations. Blanket or vague exemptions are impermissible.\nCountermeasure: A Vaughn index (Vaughn v. Rosen, 484 F.2d 820 (D.C. Cir. 1973)) is required to justify each withholding.\nRequired Action: Submit a Vaughn index detailing each exemption and its justification within 10 business days.\n\nD. Decentralization and Referrals\nReferrals or decentralization excuses do not absolve your agency of its responsibility to provide a consolidated response. As held in McGehee v. CIA, 697 F.2d 1095 (D.C. Cir. 1983), agencies must coordinate internally to ensure compliance.\nCountermeasure: Require assurance of continuity and coordination across divisions.\nRequired Action: Consolidate records from all relevant offices and provide a unified response.\n\n2. ADA and Rehabilitation Act Compliance: Equal Access as a Legal Right\nAs a person with a documented disability, I am entitled to reasonable accommodations under the ADA and Section 504 of the Rehabilitation Act. Your failure to provide accessible formats for requested records constitutes discrimination and violates federal law.\n\nCase Law:\nTennessee v. Lane, 541 U.S. 509 (2004): Agencies must ensure meaningful access to government services.\nAlexander v. Choate, 469 U.S. 287 (1985): Denial of reasonable accommodations creates barriers that violate civil rights.\n\nRequired Action:\nProvide all requested records in accessible formats, including plain-language summaries or electronic files compatible with assistive technologies.\nConfirm compliance with ADA requirements by [specific date].\n\n3. Mandated Reporting and Whistleblower Protections\nYour handling of this request implicates broader concerns, including potential fraud, misuse of federal funds, or retaliation against whistleblowers. Under the Whistleblower Protection Act (5 U.S.C. 2302), you are required to report and address systemic violations.\nCountermeasure: Reference Misprision of Felony (18 U.S.C. 4), which requires the reporting of observed violations of law.\nRequired Action: Document and escalate evidence of misconduct to oversight bodies, including the Office of Inspector General (OIG).\n\n4. Consequences of Non-Compliance\nFailure to comply with your statutory obligations knowingly constitutes violations of:\nObstruction of Justice (18 U.S.C. 1505): Delaying lawful access to records obstructs public accountability.\nCivil Rights Violations (42 U.S.C. 1983): Denying ADA accommodations constitutes a deprivation of federally protected rights.\nMisprision of Felony (18 U.S.C. 4): Concealing or failing to report observed violations is a criminal act.\nCountermeasure: Prepare for judicial review, oversight complaints, and public advocacy if compliance fails.\n\n5. Escalation Pathways\nIf your office does not comply within the specified timeframe, I will escalate this matter through:\nJudicial Review: Filing a lawsuit under 5 U.S.C. 552(a)(4)(B) to compel disclosure.\nOversight Complaints: Submitting formal complaints to OGIS, OIG, and the DOJ Civil Rights Division.\nPublic Advocacy: Engaging investigative journalists, transparency advocates, and public interest organizations to ensure accountability.\n\n6. Final Statement: Upholding Transparency and Accountability\nThis matter reflects the publics right to transparency and the preservation of trust in government institutions. Your actions will either affirm your agencys commitment to accountability or further evidence systemic disregard for these principles.\n\nI look forward to your prompt and substantive response.\n\nDavid Medeiros\nABI Resources\n\nState of Connecticut Officials:\n\nGovernor Ned Lamont\nTitle: Governor of Connecticut\nOffice Address: State Capitol, 210 Capitol Avenue, Hartford, CT 06106\nPhone: (860) 566-4840\nToll-Free: (800) 406-1527\nTDD: (860) 524-7397\nEmail: Contact Form\nWebsite: https://portal.ct.gov/governor\n\nAttorney General William Tong\nTitle: Attorney General of Connecticut\nOffice Address: 165 Capitol Avenue, Hartford, CT 06106\nPhone: (860) 808-5318\nEmail: attorney.general@ct.gov\nWebsite: https://portal.ct.gov/ag\n\nCommissioner Andrea Barton Reeves\nTitle: Commissioner, Connecticut Department of Social Services (DSS)\nOffice Address: 55 Farmington Avenue, Hartford, CT 06105\nPhone: (860) 424-5053\nEmail: andrea.bartonreeves@ct.gov\nWebsite: https://portal.ct.gov/dss\n\nConnecticut Freedom of Information Commission (FOIC)\nOffice Address: 165 Capitol Avenue, Suite 1100, Hartford, CT 06106\nPhone: (860) 566-5682\nToll-Free: 1-866-374-3617\nEmail: foi@ct.gov\nWebsite: https://portal.ct.gov/foi\n\nFederal Officials and Agencies:\n\nSenator Richard Blumenthal\nTitle: U.S. Senator from Connecticut\nWashington D.C.
